ADDENDUM TO 52.212-1
1. PROGRAM STRUCTURE AND OBJECTIVES
The purpose of the Medical Q-coded Services (MQS) platform is to award multiple contracts aimed at providing a standardized process of procuring qualified contract Health Care Workers (HCW). The resulting contracts from this acquisition will be Indefinite Delivery/Indefinite Quantity (IDIQ) Multiple Award Contracts (MACs). This requirement is 100% small business set-aside under North American Industry Classification System (NAICS) number 622110. The Government anticipates awarding approximately 30 IDIQ contracts for the Physicians market segment, 10 IDIQ contracts for the Dental market segment, 35 IDIQ contracts for the Ancillary market segment, and 20 IDIQ contracts for the Nursing market segment as a result of this one solicitation. Offerors will not be required to propose on all segments; the Government will evaluate segments separately. Offerors will receive one contract that will encompass the market segments in which they were found to be the best value to the Government.
Offerors shall indicate those market segments on which they intend to propose on their Self Scoring Technical Capability Worksheet (Attachment 5).
The maximum program value is $7.5B over a 5-year ordering period. However, these contracts are IDIQ ordering vehicles only and do not guarantee any funds above the minimum contract award amount. Congressional budget year allocations and prioritized requirements may determine future task order awards and exercise of task order options.
All referenced documents for this solicitation are available on the Federal Business Opportunities (FedBizOpps) web site at http://www.fbo.gov under the solicitation number listed in block 5 of this document. Potential offerors are encouraged to subscribe for real-time e-mail notifications when information has been posted to the website for this solicitation.
2. GENERAL INSTRUCTIONS
This section provides general guidance for preparing proposals as well as instructions on the format and required content of the proposal. Offerors are instructed to read the entire Request for Proposal (RFP), including all attachments, prior to preparing an offer. Documents submitted in response to this RFP must be fully responsive to, and consistent with, the requirements of the RFP, Performance Work Statement, and evaluation factors for Award in
FAR Provision 52.212-2. At a minimum, for a proposal to be considered responsive the following documents are required:
A complete SF 1449 with all Amendments (SF 30) signed by an authorized representative o Includes completion of all fillable Provisions and Clauses (you may print the Provisions and
Clauses filled at sam.gov and attach to the signed SF1449/SF30).
Contractor Team Organization (Attachment 4) Line or Letter of Credit ($6M) Self Scoring Technical Capability Worksheet (Attachment 5) o Market segment supporting documentation o Magnitude supporting documentation o Applicability supporting documentation o Complexity supporting documentation o Indefinite Delivery/Indefinite Quantity (ID/IQ) contract experience supporting documentation o FFP contract experience supporting documentation o Prime contractor supporting documentation
Past performance references (Attachment 6) Organization Change History Declared sample market segment TOPR proposals (Attachment 2)
Omission of any information from the proposal submission requirements may result in a determination that the Offeror is unresponsive. Failure to provide the required documents set forth in this solicitation may also result in a determination that the Offeror is unresponsive. Offerors who have been determined unresponsive will no longer be considered for award
All proposal information is subject to verification by the Government. The documentation must be in the Offeror’s name as submitted in Block 17a of the Standard Form (SF) 1449, Solicitation/Contract/Order for Commercial Items, with a corresponding Cage Code and DUNS Number. Offerors shall assume that the Government has no prior knowledge of their operation and will rely on documentation provided as part of the Offeror’s proposal. Proprietary information shall be clearly marked.
By signing the SF 1449, the Offeror acknowledges that the terms and conditions of the proposals are valid for a minimum of 180 calendar days after the proposal due date in Block 8.
Oral presentations will not be considered for this competitive acquisition.
Market research confirmed that subcontracting and teaming arrangements are possible even with the four market segments; therefore, such arrangements are encouraged to ensure mission success. However, during this evaluation, if a company is identified as a prime contractor or teaming partner/subcontractor on any proposal for this acquisition, then that company cannot participate as a prime contractor or teaming partner/subcontractor on any other offeror's proposal. It is the Offeror's responsibility to ensure teaming partners and subcontractors listed in Attachment 4, Contractor Team Organization, are not teamed with other offerors. After award of contracts, the proposed teaming arrangement limitation does not apply to task order awards.
Proprietary information submitted in response to this solicitation will be protected from unauthorized disclosure as required by Subsection 27 of the Office of Procurement Policy Act as amended (41 U.S.C. 423), herein after referred to as “the Act”, as implemented in the FAR.
3. EVALUATION PROCESS
Responsive: Offeror proposals must adhere to proposal submission instructions as outlined in 52.212-1 Instruction to Offerors to include Table 1, Proposal Organization format compliance, completeness of each volume, and submission of all volumes on time. Offerors are advised to thoroughly read the instructions to offerors.
Step 1 - Technical Capability: Offerors will submit one Self Scoring Technical Capability Worksheet (Attachment 5), which identifies the market segment(s) within which the Offeror intends to compete. Offerors are required to provide supporting documentation for each claimed item on the Self-Scoring Technical Capability Worksheet. The Government will review the supporting documentation to validate each claimed item.
Step 2 - Past Performance: Offerors will submit up to three (3) past performance references for each market segment the Offeror identified on the Self Scoring Technical Capability Worksheet. The Government will determine the performance confidence assessment, by market segment, based on the references provided by the Offeror and any other available Government system.
Step 3 - Price: Offerors will submit a proposal in response to the sample market segment Task Order Proposal Requests (TOPRs) provided at Attachment 2 for each market segment the Offeror identified on the Self Scoring Technical Capability Worksheet. The Government will review the proposed prices using price ranges within which proposed prices would be considered reasonable and realistic. If an Offeror proposes a price outside a Government furnished range, the Offeror shall be required to provide a rationale for why the proposed price is outside the range.
4. PROPOSAL SUBMISSION
The Offeror’s entire proposal loaded on a single DVD-R (Digital Versatile Disk – Recordable) must be sent by FedEx or United Parcel Service or hand delivered to Building 1000 which is Defense Health Agency Contracting Office – SA Medical Q Services, 4130 Stanley Road (Old BAMC), Room 239, JBSA Fort Sam Houston, TX 78234 ATTN: Melissa Oliva. U.S. Postal Service (Mail) does not deliver to building 1000. This is a secure military facility so appropriate arrangements are required to access the facility with enough time to meet the proposal deadline. It is the Offeror’s responsibility to make those arrangements to assure meeting the proposal deadline. If the Offeror decides to ship the proposal, it is the Offeror’s responsibility to assure the proposal meets the proposal deadlines. Shipment delays are not a justification for accepting a late proposal. Proposals received after the due date and time specified herein will be considered late.
5. PROPOSAL ORGANIZATION
The Offeror shall organize the proposal as set forth in Table 1, Proposal Organization. The Offeror’s proposal shall be formatted into four (4) separate electronic folders, by volume number and title, as follows:
Volume I – Administration Volume II – Technical Capability Volume III – Past Performance Volume IV – Price
Offerors must include their company name and volume number as shown in the filename example of Table 1. For example, ABC Incorporated filename for Volume II, Physician supporting documentation is ABC.VOLII.TAB2A.pdf. (Filenames do not have to be capitalized). The Offeror shall label multiple documents provided under one tab sequentially (i.e. Tab 2A.1, Tab 2A.2, Tab 2A.3, etc.). Offerors may make minor adjustments to the file naming methodology so long as the resulting file names and organization are clearly understandable. Additionally, the Offeror shall provide a table of contents in the Administration Volume (Volume I) that serves as an overall guide to what files are included, where they are located, and brief descriptions of the documents. The table of contents will not be evaluated.

7. VOLUME II – TECHNICAL
The Technical Volume shall include the following:
Self Scoring Technical Capability Worksheet (Attachment 5) (Tab 1)
For purposes of this technical proposal evaluation the Offeror shall claim experience on the Self-Scoring Technical Capability Worksheet in accordance with this section.
The Offeror shall submit the Self Scoring Technical Capability Worksheet (Attachment 5) in the electronic format provided in this solicitation. No other format will be considered. The Offeror shall not alter rows, columns, or formulas in the worksheet.
The Offeror shall follow the instructions listed below when filling out this worksheet:
o Enter Offeror name in cell B7.
o Enter the market segments within which the Offeror intends to compete in cells C12 through F12. The
Offeror must select at least one market segment to compete for an award on this solicitation. Each market segment that the Offeror intends to compete must have an “x” in the market segment cell to be considered for that market segment. Failure to select a market segment in this section will prevent the Government from seeing a score in that segment and completing a technical capability evaluation.
o Scope Section: The scope section consists of the four market segments: physicians; dental services;
ancillary services; and nursing. The Offeror must fill in the appropriate columns starting at Column C associated with the relevant experience for common, difficult-to-fill, and clinical settings, when appropriate, by entering an “x” for each item. No other character or word will calculate the appropriate point value. Only one column “x” may be entered for each row. If the Offeror enters an “x” in more than one column in a row, the point value for that row will default to the column with the lowest point value, and this point value will automatically be added to the Market Segment Totals tab of the worksheet.
o Magnitude Section: The Offeror must fill in the appropriate column starting at Column C associated with the highest contract value by entering an “x” in the associated cell. No other character or word will calculate the appropriate point value.
o Applicability Section: The Offeror must fill in the appropriate rows starting at Column C associated with contract performance for the various customers, when appropriate, by entering an “x” in the associated cell.
No other character or word will calculate the appropriate point value.
o Complexity Section: The Offeror must fill in the appropriate rows starting at Column C associated with contract performance for the highest demand and difficult-to-fill locations, when appropriate, by entering an “x” in the associated cell. No other character or word will calculate the appropriate point value.
o Organizational Certification Section: The Offeror must fill in the row in Column C only if the Prime has an organizational certification by The Joint Commission for Health Care Staffing Services by entering an “x” in the cell. If the Prime Contractor is a Joint Venture (JV), at least one of the parties in the JV must have a current certification for the JV to claim this item in the worksheet. No other character or word will calculate the appropriate point value.
o ID/IQ Clinical Service Contract Experience Section: The Offeror must fill in the appropriate row starting at Column C associated with ID/IQ contract experience by entering an “x” in the associated cell. No other character or word will calculate the appropriate point value.
o FFP Clinical Service Contract Experience Section: The Offeror must fill in the appropriate row starting at Column C associated with FFP contract experience by entering an “x” in the associated cell. No other character or word will calculate the appropriate point value.
o Prime Clinical Service Contractor Experience Section: The Offeror must fill in the appropriate row starting at Column C associated with prime Contractor experience by entering an “x” in the associated cell. No other character or word will calculate the appropriate point value.
Technical Capability Supporting Documentation (Tabs 2 – 9)
The Offeror shall provide supporting documentation for each item claimed within the time frame identified on the Self Scoring Technical Capability Worksheet (Attachment 5).
For the Scope, Magnitude, Applicability, Complexity, ID/IQ, FFP, and Prime Contractor Sections, the Offeror shall provide one of the following items as supporting documentation.
o For Government Contracts with Contractor Performance Assessment Reporting System (CPARS) Reports:
Provide a copy of the CPARS report in the Technical Volume as outlined in Table 1, Proposal Organization. On the Self Scoring Technical Worksheet (Attachment 5), identify the file name for the CPARS report starting at Column H for each row a CPARS report exits for a claimed item.
o For Government Contracts without an existing CPARS Report: Provide a signed copy of Attachment 3, Technical Capability Validation Worksheet. The Offeror must fill in Sections 1 through 3 and send Attachment 3 to the primary customer point of contact (POC) for signature in Section 4. The Technical Capability Validation Sheet (Attachment 3) must be signed by the customer POC to be used as supporting documentation. The Offeror will identify the file name for the signed Attachment 3 starting at Column H for each row a signed Attachment 3 is submitted for a claimed item. A signed Attachment 3 can only be used when a CPARS does not support a claimed item. This situation may occur when the Offeror is performing in the first year of a Government contract or whenever a CPARS report is rolled up to the contract level of performance.
o For Commercial Contracts: Provide a signed copy of Attachment 3, Technical Capability Validation Worksheet. The Offeror must fill in Sections 1 through 3 and send Attachment 3 to the primary customer POC for signature in Section 4. The Technical Capability Validation Sheet (Attachment 3) must be signed by the customer POC to be used as supporting documentation. The Offeror will identify the file name for the signed Attachment 3 starting at Column H for each row a signed Attachment 3 is submitted for a claimed item.
Supporting documentation must address the specific service being provided. A specific supporting document can be applied to more than one row on the Self-Scoring Technical Capability Worksheet as long as that document supports the claimed item. Do not provide a contract-level CPARS if the item claimed was provided under a task order (provide either that Task Order CPARS or a signed Technical Capability Validation Worksheet if the CPARS happened at the contract level or there is no CPARS). The Offeror shall not consolidate requirements on multiple task/delivery orders to obtain a higher point value. Likewise, the Offeror shall not consolidate requirements for different option periods on the same contract to obtain a higher point value as part of their supporting documentation.
Offerors are cautioned that the supporting documentation must demonstrate performance in the area claimed on the Self-Scoring Technical Capability Worksheet (i.e., labor category, location, number of full-time equivalent [FTEs] as outlined in paragraph 2.1.15 in the Performance Work Statement). For example, Attachment 3 must support the claimed item on the self-scoring technical capability worksheet. The Government reserves the right to review any information related to the supporting documentation for validation only. The supporting documentation must match the labor categories listed in Exhibit 3.
For Organizational certification section, the Offeror, must provide a copy of The Joint Commission (TJC) certification in Health Care Staffing Services for the prime Contractor only. Certification by a subcontractor or teaming partner is not acceptable. If the prime contractor is a Joint Venture (JV) with more than one company making up the JV, one member of the JV is sufficient to count as being certified. No other certification will be acceptable.
8. VOLUME III - PAST PERFORMANCE
Each Offeror shall submit a past performance volume as outlined in Volume 3. Past Performance information is required by the Offeror, but can also be submitted from a significant subcontractors, teaming partners, and/or joint venture partners. If past performance information is provided by a subcontractor, teaming partner and/or joint venture partner, those arrangements must be identified in Contractor Team Organization (Attachment 4) found in the Administration Volume (Volume I, Tab 3) of the Offeror’s proposal. The Government will use past performance information submitted by the Offeror and other past performance information available to the Government during the evaluation of past performance.
Along with the information required in this paragraph, the Offeror shall submit a consent letter (Attachment 7) executed by each subcontractor, teaming partner, and/or joint venture partner, authorizing release of past performance information to the Offeror so the Offeror can respond to such information.
For each identified effort for a commercial customer, the Offeror shall also submit a client authorization letter (Attachment 8), authorizing release to the Government of requested information on the Offeror's performance.
Recent Contracts: Each past performance information submission shall be recent. To be recent, the effort must have occurred anytime during the period 1 Jan 12 through 30 Sep 16.
Relevant Contracts: For contracts to be relevant or somewhat relevant, they must provide services in the minimum number of labor categories from Exhibit 3 as identified in Table 2.
Table 2, Minimum Number of Labor Categories
Market Segment Relevant Somewhat Relevant Minimum Number of Labor Categories Minimum Number of Labor Categories
Ancillary Services 3 1 Dental Services 1 1 Nursing Services 2 1 Physician Services 2 1
Past Performance References: The offeror shall submit up to three (3) Past Performance Information (PPI) references for each of the market segments the Offeror has identified on the Self Scoring Technical Capability Worksheet (Attachment 5) they intend to compete. Each PPI submission will be labeled in Volume III as identified in Table 1, Proposal Organization. The Offeror will provide PPI references that illustrate the most relevant experience in regards to demonstrating the quality of performance on the proposed effort. The PPI references must include a minimum of one (1) recent contract performed by the Prime Offeror, as either a prime Contractor or subcontractor. Because the maximum number of past performance references for the Offeror in any market segment is three (3), no more than two (2) past performance references per market segment can be from teaming partners or subcontractors.
Past Performance Information - Tool: Offerors will use the past performance information tool to submit the past performance information on each reference electronically as outlined in this section and Attachment 9. The past performance information tool allows the Offeror to provide contract information, a brief description of services, use of management actions for performance problems, and key program points of contact for each reference.
References (Tabs 1A-4C)
Each past performance reference shall consist of the following:
Past performance tool (see Attachment 9 for data requirements on the past performance tool): The Offeror shall use the past performance information (PPI) tool for submitting recent past performance contract information. This tool can be downloaded from FedBizOpps (https://www.fbo.gov/) as an attachment to the solicitation posting. The Offeror shall save each past performance reference from the past performance tool on the submitted DVD-R. If the Offeror is unable to download the past performance information tool, contact the PKO for assistance. The Offeror must save the PPI database file using the following convention: Prime Contractor Name + RFP Number.accdb (e.g., XYZCompanyFA701407RA016.accdb). (Note: There are no page numbering, line spacing or font size restrictions on the PPI tool).
Past performance questionnaire (if required) (Attachment 6): The Offeror is responsible for initiating Attachment 6 Past Performance Questionnaire (PPQ) only if the past performance reference is not available in CPARS. The Offeror will forward the questionnaire to the primary customer point of contact (POC), with instructions to send the completed, signed questionnaire back to the Offeror. Offerors shall provide signed questionnaires as part of the Past Performance Volume of their proposal.
Subcontractor/teaming partner consent letter (if required) (Attachment 7): Past performance information pertaining to a subcontractor cannot be disclosed to the prime Offeror without the subcontractor’s consent. Provide with the proposal, a letter from all subcontractors that will perform major or critical aspects of the requirement, a letter consenting to the release of their past performance information to the Offeror.
Client authorization letter (if required) (Attachment 8): Each Offeror, teaming partner, and/or joint venture partner shall execute a Client Authorization Letter for commercial customers.
Organizational Change History (Tab 5)
Many companies have acquired, been acquired by, or otherwise merged with other companies, and/or reorganized their divisions, business groups, or subsidiary companies. In many cases, these changes have taken place during the time of performance for relevant past efforts or between the conclusion of recent past efforts and this source selection. To clarify any organizational changes, the Offeror shall provide a "roadmap" describing all such changes in the organization of the company. A pamphlet or other commercial document describing such reorganizations may suffice within the page limit identified in Table 1, Proposal Organization. As part of this explanation, show how these changes impact the relevance of any efforts the Offeror identified for past performance evaluation/performance confidence assessment.
9. VOLUME IV – PRICE
This section is to assist offerors in submitting a price proposal to the sample market segment Task Order Proposal Request (TOPR) for each market segment in which the Offeror intends to compete. Sample market segment TOPRs provide instruction to complete pricing proposals, and are found in Attachment 2. The Government will evaluate the sample market segment TOPR proposal submission to determine a price that is reasonable and realistic.
Direct Labor Range – For the purposes of this acquisition, the Government has provided a direct labor range for each HCW in the sample market segment TOPR. The direct labor range has been established using independent market research to determine a realistic direct labor range for each HCW indicated in the sample market segment TOPR. While offerors are free to submit whatever direct labor rates they see fit, offerors are encouraged to propose a direct labor rate for each HCW in the sample market segment TOPR within the ranges provided. The Government understands that market forces can change the rate at which a HCW is hired; therefore, if the Offeror’s proposed direct labor rate for HCWs is either lower or higher than the Government-specified range, the Offeror will be required to provide rationale to support their proposed price.
Total Task Order Price Range – For the purposes of this acquisition, the Government has provided a total task order price range for each sample market segment TOPR. The total task order price range has been established using independent market research to determine a reasonable total task order price range for each sample market segment TOPR. While offerors are free to submit whatever task order price they see fit, offerors are encouraged to propose a price for the sample market segment TOPR within the ranges provided. The Government understands that market forces can change the price at which a HCW is hired;
therefore, if the Offeror’s proposed total task order price is either lower or higher than the Government-specified range, the Offeror will be required to provide rationale to support their proposed price.
Offerors are strongly advised to provide clear and convincing rationale to support lower or higher direct labor rate(s) and/or total task order pricing outside of the ranges provided in the sample market segment TOPR instruction.
Offeror’s are cautioned that if the Government does not accept the rationale for higher or lower proposed prices, the Government may not consider the proposed price to be reasonable or realistic.
Prices provided in response to sample market segment TOPRs are for source selection evaluation purposes only.
Sample market segment prices will not be tied to any Contract Line Item Number (CLIN) on the resulting IDIQ contract.
Market Segment Proposals (Tab 1A-D)
Offerors will be required to submit from one to four price proposals based on the number of market segments on which the offerors intend to compete. The Offeror shall submit their pricing on the pricing worksheet provided in the sample market segment TOPR for the market segment in which the Offeror intends to compete. All information relating to the proposed price, including all required supporting documentation must be included in the section of the proposal designated as the Volume IV - Price. Under no circumstances shall this information and documentation be included elsewhere in the proposal.
Offerors are cautioned that submission of a TOPR in a market segment in which they intend to compete must correlate with the market segments identified in the Self Scoring Technical Capability Worksheet (Attachment 5).
For example; if an Offeror did not indicate their intention to compete in the nursing segment on the Self Scoring Technical Capability Worksheet (Attachment 5), the Offeror will not be considered for the nursing sample market segment TOPR in the Price step of the evaluation.

ADDENDUM TO 52.212-2 Evaluation – Commercial Items
1. PROGRAM STRUCTURE
These contracts will consist of a five-year ordering period with Task Orders (TO) being placed during the five year contract period of performance IAW the terms and conditions of the base IDIQ MAC’s. There is a program ceiling limit of $7.5B inclusive of all TOs issued under the IDIQ MACs. During contract competition, cross-teaming is prohibited (see 52.212-1, paragraph 2, General Instructions). When questions arise between proposals where the same teaming partner and/or subcontractor is listed on multiple proposals, written documentation provided in Attachment 4, Contractor Team Organization, will determine which of the proposals will be evaluated. If the proposals in question have written documentation of the same teaming and/or subcontracting arrangements, or if neither of the proposals in question have written documentation of teaming and/or subcontracting arrangements, none of the proposals in question will be evaluated. If only one proposal in question has written documentation of teaming and/or subcontracting arrangements, the proposal with the written documentation will be evaluated IAW the terms of the solicitation.
2. BASIS FOR CONTRACT AWARD
The basis for contract award are Offerors found to have the highest self-scored, Government-validated, technical worksheets with satisfactory past performance and prices that are reasonable and realistic. The source selection process for this acquisition will neither be based on the Lowest Price Technically Acceptable (LPTA) nor Tradeoffs.
Within the best value continuum, FAR 15.101 defines best value as using any one or a combination of source selection approaches. Best value will be determined within each market segment using a 3-step evaluation process including responsiveness, technical capability using a Self-Scoring Technical Capability Worksheet, past performance, and price where non-priced factors are significantly more important than price. See Figure 12. The Government may conduct evaluations on all four steps either concurrently or sequentially.
Figure 12, MQS Best Value Continuum
The COD-SA will issue Multiple Awards of approximately 30 IDIQ contracts for the Physicians market segment, approximately 10 IDIQ contracts for the Dental market segment, approximately 35 IDIQ contracts for the Ancillary market segment, and approximately 20 IDIQ contracts for the Nursing market segment as a result of this one solicitation using a 3-step evaluation process. The Contracting Officer (KO) may determine that the number of proposals, by market segment, exceeds the number at which an efficient competition can be conducted. For the purposes of efficiency, the KO may establish a competitive range, by market segment, comprised of the most highly rated proposals based on evaluation criteria, as stated in FAR 15.306(c).
Responsive: The Government will review each proposal to ensure adherence to proposal submission instructions in 52.212-1. The review will include format compliance, completeness of each volume, and timeliness of proposal submission. Offeror’s whose proposal is missing items, not submitted in the required format or not submitted in a timely manner will be considered unresponsive. The Government anticipates that competition will be significant in this process and, therefore, adherence to proposal submission instructions is of the utmost importance. Noncompliance with these instructions will result in a determination by the KO that the Offeror is unresponsive. All responsive proposals will be evaluated in Step 1, Technical Capability.
Step 1 - Technical Capability: For all responsive offerors, the Government will validate each claimed item
(point value applied by Offeror) on the Self Scoring Technical Capability Worksheet (Attachment 5) using only the supporting documentation provided by the Offeror in their proposal. The Offeror shall provide supporting documentation in the form of a CPARS report or a signed Attachment 3 for the Government to validate a claimed item on the Self-Scoring Technical Capability Worksheet. Any claimed item that does not have supporting documentation will not be validated by the Government. If the supporting documentation is provided on a signed Technical Capability Validation Sheet (Attachment 3), the Government may use other sources such as Electronic Document Access (EDA) to validate the claimed item or contact the Point of Contact (POC) provided by the Offeror on Attachment 3. If the Government cannot validate a claimed item in a market segment, the Offeror will not be considered for award in that market segment; however, if the Government enters into discussions, the Offeror may be considered for award in the market segment if the issue is resolved through discussions. If the Government cannot validate a claimed item that applies across multiple market segments (e.g., magnitude, complexity, organizational certification), the Offeror will no longer be considered for award; however, if the Government enters into discussions, the Offeror may be considered for award in the solicitation if the issue is resolved through discussions. Those offerors whose claimed items on the worksheet are fully validated by the Government, based on the supporting documentation provided by the Offeror, by market segment, will be further evaluated in Step 2, Past Performance either concurrently or sequentially.
Step 2 - Past Performance: For those offerors whose claimed items on their Self-Scoring Technical Capability Worksheet were validated by the Government in Step 1, the Government will evaluate the past performance record, by market segment, based on the references provided by the Offeror and any other available Government sources. Past performance records in a market segment in which the offeror did not previously state their intention to compete as indicated on their Self-Scoring Technical Capability Worksheet will not be evaluated. If an Offeror’s proposal in a market segment is “Limited Confidence” or “No Confidence”, the Offeror will no longer be considered for award in that market segment. If an Offeror’s proposal is found “Limited Confidence” or “No Confidence” in all market segments, the Offeror will no longer be considered for award. Offerors with past performance information that is so sparse that a performance confidence assessment cannot be made will receive a “Neutral Confidence” assessment. Neutral Confidence assessments will neither be treated favorably nor unfavorably by the Government. Offerors determined to have a Satisfactory performance confidence assessment in the market segments within which they intend to compete will be further evaluated in Step 3, Price either concurrently or sequentially.
Step 3 - Price: For those offerors who were assessed as Satisfactory confidence assessment in the market segment(s) within which they intend to compete (as indicated on their Self-Scoring Technical Capability Worksheet found at Tab 1, Technical (Volume II), the Government will evaluate the offerors’ pricing proposal in response to the sample TOPRs (Attachment 2), by market segment. The evaluation will determine whether the proposal pricing, by market segment, is reasonable and realistic. Submission of a sample market segment TOPR proposal in a market segment in which the offeror did not previously state their intention to compete as indicated on their Self-Scoring Technical Capability Worksheet will not be evaluated. If the Offeror’s proposal in a market segment is not found to be reasonable and realistic, the Offeror will no longer be considered for award in that market segment unless the Government enters into discussions.
Award Without Discussions: The Government reserves the right to award without discussions. Therefore, each proposal should contain the Offeror’s best terms from a technical, past performance, and price standpoint. The Government may make a determination as to whether the Offerors’ proposal results in the award of a contract based on the initial proposal as submitted. The Government reserves the right to conduct discussions if the KO determines discussions are necessary. If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, Offeror responses to Evaluation Notices (EN’s) and the Final Proposal Revision (FPR) will be considered in making the Source Selection Decision. Clarifications and communication exchanges may be conducted after receipt of proposals for the reasons identified in FAR 15.306(a) and (b) and the KO reserves the right to award a contract without the opportunity for proposal revision if awarding without discussions.
The criteria for contract award is the highest technically rated offerors, as determined by the validated Self-Scoring Technical Capability Worksheets that possess a Satisfactory past performance with a reasonable and realistic price.
The Defense Health Agency reserves the right to award more or fewer best value contracts, by market segment, if the Source Selection Authority (SSA) determines it is in the Government's best interest based on a consideration of one or more of the following items: available funding for minimum guarantee; the need to sustain adequate competition; and the availability of best value proposals.
Solicitation Requirements: By submission of its proposal, the Offeror accedes to all solicitation requirements, including terms and conditions and technical requirements. Failure to meet a requirement may result in a proposal being determined unawardable.
