QUESTIONS & ANSWERS

HT001419R0021 Q&As

Question 1: Can you provide clarity on the requirement for offerors to have a collective bargaining agreement (CBA) with the National Association of Concierges? We are only familiar with CBAs that are provided as part of a solicitation and typically have an impact on pricing. Is this a CBA between each prospective offeror and the National Association of Concierges? Or is it something the Govt. will provide as a solicitation attachment?

Answer 1: Addendum to FAR 52.212-1, Factor IV: RFP Documents, paragraph (f) has been amended as follows:

(f) Within this volume, Offerors should submit one (1) copy of their current collective bargaining (CBA) agreement with the National Association of Concierge’s as part of their submission. If the offeror does not have a current CBA with the National Association of Concierge's, a negotiated CBA with the National Association of Concierge’s shall be submitted to the Government within 30 days after contract award.

The following text has been deleted, “Failure to provide the collective bargaining agreement with the National Association of Concierge shall eliminate the offeror from further consideration for award.”

Addendum to FAR 52.212-2, Factor IV: RFP Documents, paragraph 2 has been amended as follows:

2. Collective Bargaining Agreement: Offerors should submit one (1) copy of their current collective bargaining agreement with the National Association of Concierge’s as part of their submission. If the offeror does not have a current CBA with the National Association of Concierge's, a negotiated CBA with the National Association of Concierge’s shall be submitted to the Government within 30 days after contract award.

Question 2: Reference: Factor IV: RFP Documents. *Collective Bargaining Agreement:

Offerors must submit one (1) copy of their current collective bargaining agreement with the National Association of Concierge’s as part of their submission. Compensation Factor 1, will be evaluated on a “Go/No- Go” basis. *Failure to provide the collective bargaining agreement with the National Association of Concierge shall eliminate the offeror from further consideration for the award.

Please clarify this requirement further. How should we have this in place before the contract award? Is there a CBA/Union in place that the government wants the new contractor to incorporate? The clarification on this will be highly appreciated.

Answer 2: Please refer to question and answer #1.

Question 3: Reference Factor II: Past Performance. Past performance information may be used for both responsibility determinations and as an evaluation factor for award. The Past Performance Questionnaire included with the Attachments will be used to collect information on an offeror’s performance under existing and prior contracts/subcontracts for services similar in scope, magnitude, relevance and complexity to this requirement in order to evaluate offerors’ consistently in accordance with the past performance evaluation factor set forth in the Evaluation Factors for Award clause. References other than those identified by the offeror may be contacted by the Government and used in the evaluation of the offeror’s past performance.

Due to COVID-19 lockdown situations, many of our customer POC/CORs are not able to respond to PPQs on time. Considering this situation, will the government accept any other form of response for the evaluation purpose. E.g. CPARS?

Answer 3: Please refer to the Addendum to FAR 52.212-1, Factor II: Past Performance, section (c), paragraph (3).

Question 4: What kind of vehicles (model of vans, buses, etc), currently used by the incumbent at the seven MTFs, is used as a Patient Transporter?

Answer 4: WRNMMC: Equipment: The Contractor will furnish one American with Disabilities Act (ADA) compliant vehicle; which will be no more than 3 years old and have no more than 60,000 miles on the Odometer. Additionally, the contractor will furnish one Golf Cart to conduct environment of care rover patrols. Both of these vehicles will be maintained mechanically by the contractor. The vehicles will have appropriate insurance coverage. The contractor will also be responsible for replacement vehicles if either should be inoperable for more than 48 hours to ensure complete coverage of requirements within this contract. The vehicle currently used is a van with ADA compliance.

Question 5: On page 94, seven (7) places of performances are indicated; at what point in the five year contract will the duty location for personnel be located at an MTF within the National Capital Market?

Answer 5: Duty locations will be identified on individual task orders placed off of the awarded Indefinite Delivery, Indefinite Quantity (IDIQ) contract resulting from this solicitation.

Question 6: On pages 85-87 of the RFP, Past Performance, there is no requirement of the subcontractor to submit any past performances; is this an oversight?

Answer 6: Please refer to the Addendum to FAR 52.212-1, Factor II: Past Performance, section (a).

Question 7: On page 88 of the RFP, "Failure to provide the collective bargaining agreement with the National Association of Concierge shall eliminate the offeror from further consideration for award." Will you provide a copy of the current CBA or the name, phone number and email address of the individual in the NAC responsible for the CBA for this RFP.

Answer 7: This information will be provided to the awardee.

Question 8: On page 88 of the RFP, you cite two requirements, if not met, shall eliminate the offeror's bid proposal...to provide the $5M LOC and the CBA with the National Association of Concierge. We believe that both requirements, if they remain in the RFP, will lead to a protest before the bid submission date. The pricing proposal should accommodate the $5M LOC, and your providing the current CBA should accommodate the other. Why don't you make the adjustments by eliminating both requirements of the RFP?

Answer 8: Please refer to question and answer #1. There is no change to the Letter of Credit requirement.

Question 9: Evaluation Factor IV (f); p. 88 of 147. Per solicitation Factor 4, section F; offerors are to submit 1 copy of their current collective bargaining agreement with the National Association of Concierge’s as part of their submission. Not all qualified vendors have current CBA’s with the NCA. Requiring a current CBA in place with the NCA unduly limits competition and provides an unfair advantage to the incumbent contractor. Any awardee will be required to negotiate a CBA with NCA upon award.

Will the government remove the requirement for a current CBA with the NCA? Instead, to reflect experience with a Collective Bargaining Unit (CBU), can the Government use the past performance submissions to substantiate CBU experience?

Answer 9: Please refer to question and answer #1.

Question 10: Evaluation Factor I; p. 85 of 147. To properly price fringe benefits under the CBA, can the government please provide the current CBA under the incumbent contractor (GCP, Inc)?

Answer 10: Please refer to question and answer #7.

Question 11: Reference: 1.19 Personal Security – Criminal Background Investigation Requirements. 1.19.5 Personnel may be employed under the contract pending completion of the background checks provided the activity uses line-of-sight supervision while minor children are in the care of that individual. The contract personnel shall be within line-of-sight supervision of a staff person whose background check has been successfully completed, or is in the presence of the child's parent or guardian.

Historically what is the timeframe for getting the completed Background checks done? Based on 1.19.5, will the government allow contractor employees to start on the job while the background investigation is going on?

Answer 11:

JBA - Normally it can take anywhere from 3 to 6 weeks for a clearance to be processed and approved. Normal process is that no candidate can start unless they can receive a CAC; however due to current conditions and fingerprints are closed at this time management can waive the security process until fingerprints are up and running again. Please note that once fingerprints are open again, all candidates will not be able to start until their security clearance is approved.

FBCH - The initial background investigation usually takes from one to three days. If the initial background check comes back clean, it is possible for contractor employees to start before the extensive background investigation is completed by OPM, but never without having the basic background investigation completed.

WRNMMC - Historically, the contractor is usually already working from the previous contract.

If the new vendor is bringing on a new contractor, his/her fingerprinting should be completed through Base Security. Once the results are received in Personnel Security, the COR will receive an email that states: The following Subjects have been deemed an acceptable risk to in-process while their investigation is ongoing. If the Central Adjudication Facility determining the Subject's eligibility awards a Favorable determination at the conclusion of their investigation, he/she will be allowed to continue on the contract endeavor; however, if the Subject receives an Unfavorable determination, he/she will not be allowed to continue on the contract endeavor and must be dismissed immediately.

Question 12: Reference: 1.19 Collective Bargaining Agreement (CBA)

We reached out to the National Association of Concierge and requested the information on CBA and they mentioned that NAC has no information or idea about it. Will the government provide more Information on the process to get CBA in place and approved?

Answer 12: Please refer to question and answer #1.

Question 13: Is the incumbent contract has a CBA in place and if so, will the government share a copy of the same.

Answer 13: Yes, please refer to question and answer #7.

Question 14: Reference: 1.16 Health and Immunization Requirements

In addition to the Health and Immunization requirements mentioned in the solicitation, will the government require any specific or additional requirements in view of ongoing COVID-19 pandemic? If so, please provide that information.

Answer 14: JBA/FBCH/WRNMMC - There is no change to the current requirement as stated in the requirement.

Question 15: Please provide the incumbent contract number and information. Please clarify if the services covered under the incumbent contract are similar in scope and magnitude (Locations and FTEs) as required by the current solicitation, if not please provide additional information for the same.

Answer 15: The incumbent information will be provided to the awardee. The service on the solicitation is the same as the current contract.

In the past we have always been granted a 30 day period from the time of award to negotiate with the incumbent union. Is it possible to remove this requirement, or alter it to give a negotiating period with the union upon award?

Answer 22: Please refer to question and answer #1.

Question 23: Is there currently an incumbent for this contract?

Answer 23: Yes.

Question 24: Will this contract be multiple awards? If so, how many companies will be awarded the contract?

Paragraph (a) is hereby supplemented with the following:

(d) The government will award a contract resulting from this solicitation to the responsible offeror whose proposal, conforming to the solicitation, will be most advantageous to the government, price and other factors considered. The following factors will be used to evaluate quotations:

(1) Price

(2) Past Performance

(3) Compensation Plan

• Letter of Credit

• Collective Bargaining Agreement

EVALUATION FACTORS

Award will be made to the offeror whose proposal is most advantageous to the Government based upon an integrated assessment of the evaluation factors described below.

The following evaluation factors will be used to evaluate each proposal:

Factor III: Compensation Plan Factor IV: RFP Documents

1. Letter of Credit

2. Collective Bargaining Agreement

The contract will be an Indefinite Delivery, Indefinite Quantity type contract with Firm Fixed Price (FFP) ordering provisions. The Government will use the Price matrix (Attachment 2) when determining a total evaluated price. The Government has structured the Price matrix similar to the structure of the task orders anticipated to be issued during the five (5) year performance period by having the Price matrix list all the services and the quantities that the Government anticipates to order during the five (5) year performance period. To determining the total evaluated price

The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement.

a. Price will not be adjectively rated.

b. Options: The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options shall not obligate the Government to exercise the options.

c. Given that FAR 52.217-8 provides that the Government may exercise the Option to Extend Services at the rates specified in the contract (i.e., the rates in effect when the Extension of Services option is exercised), for purposes of evaluating the Option to Extend Services, the Contracting Officer will consider the prices submitted for the base period and each option period, since those are the binding prices should the Option to Extend be exercised.

The Government will evaluate performance information on all offerors based on (i) the references provided by the offeror, and (ii) any past performance information obtained from survey/ questionnaires (Attachment 1), and (iii) any data independently obtained by the government. If a reference identified by the offeror in accordance with 52.212-1(m)(B)(4)(c), does not submit a survey/ questionnaire, the government may follow up with the reference POC, but the Government is not responsible for the failure of a reference POC to provide a survey/questionnaire. In addition to evaluation of recency and relevancy, the Government will perform a performance quality assessment of such work when assessing the entirety of an offeror’s Past Performance.

(b) Past performance regarding predecessor companies of the offeror and/or subcontractors, key personnel, and subcontractors that will perform major aspects of the requirement, if applicable (see 52.212-1(m)B.4(d)), may be considered as past performance information for the principal offeror.

(c) The evaluation of past performance information (i) may take into account past performance regarding key personnel who have relevant experience, and/or (iii) may take into account past performance regarding subcontractors that will perform major or critical aspects of the requirement when such information is relevant to this acquisition.

(d) Recent past performance information includes efforts performed and/or being performed for any customer within the last three (3) years prior to the issuance date of the solicitation.

(e) Relevant contracts performance effort involved similar scope, magnitude of effort, and complexities to that required by this solicitation. The Government will assess relevancy for each contract and assign a rating as described in Table 2 below:

Past Performance Relevancy Rating Method:

Adjectival Rating Description

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

The following ratings will be used to evaluate Past Performance:

Adjectival Rating Description

Substantial Confidence

Based on the Offerors recent/relevant performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.

Satisfactory Confidence Based on the Offerors recent/relevant performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available or the Offerors performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

The Offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence Based on the Offerors recent/relevant performance record, the Government has a low expectation that the Offeror will successfully perform the required effort.

No Confidence Based on the Offerors recent/relevant performance record, the Government has no expectation that the Offeror will be able to successfully perform the required effort.

The following definition is applicable:

“FAPIIS.”

If your proposed base hourly rate, for a given labor category is below the hourly rate identified in the Labor Category Minimum Compensation Matrix, offeror shall provide a justification showing evidence of why the proposed compensation for workers is adequate to obtain and retain qualified workers.

Compensation Factor 3, will be evaluated on a “Go/No- Go” basis. If a Justification is not adequate to obtain and retain qualified workers, the offeror shall be eliminated from further consideration for award.

Factor IV: RFP Documents

1. Letter of Credit: Offerors must include a Letter of Credit to demonstrate the offeror’s financial health and capacity to cover expenses for this requirement. The document, issued by a bank or other financial institution, shall provide the offeror a line of credit for a minimum of $5 million.
