6) Each affected employee shall be furnished by the contractor with a written copy of such determination or it shall be posted as a part of the wage determination (See 29 CFR 4.6(b)(2)(iii)).
Information required by the Regulations must be submitted on SF-1444 or bond paper.
When preparing a conformance request the ""Service Contract Act Directory of Occupations"" should be used to compare job definitions to ensure that duties requested are not performed by a classification already listed in the wage determination. Remember it is not the job title but the required tasks that determine whether a class is included in an established wage determination.
Conformances may not be used to artificially split combine or subdivide classifications listed in the wage determination (See 29 CFR 4.152(c)(1))."

(l) The solicitation should be completed, signed and received at this office not later than the date/time specified on page one of the solicitation (Standard Form [SF] 1449). Failure to provide all information requested and in the appropriate format as required may cause your proposal to be rejected and no longer considered for award.
Please note that your proposal must include all of the following information. Submit proposal in three (3) separate parts as follows:
I. Technical: Compensation & Price Matrix
II. Past Performance
III. Price
The following evaluation factors will be used to evaluate each proposal: Technical, Past Performance and Price. The Offeror’s Technical: “Compensation & Price Matrix” (with supporting market research) will be evaluated as either “Acceptable” or “Unacceptable”. If an Offeror’s Technical factor is evaluated and rated as “Unacceptable”, the Offeror will not be eligible for award. Past performance is significantly more important than price. A trade-off analysis between past performance and price will be utilized to determine which proposal represents the best value to the Government. Award may be made to other than the lowest price quotation.
PART I: TECHNICAL INFORMATION: The information provided by the offeror is a significant factor in the Government’s determination of technical acceptability as it pertains to the offeror’s ability to hire qualified personnel as well as to provide continuous service based on a sufficient incentive to retain those qualified personnel.
Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of each proposal. Proprietary information shall be clearly marked. Within the technical portion of the offeror’s proposal, the offeror shall provide: Compensation. See Attachment # 1 to the solicitation entitled “Compensation & Price Matrix”.
(a) Offerors are directed to fill-in / populate the “Compensation & Price Matrix” that includes employee ‘Base Salary (Hourly)’, employee ‘Fringe Benefits’ and ‘Total Billable Hourly Rate’ for the geographic area of services (Walter Reed National Military Medical Center, Bethesda, MD 20889-5600). If the salary is less than the amount paid in the local area, the offeror must demonstrate that its “Compensation & Price Matrix” is adequate to recruit and retain quality health care providers and ensure uninterrupted performance of services throughout the life of the contract.
(b) The escalation factor or other means for price changes in the Option periods must be addressed in a narrative of the offeror’s market research that should accompany the completed “Compensation & Price Matrix”.
(c) Vendors are notified that the Service Contract Labor Standards Statute applies to all applicable labor categories unless exempted. Vendors are responsible for determining whether employees proposed to work under the contract are covered by the Service Contract Labor Standards Statute or if they are covered by an exemption.
Vendors should explain this determination in their quote and price the task order accordingly.
(d) For evaluation of price the offeror shall complete Tab B of “Attachment 2 Compensation & Price Matrix” and provide any supporting documentation in accordance with FAR 52.222-46 that covers each proposed employee.
The documentation shall include the following items:
a. The proposed unburdened direct labor rate (base compensation) for each employee proposed.
b. The total unburdened cost of the proposed fringe benefits package for each employee proposed, including (1) a list and brief summary of the benefits that make up the fringe package (e.g. vacation time, sick leave, bonus/incentive plans, family leave, insurance); and (2) An itemization of the benefits that require employee contributions and the amount of that contribution as a percentage of the cost of the particular benefit.
c. Supporting information to be submitted with the plan shall include data, such as recognized regional compensation surveys and studies of professional, public, and private organizations used in establishing the total compensation structure.
d. For each labor category proposed, the contractor shall map to the appropriate labor category on salary.com and provide written rationale explaining why that is the appropriate labor category. In addition, the contractor must provide a dated screenshot of the selected labor categories from Salary.com that shows the information used as the basis of the comparison.
e. The technical (offeror’s market research) shall not exceed 10 pages (page count does NOT include the offeror’s completed Compensation Matrix) and must be submitted in Microsoft Word compatible format. The technical information shall include the company’s name, address, individual names, CAGE Code, DUNS number on the first page.
PART II: PAST PERFORMANCE: Offeror is required to submit a past performance listing (PPL) containing relevant federal, state, local government and/or private contracts performed within the past three (3) years, which are similar in scope, type of work, and size (e.g. number of employees by type and anticipated dollar value) to the effort described in this solicitation. See specific information that must be identifed in your PPL in paragraph (a) (2) below.
If the offeror has no relevant past performance, the offeror should state so for this evaluation factor. In addition to this PPL, all offerors must provide a copy of the past performance questionnaire (see Attachment 2 PPQ Template), to each individual / company listed in the offeror’s PPL. The customer completes the PPQ for each reference identifed on the PPL and returns it to the offeror for submission with their Factor II Past Performance proposal.
(a) Offerors shall submit the information requested below as part of their proposal for both the offeror and any proposed subcontractors for subcontracts expected to exceed 25% of the requirement. The document shall be submitted in Microsoft Word compatible format and shall not be more than one page for the prime contractor and one additional page for each major subcontractor.

(1) Past performance information will be used for both responsibility determinations and as an evaluation factor for award. Completed PPQs received from the offeror will be assessed for the offeror’s performance under existing and prior contracts/subcontracts for services similar in scope, type of work, and size to this requirement. References other than those identified by the offeror may be contacted by the Government and used in the evaluation of the offeror’s past performance.
(2) Any information collected concerning an offeror’s past performance will be maintained in the official contract file.
(3) Offerors with no relevant past performance history or for whom information on past performance is not available, will be evaluated neither favorably nor unfavorably on past performance.

Impartial consideration will be given to all offers received in response to this solicitation. Offers will be reviewed to determine compliance with all requirements of the solicitation, including any attachments and exhibits. Any offer that is not in compliance with the requirements of the solicitation will be unacceptable and ineligible for award.
The evaluation criteria will be applied to all offers in the same manner. Each proposal will be evaluated strictly in accordance with its content and the Government will not assume that performance will include areas not specified in the offeror's proposal.
Please note the following:
a) The Government intends to evaluate proposals and award a contract without discussions with the offerors.
However, pursuant to FAR 52.212-1(g), the Government reserves the right to initiate discussions/negotiations with the offerors. The offeror’s initial proposal should contain the offeror’s best terms from a price and non-price standpoint.
b) Alternate proposals will not be considered; the offerors are limited to a single proposal. Multiple solutions, optional solutions, etc., shall not be provided and may render a quotation unacceptable.
c) The Government intends to make a single award resulting from this RFP.
FACTORS TO BE EVALUATED:

The Offeror’s proposed Technical: Compensation (for each labor category solicited) will be evaluated as either “Acceptable” or “Unacceptable”. If an Offeror’s compensation plan is “Unacceptable” the Offeror will not be eligible for award.
Past performance is significantly more important than price. A trade-off analysis between past performance and price will be utilized to determine which quotation represents the best value to the Government. Award may be made to other than the lowest price proposal.
