Additional Regulation or Supplemental Clauses Incorporated by Full Text
The following Clauses modifications were made:
52.212-2 Evaluation-Commercial Products and Commercial Services. (Deviation 2026-O0038) Feb 2026 hereby reads as follows:
Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Technical Approach and Quality Control Plan are equally important, and both are more important tha Past Performance. For evaluation factors other than price, when combined, non-price factors are more important than price.n
The following factors will be used to evaluate offers:
Factor I - Technical Approach: The Technical Approach will be evaluated based on the Offeror's demonstrated ability to perform the requirements of the PWS. The Government will evaluate the Technical Approach considering at a minimum the following elements:
1. Ability to provide electronic fingerprint collection with direct submission to DCSA (PWS 5.1.2.1).
2. Ability to produce Physical fingerprint cards to ship to DHA Headquarters (PWS 5.1.2.2).
3. Provide locations available to collect fingerprints allowing for maximum accessibility for DHA customers to use the service. (PWS 1.7.1 and 1.7.3).
4. Describe the means to allow DHA access to an electronic portal to view/search applicant information, verify statuses and create reports (PWS 5.1.3).
5. Ability to provide a web registration process for applicants (PWS 5.1).
Factor II - Past Performance: The Government will evaluate the Offeror's record of relevant and recent performance on similar contracts. The Government may use information provided by the Offeror and obtained from other sources.
Factor III - Price: Price proposals will be evaluated for reasonableness in accordance with FAR 15.404-1. Price will not be assigned an adjectival rating. The evaluation will consider whether proposed prices are reasonable for the work to be performed, reflect a clear understanding of the requirements, and are consistent with the Offeror's technical proposal.
Factor IV - Organizational Conflict of Interest (OCI): The OCI statement and Mitigation Plan (if applicable) will be reviewed for compliance and not given any evaluation ratings.
Factor V - Quality Control Plan (QCP): The Offeror's approach to managing contract performance and ensuring quality will be evaluated, relying on the content of the Quality Control Plan (QCP) to reflect the Offeror's ability to proactively monitor, correct and prevent performance issues.
(b) . The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Options Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the options. Option (Extension Provision) price: In accordance with FAR 52.217-8, OPTION TO EXTEND SERVICES (NOV 1999), the Government has the unilateral right to extend any resulting contract under the same terms and conditions for a total of not more than six months. To account for the option period(s) possible under 52.217-8, the Government will evaluate the option to extend by adding six months of Offeror's performance period to the Offeror's total price, based on pricing provided for Option Period Four. The method for evaluating the extension is to multiply an additional six months of requirements by the offered monthly price of the last option period. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) . A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall Notice of award result in a binding contract without further action by either party. Before the Offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The Government intends to award without discussions.
(End of provision)
ADDENDUM TO 52.212-2
Basis for Award: The basis of award for this acquisition will be Performance Price Tradeoff (PPT). A technical evaluation will be conducted on the Offeror's technical proposal. If the Offeror is determined unacceptable on the technical evaluation they will be removed from further consideration. By submission of its offer, the Offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in an offer being determined unacceptable.
Government evaluators will not assume that the Offeror possesses any capability or knowledge unless it is specified in the proposal and offer.
Initially offers shall be evaluated in accordance with provisions cited in FAR 52.212-2- Evaluation of Commercial Items. Offerors receiving an acceptable technical rating will be ranked according to price, including priced options.
Offers will receive a preliminary price analysis to determine if quotations are within fair market range. Grossly understated or overstated quotations "may be" removed from consideration if it has been determined the Offeror price quotation does not have a clear understanding of the requirement.
Technically acceptable offers will then receive a performance confidence assessment in accordance with the evaluation criteria. The contracting officer will make a determination to award to the Offeror with overall Substantial Confidence, lowest overall price after formal price analysis.
If lowest price Offeror is determined to have a less than Substantial Confidence performance assessment, the next lowest priced Offeror will be evaluated and the process will continue (in order by price) until an Offeror is judged to have a Substantial Confidence performance assessment or until all technically acceptable Offerors are evaluated. If no Offeror is determined to have a Substantial Confidence performance assessment, the contracting officer will make a determination to award to the Offeror with overall Satisfactory Confidence, lowest overall price.
Prior to award, a responsibility determination is made as described in FAR Part 9.
Non-Cost/Price Evaluation Criteria:
The following criteria will be used to evaluate the non-cost/price aspects of the offer detailed in provision 52.212-2. Evaluation Criteria (Technical Factors) include:
Factor - Technical Approach I
RATING DESCRIPTION
Acceptable An Acceptable rating will be assessed if the offerors' proposal clearly meets the Government's requirements in accordance with
Attachment 1 - PWS.
Unacceptable Failure to meet the Government's requirements as identified in Attachment 1 - PWS, or to provide sufficient detail for the
Government to determine whether its offer meets the requirements of this solicitation.
Factor - Past Performance II
The evaluation will follow a three-step process:
1. Recency - Past performance efforts must be within the last three (3) years from the date of the solicitation.
2. Relevance - The degree to which past efforts are similar in size, scope, and complexity to this requirement.
3. Confidence Assessment - An evaluation of how well the Offeror performed on the identified relevant contracts.
Factor V - Quality Control Plan
Rating Description
Acceptable Plan clearly meets the minimum requirements of PWS Section 1.10.1.
Unacceptable Plan fails to meet the Government's requirements as identified in PWS Section 1.10.1, or to provide sufficient detail for the
Government to determine whether its offer meets the requirements of this solicitation.
Price Evaluation Criteria: Price will be evaluated separately from the non-price factors. Price will be evaluated to determine fair and reasonable pricing. The Government will determine price reasonableness by comparison of the proposed price to the market price derived from market research or from adequate price competition. The evaluated price will be the total of all the priced line items, for the base year and all options as specified in provision 52.212-2 (b) Options. In order to establish a fair and reasonable price, the Government shall obtain any data as necessary.
The Government intends to award a contract without discussions with respective Offerors. Therefore, the Offeror's initial offer should contain that Offeror's best terms from a price and technical standpoint. The Government, however, reserves the right to conduct discussions if deemed in its best interest. Prior to discussions, a competitive range may be established and the Offerors within the competitive range will be part of the discussions. The Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
A written notice of award or acceptance of an Offer mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action.
