General
Who has the contract now and is there an incumbent or is this a totally new requirement. If there is an incumbent then can I have a copy of the old contract through a Freedom of Information act (FOIA) request? Do I have to contact the FOIA office on how much they will charge, if any, for a copy of the old contract?
See response to question #1. A copy of the existing contract can only be obtained through a FOIA request. The FOIA office would provide information regarding charges for FOIA requested information.
General
Is there an incumbent contract/contact number associated with PSO New Jersey (HSHQE312R00001). If not, is this a brand new effort? See response to Question #1.

Amendment 000002 dated 10/18/12 incorporated the seniority list.
SF1449
Will FPS provide its standard excel-based “Schedule of Services” for this solicitation? If not, may the offeror provide this in lieu of typewritten or hand written entries on the SF1449? See response to Question #5.
Post Exhibit Post listing does not indicate which posts require breaks; which posts require physical relief?
Amendment 000002 dated 10/18/12 confirms that all posts require relief. As a result, offerors will submit their plans on how they will plan, schedule, and execute relief for the PSO force.

Collective Bargaining Agreement
(CBA)
Can the government confirm with the present contractor that there has been no hourly wage or H&W increase since December 1, 2010?
Amendment 000002 dated 10/18/12 includes Schedule A - Addendum to the CBA which contains the current wage rates.
14 Collective Bargaining Agreement
(CBA)

Current contract employees are qualified to the standards in the current BPA.

Do current contractor employees require a new physical during transition to meet the physical requirements? If a new physical is required, is a new drug test required during transition as well (per the RFP standards)? The answer to both questions is yes.
SOW
Are new respirator fit tests required during transition for previous contractor employees transitioning to the new contract?
Refer to Section 14.5.3. This section contains two distinct requirements. First, the Contractor shall “medically evaluate and clear contract PSOs for use of respirators, at least every three years IAW 29 CFR 1910.134.” The requirement at
5.2.2.3.5 (Chest and Respiratory System) addresses the required medical evaluation. The second requirement which is independent of the first requirement, is that the “Contractor is responsible for employee fit testing, at such time a public health authority declares use of respirators to be mandatory.

No, the successful offeror is required to provide its own office space and furnishings.
20 SOW Are clearing barrels authorized on-site at any locations? No.
SOW
The solicitation states that the awardee must be licensed as a security guard company in the state of New Jersey. According to New Jersey, if security guards perform their duties on federal property, (owned or leased) the company employing them is not required to have a company guard license. Is FPS still requiring the company license even though New Jersey does not?
While it is correct that the State of New Jersey has determined that a state license is not required if a security contractor is solely providing security services in the state on federal property under a federal contract, FPS has determined that it is in the best interest of the contractor and the Government that the company and its Protective Security Officers (PSOs) are licensed in the State of New Jersey. Therefore, compliance with state licensing provisions is required.
SOW
Are fresh contractor-provided background checks required for previous contractor employees transitioned to this contract?
If incumbent employees (PSOs) already have a current, valid suitability (background investigation), they can work on the new contract, although it is recommended by HQ that the vendor submit new CIWs (for the PSOs) so that FPS Contract Suitability Office can update the files.
23 SOW Are both a baton and OC spray required? Yes.
SOW
Are supervisors allowed to provide breaks (if breaks are required) as long as they have signed out as a supervisor and signed in as a guard (and removed their rank devices)?
Supervisors may work in other than a supervisory capacity when they are not acting as a supervisor. They may provide relief or stand post; however, the relief time or time standing post can not count towards supervisory hours. Vendors are reminded that the level of supervision proposed in the technical proposal will be made part of the contract and must be maintained.
Attachment #9
The proposal check list (last item on document) requests certification of current Facility Clearance Level; is this required in view of fact that no “clearances” are required?
Amendment 000002 dated 10/18/2012 deletes the requirement for an offeror to certify its current facility clearance level.

Yes. Only the cover page and past performance questionnaires are excluded.
Sub-section E-2, Proposal Submission Requirements.
Contract Clauses, Subsection E-2, Technical Proposal (Non-price factors), #3 Socio Economic Factor presents a chart that requires the bidder to provide the overall price of the contract as bid. Since this is a “technical” factor, how does the entry of the price data in the chart reconcile with the prohibition against placing price data in the technical proposal? Does the Government want a dollar value in the first block, or just a percentage value in the subsequent blocks of this chart? (One possible solution would be to put the chart with the dollar values in the price proposal, with a chart with the percentage values in the Technical Proposal.)
Subsection E-2, page 9 of will be removed by the Contracting Officer before the proposals are evaluated by the Technical Evaluation Team (TET).
SOW

Each security officer on post must have the capability of transmitting and receiving clear and concise vocal transmissions between the security officer, supervisory personnel, the Contractor’s base station, FPS and the Post Tracking System. Note: The geographic location of some posts as well as the structural makeup of some facilities may affect the ability to transmit and receive communications and thus may require both hand held radio and cell.
