Enterprise Security Services, Glynco, GA Amendment 000002

A. The purpose of this amendment is to respond to contractor inquiries to date and are provided in a Q (question) and A (answer) format:

Q1. Solicitation, Page 218 of 260, The solicitation instructions state that no indications shall be made to identify the company. Please clarify whether it is acceptable to identify key personnel and/or submit resumes.

A1. Refer to page 220 of 260 under paragraph 3. Staffing which states, “The offeror shall identify the qualifications of proposed personnel functional categories.” Also, refer to paragraph 1.7, Key personnel regarding submission of resumes.

Q2. Solicitation, Page 218 of 260, Please clarify whether foldout pages of 8.5 by 17 inches are acceptable.

A2. Yes, foldout pages of 8.5 by 17 inches are acceptable. Paragraph Volume 1 on page 218 of 260 will be revised to add 8.5 by 17 inch foldouts.

Q3. Solicitation, Page 4 of 260, The RFP states, “In order to view several of the technical exhibits and attachments, offerors must double click on the page to view the attachment.” Please clarify, as we only identify links in the solicitation’s table of contents to pages within the single solicitation document provided by the government.

A3. Technical Exhibits 5, 6, 8, 10, 13 through 17 and Attachments 1 through 8 have been entered into the solicitation package as objects. In order to view these documents, place the cursor on the form and you will notice a dotted line appears around the entire document or form.

Then double click on the form or document and the entire file will appear.

Q4. Solicitation, Page 218 of 260, Within Volume 3, the governments says bonds are required, along with Section A, Section B, Representations and Certifications. Please clarify the requirement for bonds.

A4. Refer to page 65 of 260, FAR Clause 52.228-16 which states in part, “The contractor shall furnish a performance bond for the protection of the Government in an amount equal to 20 percent of the original contract price.” The Government also requires a bid guarantee in the amount of $3 Million. FAR Clause 52.228.1 is referenced in the solicitation package on page 259 or 260, however, this clause will be revised and issued in full text. Please note that the Government did not require a payment bond.

Q5. Solicitation, Page 161, Technical Exhibit 16 provides only a cover page of the Collective Bargaining Agreement CBA-2014-7021 between Chenega Security and Protection Services, LLC and Industrial Technical Professional Employees Union Local OPEIU. Please provide the complete document.

A5. See response provided under Answer 3 (A3).

Q6. Solicitation, Page 162 Technical Exhibit 17 provides only a cover page of the Collective Bargaining Agreement CBA-2014-7027 between Chenega Security and Protection Services, LLC and Industrial Technical Professional Employees Union AFL-CIO. Please provide the complete document.

A6. See response provided under Answer 3 (A3).

Q7. Solicitation, Page 92, In paragraph 1.12 of the PWS, it states, “The contractor shall establish a Training Program consisting of the eight major training subject areas provided in the ISC Recommended Best Practices. …” Starting on page 10 of the ISC Best Practices for Armed Security Officers in Federal Facilities (1st Edition), within the Training section, we find six subject areas listed in the table, Recommended Best Practices to Meet Critical Tasks. Please reconcile the difference between the required eight subject areas and the listed six subject areas.

A7. The most current edition (2nd) of the ISC Best Practices for Armed Security Officers in Federal Facilities lists 8 subject area tasks which corresponds to the 8 major training subject areas identified in paragraph 1.12 of the PWS.

Q8. Solicitation, Page 118, Among major PWS tasks is listed Lost and Found (5.9), which requires performance in line with FLECT Directive 70-00.d. As this is listed as a major PWS task, will the government provide the referenced directive?

A8. Yes, the Government will provide the referenced directive after receiving a signed copy of Technical Exhibit 5, DHS Non-Disclosure Agreement, DHS Form 11000.6. Refer to Part 6, paragraph 6.1, General regarding instructions on obtaining directives or publications.

Q9. Solicitation, Pages 78-79, In Section D – Documents, Exhibits or Attachments, the number of pages listed for the following attachments do not correspond to the number of pages provided with the solicitation document: Performance Work Statement; Technical Exhibit 14 (Glynco CBA); Technical Exhibit 15 (Artesia CBA); Technical Exhibit 16 (SCA Charleston); Technical Exhibit 17 (SCA Cheltenham). Please clarify.

A9. Based on the fact that the referenced documents were uploaded as objects and in order to avoid confusion, each of the documents were counted as one page. When downloading the documents the total file will be retrieved.

Q10. If an entity is bidding as a Joint Venture (JV); can the JV entity cover the bonding requirement, or, must the 8(a) firm have the bonding limit(s) needed in order to bid on this effort?

A10. The FLETC has verified with the SBA point of contact for DHS that SBA approved JV's can rely on the financial resources of the mentor to obtain bonding.

A13. Yes and the required amount was equal to 20% of the original contract price, including all option periods.

Q14. What range would you say will be required for bonding purposes (E.g., $700,000 $1,000,000, etc.)?

A14. The bid guarantee shall be in the amount $3M. The performance and payment bond shall be 20% of the original contract price. The expenditure that the company will incur will be predicated on the surety’s determination. Historically, we have seen the percentages range from 1.2% to 2%.

Q15. What is the GFE for Solicitation # HSFLGL-15-R-00023, “ENTERPRISE SECURITY

SERVICES, FEDERAL LAW ENFORCEMENT TRAINING CENTER?

A15. The GFE listing is Technical Exhibit 7 of the subject solicitation which is posted on

Section C Contract Clauses

Contractor shall be held to terms and conditions described herein.

Special points of interest:

FAR 52.212-4 and its addendum

FAR 52.219-14

FAR 52.222-17

FAR 52.228-16

FAR 52.237-3

Presenter Presentation Notes The onus is on each offeror to review each clause in Section C identified either by reference or in full text and will be held to the terms and conditions of each one. However, I would like to make a few comments on the following clauses.

An amendment is forthcoming to FAR Clause 52.212-4 , Contract Terms and Conditions to add language that The Government is requiring supporting data with invoices to substantiate compliance with FAR 52.219-14, Limitations on Subcontracting that at least 50 percent of the cost of personnel or labor shall be performed by the prime 8(a) firm.

52.222-17, Nondisplacement of Qualified Workers, please note that the successor shall in good faith offer the employees for which they are qualified, a right of first refusal of employment under this contract.

52.228-16, Performance Bonds – Other Than Construction, Alternate 1. The contractor shall furnish only a performance bond in the amount equal to 20% of the original contract price. Please note that the Government did not require a payment bond.

52.237-3, Continuity of Services Clause, This clause is important because the services under this contract are vital to the Government and must be continued without interruption. Examples include a Government shutdown as experienced in 2013, natural disasters, epidemics, labor strikes, riots, etc. It should also be noted that even if funds are not currently available such as operating under no budget or a Continuing Resolution, guard services must be provided. I will give you an example, last year on March 6, 2015, the Government passed the 2015 DHS Appropriations Act which included funding through September 30, 2015. Procurement didn’t receive the funds until May 26, 2015. I want you to be aware of the potential funding lapses and a significant burden this can place on a contractor.
