1.1.2 Deduction Threshold: The contractor must perform in accordance with the contract requirements at all times. As an added incentive to perform certain particularly important tasks, performance-based deductions may be taken when contractor performance drops below an acceptable level. If the contractor fails to meet the contract requirements specified in Section 1.1.1, and if the quantity of failures during any month is greater than the Acceptable Quality Level (“AQL”), then there will be a deduction form the Contractor’s monthly payment based upon this unacceptable level of performance.

1.1.3 Example of a Performance-Based Deduction:

1. Assume the maximum possible monthly payment for performing in accordance with the contract requirements is $12,000.

2. Assume there are 6 such pickups for the entire month.

3. The AQL of 25% multiplied by 6 pickups is 1.5 pickups per month.

Therefore, if the Contractor fails to provide on time pickup for more than 25% of the time or more than 1.5 times per month, there may be a performance-based deduction.

4. Assume that, during a given month-long period, the Contractor fails to provide on-time pickup on 2 occasions. This means that the Contractor has failed to perform in 33.3% (2 into 6) of the required monthly performances.

This failure rate is greater than the AQL of 25%, and therefore, there will be a performance-based deduction from the Contractor’s monthly payment.

5. Assume that the weight given for maintaining the required pick-up schedule in

Table at Section 1.1.1 is 20%.

6. The deduction in the Contractor’s monthly payment will be: the (maximum possible monthly payment) multiplied by (weight of the specific work item failure rate) multiplied by (Contractor’s actual failure rate) . In this example, the deduction is ($12,000) x (20%) x (33.3%) = $799.20.

7. Therefore, during this month, the Coast Guard would deduct $799.20 from the

Contractor’s monthly payment.

1.2.4 Performance-based deductions may be cumulative. If the Contractor’s performance falls below the AQL for more than one work requirement listed in the table at Section

1.1.1, then the Coast Guard may take more than one deduction from the Contractor’s monthly payment.
