Security Guard Services
Under Amendment 000004, the Answer for Question #2 is hereby DELETED. The question is answered as follows:
(Q): Our company has an established Mentor Protégé (MP) Relationship through the SBA with a large firm. We are planning to bid on this project based on this relationship with our Mentor firm being a subcontractor to us and of course doing some of the productive work on the contract.
Given the Mentor Protégé relationship, can we use the Mentor's past performance as well as the Mentor's facility clearance, as part of our (the Protégé’s) bid? In other words, can the Mentor's past performance and clearance be attributed to the prime (Protégé).
(A): The Government hereby clarifies that THE PRIME CONTRACTOR MUST HAVE A SECRET FACILITY CLEARANCE AT TIME OF PROPOSAL SUBMISSION. In addition, Amendment 000002 clarifies the evaluation criteria in terms of corporate experience and past performance.
In addition, the following three (3) solicitation sections have been changed to reflect this requirement as follows (in bold):
1. 18.2 Access To Classified Information (Contractor) (page 53)
A. The DHS has determined that the performance of this Contract requires that the Contractor, subcontractor(s), vendor(s), etc., (herein known as Contractor) require(s) access to sensitive DHS information or classified National Security Information (herein known as classified information). Classified information is Government information that requires protection in accordance with Executive Order 12958, Classified National Security Information, and supplementing directives.
B. See Exhibit 6C, Security Clearance Requirements, for a determination of which, if any, Contractor facilities and Contractor personnel, including Contract Manager or Supervisor, assigned to this Contract are required to possess up to a TOP SECRET security clearance.
C. If access to classified information is required as identified in Exhibit 6C, the Contractor will abide by the requirements set forth in the DD Form 254, Contract Security Classification Specification, DHS MD 11035 (Industrial Security Program), and the National Industrial Security Program Operating Manual (NISPOM) for the protection of classified information at its cleared facility, if applicable, as directed by the Defense Security Service. If the Contractor has access to classified information at a DHS or other Government facility, it will abide by the requirements set by that agency. If these procedures are not properly followed by the Contractor, it will result in deductions from monthly invoices.
D. The Contractor and all applicable personnel shall be cleared pursuant to the Defense Industrial Security Regulations, or other applicable regulations. The PRIME Contractor shall hold a SECRET facility clearance at time of proposal submission in order to be considered for contract award.
E. (Section removed under Amendment 000004)
F. If access to classified information is required as identified in Exhibit 6C, the Contractor must possess up to a TOP SECRET facility clearance consistent with the DHS MD 11035, Industrial Security Program prior to Contract award.
2. Addendum 52.212-1 – Instructions to Offerors, III. Proposal Content (page 72)
*Subcontractors/Teaming Arrangements: The government may not attribute to the offeror, as an organization, the relevant corporate experience and the relevant past performance of its proposed subcontractors (i.e. managers, key personnel, or other partners.) These evaluation factors shall be demonstrated at the prime contractor level. However, the government will evaluate the subcontractor’s relevant corporate experience and relevant past performance separately and consider its findings about them when determining best value. It will determine whether the proposed subcontractor’s relevant corporate experience and relevant past performance offsets the risk of doing business with an offeror that has no or limited experience and past performance of its own.
The government will consider the relevant corporate experience and relevant past performance of subcontractors to be less applicable than the relevant corporate experience and relevant past performance of the offeror (prime contractor.)
IMPORTANT: THE PRIME CONTRACTOR MUST HOLD A SECRET FACILITY
CLEARANCE AT TIME OF PROPOSAL SUBMISSION.
3. Addendum to 52.212-2 – Evaluation – Commercial Items (JAN 1999) (page 73)
Method of Award
Offers shall be submitted to:
DHS/ICE/Federal Protective Service Mellon Independence Center Suite 4200 701 Market Street Philadelphia, PA 19106 Attn: Denise Morales
Proposals received after 2:00 PM, Eastern Standard Time on October 17, 2008 will be considered late submissions and will not be considered for award.
Evaluation Criteria - Technical merit shall be determined by the technical evaluation panel’s assessment of the information submitted in the offeror's proposal.
The following evaluation criteria will be used in determining technical merit:
RELEVANT CORPORATE EXPERIENCE
RELEVANT PAST PERFORMANCE
Offerors shall be evaluated against the stated evaluation criteria using adjectival ratings.
IMPORTANT: THE PRIME CONTRACTOR SHALL HOLD A SECRET
CLEARANCE AT TIME OF PROPOSAL SUBMISSION. The FPS Contracting Office (upon receipt of proposals) will confirm each offeror’s Secret facility clearance status through the Industrial Security Database. A proposal from an offeror (including all types of teaming arrangements) who does not possess a Secret facility security clearance at time of proposal submission will be considered non-responsive.
All other terms and conditions remain unchanged.
