Hours and Supervisors categories, regular and

TAS) inclusive of all 3 RFP sites. The wage and benefit requirements of the two CBAs and AWD required for the 3 sites vary significantly in compensation requirements. The contractor assumes a great deal of risk in having to bid one rate, for multiple locations, based on ESTIMATED hours (reference Section B, Item 03, Estimated

Quantities). The actual hour quantities and site locations for those hours could be significantly different than estimated, resulting in the offeror having to pay mandated compensation terms higher than the one "blended" unit rate, or even the Government paying higher costs if more hours are ordered at the lower compensation site(s).

This is further complicated by the fact the

Government may unilaterally change the ordered hours requirements (reference Section C, 1.5).

We request that the Section B, Schedule, be revised to require hourly pricing separately for each of the three sites, so that pricing can accurately reflect the CBA or AWD, and other specific performance requirements related to each site (such as relief officers).

1A. Section B, Schedule, reflects estimated annual hours. Both the line items on the SF 33 and Section M will be changed to reflect total hours per site, as the request for a "blended" or

"weighted" wage rate for the 3 locations is hereby removed. Section B of this amendment will reflect those changes.

2Q. What is the correct section to determine the

Post Hours? Form 33, pages 2 states the Post hours for the base year are 64,394.5. Section B pages 1 & 2 list 64,444 hours per year. Section

"J" when multiply out the hours per day by the given number of days the total is 69,692. We assume section "J" to be correct. From the basics established in section "J", we will compute the

Relief required and the reserve component required.

2A. The post hours per year are estimates.

However, SF33, Section B Schedule, and the post exhibit under Section J will be changed to reflect consistency. Section B of this amendment will reflect those changes.

3Q. Section B, Section 02, refers to the contract type as indefinite delivery, indefinite quantity. Section C, 1.4, refers to a fixed-price requirements contract. Please clarify resulting contract type.

3A. The contract will be an Indefinite Delivery, Indefinite Quantity (IDIQ) with fixed price rates.

4Q. Section B, Section C, Option Pricing.

Paragraph 1 of this section states that the offeror shall price the options for the four (4) additional 12-month periods by assuming the minimum hourly wages and fringe benefits established for the initial performance period will apply to the 4 additional 12-month periods.

Please confirm that this means that the offeror shall price both the AWD and CBA sites under these conditions. That is, for the CBA sites, the "weighted" rate from the CBA compensation schedules for the corresponding base year term should also be priced for each subsequent option year.

4A. This questions refers to Paragraph C under

Section B of the solicitation. The request for

"blended" or "weighted" wage rate is hereby removed. Section B of this amendment will reflect those changes.

5Q. Section C, 7.3, Supervisor. Do the hours for the Supervisors stated in this section correspond to those for "Supervision" listed in

Section J, Exhibit I, or are these Supervisors in addition to the Section I requirements, and to be priced within the unit prices of the offeror?

5A. Yes, these hours correspond to the Exhibit.

6Q. Section C, 14.1, Training, General.

Paragraph C of this section states that the offeror is responsible for reimbursing employees for training attendance and expenses. Does this condition apply to personnel that are not yet company employees, but would be if they were to pass the required basic and other qualifications testing (such as firearms, CPR, AED, First Aid) required for this contract?

6A. Contractor is responsible for the training.

7Q. Section F, Section 02, states work under this contract is expected to commence on or about

June 1, 2008. There is no mention of any

"transition period" for the resulting contract in the RFP.

a.Will the Government provide for a "transition period" prior to June 1st, or starting on June

1st?

b.If there will be a transition period, how long will it last?

c.If there will be a transition period, how should the offeror price associated costs?

d.If there is no transition period, how is the offeror to conduct any start-up training or other activities?

7A. There will be a 60 day transition period.

Section B of this amendment will reflect those changes.

a.The Government will provide a 60 day transition period prior to contract effective date. Work is expected to commence on or about

June 1, 2008.

b.Transition will last 60 days.

c.Transition costs shall be factored in as stated in the solicitation (see Section B, paragraph F of the solicitation).

8Q. Section J, Exhibit 1. Is the offeror to price relief officers (for the positions stating

"yes" for relief) within its unit price rate?

11A. See answer 8A.

12Q. Section J, Exhibit 1. This schedule uses a calendar term of January-December for each contract period. According to Section F, the contract term is proposed to be June through May, which would change the number of days for the five contract years. Will DHS/ICE/FPS modify the

RFP to provide an updated Section J, Exhibit 1 for each contract year, reflecting the most current projected annual term, to be used for pricing?

12A. Although the post hours are estimated, an updated Section J will be provided. Section B of this amendment will reflect those changes.

13Q. Section J, Exhibit 8A, National Building

Museum CBA. Article XXIX of the CBA states it shall remain in effect until (and including) May

31, 2009. However, the Appendix provided with the CBA shows the last wage and H&W changes effective October 1, 2006 and the last uniform and pension changes effective October 1, 2005.

Please confirm these are the current compensation rates to be used for pricing this proposal, or provide the most current appendix with compensation data.

13A. An updated CBA for the National Building

Museum is attached.

14Q. Section L, Price Proposal. Is the returned solicitation document to include all pages of the solicitation - inclusive of attachments and amendments, or only certain portions of the document?

14A. Section L describes the required items needed for the proposal.

15Q. Section C.12.B indicates the government will not pay for overtime; however, if overtime is needed to fill a short-notice TAS requirement, will the government reimburse the contractor for the overtime expenses it incurs?

15A. The government will not reimburse the contractor for the overtime expenses it incurs.

16Q. Section J, Exhibit 2C lists body armor, but does not list a quantity. If the contractor is required to provide body armor, please indicate the quantity (i.e., one for each person per shift or another quantity).

16A. Body armor not required for this effort.

17Q. The solicitation indicates that 40 hours of weapons training must be provided. In section J, Exhibit 4F it also says 40 hours of training but it is unclear as to whether this additional 40 hours refers to the annual weapons refresher training/qualification or to the initial firearms training. Please clarify whether the annual weapons training/qualification must also span 40 hours.

17A. Section C, 14.4 of solicitation, "Weapons

Training and Qualification", (page C-27) clarifies this question/concern.

18Q. The CBA for the National Building Museum reflects pay rates and H&W as of October 2006.

If these are not the current rates, could you provide them?

Item 13 on page I-20 indicates different sick leave, vacation, and wages than the CBAs.

Further, they do not conform to the cited Federal

Wage Schedule. Since these are items that greatly impact pricing, please indicate what the required employee sick leave, vacation, and wages are for each building.

18A. An updated CBA for the NAtional Building

Museum is attached.

19Q. Section M, Proposal Submittal. Please confirm that the DHS/ICE/FPS address listed in

Section M is the correct address for submission of offers.

19A. Mailing address remains unchanged.

20Q. Is the CM expected to be located on site at one of the facilities? Section C, sub paragraph

the qualifications, but is not specific as to whether or not this position is to be on site.

20A. As stated in Section C, CM is expected to be accessible.

21Q. Which building is considered the "Lead" for this project, and where will most of the interface and interaction between the Client & contractor occur?

21A. There is no "Lead" building.

22Q. Section 3.2 During Performance of Contract

E. Armed security guards must carry their firearm license/permits (and, where legally required, their concealed weapons permits) on their person while on duty, unless local or state law requires the Contractor to maintain the records. Failure by an armed security guard to carry a valid firearm certificate or permit while on duty shall result in the security guard being removed from the armed post until the certificate or permit is obtained.

In reference to section 3.2- E, In order for a security guard to be licensed in the District of

Columbia, they must be certified as Special

Police Officers (SPO) by the DC-MPD Security

Officers Management Branch and the only firearm they are licensed to carry is a .38 caliber revolver. The firearm requirement per the statement of work is for a 9mm handgun, please clarify.

22A. FPS was informed by DC-MPD that as long as the security officer remains on federal property and meets all other requirements, he/she is able to carry/use the 9mm. The 9mm is the required handgun.

23Q. Our research has determined that there are a very limited number of firearms that meet the statement of work criteria, will the government provide a list of approved 9mm firearms?

23A. Section B of the amendment shows updated exhibit 2E with the required information.

Please verify that it is the government¿s intention that the contractor provides break relief for roving guards and supervisors at the

Franklin Court Building, as well as for the roving guards at the IRS building.

25A. The contractor is required to provide break relief as stated in the solicitation.

26Q. Reference Sample Section J, Exhibit 1. It appears that the supervision Hours Per Day and

Total Hours columns are incorrectly calculated given the duration of the required shifts.

Please provide clarification.

SECTION B - SUPPLIES OR SERVICES AND PRICES/COSTS

01. DESCRIPTION OF SERVICES

The Contractor shall furnish professional security services, defined by this solicitation as armed security guard services, at the National Building Museum, located at 5th and F Streets, NW, Washington D.C., the Franklin Court Building, located at 1099 14th Street, NW and 1750 Pennsylvania Avenue NW, Washington D.C., and the Internal Revenue Service (IRS) Building, located at 1750 Pennsylvania Avenue NW, Washington D.C.

In furnishing these services, the Contractor shall provide all necessary corporate management, supervision, personnel, materials, supplies, training, licenses, permits, certificates and equipment, and shall plan, schedule, coordinate and ensure effective performance of, and conformance to, all aspects of the work statement contained herein. Offerors are advised to read the solicitation carefully and in its entirety before preparing their technical and pricing proposal.

02. CONTRACT TYPE

An indefinite delivery, indefinite quantity contract will be awarded under this solicitation.

Services shall be furnished via task order against the contract. Fixed-price line item task orders shall be placed.

04. PRICES

A. Pricing Required for All Services and Performance Periods

Offerors must quote prices for all services required during the initial performance period, as well as for each option period, in order to be considered for award. Offerors submitting partial pricing information shall be ineligible for award of the contract.

B. Department of Labor Wage Determination and/or Collective Bargaining Agreement

1. The minimum wage rates and fringe benefits applicable to the initial period of performance are outlined in the Department of Labor (DOL) Wage Determinations and/or Collective Bargaining Agreement (CBA) included within the request for proposal.

CONTRACTOR FURNISHED FIREARMS AND AMMUNITION

The contractor will provide all security guards, including part-time and reserve guards with one (1) pistol each meeting the following requirements:

The overall size shall not exceed 7.5” long, 5.5” high, and 1.5” wide and weigh no more then 30

oz. excluding the magazine. The caliber authorized is 9MM and not any larger. The magazine shall hold a minimum of 10 rounds and not more then 17. The pistol must be able to be fired without a magazine inserted into the weapon. The magazine must fall free (unloaded) when the magazine catch is activated. The double action only trigger pull must not weigh more than 12 pounds and not less than 5 pounds. The pistol may be either a traditional double action only or a striker fired design.

The pistol shall have a dark corrosive resistant finish and must be must be capable of being fired without the manipulation of an external safety or cocking lever. The normal function of the pistol shall be double action only. The pistol must be operable by a right or left-handed user. The use of a polymer-framed pistol is acceptable. There is not a requirement for an all-metal firearm.

All safeties must be internal and passive. An inertial interlocked firing pin will be the primary safety to positively prevent movement of the firing pin unless the trigger is pulled completely through its entire length of travel.

The sights must be drift adjustable and be luminous night sights, one (1) dot on the front sight, and two (2) dots on the rear sight, which appear as three (3) illuminated dots when the weapon is held at arm’s length. The illuminated dots must not be visible when viewed from the muzzle end of the pistol. The color of the illuminated dots must be green. The illumination materials for the night sight must comply with Nuclear Regulatory Commission standards.

The following pistols are recommended:

SECTION M – EVALUATION FACTORS FOR AWARD

01. Method of Award

a. The Government will award an Indefinite Delivery/Indefinite Quantity (IDIQ) contract from which Fixed Price task orders for the services described herein, will be given to the Contractor whose proposal provides the best value to the Government in terms of price and technical merit. Source selection procedures will be used that allow for price/technical tradeoffs to achieve best value. The technical evaluation factors of Relevant Corporate Experience and Relevant Past Performance are of equal importance. When combined, these two technical evaluation factors are approximately equal to price.

b. It is the Government’s intent to award the contract without discussions.

Therefore, contractors should submit initial technical and price proposals that contain the contractor’s most favorable terms. However, the contracting officer does reserve the right to conduct negotiations with offerors, if it is later determined to be necessary.

c. Unnecessarily elaborate brochures, artwork, expensive paper and bindings, expensive visual aids or other presentations, beyond that sufficient to present an efficient and effective proposal, are not required or desired.
