ICE Solicitation HSCEDM-16-R-00001 Mandatory Responses to Questions to Responses
1.
Solicitation Section/Subsection Number:
Q&A Responses: 38, 54, 278, 288, 291, 317, 332, 350, 353, 380, 436, 438, 452, 454, 455, 456, 467, 468, 469, 473, 478, 537, 538, 543, 547, Question: Multiple questions indicated an attachment with the response document
– but no attachments, other than the updated Attachment 5, were posted.
ICE Response: Attachment are provided along with these responses.
(For ICE use only)
2.
Solicitation Section/Subsection Number: Q&A Responses: 140, 141, 142, 143 Question: The response to these questions, “The mileage reimbursement is limited to the FTR” and the statement in PWS C.23 that says, “Transportation mileage reimbursable rates will be commensurate with current applicable federal travel allowance rates” conflicts with instructions in attachment 20 specifying offerors to submit a BOE that includes the methodology for the mileage rate including:
operations and maintenance, amortization, insurance, fuel, registration, parking, tolls, etc; and also conflicts with the broad statement that “the ceilings for this Solicitation have been removed”.
The .57 FTR rate is for reimbursement for travel when using one’s own privately owned vehicle (POV); it is not feasible to own and operate a fleet of new (less than 10 years old) prisoner transport large multi passenger vehicles for .57 per mile. The fuel alone for these large vehicles costs more than .57 per mile. In addition to fuel contractors have costs for amortization, maintenance, tolls/parking, registration, and insurance.
Will the Government confirm that offerors are not expected to limit their price proposal for CLINS XXX4C/4D to $0.57 per mile?
ICE Response: Yes.
Solicitation Section/Subsection Number: Q&A Responses: 100, 124, 178, 179, 180, 181, 182, 234, 235, 281, 282
3.
Question: Multiple questions are trying to obtain a better understanding of the C.15 statement that “Staffing levels shall not fall below a monthly average of 95% of the ICE-approved staffing plan based on man-hour requirements”. The Government’s response to all of these questions is somewhat unclear.
The 95% staffing level referred to in C.15 is of the total full-time-equivalents identified on the staffing plan; and not post coverage, which is expected to be 100%.
Should it be clearly explained to offerors that the Government’s expectation is 100% coverage of all posts (shifts/days) identified on the staffing plan in the awarded contract; and that this is mandated in the facility post orders and
SOP?
If the Government doesn’t make this clear, offerors may price their proposals with 95% coverage of posts to reduce their price to win.
ICE Response: The Government’s expectation is that 100% coverage of all posts (shifts/days) identified on the staffing plan in the awarded contract be covered; and that this is mandated in the facility post orders and SOP.
4.
Solicitation Section/Subsection Number: Q&A Response #183 Question: The response says that it’s up to the contractor in their proposal whether or not to conduct pre-shift muster/briefings?
Pre-shift muster time is a common practice in all ICE SPCs for conducting roll call, recording presence (sign in/out), inspecting uniforms and equipment, and communicating important daily facility information. Oftentimes, ICE leadership asks to speak at muster meetings to convey important information to the staff.
Is it truly the Government’s intent to allow for contractors to eliminate the pre-shift muster/briefing?
ICE Response: Pre-shift musters are required prior to each shift.
5.
Solicitation Section/Subsection Number: Q&A Response #246 Question: The response is confusing because according to AZ 42-5159, the only tax exemption that would be authorized is for food, drinks, and condiments purchased for consumption within the premises; and the contractor is not purchasing these items.
Will the Government confirm that ODCs such as vehicles, uniforms, weapons, equipment are all subject to AZ state sales tax? Otherwise, contractors may omit applicable taxes in their price proposals.
ICE Response: The prevailing tax rates apply for ODCs in the locality in which they are purchased. The Government will provide a tax exemption certificate for use by the selected contractor in instances in which the exemption can be accepted.
6.
Solicitation Section/Subsection Number: Q&A Response #247 Question: Please confirm that it’s the Government’s intent to have transportation supervisors billed in CLIN XXX4A?
The blended rate of transportation officers, stationary guards, and transportation supervisors will make the hourly rate higher.
All supervisors are typically accounted for in the FFP bed day rate.
ICE Response: It is the Government’s intention to have all costs associated with transportation including transportation supervisors included in the Transportation CLINs.
7.
Solicitation Section/Subsection Number: Q&A Response #236 Question: Are the government’s answers to contractor questions during the RFP process considered part of the ultimate contract? ICE Response: No
Please clarify this response.
ICE Response: The answers are not considered to be a part of the ultimate contract but they are considered to be a part of the solicitation.
