Solicitation Section/Subsection Number: Section L Page 163/164/15.1/CBA

Question: The government’s CLIN estimates appear to substantially understate the contractor’s costs to successfully operate (within PBNDS/ACA and other standards) the

FLO SPC.

The limits also appear to be substantially lower than current pricing considering the labor cost involved in complying with the CBA.

A conservative analysis that multiplies total detention hours (all unarmed and armed DO’s/Unarmed Supervisors only) for the posts listed in para 15.1 times the hourly average shift rate of $37.08 (average of all 3 shift rates + H&W $5.05, Pension $1.27, uniform, license, and hygiene $0.62 + .0765% FICA tax), when added to overhead hours for vacations, holiday pay, holiday premium pay, sick pay, and annual training, exceeds the CLIN xxx2A/2B limits for the base and the option years, and does not consider the contractor’s costs for other direct expenses and overhead and profit.

There is also to be considered the USDOL Wage Conformance of Supervisors to $3.00 per hour more than the DO’s, Transport Supervisors to $3.00 per hour more than Transport Officers, and the Captains to $5.00 per hour more than the DO’s all with CBA-matching benefits and allowances.

The RFP also demands new firearms, vehicles less than 10 years old, contractor-provided parking, training space offsite, radios, uniforms, physicals, drug screens, etc., as contractor other direct costs. When these costs are considered the CLIN limits appear to be even more understated.

Is it the government’s intent that the staffing chart in paragraph 15.1 be severely reduced to meet the mandatory CLIN limits?

ICE Response: The ceilings for this Solicitation have been removed. However, ICE hopes that the amounts provided will serve to provide as guides to the

Solicitation Section/Subsection Number: C.15.1/C.15.2 mailto:Brandon.Harrell@ice.dhs.gov

98.

Question: In para 15.1 it states:

NOTE: This staffing plan is provided for informational purposes. Offerors shall submit an innovative staffing plan which demonstrates conformance with all PWS and contract requirements and applicable standards, including ACA and ICE PBNDS 2011 standards.

In para 15.2 it states:

The Contractor shall fully staff the facility to secure, control, and supervise detainees in custody regardless of the detainee population. Staffing must be sufficient to cover the positions as listed in the solicitation.

Is paragraph 15.2 “minimum staffing” referring to the positions listed on the informational staffing chart and therefore making the chart staffing list what is to be considered as minimum number of staff to provide?

ICE Response: The staffing chart is information for the contractors to base their staffing plan on. The minimum staffing is up to the contractor as long as they can provide the staff to fully staff the facility.

99.

Solicitation Section/Subsection Number: C.15.1/C.15.2

Question: If the staffing chart is the minimum number of staff provided daily, how is this consistent with the “innovative staffing chart” and the CLIN limits?

ICE Response: The staffing chart is information for the contractors to base their staffing plan on. The minimum staffing is up to the contractor as long as they can provide the staff to fully staff the facility and meet all standards.

Attachment 1 QASP/Performance Requirements Summary and

RFP Para 15

100.

Question: The PRS states that “Staffing Pattern Compliance within 10% of required (Contract) 4-ALDF-2A-14”. How does this reconcile with Para 15 of the RFP which states: Staffing levels shall not fall below a monthly average of 95% of the ICE-approved staffing plan based on man-hour requirements?

ICE Response: The staffing level listed in Para 15 applies.

101.

Solicitation Section/Subsection Number: C4; 4.1

Question: Paragraph C4-4.1 states: “All guard posts shall be fully staffed.” Since this is an objective-driven contract, and since this is not an “hourly rate” contract (for detention), and since the guiding document is “Performance Based” National Detention Standards, is this a “Performance Based Management” Contract?

102.

Question: Paragraph C4-4.1 states: “All guard posts shall be fully staffed.” Since the population of the facility varies from day to day, if housing units are not occupied, do posts in these areas need to be staffed daily, even if empty?

ICE Response: Staffing has to be readily available to cover any post even if not occupied by detainees since they could be opened at any time.

Question: Paragraph C4-4.1 states: “All guard posts shall be fully staffed.” Is ICE requiring 100% staffing of all posts proposed on the contractor’s staffing chart on a daily basis?

ICE Response: All posts must be staffed on a daily basis, based on the post and

Solicitation Section/Subsection Number: 6.19 and H.1

Question: Paragraph 6.19 states: comply with: “Applicable Federal, state and local motor vehicle laws and regulations”; Paragraph H.1 states: “Additionally, an automobile liability insurance policy providing for bodily injury and property damage liability covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property coverage.”

Do these regulations include the Federal Motor Carrier Safety Administration’s requirement that operators of passenger vehicles* carrying 16 or more people obtain and maintain at least $5,000,000 in insurance?

Ref: https://www.fmcsa.dot.gov/registration/insurance-requirements

*such as buses in this case

ICE Response Yes, you must comply with all applicable federal, state and local motor vehicle laws and requlations.

105.

Solicitation Section/Subsection Number: C.7

Question: Paragraph C.7 states: “Contractor vehicles must also be less than ten years old.” Did ICE consider the cost savings of using older model vehicles (buses) with new/reconditioned engines, air conditioners, etc. in requiring vehicles to be less than 10 years old?

https://www.fmcsa.dot.gov/registration/insurance-requirements

106.

Question: Paragraph C.7 states: “Contractor vehicles must also be less than ten years old.” Did ICE consider the average life span of an MCI 12 bus (approximately 15 years) in requiring vehicles to be less than 10 years old?

107.

Question: Para C.7 states: Parking at the facility is limited. No parking is available for Contractor staff. The Contractor shall provide parking accommodations for its employees/subcontractors according to its needs for the duration of the period of performance. ICE shall not be responsible for providing parking spaces or parking subsidies for Contractor or subcontractor staff.

Did ICE consider the implications of this requirement in setting the CLIN limits for CLIN xxx2?

ICE Response There is a MOU, for parking, between ICE and the AZ National Guard. The parking space outlined in the MOU and designated along the fence line is expected to remain the same.

ICE Response: There is parking located in the rear of the facility for these size/types of vehicles.

110.

Question: What maintenance will the government allow to be conducted in the back parking area, i.e. oil changes, fluid flushes, brake repairs, etc.?

ICE Response: General vehicle maintenance will be allowed, no vehicle fluid replacement and or flushes allowed.

111.

Question: Will the government allow the contractor to erect a building ON SITE that could be used to provide maintenance on the transportation vehicles?

Question: Would the government be willing to tie into the existing sewer system in order to provide bathrooms in the transportation parking area?

112. ICE Response: No.

113.

Question: If the cost of fuel was to increase back to the high ($4.00 per gallon) again, will the government consider a "fuel surcharge" program much like the one used in the trucking industry if the GSA/FTR rate change isn’t timely in changing?

114.

Question: Can the government install a "dump station" in the back parking area for the dumping of buses? (Current practices require over an hour to complete and a 25 mile round trip.)

115.

Solicitation Section/Subsection Number: C.8

Question: Para C.8 States:

Bed-Day - The total billable cost to the Government to maintain and house one detainee for one day. Bed-day means day in or day out and all days in between. The Contractor may charge for day of arrival or day of departure, but not both.

How does a contractor bill for a detainee who arrives at the facility in the morning prior to breakfast meal and departs in the evening after the dinner meal?

ICE Response: Since the contractor can bill for the day of arrival OR day of departure, that would be billed as one day.

116.

Question: Para C.8 States:

Man Hour - Man-hour means productive hours when the required services are performed. Only productive hours can be billed and invoiced.

Does this definition apply only to Transportation hours which are the only hourly billed hours in the contract?
