52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

This is a commercial item requirement using Simplified Acquisition Procedures under FAR part 12 & 13, respectively. Evaluation will be conducted using simplified procedures in accordance with FAR 13.106.

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation that provides the best value to the Government, when considering Technical Capability, Past Performance and Price. Tradeoffs may be utilized. While tradeoff provides the opportunity for a price/technical capability trade off and does not require that the award be made to the offeror submitting the lowest price or the highest technically rated offeror, the ultimate decision may be to select the lowest priced offer OR the highest technically rated offeror.

The evaluation criteria consist of three (3) evaluation factors: Technical Capability, Past Performance and Price. Offers will be evaluated at the Factor level. However, offers determined to be ‘no go’ for Raymond Certification in terms of its technical capability shall not be considered for Award. To receive consideration for award, a rating of “Acceptable” must be achieved for the Technical Capability and Past Performance factors.

Evaluation factors shall be the primary determinant of the detailed information requested in the solicitation’s instructions to offerors. Where sub-factors are used, they are to be evaluated separately.

Evaluation Factors: Offerors proposals will be evaluated against the following factors:

1. Technical Capability Subfactor: Tier 1 Raymond Certification Subfactor: Tier 2 General MHE Repair and Preventative Maintenance

2. Past Performance

3. Price

Factor 1 – Technical Capability

The technical rating reflects the degree to which the proposed approach meets or does not meet the minimum performance or capability requirements through an assessment of the strengths, weaknesses, and deficiencies of the proposal.

Sub-factor Tier 1: Raymond Training Program Certification. The Government will evaluate the offeror’s proof of Raymond Training Program Certificate for Models 9600/9700, which is necessary to assure the integrity of the equipment and maintain a valid warranty. The methodology used to evaluate the Certification will be on a Go/No Go basis as shown in Table 1.

Only those proposals determined to have Raymond Certification shall be considered for award.

The Government will not award to an Offeror that has a “No Go” rating for this subfactor.

If Certification is determined No Go, the evaluation of the proposal will cease, no other factors or subfactors will be evaluated. Offerors with a No Go rating will be notified of the cease of evaluation.

Table 1. Raymond Certification Rating Description Go Provides proof of Raymond Training Program Certification No Go Does not provide proof of Raymond Training Program Certification

Sub-factor Tier 2: General MHE Repair and Preventative Maintenance. Based on the narratives provided by the Offeror, the Government will evaluate Offeror’s mechanical aptitude and working knowledge of troubleshooting, diagnosing and repairing the equipment listed in APPENDIX D, DeCA Okinawa Equipment Listing, of the PWS as well as the ability to provide the services detailed in Paragraphs 1.1, 1.2, 4.2, 4.5.2, and 4.7 of the Performance Work Statements (PWSs) and Preventive Maintenance (PM) task lists. The methodology used to evaluate the Certification will be on an Acceptable/Unacceptable basis as shown in Table 2.

Only those proposals determined to be Acceptable shall be considered for award. The Government will not award to an Offeror that has an Unacceptable rating for this subfactor.

Minimum Requirement: Offeror provides evidence that service technicians have the training or experience to perform repair(s) and Preventative Maintenance of equipment listed in APPENDIX D, DeCA Okinawa Equipment Listing, of the PWS.

Table 2. General MHE Repair and Preventative Maintenance.

Rating Description Acceptable Quote meets the requirements of the solicitation.

Offers will be evaluated at the factor level. Offers determined to be ‘unacceptable’ in terms of its technical capability shall not be considered for Award.

Technical Capability: Acceptable / Unacceptable Ratings Rating Description Acceptable Quote receives a Go rating for Tier 1 AND an Acceptable rating for Tier 2.

Unacceptable Quote does not meet the requirements of the solicitation.

Factor 2 - Past Performance:

a. The information presented in the Offeror’s Past Performance documentation, together with performance information from the referenced points of contact and other sources available to the Government will be the basis of evaluation for this factor. In accordance with the instructions in the Addendum to FAR 52.212-1, Offerors submit three to five questionnaires for current/previous contract efforts that that are most similar to the work of this solicitation.

b. The Government will evaluate the Offeror’s record of past and current performance to ascertain the probability of successfully performing the required efforts of the PWS. The Government will focus its inquiries on the Offeror’s record of performance as it relates to all of the solicitation requirements, including customer satisfaction, quality of services, timeliness of performance, compliance with the terms and conditions of contract, and business relations.

c. There are three aspects to the past performance evaluation: recency, relevancy and quality.

As a result of this evaluation and considering all efforts, an overall Performance Confidence Assessment will be assigned to each Offeror. The following adjectival ratings will be used to rate Past Performance:

1) Recency. The first aspect is to evaluate the recency of the Offeror’s past performance.

Recency is generally expressed as a time period during which past performance references are considered relevant, and is critical to establishing the relevancy of past performance information. For this requirement, recency is determined to be within five years from the issue date of this RFP.

2) Relevancy. The second aspect to the Past Performance evaluation is to evaluate the Offeror’s Past Performance to determine how relevant a recent effort accomplished by the Offeror is to the effort required under the current solicitation. Relevancy is not separately rated; however, the following criteria in the table below will be used to establish what is relevant in terms of similarity of services, complexity, and dollar value.

Past Performance Relevancy Ratings

Very Relevant Present/Past Performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/Past Performance effort involved similar scope and magnitude of effort and complexities this solicitation requires

Somewhat Relevant

Present/Past Performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/Past Performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

3) Quality of Services. The third aspect of the past performance evaluation is to establish the overall quality of the Offeror’s past performance. The Past Performance evaluation will include a review of all past performance information collected to determine the quality of the Offeror’s performance, general trends in the quality of performance over time or with different types of customers, and usefulness of the information and will incorporate these into the performance confidence assessment. A separate quality assessment rating is not required; rather, the past performance confidence assessment rating is based on the Offeror’s overall record of recency, relevancy, and quality of performance.

d. Performance Confidence Assessment. The Government will evaluate Past Performance information in accordance with FAR 13.106-2 to ascertain the probability of successfully performing the required efforts of the PWS. As a result of the evaluation of the Offeror’s past performance, an overall Performance Confidence Assessment will be assigned to each Offeror using the criteria in the table below.

Performance Confidence Assessment

Substantial Confidence

Based on the Offeror’s recent/relevant performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.

Satisfactory Confidence

Based on the Offeror’s recent/relevant performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.

Neutral Confidence

No recent/relevant performance record is available or the Offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The Offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence

Based on the Offeror’s recent/relevant performance record, the Government has a low expectation that the Offeror will successfully perform the required effort.

No Confidence Based on the Offeror’s recent/relevant performance record, the Government has no expectation that the Offeror will be able to successfully perform the required effort.

e. The Government may reject an offer if it is found that any information that has a negative impact on the Offeror’s past performance record has been deleted, misrepresented, or withheld.

f. It is at the Government’s discretion to determine whether past performance information furnished is or is not considered similar to the size and complexity of the present requirement.

Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the Offeror will be assigned a “neutral confidence rating” and its offer will not be evaluated either favorably or unfavorably on past performance.

g. Offerors are cautioned that in conducting the past performance assessment, the Government may use data provided in the offer and data obtained from other sources.

h. The Government will evaluate only the Offeror’s recent and relevant past performance.

Factor 3 – Price:

Price will be considered in making the contract award decision. Price will be evaluated for completeness and reasonableness; however, price will not be rated. The Offeror’s proposed pricing will be evaluated using one or more of the techniques set forth in FAR 15.404-1(b)(2) to determine prices fair and reasonable. Proposed pricing will also be evaluated to determine that all prices are complete (all price fields in the Pricing Spreadsheet have been entered and/or extended as required).

Each offer must submit a fixed price for maintenance and repair services CLINs for each in the solicitation. The sum of the total evaluated price for the base and all option years for all FFP CLINs plus the Time and Materials (T&M) CLIN, which will be an estimated amount provided by the Government, will determine the total value for each proposal.

For options, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options.

If the Government extends the contract pursuant to FAR 52.217-8, Option to Extend Services, such extension will be at the rates in effect under the contract when the option is exercised. For the Total Evaluated Price (TEP) calculation, pricing for a 6-month extension of services period will not be included.

ONLY ONE AWARD IS POSSIBLE. THE GOVERNMENT RESERVES THE RIGHT TO

AWARD WITHOUT DISCUSSIONS.

A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of clause).
