SECTION 1 - THE SCHEDULE

I. SCOPE OF SERVICES
Contractor shall provide a minimum of 30 and a maximum of 6,000 single hotel rooms in Jerusalem. Contract type will be indefinite quantity.
Lodging rooms shall include private bath, heating and air conditioning, and telephone, in hotel located in Jerusalem. The Government shall be liable for the price of each room ordered but not used, unless the Contracting Officer gave the Contractor an oral or written cancellation no less than one day before to the anticipated effective date of the cancellation.
A. The contract will be for a one year period from the date of the contract award, with 2 (two) one-year options.
B. VALUE ADDED TAX (VAT)
VALUE ADDED TAX. Value Added Tax (VAT) is not included in the CLIN rates. Instead, it will be priced as a separate Line Item in the contract and on Invoices. Local law dictates the portion of the contract price that is subject to VAT; this percentage is multiplied only against that portion. It is reflected for each performance period. The portions of the solicitation subject to VAT are the Deluxe Single Rooms when booked for Locally Employed Staff only.

II. BASE PERIOD. The period of performance will be from date of contract award and continuing for 12 months.

DESCRIPTION/SPECIFICATIONS/WORK STATEMENT
1. Definitions
Deluxe Single rooms - Single room with queen/king sized bed, AC, desk + chair, closet, safe, full bathroom, WiFi access.
Deluxe Double rooms - Double room with queen/king sized bed, AC, desk+chair, closet, safe, full bathroom, WiFi access.
Suite - Single suite with queen/king sized bed, AC, desk+chair, closet, safe, full bathroom, WiFi access.
Conference Hall – Large meeting halls of up to 50 pax including A/C, lighting, table setup, chairs, A/V equipment: loud-speaking system, projector and screen; paper and pens.
Banquet hall - Large meeting halls of up to 500 pax including A/C, lighting, table setup, chairs, A/V equipment: loud-speaking system, projector and screen; paper and pens.
Check in – Regular check in shall be from 14:00 PM
Check out – Regular check out shall be up to 13:00 PM.
2. Responsibility of the Government
The Government shall be responsible for all room charges, not including incidentals.
Reservations to the Hotel shall be accompanied by either Task orders or state that the room will be paid directly to the hotel by the traveler.
3. Responsibility of the Traveler
The Traveler will be responsible for paying all incidentals to include, but not limited to:
- Laundry.
- Mini Bar charges.
- Restaurants.
- Gym
- Parking and Valet Parking.
- Room Service.

4. Task Orders
Task Orders under this contract shall contain the following information:
(a) Name of Contractor
(b) Contract Number
(c) Date of Purchase
(d) Purchase Number
(e) Number of Rooms
(f) Unit Price, and
(g) Total Price
The Contracting Officer may place orders orally, telephonically, by facsimile, or in writing. Oral orders shall be confirmed in writing within three calendar days.
If more than one contractor has received an award, the following procedures shall govern regarding issuance of individual task orders. The contractor shall provide no rooms without an order issued by the Contracting Officer.
(1) The Government will develop a price estimate. If the estimate does not exceed $10,000 USD, the Government will follow the procedures in paragraph (2) below. If the estimate exceeds $10,000 USD, the Government will follow the procedures in paragraph (3) below.
(2) Orders not exceeding $10,000 USD - The Government will select a contractor for issuance of the order on a rotating basis. This decision will be based on the Government's best interests, which may include factors such as price, past performance, and unique qualifications which meet the level of quality required.
(3) Orders exceeding $10,000 USD - Unless one of the exceptions in paragraph (4) below applies, the Government will:
a. Make its award based on comparisons of price, past performance, and unique qualifications which meet the level of quality required to meet the Government’s security and logistical requirements. Award will be made to the lowest priced, technically acceptable hotel.
b. Regardless of whether the procedures in paragraph (1) or (2) above were followed, selection of contractors shall not be protestable to GAO under FAR subpart 33.1, except on the grounds that the order increases the scope, period, or maximum value of the contract. However, the Department of State does have an Acquisition Ombudsman who will review complaints by contractors to ensure that all contractors are afforded a fair opportunity to be considered for these task orders, pursuant to the procedures for award of task orders established herein.

(4) Exceptions to the procedures in paragraph (3) above:
a. The agency need for the required services is of such urgency that providing such competitive opportunity would result in unacceptable delays;
b. The order should be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order; or
c. It is necessary to place an order to satisfy a minimum guarantee.
5. Hotel Property Renovations
The hotel shall be responsible for informing the Government up to three (3) months in advance on any planned renovations to the Hotel property.
6. Quality Assurance and Surveillance Plan (QASP)
This plan provides an effective method to promote satisfactory contractor performance.
The QASP provides a method for the Contracting Officer's Representative (COR) to monitor Contractor performance, advise the Contractor of unsatisfactory performance, and notify the Contracting Officer of continued unsatisfactory performance. The Contractor, not the Government, is responsible for management and quality control to meet the terms of the contract.
The role of the Government is to monitor quality to ensure that contract standards are achieved.

The following FAR clause(s) is/are provided in full text:
52.216-18 Ordering (AUG 2020)
(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule.
Such orders may be issued from date of award through base period and option periods if exercised.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract.
In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) A delivery order or task order is considered “issued” when –
(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;
(2) If sent by fax, the Government transmits the order to the Contractor’s fax number; or
(3) If sent electronically, the Government either –
(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or
(ii) Distributes the delivery order or task order via email to the Contractor’s email address.
(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.

52.216-19 ORDER LIMITATIONS (OCT 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $400, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor--
(1) Any order for a single item in excess of $1,000,000.
(2) Any order for a combination of items in excess $1,500,000; or

(3) A series of orders from the same ordering office within 5 days that together call for quantities exceeding the limitation in subparagraph (1) or (2) above.
(c) If this is a requirements contract (i.e., includes the Requirement clause at subsection
52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) above.
(d) Notwithstanding paragraphs (b) and (c) above, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 2 working days after issuance, with written notice stating the Contractor's intent not to ship the…
