C.1 STATEMENT OF WORK

STATEMENT OF WORK

National Consensus Development and Strategic Planning for Healthcare Quality Measurement

I. Background

Section 1890 of the Social Security Act (the Act) requires the Secretary of the Department of Health and Human Services (HHS) to contract with a consensus-based entity (CBE) for the performance of various duties pertaining to health care performance measurement, including prioritization, endorsement and maintenance of performance measures, and convening multi-stakeholder groups for input into the selection of performance measures for use by HHS.

Therefore, HHS, through the Centers for Medicare and Medicaid services (CMS) is contracting with a CBE to meet these statutory requirements.

Moreover, as healthcare advances and evidence evolves, it is critical for CMS and other divisions of HHS to continuously assess priorities, support advancements, and lead efforts in healthcare performance measurement. With the development and release of the 2011 National Quality Strategy, the 2016 CMS Quality Strategy, coordination of public- and private- quality improvement initiatives, and passage of legislation such as the Patient Protection and Affordable Care Act (ACA) of 2010, the Improving Medicare Post-Acute Care Transformation Act (IMPACT) of 2014, and the Medicare and CHIP Reauthorization Act of 2015, the identification and utility of high quality performance measures widely endorsed by stakeholders is key to the successful implementation of efforts to improve healthcare. CMS and other HHS divisions have benefitted in the past from the assistance of a consensus based entity in securing multistakeholder input into identifying high caliber performance measures and related issues.

Through this contract, HHS seeks to continue to secure this assistance.

A. Purpose The purpose of this contract is to procure the services of a CBE, as required under Section 1890 of the Act. The consensus-based entity must meet voluntary consensus standards requirements under section 12(d) of the National Technology Transfer and Advancement Act of 1995 (NTTAA), – P.L. 104-113, the Office of Management and Budget (OMB) Revised Circular A- 119, and other criteria described in this Statement of Work (SOW), to:

a. Convene key stakeholders to synthesize evidence and submit recommendations on an integrated national strategy and priorities for healthcare performance measurement, in accordance with Section 1890(b)(1) of the Act;

b. Establish and conduct consensus-based endorsement processes and expedited review processes of healthcare performance measures, in accordance with Sections 1890(b)(2) and 1890(b)(6) of the Act;

c. Establish and implement consensus-based maintenance and ad hoc review processes to ensure measures endorsed by the Contractor are updated (or retired) as new evidence is developed, in accordance with Section 1890(b)(3) of the Act;

d. Produce and submit Annual Reports to Congress and the Secretary, in accordance with Section 1890(b)(5)(A) of the Act;

e. Convene multi-stakeholder groups for input on national priorities and the selection of quality measures for the Federal Pre-Rulemaking Process, which is required by Social Security Act Sections 1890(b)(7) and 1890A; and

f. Convene stakeholders for ad hoc reports and frameworks related to performance measurement, as determined by CMS and HHS.

II. Requirements Independently, and not as an agent of the Government, the Contractor must furnish all the necessary services, qualified personnel, material, equipment and facilities not otherwise provided by the Government, as needed to perform the requirements of this SOW.

The Contractor must meet the following general requirements for the successful completion of this contract SOW:

1. The Contractor must be a private nonprofit entity governed by a board.

2. The members of the board of the Contractor must include--

a. Representatives of health plans and health care providers and practitioners or representatives of groups representing such health plans and health care providers and practitioners;

b. Health care consumers, or groups representing health care consumers;

c. Representatives of purchasers and employers or representatives of groups representing purchasers or employers.

3. The membership of the Contractor must include persons who have experience with--

a. Urban health care issues;

b. Safety net health care issues;

c. Rural and frontier health care issues;

d. Healthcare quality and safety issues and patient experience across the spectrum of care, especially those related to care transitions.

4. With respect to matters related to the contract, the Contractor must conduct its business in an open and transparent manner and provide:

a. The opportunity for public comment on its activities.

b. Timely advance notification to the public of upcoming activities and dissemination of agendas and materials related to these activities.

c. Input from technical experts and consumers/caregivers on the quality of candidate measures for endorsement with assurances that such input does not impede the consensus process by prohibiting opportunities for broad membership and public review and comment;

d. Input from experts and consumers/caregivers based on diverse and balanced stakeholder points of view;

e. The inclusion of quality measure developers on technical expert panels when possible;

f. Access to the consensus-based process by a wide variety of both individual and group healthcare industry and consumer/caregiver stakeholders; and

g. Timely and balanced guidance, including the most current updates or revisions to the measure specifications or measure testing results from measure developers/stewards, to experts evaluating performance measures on the evaluation criteria. If the Contractor includes public comments on a candidate measure for committee review, then the Contractor shall notify the measure developers/stewards in a timely manner of such inclusion, and give them an opportunity to address these comments should they choose to do so. The Contractor shall include the measure developers/stewards’ responses along with the public comments in the materials for committee review.

5. The Contractor must operate as a voluntary consensus standards setting organization as defined for purposes of section 12(d) of the National Technology Transfer and Advancement Act of 1995 (Public Law 104-113) and Office of Management and Budget Revised Circular A-119 (published in the Federal Register on February 10, 1998).

6. The Contractor must have at least four (4) years of experience in establishing national consensus standards.

7. If the Contractor, as a CBE, requires a membership fee for participation in the functions of the CBE, . such fees shall be reasonable and adjusted based on the capacity of the potential member to pay the fee. In no case shall membership fees pose a barrier to the participation of individuals or groups with low or nominal resources to participate in the functions of the

CBE.

8. The Contractor’s ability to perform work under this Contract must not pose a conflict of interest, either actual or potential, with the Contractor’s other duties and activities.

Should the Contractor learn about an actual or potential conflict of interest, it must disclose to HHS the material facts surrounding any actual or potential conflict of interest, including specific information relating to the terms and conditions under this contract. A conflict of interest will be deemed to exist if the activity affects the Contractor’s ability to conduct a neutral consensus-based endorsement process. If such a conflict exists, the Contractor must promptly notify HHS of the conflict and prepare and establish a mitigation plan to avoid such conflict.

The precise timing of each task under this contract cannot be projected with sufficient accuracy to allow specific descriptions to be incorporated into a single SOW, thus CMS plans to release specific Task Orders throughout the course of the contract. It is expected that all tasks specified in the delivery schedule will be accomplished by the end of the specified contract period. The work shall commence upon issuance of individual Task Orders. Each Task Order will transmit a specific Statement of Work for the completion of activities under each Task Order domain, including a list of Task Order deliverables, deliverable due dates, and the period of performance for completion. The Indefinite Delivery Indefinite Quantity (IDIQ) Contracting Officer’s Representative (COR), Contracting Officer (CO), and HHS Task Order lead are the only individuals who can authorize changes to work plans and accept deliverables.
