About this file

This document contains questions and answers related to a federal solicitation (HE1254-24-R-2015) issued by the Department of Defense Education Activity (DoDEA) for security training services for bus drivers and safety attendants in Germany, Benelux (Belgium and the Netherlands), and the United Kingdom.

The key details are:

  • DoDEA intends to award a single or multiple Firm-Fixed Price (FFP), Indefinite Delivery/Indefinite Quantity (IDIQ) contracts for these services.
  • The purpose of the training is to provide bus drivers and safety attendants with knowledge of antiterrorism and crime prevention practices tailored to student transportation, prior to the start of the school year.
  • The training must be conducted in-person and cannot be done virtually or remotely.
  • DoDEA is seeking proposals by June 11, 2024 and will make award(s) based on price analysis to determine fair and reasonable pricing.
  • There are no incumbent contractors, but the services were previously provided under separate student transportation service contracts.

No. Industry Questions to 24R-2015 Gov't Clarifying Response/Answer

Per 52.212-1 ADDENDUM – INSTRUCTIONS TO OFFERORS - - COMMERCIAL ITEMS (DEC 2006) Paragraph 11 notes; "DoDEA intends to award a single or multiple single Firm-Fixed Price (FFP), Indefinite Delivery/Indefinite Quantity (IDIQ) contracts from this solicitation." If issuing multiple awards, is this per country or for all countries to compete amongst the IDIQ Holders?

Any decision for a single award FFP IDIQ contract or multiple single-award FFP IDIQ contracts shall be made according to the solicitation. If multiple single award FFP contracts, then those award decisions would be based on the following 3 locations: 1) Germany, 2) The United Kingdom, and 3) Belgium & the Netherlands.

Per PWS 1.3 [in all three (3) PWS sections], "The purpose of the security training is to provide bus drivers and bus safety attendants with knowledge and awareness of the basic antiterrorism and crime practices and techniques, tailored to student transportation, prior to the beginning of the school year." We interpret that the government is seeking training only in accordance with the requirements of the various PWS. Is this correct? We also understand that conducting individual route assessments is not required for this potential contract. Is this correct?

The Government seeks services only as specified in the PWS, provided in Attachments 1a, 1b and 1c of this solicitation (as amended). The Government is not seeking the Offerors to conduct individual route assessments.

Per PWS, [in all three (3) PWS sections], "b. Task 2 – Personnel. Within five (5) business days after contract award: (1) Subtask 1. Recruit, screen, vet, hire, train, document, and equip local site supervisors, training instructors, and necessary support personnel, meeting the suitability and qualification requirements. Maintain the most current background checks of all persons employed under this performance work statement." Are the personnel required to be located in each country/location or able to perform in each country/location from a central location that service all locations?

Any decision for a single award FFP IDIQ contract or multiple single-award FFP IDIQ contracts shall be made according to the solicitation. If multiple single award FFP contracts, then those award decisions would be based on the following 3 locations: 1) Germany, 2) The United Kingdom, and 3) Belgium & the Netherlands.

Per PWS [in all three (3) PWS sections]), c. Task 3 – Requests and Notification. Within six (6) hours: (1) Subtask 1. From request, provide screening, vetting, background checks, and other records as necessary to the DoDEA Regional Force Protection Officer." Are these for DoDEA or bus company's employees/drivers? Could you clarify the scope of this task for workload management and pricing purpose?

Screening, vetting, and background checks information are required for processing paperwork to gain Base Access passes for any personnel requiring entry unto the Military Installations. Wait time varies according to the Base Installation procedures and quality/timeliness of obtaining information required, but expected wait times for base passes from the point all required documents are submitted typically ranges from one to three months depending on country. Bus company drivers and safety attendants are contracted locally at each location/country.

Per PWS [in all three (3) PWS sections], "d. Task 4 – Installation Access Requests. Submit U.S. military installation pass, hereafter referred to as “installation passes” in this performance work statement, access requests and all required information to support the contractual obligations at each community." Could you clarify the scope of this task for workload management and pricing purpose? Are these passes for DoDEA or bus company's employees/drivers?

Installation/Base Passes are required for any personnel requiring entry unto the Military Installations. Wait time varies according to the Base/Installation procedures and quality/timeliness of obtaining information required, but expected wait times for base passes from the point all required documents are submitted typically ranges one to three months depending on country.

Per PWS [in all three (3) PWS sections], "e. Task 5 – Training Material Draft. Within five (5) business days after contract award, develop training curricula, tests, and supporting material and provide a draft to the DoDEA Regional Force Protection Officer. Reference Annex B (Training Requirements) for additional performance standards." Could you specify the type of training delivery that is allowed? Do contractors have discretion with the delivery method for efficiency and record keeping across all three countries that meets the PWS requirements?

The method and location of delivery will be in accordance with Appendix B of the PWS (as amended) and shall be in-person training, using PowerPoint slides, supporting videos, etc. to be reviewed and approved by the Government before use. Virtual or remote training is not an option. In addition, Appendix C of the PWS outlined the format that is required for each deliverable. REF revised Attachments 1a, 1b, and 1c (PWS) accompanying this amendment, with all changes highlighted in yellow.

Per PWS [in all three (3) PWS sections], "h. Task 8 – Conduct Training.

Once training material is approved and prior to the start of the school year, conduct security training for all the bus drivers and bus safety at the CLIN locations. Reference Annex B (Training Requirements) for additional performance standards." Could you provide a training schedule draft (i.e. dates, locations, number of students per training, etc.) based upon historical data to assist with determining the workload breakout for each country and pricing? The historical data will assist with planning to prevent overlaps as well as hiring personnel.

No historical data is provided, nor description of ‘scope’ other than what is contained/described with the PWS (Attachments 1a, 1b, and 1c) for these services solicited.

PWS Sections A-1 (PERSONNEL FUNCTIONS) of all three sections of the PWS is amended (as highlighted in yellow within PWS accompanying this amendment) and provides more so for four key functions expected to be fulfilled, more so over personnel positions, to successfully meet the service requirements sought by this solicitation..

Per PWS [in all three (3) PWS sections], "A-1. PERSONNEL ROLES/POSITIONS. There are four positions associated with this performance work statement. A principal representative, local site supervisor, training instructor, and non-specific or undefined support personnel." If training is only required "prior to the beginning of the school year (PWS 1.3)," does the US Government require the location to be staffed year-round which would increase the cost? Can the Government clarify this task? Is there an expectation that these employees will be providing training throughout the year as opposed to at the beginning of each year?

REF revised Attachments 1a, 1b, and 1c (PWS) accompanying this amendment, with all changes highlighted in yellow.

Per PWS [in all three (3) PWS sections], "A-1. PERSONNEL ROLES/POSITIONS (6) Monitor the contractors’ activities and tasks, and coordinates with the Contracting Officer, DoDEA Regional and District Force Protection Officers, and DoDEA Student Transportation Officers." If this requirement is for training, can the Government clarify what the trainers will be monitoring? Depending on what the trainers will be monitoring, will the task be inherently government functions of the COR?

Per the PWS, “the Principal Representative is the primary contract manager(s), serving as the awarded contractor’s principal interface....” to the Gov’t for the anticipated contract(s) awarded. The Principal Representative is responsible for monitoring all the ‘activities and tasks’ of their own company’s personnel (and none others). The requirements sought are anticipated to result in Non-personal Services (NPS) contract(s), in accordance with Far 37/DFARS 237, and none of the tasks specified within the PWS are Inherently Governmental in nature.

Per PWS [in all three (3) PWS sections], "B-3. COURSE OF INSTRUCTION. The course of instruction is a Baseline Security Training course. a. Training Length. The security training course shall be at least three (3.00) but not more than four (4.00) total instructional hours." Is there a specify type of course delivery method that is not authorized? If so, can the Government provide the type of delivery method that is not authorized and why?

Virtual or remote training is not authorized due to cultural and language barriers.

Per PWS [in all three (3) PWS sections], "B-4. TRAINING CONTENT. The Baseline Security Training course shall include: a. Introduction to Terrorism. This will include the history of terrorism against U.S. and host nation interests; existence, history and capabilities of trans- and sub-national terrorist groups that currently target U.S. and host nation interests; and the current threat to U.S. and host nation interests." Is this the same training that was created by, developed for, and provided to the US military and civilians?

The training is intended for local contracted bus drivers and bus safety attendants providing student transportation services to DoDEA students in each country/area as outlines in the PWS.

Per PWS [in all three (3) PWS sections], "B-4. TRAINING CONTENT.

d. Surveillance Detection and Attack Recognition. Presents fundamental surveillance techniques, detection of surveillance “what to look for,” and the indicators of a terrorist or criminal attack that is about to happen. The objective is to teach the modus operandi and tactics terrorists or criminals may use in the surveillance phase of planning an attack on school buses in motion and school bus stops." To clarify, DoDEA is not seeking Route Vulnerability Assessments?

Route Vulnerability Assessments are NOT a requirement nor deliverable for the anticipated contract(s).

Per 24R2015_Attachment_X2_Pricing + Sheet, DoDEA is only seeking pricing per session, but requires personnel to be established at various locations. Could you clarify if DoDEA is seeking only training or are there other unwritten tasks not stated in the PWS (all three)? The Pricing Spreadsheet notes training, but the PWS requires curriculum development, personnel staffing, vetting and installation pass requests, findings and analysis, monitor the contractors’ activities and tasks, and coordinates with the Contracting Officer. Should these fees be included in the training cost? Could you clarify how we should capture these fees as each task, while they may be necessary or required, it is not training?

Attachment X2 (Pricing Sheets) requires unit pricing with Offerors’ complete proposal(s) IAW the solicitation, that propose (quote) the Offeror’s firm-fixed prices to deliver each of those Sessions, accounting for all the Task and Objectives required within the PWS associated with performing these services. There is no further ‘break-out’ pricing for any additional (ancillary and/or related) task, so Offerors must account for all their costs to deliver these services in with the firm-fixed price proposals offered.

REF revised Attach 2 (Pricing Sheet) accompanying this amendment.

In consideration of Labor Categories for staffing personnel that must be hired, will the Government revise the Pricing Sheet to include these Labor Categories? Including the staffing cost in the training cost will demonstrate an elevated and unrealistic training cost per unit. These are separate costs as well as the other mentioned requirements.

No, the X2 Pricing Sheets are not being revised to include anything other than the 'Training Sessions' services being solicited for these requirements. The type of contract(s) being considered to meet these commercial service requirements is a firm fixed-price (FFP) type contract, according the solicitation, and any Offeror(s) must carefully consider (and price) the entirety of all their costs associated with performing these services to assure proper (fixed) prices are proposed.

How can the Government determine price reasonableness for training with so many other tasks noted in the PWS that aren't associated with providing training and the contractor does not have a place to add these costs without significantly padding the training sessions to demonstrate the true cost?

The government shall make a price reasonableness determination(s) on any contract(s) awarded according to FAR 13.106-3, and IAW the solicitation.

If the Government declines to add these separate CLINs, will the Government revise the PWS that specifically requires training as noted in PWS 1.3? The Government has included mandated items without an opportunity for compensation to the potential contractor.

The anticipated award(s) for these requirements shall result in firm fixed-price, commercial service contract(s), and there are no further changes anticipated in the Contract/Service Line Items (C/SLINs) nor PWS that were solicited to meet these requirements. As such, PWS 1.3 remains unchanged [in all three (3) PWS sections].

17 Per 24R2015_SF1499, the closing date is June 11, 2024. Will the Government extend the due date?

No. The closing date/time for receipt of proposals for this solicitations is unchanged resultant this Amendment.

The timelines noted in the PWS (all three) to train almost 500 drivers/attendants prior to August 1st, 2024 (start of school). Will the Government modify this timeline?

The PWS is silent with reference to specific dates REF revised Attachments 1a, 1b, and 1c (PWS) accompanying this amendment, with all changes highlighted in yellow.

REF revised Attachments 1a, 1b, and 1c (PWS) accompanying this amendment, with all changes highlighted in yellow.

NOTE: PWS 2.2.f. (Task 5 - Training Material Draft) and 2.2.g. (Task 7 - Coordinate and Schedule Training), do specify: "Within fourteen (14) calendar days prior to the first training session, provide the training curricula, tests, attendance records and supporting material final draft in English to the DoDEA Regional Force Protection Officer" and then, thereafter for the Security Training contractor(s) awarded to "Schedule bus driver and bus Safety Attendants training" respectively. PWS B-3.b. further specifies “Coordination and Scheduling. The contractor is responsible for coordinating with the District Student Transportation Officer and scheduling the security training no less than 30 days out from school start.” Note these nominal timelines also in the 'Deliverables' chart summarized in Annex C. There are no specific dates mentioned in this

PWS.

PWS [in all three (3) PWS sections], since the Government has identified the Labor Categories in the PWS that must be hired to perform the required services under the resulting contract, should each Labor Category be prices with a unit of 1920 hours (minus holidays)?

REF revised Attachments 1a, 1b, and 1c (PWS) accompanying this amendment, with all changes highlighted in yellow.

Regarding the location of the two (2) German Districts, how many people will be trained for each location; e.g., SLIN 0001AA Baumholder how many drivers/attendants, etc. for the other locations?

The general ‘District’ locations for the training sessions are provided I the SLINs (i.e., SLIN structure in the anticipated schedule) of the solicitation, and the specific locations for each district are the DoDEA schools as coordinated between the awarded contractor(s) and the DoDEA COR (PWS B-2) and estimated numbers of sessions and town locations of these schools are provided in Table 1 for each PWS at Attachments 1a, 1b, and 1c of the solicitation. Please also note that PWS B-1 states “Each training session will accommodate fifteen (15) trainees.”

Do the courses have to be taught in English or in the language of the host country?

The courses are taught in English, but mastery of the host country language is essential as well, and as required in PWS A-2.d.: “The contractors (management, site supervisor, instructor, and any support personnel) must be able to read, speak, and write in the host nation language and English. Full capability in the official host nation language is essential to effectively ensure communication with school bus drivers and bus safety attendants” as well.

Per PWS (all three), c. Task 3 – Requests and Notification. Within six (6) hours: (1) Subtask 1. From request, provide screening, vetting, background checks, and other records as necessary to the DoDEA Regional Force Protection Officer." Could the Government provide the number of historical estimates of background checks that would be required and how or where should we price this?

Background checks are required for installation access for all contractor personnel proposed and as per the PWS. Theses can vary slightly by installation, but historically, local background checks (and other records as necessary to the Regional Force Protection Officer) typically (most commonly) include a (local) Police Good Conduct Certificate and the installation access application forms. Specific requirements for each country/installation will be provided after contract award. Total pricing is provided by the potential Offerors (i.e., the firms bidding) for all the requirements sought for award on a firm fixed contract(s) this solicitation.

Per PWS [in all three (3) PWS sections], "d. Task 4 – Installation Access Requests. Submit U.S. military installation pass, hereafter referred to as “installation passes” in this performance work statement, access requests and all required information to support the contractual obligations at each community." Could the Government provide the number of historical estimates of installation pass submission that would be required and how or where should we price this?

Background checks are required for installation access for all contractor personnel proposed and as per the PWS. Theses can vary slightly by installation, but historically, local background checks (and other records as necessary to the Regional Force Protection Officer) typically (most commonly) include a (local) Police Good Conduct Certificate and the installation access application forms. Specific requirements for each country/installation will be provided after contract award. Total pricing is provided by the potential Offerors (i.e., the firms bidding) for all the requirements sought for award on a firm fixed contract(s) this solicitation.

Per PWS [in all three (3) PWS sections], "e. Task 5 – Training Material Draft. (b) Syllabus and topical lesson plans that reflect primary points of instruction." A syllabus is a document that outlines all the essential information about a college course. It lists the topics you will study, as well as the due dates of any coursework including tests, quizzes, or exams. Lesson plans are typically used during K-12 to help teachers be more effective in the classroom by providing a detailed outline to follow each class period. As such, a syllabus and lesson plan are not normally used industrywide, commercially, or in professional trainings for this type of requirement training considering this is not a college or K-12 level training but for professionals. Is this a mistake? Will the syllabus and lesson plan be required to be issued to the attendees for a three (3) to four (4) hour training presentation? Will the syllabus and lesson plan be evaluated and if so, how will it be evaluated? Pass or Fail? Go or No-go?

The syllabus and lesson plans are NOT required to be issued to the training session attendees, but ARE deliverable requirements to the Regional Force Protection Officer per the PWS. Evaluations for contract award shall be in strict accordance with the solicitation, esp. the addendum at 52.212-2. Post contract award, the Region Force Protection Officer will review the proposed syllabus and training material and coordinate adjustments with the contractor.

Per PWS [in all three (3) PWS sections], "b. Task 2 – Personnel. Within five (5) business days after contract award:.....include all sub-tasks."

The scope is to "security training is to provide bus drivers and bus safety attendants with knowledge and awareness of the basic antiterrorism and crime practices and techniques, tailored to student transportation, prior to the beginning of the school year." However, it appears DoDEA may be requiring the contractor certify the employment of all personnel that supports this requirement even though said personnel that will have no contact with the students. The PWS does not state that these personnel will work onsite with the Government. Can the Government explain why the potential awardee has to certify their personnel with the Government? Will these personnel work onsite at the Government's facilitates? Is a security clearance required for such a requirement?

There are no ‘personnel certification requirements’ nor 'Security Clearances' necessary to provide these requirements other than the personnel ‘suitability and qualification’ performance standards in the PWS. Security Trainer personnel/employees are the responsibility of the awarded contractor(s), will not have contact with youth (i.e., they are training qualified adult bus drivers and adult safety attendants), but will often perform duties at an overseas DoDEA school complex located on military installations – thereby, ability for contracted personnel to be able to obtain installation pass access is essential these requirements per the PWS. The government is commercially contracting for course training services per the PWS this solicitation, and is not at all involved with any commercial company’s recruiting, hiring, or any other personnel management tasks or processes to meet any of these requirements.

Per the PWS [in all three (3) PWS sections], "b. Task 2 – Personnel.

Within five (5) business days after contract award: (1) Subtask 1.

Recruit, screen, vet, hire, train, document, and equip local site supervisors, training instructors, and necessary support personnel, meeting the suitability and qualification requirements. Maintain the most current background checks of all persons employed under this performance work statement." If the scope is to provide training prior to each school year (June to August), why is the Government requiring local training sites that is not funded for the duration of the year and the training is only for Baseline Training that does not support funding local sites?

There are no (government or otherwise) ‘funding’ objectives, task, nor performance requirements associate with the performance of these service requirements. Per the solicitation, the government anticipates awarding a single or multiple single Firm-Fixed Price (FFP), Indefinite Delivery/Indefinite Quantity (IDIQ) type contract(s) for these requirements, and any Task Order (TO) resultantly ordered a resultant IDIQ contract shall be individually ‘funded’ for (ultimate) payment according to the terms and conditions of the TO contract(s) awarded, and the form fixed price schedules so awarded o the IDIQ-level contract(s)/ordering instrument(s).

Per the PWS [in all three (3) PWS sections], "A-1. PERSONNEL ROLES/POSITIONS. There are four positions associated with this performance work statement. A principal representative, local site supervisor, training instructor, and non-specific or undefined support personnel." Per this requirement, each country is required to have a minimum of 8 personnel. Is this correct? If so, how should this be priced to prevent showing an excessive or unbalanced training cost?

Since the Government is appears to be mandating the number of personnel, should they be part-time or full-time? Will the Government this section and allow offerors to determine how they will structure to deliver the training?

Personnel staffing is completely determined from an Offeror’s proposal(s). REF revised Attachments 1a, 1b, and 1c (PWS) accompanying this amendment, with all changes highlighted in yellow.

The four (4) key functions outlined in PWS A-1 provide a framework for key management/performance functions the government expects the Security Training contractor(s) selected to provide these services to minimally maintain in order to successfully perform these services. The anticipated contract(s) resultant this solicitation shall be Non-personal Service (NPS) contract(s), and the ultimate responsibility for appropriately staffing to provide these services shall reside completed with the awarded contractor(s) management.

Per the PWS [in all three (3) PWS sections], "A-2. PERSONNEL QUALIFICATION REQUIREMENTS. The following contractor suitability qualifications apply to the Principal Representative, Local Site Supervisor, Training Instructor, and any support personnel not specifically identified by position title. The contractor shall select the highest caliber personnel from the pool of those deemed suitable through screening and vetting. The Contractor shall not waive or grant exception to the personnel qualifications, requirements, and standards and meet all qualifications, requirements, and standards without exception." If this requirement is to provide the tasks outlined in Appendix B to bus drivers and safety attendants, why is the Government so involved with the qualifications of the Subject Matter Experts? Can the Government define "highest caliber?"

There are no ‘personnel certification requirements’ necessary to provide these requirements other than the personnel ‘suitability and qualification’ performance standards in the PWS. The government is commercially contracting for course training services per the PWS this solicitation, and is not at all involved with any commercial company’s recruiting, hiring, or any other personnel management tasks or processes to meet any of these requirements. All the ‘suitability and qualification’ performance standards in the PWS must be met, and any additional personnel qualifying terms of ‘SME’ and ‘highest caliber’ are left to the discretion, determination, and selection of personnel within an Offeror’s proposal(s).

Per the PWS [in all three (3) PWS sections], "c. Employment and Criminal History. Contractors employed under this contract shall have a stable work history with no terminations for cause." Can the Government explain why an applicant cannot have previously had a "termination for cause" without knowing the circumstance and how this would negatively or adversely impact the contract performance?

The ‘suitability and qualification’ performance standards in the PWS must be met, and any additional personnel qualifying terms of ‘SME’ and ‘highest caliber’ are left to the discretion, determination, and selection of personnel within an Offeror’s proposal(s).

REF revised Attachments 1a, 1b, and 1c (PWS) accompanying this amendment, with all changes highlighted in yellow.

Per the PWS [in all three (3) PWS sections], "A-3. INSTALLATION PASSES. The contractor shall coordinate with the applicable DoDEA student transportation office for the local requirements and procedures to obtain installation passes for contractor personnel. (1) Contractors working under this contract may retain installation passes over the annual summer operations hiatus to facilitate performance of contracted services." Are the contractors required to work on the installation and at each local site? Who determines where the contractor will work? If the contractors are required to work at the Government facilities will the Government issue Government computers, provide workspaces, a Common Access Card, etc.? Is remote or telework authorized? Further, this task suggests that the employees will be employed throughout the year. Is this correct?

There are NO GFP anticipated for any resultant contract this solicitation, other than the installation passes and as specified in the PWS, and there is no requirement for ‘year round’ services other than what’s specified I the PWS to provide for the Training Sessions as specified in the PWS (Attachments 1a, 1b, and 1c of this solicitation). Per the PWS, “Contractors working under this contract may retain installation passes over the annual summer operations (POP) hiatus to facilitate performance of contracted services.”

The resultant service contract(s) this solicitation shall be Non-personal Services (NPS), and the awarded contractor(s) are responsible for all of the company's employee/employment and other personnel management tasks and decisions, e.g., travel to training site, residence, site location, part-time v. full-time employment, remote duty assignments, etc., as mentioned in this question.

Per the PWS [in all three (3) PWS sections], "B-2. DELIVERY LOCATIONS. The delivery location under this performance work statement will be at the CLIN locations, or a location coordinated between DoDEA transportation and the security training contractor." If services are not provided on the installation, but at the CLIN locations, or a location coordinated between DoDEA transportation and the security training contractor, is the installation pass (A-3. INSTALLATION PASSES) applicable? If not, will the Government delete this?

If 100% of the contracted services are NOT provided on the installation, then Installation Passes are not required for those contracted personnel performing those services. Whereby and if contracted performance objectives/tasks DO require contractor performance on base/installations, then Installation Passes are required for those contracted personnel performing those services. It is not foreseeable whether all the training sessions will be held on or off installations, however, the training will most likely be held at a DoDEA owned or managed facilities/schools that are on US military installations, thus installation access passes are required. Training can/may also take place at local bus company facilities (as arranged), but this is not foreseeable/forecasted at any time before contract award(s) are made.

Please also especially note whereby Installation Passes are necessary for successful performance these requirements, that “the DoDEA Regional or District Force Protection Officers and DoDEA Student Transportation Officer will act as the sponsoring agency for acquisition of installation access passes for contractor personnel as needed” [PWS A-3 (5)].

Per the PWS (all three), "c. Testing and Evaluation. Upon completion of each training session, the contractor shall test bus drivers and bus safety attendants, using a written test with a pass or fail grading standard to evaluate comprehension and assimilation of the training."

Is the training and exams in Host Nation language or English?

All the training and exams are to be conducted in English or in the host country language, since the local national bus drivers and bus safety attendants may not be proficient in English.

SF1449 page 35 52.212-2 ADDENDUM – EVALUATION – COMMERCIAL ITEMS (DEC 2006) Addendum to 52.212-2 Paragraph (a) "The Government shall conduct price analysis first to determine whether a vendor’s proposal is fair and reasonable in accordance with FAR 13.106- 3(a)." There are a lot of unknowns, and the requirement does not appear to be clearly defined. For example: the establishment of site locations for a three (3) or (4) hour training without clear and sustainable tasks for the entire year; the lack of quantities to process background checks and vetting; hiring personnel; personnel work location; etc. These items are not separately captured in the pricing spreadsheet and the Government has not defined how and where these items can be priced. Based upon these unpriced areas can the Government share how it will determine the price to be reasonable with limited information and unpriced items that are required but provide no opportunity for pricing?

The government shall conduct price analysis first to determine whether a vendor’s proposal is fair and reasonable in accordance with FAR 13.106-3(a) as specified in the solicitation, and also otherwise evaluate all responsive proposals received to this solicitation in strict accordance with the solicitation as well. Offerors must provide total, firm fixed prices for all areas in Attach X2 as specified i the solicitations, and should consider all company fully burdened cost elements to provide these services as proposed in company pricing, as well focus on periods of performance (PoP) for these sessions as specified throughout the PWS [Attachments 1a, 1b, and 1c].

Can the Government provide the current contract number? These are new requirements for the Agency, and as such, there are not incumbent contractors performing all these requirements for the government. However, these services were mostly met as part of much more comprehensive Student Transportation Services Security Program (STSSP) service contracts that expire the end of this school year. For those efforts, the TUPE provision has been added to this solicitation as follows:

TRANSFER OF UNDERTAKING (TUPE)

1. The Government does not have in its possession incumbent employee record information. The information belongs to the incumbent contractors.

2. Without making any representations regarding applicability of Transfer of Undertaking (Protection of Employment) TUPE regulations, or similar country specific employment protection, to this procurement, the Government reminds offerors that DFARS clause 252.222- 7002, Compliance With Local Labor Laws (Overseas), is incorporated by full text in this solicitation.

For your convenience the names of the incumbent contractors are provided below:

• POND SECURITY SERVICES GMBH (NCAGE: BD246), under contract number HE1254-19-D-2006; and

• BROADLAND GUARDING SERVICED LIMITED (NCAGEs: U1KW9 and KC7Y1, respectfully), under contract numbers HE1254-19-D-2007 and HE1254-19-D-2008.
