The following have been modified:
SECTION L
L1. INFORMATION TO OFFERORS
L1.0. Program Title and Objectives.
The Request for Proposal (RFP) solicits a non-commercial contract utilizing a best-value, trade-off evaluation method. The resultant contract will be for Electromagnetic Battle Management Joint (EMBM-J) Situational Awareness (SA) support services.
The purpose of these instructions is to establish uniform evaluation procedures by the source selection evaluation teams for the development of the best-value decision by the Source Selection Authority (SSA) using the trade-off process (See Federal Acquisition Regulation (FAR) 15.101-1). In as much as the proposal shall describe the capability of the Offeror to perform the resulting contract, the proposal shall be specific and complete in every detail as well as be prepared simply and economically, providing a straightforward and concise description of capabilities to satisfactorily perform the contract.
L1.1. Funding Information.
The Government's obligation under this contract is contingent upon the availability of funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer (KO) for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the KO. The Government reserves the right to begin services for the contract based upon funds available. Funds are not presently available for this effort and no award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an Offeror for any costs.
L1.2. Scoping Information.
The Government anticipates a transition from major capability development to sustainment of EMBM-J SA during the performance of this contract. The following full-time equivalent estimates are provided as baseline information only and is not intended to define this requirement or establish any limitations on your proposal. It is the responsibility of the Offeror to provide a technical approach with the appropriate labor categories and number of hours.

L2.0. General Instructions.
L2.0.1. This section of the Information to Offerors provides general guidance for preparing proposals as well as specific instructions on the format and content of the proposal. The Offeror's proposal must include all data and information requested by the RFP and must be submitted in accordance with these instructions. Offerors shall address all aspects of the Performance Work Statement (PWS) within their technical/management approach. Non-conformance with the instructions provided in this Information to Offerors may result in removal of the proposal from further evaluation.
L2.0.2. The proposal shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal should not simply rephrase or restate the Government's requirements but rather shall provide convincing rationale to address how the Offeror intends to meet these requirements. Offerors shall assume that the Government has no prior knowledge of their capabilities and experience and will base its evaluation on the information presented in the Offeror's proposal.
L2.0.3. Elaborate brochures or documentation, binding, detailed artwork, internet hyperlinks, or other embellishments are unnecessary and are not desired.
L2.0.4. The proposal acceptance period is 180 calendar days. Offerors shall make a clear statement in Volume I / Part A - Executive Summary that the proposal is valid through this date. By not doing so, this may result in removal of the proposal from further evaluation.
L2.0.5. In accordance with (IAW) FAR Subpart 4.8 (Government Contract Files), the Government will retain one digital copy of all unsuccessful proposals.
L2.0.6. Portions of the successful Offeror’s proposal may be incorporated into the contract as an attachment in Section J.
L2.1. General Information.
L2.1.1. Point of Contact.
The KO and the Contract Specialist (CS) are the sole points of contact for this procurement. Address any questions or concerns to the KO and CS. Written requests for clarification must be sent to the KO and CS, at the email addresses located in Section G. These are the only two email addresses that will be used for communications.
Please include both emails in all correspondence. Oral communications are not permissible. No telephonic communications will be permitted.
L2.1.2. Debriefings.
The KO will notify unsuccessful Offerors of the source selection decision in accordance with FAR 15.503. Upon such notification, unsuccessful Offerors may request and receive a debriefing. Offerors desiring a debriefing must make their request in accordance with the requirements of FAR 15.505 or 15.506, as applicable. Excluded Offerors are only entitled to one debriefing for each proposal.
L2.1.3. Discrepancies.
If an Offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the Offeror shall immediately notify the KO and CS in writing with supporting rationale.
L2.1.4. Electronic Reference Documents.
Except for documents referenced in the Reading Library Index, all referenced documents for this solicitation are available on the Contract Opportunity web site at http://www.sam.gov. Potential Offerors are encouraged to subscribe for real-time e-mail notifications when information has been posted to the website for this solicitation.
The Government shall communicate all formal information regarding this solicitation, except documents contained within the Reading Library, via the Contract Opportunities website.
Documents referenced in the Reading Library Index may be obtained via written request to the KO and CS. Request for access may only be granted by the KO and CS after a formal request is received. Offerors must submit a written request to the KO and CS listed in Section G, specifying which documents they are requesting from the reading library by April 2, 2025, to allow adequate time for proposal preparation. The written request shall include the Offeror’s Commercial and Government Entity (CAGE) code and Unique Entity Identifier code (UEI). For Unclassified (non-controlled) documents (U), Offerors are not required to be pre-certified by the Joint Certification Program and must provide a written request with their CAGE Code and UEI.
For Controlled Unclassified Information (CUI) documents, Offerors will only be given access to the CUI documents if they are certified by the Joint Certification Program. For CUI documents, written requests shall be sent to the KO and CS via their Data Custodian (block 3A of the DD Form 2345) with their CAGE code and UEI. The Data Custodian is the only individual that will be provided access to the CUI documents.
Reading Library documents will be sent to eligible Offerors via their Data Custodian on April 3, 2025, via the Department of Defense Secure Access File Exchange. Offerors are responsible to manage the documents in accordance with the prescribed Department of Defense/Department of National Defense directives.
The Joint Certification Program web site:
https://www.dla.mil/HQ/LogisticsOperations/Services/JCP/
It is the exclusive responsibility of interested/prospective contractors to gain access to and retain an account with Contract Opportunities. Any and all technical, connectivity, or other access-related issues (electronic or physical) regarding the Contract Opportunities must be directed to the Contract Opportunities systems administrators, Federal Service Desk (FSD) by phone at 1-866-606-8220 and/or https://www.sam.gov/help. The KO and CS for this solicitation has no influence over Contract Opportunities regulations, policy and protocol.
L2.1.5. Communications.
Exchanges of source selection information between Government and Offerors will be controlled by the KO or CS.
Evaluation notices and responses will be transmitted as emails and will be treated as source selection information.
The subject line of the email shall be titled: “RFP HC104725R0003, [Contractor Name], Source Selection Information See FAR 2.101 and 3.104.” Offerors shall provide a viable email address to be used by the Government for official correspondence. Questions/comments are due no later than 11:00 Eastern Standard Time on April 9, 2025. Questions submitted after the deadline may not be answered. The email addresses for the KO and CS are contained in Section G. Questions/comments will only be responded to if received in email and only when submitted on Attachment L8 - Questions and Answer in Section J.
No information concerning this solicitation or requests for clarification will be provided in response to Offeror initiated telephone calls. All such requests must be made in writing and submitted as directed above. All questions/comments provided in a timely manner will be answered in writing and provided to all Offerors.
However, written inquiries may not be answered when requests are received by the Government points of contact after the original due date for receipt of questions as specified in this solicitation. The timeframe for submitting inquiries will not be extended as a result of an extension to the due date for the receipt of offers unless authorized by the KO.
L2.1.6. Award without Discussions.
The Government intends to award without discussions. Therefore, the Offeror’s initial proposal should contain the Offeror’s best approach/terms for technical, management, past performance, price, and small business participation;
however, despite this intent, the Government reserves the right to conduct discussions if the SSA determines they are necessary. If the SSA determines that discussions are necessary, a competitive range will be established. The competitive range may be used to limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. In the event issues pertaining to a proposed contract cannot be resolved to the SSA's satisfaction, the Government reserves the right to withdraw and cancel the solicitation. In such event, Offerors will be notified in writing.
L2.2. Organization/Number of Copies/Page Limits.
Offerors shall prepare the proposal as set forth in the Proposal Organization Table (Table L1. below). The titles and contents of the volumes shall be as defined in this table, all of which shall be within the required page limits and with the number of copies as specified in Table L1. The contents of each proposal volume are described in the Information to Offerors paragraph as noted in the table below.

L2.2.1. Page Limitations.
Page limitations shall be treated as maximums. If exceeded, the excess pages will not be read or considered in the evaluation of the proposal. Page limitations may be placed on responses to Evaluation Notices (ENs) should discussions be deemed necessary by the KO. The specified page limits for EN responses will be identified in the letters forwarding the ENs to the Offerors. Page limitations shall not be circumvented by including inserted text boxes/pop-ups or internet links to additional information; such inclusions are not acceptable and will not be considered part of the proposal. The Government reserves the right not to consider for award any proposal that does not adhere to the administrative requirements of this solicitation. Each page shall be counted as identified above.
Each page shall be counted except cover pages, blank pages, or those identified in Table L1. Proposal Organization, as having no limit.
L2.2.2. Page Size and Format.
A page is defined as each face of a sheet of paper containing information. Page size shall be 8.5 x 11 inches. Pages shall be single spaced with space between paragraphs. Except for the reproduced sections of the solicitation document, the text size shall be no less than 10-point Ariel or Times New Roman font for all text. Tracking, kerning, and leading values shall not be changed from the default values of the word processing or page layout software. Use at least one-inch margins on the top, bottom and side margins. Pages shall be numbered sequentially by volume. These page format restrictions shall apply to responses to ENs. These limitations shall apply to electronic proposals. Hardcopy proposals will not be accepted. It is the sole responsibility of the Offeror to ensure that the electronic files submitted are virus free and can be opened and read by the Government. Proposal submissions shall not be locked, encrypted, or otherwise contain barriers to opening. The Government strongly recommends that the Offeror test the files on more than one internal machine and more than one machine type or platform to ensure proposals are entirely virus free and accessible to the Government on any platform. The Government is under no obligation to seek clarification regarding electronic proposal submissions if submissions cannot be opened or accessed. In the event any file is corrupted or un-openable, the Offeror’s proposal may be rejected.
Legible tables, charts, graphs and figures shall be used wherever practical to depict organizations, systems and layout, implementation schedules, plans, etc. For tables, charts, graphs and figures, the text shall be no smaller than 10-point Arial or Times New Roman font for all text included in a table.
L2.2.3. Cost or Pricing Information.
All cost or pricing information shall be addressed ONLY in the Cost/Price Proposal Volumes. Cost trade off information, work hour estimates, and material kinds and quantities may be used in other volumes only as appropriate for presenting rationale for alternatives or design and trade off decisions.
L2.2.4. Cross-Referencing.
To the greatest extent possible, each volume shall be written on a stand-alone basis so that its contents may be evaluated with a minimum of cross referencing to other volumes of the proposal. Information required for proposal evaluation which is not found in its designated volume will be assumed to have been omitted from the proposal.
Cross-referencing within a proposal volume is permitted where its use would conserve space without impairing clarity.
L2.2.6. Indexing.
Tab indexing shall be used to identify sections.
L2.3. Electronic Offers.
In order to respond to this solicitation, Offerors shall email a copy of its proposal to the KO and CS not later than the time and date specified in this solicitation. In accordance with FAR 52.215-1, Instructions to Offerors, the Offeror's proposal submission will be considered complete when all volumes are received. The maximum size of each email transmission shall not exceed 20 MBs. Compressed files are not permitted given that zip files are stripped from emails IAW DISA’s security policy. The electronic copies of the proposal shall be submitted in a format readable by Microsoft 365 or Adobe Acrobat XI Pro, as applicable. Use of the software and procedures described in this part will reduce the amount of time and effort needed by the Government to receive and install proposals into an electronic evaluation system and will help to ensure that proposals are suitable for reading electronically.
Information regarding electronic products listed herein should not be construed as Government endorsement for such products.
For electronic copies, indicate on each document the volume number and title. Use separate files to permit rapid location of all portions, including subfactors, exhibits, annexes, and attachments, if any. Efforts by the Government to clarify or expedite installation of electronic proposal submissions, in accordance with FAR 15.207(c), will not be considered discussions. The Government is under no obligation to seek clarification regarding electronic proposal submissions if submissions cannot be opened or accessed.
The time specified on the SF-33, Block 9, is in Eastern Standard Time (EST). Any proposal, modification, or revision that is received after the exact time specified for receipt of proposals in Block 9 is “late” and will be handled in accordance with FAR 15.208(b) and subparagraphs thereto.
L3.0. Volume I - Executive Summary.
In the executive summary volume, Offerors shall provide the following information:
L3.1. Executive Summary Narrative.
The executive summary of the entire proposal should be concise, to include addressing the significant risks, and highlighting any key or unique features, excluding price. The salient features should tie in with Section M evaluation factors/subfactors. Any summary material presented here shall not be considered as meeting the requirements for any portions of other volumes of the proposal.
Offerors shall include the following information in the executive summary:
a. Name of the prime Offeror, company/division address, Commercial and Government Entity (CAGE) code, and Unique Entity Identifier (UEI) number.
b. Offeror representative(s). Provide the name, title, and telephone number of the company/division point of contact(s) regarding decisions made with respect to your proposal and who can obligate your company contractually. Also, identify those individuals authorized to negotiate with the Government.
c. If proposing subcontractors, identify the percentage of work to be performed by each subcontractor. Their names, company/division address, CAGE code, and UEI number shall be included.
d. If an Offeror is proposing as a Joint Venture, provide the names, company/division address, CAGE code, and UEI number of all joint venture partners.
e. All locations where work is to be performed and indicate whether such facility is a division, affiliate, or subcontractor, and the percentage of work to be performed at each location.
f. Facility clearance level for the prime Offeror and all subcontractor/teaming partner(s), if any.
g. Proposal expiration date.
L3.2. Table of Contents.
Offerors shall include a master table of contents of the entire proposal to include each volume.
L3.3. Cross Reference Matrix.
Offerors shall prepare a Cross Reference Matrix cross referencing all RFP requirements to the location of the Offeror’s responses in their proposal. The Cross Reference Matrix provides reference information but is not evaluated.
L4.0. Volume II - Technical/Management.
L4.1. Technical/Management Approach.
Offerors shall provide a technical/management approach that is specific and complete. Responses will be evaluated against the technical/management subfactors defined in Section M. Evaluation Factors for Award. The technical/management proposal should include all information the Offeror wants the Government to consider regarding its company’s ability to perform all required tasks and conform to all required terms and conditions. The Offeror’s technical/management approach shall provide the actual methodology and/or evidence the Offeror would use for accomplishing/satisfying all tasks specified in Section 6 of the PWS.
Specifically, Offerors shall describe their technical/management approach to:
a. Using Agile, integration/continuous development (CI/CD), DevSecOps software development methodologies, aligned to National Geospatial-Intelligence Agency (NGA) Common Operations Release Environment (CORE) capabilities to deliver EMBM-J SA mission capability. This should include proposed establishment and use of metrics to track and enhance software delivery performance.
b. Eliciting, analyzing, and decomposing EMBM-J SA capability and user requirements to enable Agile development, testing, and capability deployments. Approach should include demonstration of success to application users, and mitigations to potential requirement challenges in a multi-stakeholder environment.
c. Managing cybersecurity-related activities to ensure robust security posture of the system, to include how cybersecurity-related enhancements and/or remediations are integrated into Agile delivery, DevSecOps workflows, and/or underlying cloud infrastructure management.
d. Expanding the aggregation and fusion of multiple disparate Electromagnetic Spectrum (EMS)-related datasets with varying levels of structural correlations, across relevant Intelligence Community, spectrum management, operational, friendly, neutral, and adversary EMS datasets.
e. Synthesizing data between different classification domains (e.g. Secret Internet Protocol Router Network (SIPRNet) and Joint Worldwide Intelligence Communication System (JWICS)) and data classification markings across parallel application instances across classification domains.
f. Successfully developing mission user capabilities through incorporation of data and various spectrum engineering services into a User Defined Operational Picture, enabling mission analysis of the Electromagnetic Operating Environment.
g. Identifying, recruiting, retaining, managing, and scaling requisite staff to execute performance requirements, to include proposed mix of labor categories.
h. Balancing on-site / off-site resources and/or network access to optimize Agile software delivery, system administration, and cybersecurity activities across multiple network classification environments
Offerors shall provide their proposed approach to meeting or exceeding the minimum performance requirements for each technical/management factor/subfactor. The proposal shall address any technical risk by identifying those aspects of the proposal that have the potential disruption of schedule, increase costs, technical performance, need for increased Government oversight, and/or the likelihood of unsuccessful contract performance. The proposal shall describe the impact of each identified risk in terms of its potential to interfere with or prevent the successful accomplishment of other contract requirements (e.g., PWS or specification requirements). Offerors shall propose a realistic "work-around" or risk mitigation for identified risks that will eliminate or reduce risk to an acceptable level.
Identify any new risks introduced by such risk mitigation. Proposals shall clearly show how the Offeror will accomplish the tasks and why they have chosen that particular course. Failure to address all PWS requirements will result in a non-responsive proposal and the Offeror’s proposal will be removed from consideration.
Offerors who simply rephrase or restate the Government’s requirement without providing convincing rationale to address how the Offeror intends to meet this requirement will not be considered for award.
L4.2. Transition Plan.
Offerors shall provide a transition-in plan. The Offeror’s transition-in plan must demonstrate a thorough understanding of the organization and process required for working closely with the EMBM-J program management office, and other stakeholders to transition work efforts from the incumbent effort to the Offeror with limited delays or degradation of services. Offerors should specify their approach to rapidly establish/transition to a new development environment within NGA CORE Unclassified Cloud Impact Level (IL) 4, to include integrating with existing CI/CD pipeline and their approach to assuming operations of EMBM-J SA Test and Production IL6 environments, to include enabling cybersecurity activities. Offerors should also specify their hiring and retention processes (to include the use of subcontractors, if applicable), on-boarding processes, ability to quickly replace key personnel, and apply resources needed to successfully execute the transition, to include reestablishing/enabling Agile software capability development against the EMBM-J SA effort. Responses will be evaluated against the Acceptable/Unacceptable subfactor defined in Section M. Evaluation Factors for Award.
L4.3. Resumes of Key Personnel.
Offerors shall submit the resumes of the key personnel that it is proposing in H3. Key Personnel. Each resume shall include the name of the proposed individual and demonstrate that the proposed individuals meet the requirements identified in Section 6.1.7 of the PWS.
L4.4. Betterment.
If an Offeror believes that any part of its proposed solution will exceed the Government’s requirements, the Offeror may identify this as a betterment with an explanation as to why. At its discretion, the Government may incorporate any strength or betterment proposed by the Offeror into the resultant contract with a required bilateral signature.
Betterments may be submitted on Attachment L1 - Betterment.
L5.0. Volume III - Supply Chain Risk Management (SCRM).
A determination has been made by the program office that the items and/or services to be procured under this RFP are subject to SCRM controls as outlined in the PWS. As a result, Offerors will be required to submit a detailed organization-wide SCRM plan as part of their proposal. Supply chain risks range from natural threats to counterfeit products and applies to quality, security, resiliency, and product integrity. Mitigation plans to manage risks may involve logistics, cybersecurity, and financial management. The goal is to preclude undue risk to the Government and ensure supply chain continuity in the event normal business operations are interrupted. The full text of the selected contractor’s SCRM Plan will be included in the resulting contract award.
If a SCRM concern arises after contract award, the Government will determine whether a continuation of the contract poses an undue risk to both the common defense and security to this nation. If the Government determines that such a risk exists, the Government reserves the right to accept or reject a proposed mitigation plan by the Contractor (if one or more is presented within a reasonable time) as negotiated by the Contracting Officer or terminate the contract for convenience.
L6.0. Volume IV - Small Business Participation.
L6.1. Small Business Participation Plan and Commitment.
All Offerors (both large and small businesses) will be evaluated on the level of proposed participation of U.S. small businesses in the performance of this acquisition. The Government will evaluate if small business participation meets the Minimum Quantitative Requirements (MQRs) of this requirement as identified in the paragraphs below.
The Small Business Participation Plan is an actual commitment document that addresses the extent of small business utilization in the performance of a contract as outlined in DFARS 215.304(c)(i). The Small Business Participation Plan specifies the details of how the Offeror will maximize the utilization of small businesses within this acquisition.
The Offeror shall articulate how small businesses will participate through performance as a small business Prime Offeror and/or ‘first tier’ small business subcontracting only. Second and third tier small business subcontractors will NOT be considered towards the total small business participation percentage in this factor.
A Small Business Participation Plan template is provided as Attachment L5 - Small Business Participation Plan.
The document is for guidance but is not mandatory for use by Offerors.
All Offerors, including those who are DoD Comprehensive Test Program participants, shall submit a Small Business Participation Plan as a part of their proposal. The final Small Business Participation Plan will be monitored as a measure of contract compliance and execution and results of it may be used in Contractor Performance Assessment Reporting Systems (CPARS) assessments. The Small Business Participation Plan shall not reference the Subcontracting Plan or any other volume for information; all information required within the Small Business Participation Plan shall be contained within the tab for that element. This Small Business Participation Plan and the MQRs apply to the overall contract and will be incorporated at contract award. In accordance with DFARS 215.304(c)(i), small business participation is an evaluation factor under Section M. Evaluation Factors for Award.
For the purposes of this Small Business Participation Plan, Offerors shall use their total proposed cost/price from Attachment L2 - EMBM-J SA Cost and Pricing Spreadsheet for the “Total Contract Value” (TCV). That TCV shall be used when calculating percentages and dollars.
Offerors shall provide the following:
a. The total combined dollars and percentage of work to be performed by the prime contractor, any large business subcontractors and any small business subcontractors.
Note: The Small Business Participation Plan measures the percentage of the TCV while the Subcontracting Plan measures the percentage of the subcontracted dollars. Small Business Offerors will be required to report achievements against their Small Business Participation Plan while “Other Than Small Business” Offerors will be required to report results against both sets of goals during contract execution.
b. The total percentage of participation to be performed by each small business category. The percentage of work performed by small businesses that qualify in multiple small business subcategories should be counted in each category. For example, if a company is a Women-Owned Small Business (WOSB) and Service-Disabled Veteran-Owned Small Business (SDVOSB), the dollars subcontracted to that company should be counted for Small Business, WOSB and SDVOSB. All percentages shall use the TCV as a baseline. The Small Business Evaluation Board must be able to verify that each percentage is based on the TCV to be determined acceptable.
Offerors shall provide detailed explanations if proposed percentages are lower than the Minimum Quantitative Requirements (MQRs) listed in the solicitation. The MQRs are a percentage of the TCV. Offerors shall propose goals for each of the categories identified by the Government below for MQRs.
The Government does not recognize zero percent as an acceptable proposed goal. However, if goals of zero are proposed for small business or any subcategory, they shall be supported with a detailed explanation as to why the Offeror cannot utilize small business or that subcategory. If the Offeror does not submit a detailed rationale/explanation, the zero percentage may be deemed unacceptable.
MQRs for this requirement are:
Small Business: 25% of the total contract value;
Small Disadvantaged Business (SDB) to include 8(a): 5% of the total contract value;
Women-Owned Small Business (WOSB): 5% of the total contract value;
Historically Underutilized Business Zone (HUBZone) SB: 3% of the total contract value;
Service-Disabled Veteran-Owned Small Business (SDVOSB): 5% of the total contract value.
c. A list of principal services to be performed by small businesses. This list shall include the specific task areas from the PWS and the complexity* (low, medium or high) that small businesses will perform for this specific requirement to include the dollars planned for each small business.
*Complexity: These are presented as guidelines only and should not be construed as replacing requirements in any other section of the solicitation to include labor category requirements.
Low: Does not require technical expertise. May not require employee to have a college degree, may require direct supervision and/or requires less than five years of related experience.
Examples: SharePoint Support, Project Management, Non-technical support, acquiring products or ordering materials/software/hardware.
Medium: Requires technical expertise or knowledge. Does require employee to have a college degree, requires little direction or supervision, and/or requires 5-10 years of related experience.
Examples: Information Technology (IT) Operations, Data Management, IT Support Services, Cybersecurity, Tier I and Tier II Help Desk Support, Program Management, DevSecOps, Operations & Sustainment of existing systems.
High: Requires significant technical expertise or knowledge. Does require employee to have a college degree or advanced degree, requires no direction or supervision, and/or requires 10+ years of related experience. Examples: Engineering Support, Tier III Help Desk Support, Advanced IT Support Services, Systems Engineering work for new requirements, Innovation requirements/work.
List the extent of commitment to use such firms as either enforceable or unenforceable (enforceable arrangements demonstrate commitment vice unenforceable arrangements). Documentation regarding enforceable commitments must be provided. For example: signed teaming agreements, mentor protégés agreements, joint ventures, subcontracting or partnership letters of commitment(s), etc., may be included to support your commitment to small business utilization. Enforceable commitments must be specific to the subject requirement and include acknowledgement via signatures by both parties.
d. Description of the specifics on how the Offeror’s firm intends to maximize the utilization of small businesses within this acquisition. What plans of action will the Offeror execute to ensure maximum participation for small business? The Offeror shall articulate how small businesses will participate through performance as a small business Prime Offeror and/or ‘first tier’ small business subcontracting only.
Second and third tier small business subcontractors will not be considered towards the total small business participation percentage in this factor.
DISA is focused on removing barriers to entry for small businesses. The number one barrier is the facility site clearance (FCL). Part of maximizing the utilization of small businesses is to remove barriers.
This solicitation and any resultant contract require the prime contractor to sponsor at least two FCLs for small businesses during the first year. To be rated “Acceptable” the Offeror shall provide a written guarantee that they will sponsor two or more FCLs to small business during the first year of performance of a resultant contract.
Note: The percentages and dollar values shall be achievable for the procurement for both the Participation Plan as well as the Subcontracting Plan. For “Other Than Small Businesses” only: The dollar values proposed for small business participation presented in the Small Business Participation Plan shall be consistent with the dollar values presented for small business participation in your individual Small Business Subcontracting Plan (L6.2.).
L6.2. Small Business Subcontracting Plan.
A Small Business Subcontracting Plan is also required (FAR 52.219-9) for Other than U.S. Small Businesses ONLY (i.e., Large Businesses). ONLY OTHER THAN SMALL BUSINESS OFFERORS ARE REQUIRED
TO SUBMIT.
Separate from the Small Business Participation Plan, firms other than U.S. Small Business Offerors, shall also submit a Subcontracting Plan meeting the requirements of FAR 52.219-9 and DFARS 252.219-7003 (or DFARS 252.219-7004 if the Offeror has a Comprehensive Subcontracting Plan). Firms other than U.S. Small Businesses shall submit acceptable Subcontracting Plans to be eligible for award. The plan, at a minimum shall address the elements set forth in FAR Clause 52-219-9(d)(1) through (15). Subcontracting Plans shall reflect and be consistent with the commitments offered in the Small Business Participation Plan. Offerors shall complete Attachment L7 - SubK Plan Checklist and submit with the proposal. Note: Subcontracting Plans will only be reviewed for acceptability for those Offeror(s) deemed to be apparent awardee(s). If the apparent awardee’s Subcontracting Plan is not initially acceptable, the Contracting Officer may engage in clarifications in regard to the Subcontracting Plan and this shall not be deemed discussions.
L7.0. Volume V - Past Performance.
L7.1. General.
Offerors shall submit a past performance volume with its proposal, containing past performance information in accordance with the format contained in this Attachment L3 - Past Performance References. Offerors shall submit no more than three total recent past/present performance efforts for evaluation. Two of the three past performance efforts submitted must be efforts in which the prime for this proposal was a prime on the referenced contract. Offerors are advised that the Government will use data provided by each Offeror in this volume and may use data obtained from other sources in the evaluation of past performance.
Along with the information required in this paragraph, the Offeror shall submit a consent letter (Attachment L6 - SubK or Teaming Partner Past Performance Consent) executed by each subcontractor, teaming partner, and/or joint venture partner, authorizing release of past performance information to the Offeror so the Offeror can respond to such information.
L7.2. Relevant Contracts.
Offerors are required to submit past/present performance information using the format contained in Attachment L3 - Past Performance References on a minimum of three recent (active within the past three years from the date of this solicitation) contracts that are considered most relevant in demonstrating the ability to perform the proposed effort.
The total of past and present performance information references will not exceed three. Offerors are to include rationale supporting the assertion of relevance.
L7.3. Specific Content.
Offerors are required to explain what aspects of the contracts are deemed relevant to the proposed effort and to what aspects of the proposed effort they relate. This may include a discussion of efforts accomplished by the Offeror to resolve problems encountered on prior contracts as well as past efforts to identify and manage program risk. Merely having problems does not automatically equate to a limited or no confidence rating, since the problems encountered may have been on a more complex program, or an Offeror may have subsequently demonstrated the ability to overcome the problems encountered. Offerors are required to clearly demonstrate management actions employed in overcoming problems and the effects of those actions in terms of improvements achieved or problems rectified.
L7.4. Utilization of Small Business.
Offerors shall submit a proposal that provides a record of successful utilization of small business in previous similar contracts. Examples of documentation may include: meeting/exceeding goal against established Subcontracting Plans on contracts executing similar scope and magnitude of this requirement, Defense Contract Management Agency (DCMA) Small Business Subcontracting Program Compliance Review for the Offeror submitting the proposal (to be acceptable, the rating must be “Satisfactory” or higher), Summary Subcontract Reports (SSR) for the Offeror submitting the proposal (demonstrating meeting or exceeding goals), Individual Subcontracting Reports (ISR) for similar contracts (demonstrating meeting or exceeding goals). If SSR/ISR do not meet/exceed goals, the Offeror may submit rationale for any goals not met to include action(s) taken or being taken to meet the goals. CPARS will only be considered if the “Small Business Subcontracting” portion provides a narrative on goal achievement.
L7.5. Organizational Structure Change History.
Many companies have acquired, been acquired by, or otherwise merged with other companies, and/or reorganized their divisions, business groups, subsidiary companies, etc. In many cases, these changes have taken place during the time of performance of relevant past efforts or between conclusion of recent past efforts and this source selection. As a result, it is sometimes difficult to determine what past performance is relevant to this procurement. To facilitate this relevancy determination, Offerors shall include a "roadmap" describing all such changes in the organization of your company. As part of this explanation, show how these changes impact the relevance of any efforts identified for past performance evaluation/confidence assessment. Since the Government intends to consider past performance information provided by other sources as well as that provided by the Offerors, the "roadmap" should be both specifically applicable to the efforts identified and general enough to apply to efforts on which the Government receives information from other sources.
Offerors who have not had an organizational structure change shall provide a statement confirming that there have not been any organizational structure changes during the time of performance of relevant past efforts or between conclusion of recent past efforts and the current proposal submission.
L8.0. Volume VI - Cost/Price.
L8.1. General Instructions.
All information relating to the proposed cost/price, including all required supporting documentation must be included in the section of the proposal designated as the Cost/Price Volume. Under no circumstances shall this information and documentation be included elsewhere in the proposal.
L8.2. Cost Reasonableness, Completeness, Realism, and Balance.
This section is to assist in submitting information other than pricing data that is required to evaluate the reasonableness, completeness, realism, and balance of the proposed cost. The Government will verify that all solicitation requirements have been priced, figures are correctly calculated, and costs/prices are presented in a clear and useful format. Cost-plus-fixed-fee (CPFF) contract line item numbers (CLINs) (x002, x003, x004, x005, x006, x007, x008, x009, x010, and x011) will be evaluated for realism pursuant to FAR 15.404-1(d). The Government reserves the right, but is not obligated, to review fixed price CLIN (x001) for price realism.
