Questions and Responses

HC102819R0007

Q 1. Will a Davis Bacon Building Construction Wage Decision for Bexar County be provided or are contractors to use the service contract wage scale provided in the solicitation?

Response: This is in no way a construction contract, and FAR Part 36 is not applicable. As this is not a construction requirement, the Davis Bacon Decision is not applicable. This requirement has incidental services which brings the Service Contract Act into play. The wage determination posted in the solicitation is applicable.

Q 2. Are contractors required to apply for and obtain a Port of San Antonio Building Permit or is this project exempt? If exempt, please indicate how the project is exempt from the permit.

Response: No building permit is required. This project is installing personal property that is not turned over to, or maintained by the port, and would be taken out if DISA were to leave the building.

Q 3. Are contractors required to provide PE stamped and sealed engineered plans and specifications for DISA approval? If yes, please provide detailed requirements regarding DISA’s design requirements including the design process required including how many Design Submittals are required, number of days required for DISA design review, etc.

Response: PE stamped drawings are not required. See section 6.16 and 6.17 for submittals and drawings and in section 11 the deliverable schedule and details for all line items. A draft and final submittal/shop drawings are required for the subject question with a 10 day government review period.

Q 4. Port of San Antonio building permit process requires PE Engineered Stamped Plans and Specifications for their approval. If a Port of San Antonio building permit is required, will the owner be providing engineered plans and specifications for Port of San Antonio Approval or is the contractor required to include the cost of designing the project to obtain Port of San Antonio approval?

Response: NA – See Q2 Response.

Q 5. Port of San Antonio has sizable Building Permit fees. Is the contractor required to include the cost of the Port of San Antonio building permit fees in our proposals or is the owner paying for this permit or is the permit not applicable?

Response: NA – See Q2 Response.

6. Which Buy America Act Clause applies to this solicitation?

Response: As this is not a construction requirement, no Buy America Act is applicable.

7. Does this project have funding?

Response: Yes, or would not be advertised.

Q 8. Project is listed as having a NAICS code of 333415 Air Conditioning Equipment manufacturing. Most projects of this type are installed by contractors who purchase equipment from the equipment manufacturers. A NAICS code of 333415 will greatly limit the competition on this project. Is it the intent of the solicitation to limit competition to manufacturers of mechanical equipment? or should the NAICS code be revised to something like Construction 236220 or Mechanical 238220?

Response: The NAICS code is selected prior to solicitation IAW SBA guidelines. The particular NAICS represents the largest portion of the requirements, which is how a NAICS is appropriately selected. This procurement is not limited, as it allows large and small business to respond. DITCO cannot use the 23 NAICS series because the agency cannot do construction contracts.
