This is Addendum No. 2 to a sealed bid solicitation issued by the Massachusetts Department of Transportation (MassDOT) Highway Division for resurfacing and box widening work on Ayer Road in Harvard (Federal Aid Project No. STP-0033(045)X, Proposal 609213-134927). The project encompasses approximately 9,200 linear feet of roadway from Route 2 to the Harvard/Ayer town line and includes pavement resurfacing with multiple asphalt courses, box culvert replacement and extension, drainage improvements, a 10-foot shared use path, stormwater management enhancements, utility relocations (11 poles, 57 transformers, 8,700 feet of spacer cable, and approximately 1,925 linear feet of gas main replacement), wetland mitigation, and traffic control. The scope specifies 234 line items including milling of 25,000 square yards of pavement, 10,170 cubic yards of unclassified excavation, and 4,250 tons of Superpave intermediate course asphalt. Sealed proposals are due Tuesday, July 28, 2026, at 2:00 p.m., with the Notice to Proceed anticipated approximately two months after bid opening. Construction is scheduled from summer 2026 through summer 2028. This addendum clarifies truck safety device requirements mandating contractors certify that all applicable vehicles are equipped with lateral protective devices, convex mirrors, crossover mirrors, and backup cameras in accordance with 540 CMR 4.00, and establishes work hours as Monday through Friday (excluding holidays) from 7:00 a.m. to 3:00 p.m., with no work impacting the traveled way permitted during peak traffic hours (7:00 a.m.–9:00 a.m. and 3:00 p.m.–6:00 p.m.).

The estimated contract value is $9,977,000, funded through federal-aid Surface Transportation Program (STP) dollars with state match. A proposal guaranty equal to 5 percent of bid value is required. Price adjustments apply for hot mix asphalt ($712.50 per ton base), Portland cement ($452.13 per ton), diesel fuel ($4.497 per gallon), gasoline ($3.752 per gallon), and structural steel (Base Price Index 362.0). Prevailing wage rates established by the Massachusetts Department of Labor and Workforce Development and the U.S. Department of Labor apply. Bidders must be pre-qualified by MassDOT in the HIGHWAY-CONSTRUCTION category and must submit electronic bids through www.bidx.com; use of COMMBUYS is prohibited. The project is subject to Title VI Civil Rights Act compliance and Federal Equal Employment Opportunity Contract Specifications (Executive Order 11246) with minority and female participation goals. Federal permits include USACE General Permit 23 (verified July 17, 2025) authorizing fill discharge in streams and wetlands with compensatory mitigation, and MassDEP Order of Conditions (January 30, 2025) establishing environmental protections. Liquidated damages for failure to complete work on time are specified in Standard Specifications Subsection 8.11. Non-compliance with vehicle safety device requirements may subject contractors to statutory fines under M.G.L. c. 90, § 7 and/or contractual remedies up to and including contract termination.
