About this file

This document contains a justification and approval for other than full and open competition for a federal construction contract. The U.S. Army Corps of Engineers Louisville District requests sole source approval to specify Carrier brand chillers for an aircraft hangar renovation project at Homestead Air Reserve Base, Florida estimated between $10-25 million. As over 70% of existing base chillers are Carrier, technicians have greater familiarity with the brand, improving maintenance and repair quality and reducing total ownership costs over the lifecycle. Market research identified three local suppliers able to provide Carrier chillers and components, ensuring adequate competition. The justification cites Air Force policy mandating HVAC chiller standardization at installations for cost savings, and documents Homestead ARB's approval for Carrier brand through an inventory and supply chain analysis.

FAR Part 6 Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: U.S. Army Engineer District, Corps of Engineers, PO Box 59, Louisville, KY 40201-0059

2. Description of Action: Approval is requested to identify a specific brand for HVAC chiller systems as a sole source requirement in the construction contract for the Add/Rpr and Alter Hangar 200 project, Project# KYJM 18-9023 at Homestead Air Reserve Base (HARB). The specifications will require the installation of a Carrier chiller system, which is a brand-name product with no equivalent. This justification covers only the portion of this acquisition which specifies the Carrier chiller System. The estimated cost for the chiller system is . The hangar renovation project will be funded by FY20 Operations & Maintenance (O&M) funds.

3. Description of the Supplies/Service: The design and specifications for this construction project will require proprietary construction materials necessary for a complete and functional HVAC system. This includes the procurement of a Carrier brand HVAC chiller system.

4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. This authority is applicable to brand name acquisitions in accordance with FAR 6.302-1(c).

5. Reason for Authority Cited:

Background: In May 2019, a memorandum titled HVAC Chiller System Standardization, Single Manufacturer Selection was issued by the Air Force Civil Engineer Center Director (AFCEC/CL) who serves as the Air Force Category Manager (CM) for the Facilities and Construction Category. This memorandum directed all future HVAC chiller purchases to a single manufacturer at the installation level. Homestead ARB has received approval from AFCEC for inclusion in this requirement based on a comprehensive inventory analysis produced by the Base Civil Engineer’s office that indicates a significant majority (70%) of the chillers on Base are Carrier brand. Given the high percentage of Carrier systems currently on the installation, technicians have significantly more experience and familiarization working with their equipment than other manufacturers on the installation, which improves the quality of our preventative maintenance and repair. Additionally, a supply chain analysis was completed by Material Control. Three local companies were identified that can meet future demand requirements, and there is adequate competition to mitigate fluctuations of component and servicing pricing.

Based on this analysis, standardization to Carrier brand chillers at Homestead ARB has been determined to significantly reduce the total cost of ownership which includes the initial procurement, subsequent maintenance, and associated training costs to operate the system over its lifecycle.

(a) Supporting Documentation for Justification (attached):

- HVAC Chiller System Standardization, Single Manufacturer Selection, dated 3 MAY 19

- Addendum - Base-MFG'R Selection List

- Chiller System Manufacturer Standardization Request Memo, date 28 JAN 20

- Approval Email from AFCEC/CO ( ), dated 29 JUL 20

6. Efforts to Obtain Competition: A supply chain analysis was completed by Material

Control which identified three local companies that can meet future demand requirements, so there is adequate competition that will be available to compete to provide Carrier chillers at a subcontracting level.

7. Actions to Increase Competition: Multiple suppliers have been identified that can provide components and servicing of the equipment which will ensure competition in procurement and servicing equipment.

8. Market Research: Market research was completed as noted above.

9. Interested Sources: To date no other sources have been identified that can meet the Air

Force requirement for the brand name Carrier chiller at Homestead ARB. All required notices will be published and any response will be considered.

10. Requirements Certification: I hereby determine that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.

Project Engineer

11. Fair and Reasonable Cost Determination/Contracting Officer Certification: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable based on comparison with existing contract prices and/or established catalog prices for similar items. Based on the foregoing justification, I hereby approve the procurement of a Carrier chiller system in the estimated amount of on an other than full and open competition basis pursuant to the authority of 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

I certify that this justification is accurate and complete to the best of my knowledge and belief.

Contracting Officer

12. Legal Justification: I have reviewed this J&A and find the justification adequate to support other than full and open competition.

MEMORANDUM FOR ALMAJCOM-FOA-DRU-PSU

FROM: AFCEC/CO

139 Barnes Drive, STE 1 Tyndall AFB, FL 32403-5319

SUBJECT: HVAC Chiller System Standardization, Single Manufacturer Selection

Reference: (a) AFCEC/CL Memo, 3 May 2019, Air Force Policy Memorandum Mandatory Standardization of Essential HVAC System Components

1. The Air Force Civil Engineer Center Director (AFCEC/CL) serves as the Air Force Category Manager (CM) for the Facilities and Construction Category and he has mandated the standardization of HVAC chiller systems to a single manufacturer at the installation level. The AFCEC/CL has further delegated the authority and responsibility of administering the single manufacturer approval process to the AFCEC Operations Directorate (AFCEC/CO).

2. Standardization of all HVAC chiller systems allows the Air Force to significantly reduce the total cost of ownership which includes the initial procurement, subsequent maintenance, and associated training costs to operate the system over its lifecycle. Since standardization is a long-term strategy, Base Civil Engineers (BCEs) must perform their due diligence during the selection process to mitigate any prolonged adverse effects. This memorandum serves as AFCEC/CO’s official guidance for the evaluation, recommendation, and subsequent approval of a single manufacturer for HVAC chiller systems at each installation.

3. BCEs are required to submit a Memorandum of Request (MOR) to the AFCEC/CO that clearly specifies the requested single manufacturer for HVAC chiller systems at the respective installation as well as provide reasoning and justification per the guidance set forth by this document. In turn, AFCEC/CO will issue an Official Memorandum approving or disapproving the requested manufacturer. Should disapproval be merited, AFCEC/CO shall provide explanation for all disqualifications as well as engage with the BCE directly to identify a suitable alternative.

4. The BCE shall assign a team to perform a comprehensive inventory analysis to identify a single manufacturer for HVAC chiller systems. It is recommended that at a mimum, the team be comprised of the Installation Mechanical and HVAC Systems Sub-AMP Manager, a qualified HVAC technician, and a Material Control representative. However, BCEs may elect to augment and/or enhance the composition of the evaluating team as necessary.

CLASSIFICATION: UNCLASSIFIED

I am with USACE (Louisville District) and have been coordinating an effort to get a J&A from for approval of a Carrier chiller sole source to support a project at Homestead that I am working to award for construction this FY, therefore this situation is quite urgent. I have been in communication with this week and he has suggested I contact you with my request explaining our need.

I am available to speak at any time by either office or mobile numbers below if it would help to discuss.

Thank you for your assistance, Project Manager
