SECTION SF 30 BLOCK 14 CONTINUATION PAGE

SUMMARY OF CHANGES

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

The following have been modified:

INSTRUCTIONS TO OFFERORS

Section L - Instructions, Conditions and Notices to Bidders

L.1 General. This section provides guidance for preparing proposals as well as instructions on the format and content of the proposal. The proposal must include all data and information requested and must be submitted in accordance with (IAW) these instructions; incomplete proposals may be considered nonresponsive. Taking exception to any of the requirements specified in this solicitation may result in the proposal being found unacceptable.

DO NOT REGURGITATE THE STATEMENT OF WORK (SOW) OR REFORMULATE THE

REQUIREMENTS SPECIFIED IN THE SOLICITATION. In no case shall words like “we will comply with the requirements of the contract,” or equivalent statements, be acceptable to meet the requirements of this Request For Proposals (RFP). The Government will not provide reimbursement for any cost incurred during proposal submission.

L.1.2 Program Classification/Facility Security Clearance. Certain aspects of this program are classified at the SECRET level. The SOW is Classified SECRET//NOFORN. These performance requirements are called out in classified attachments to the RFP. Interested parties are alerted they must meet facility and personnel security clearance requirements for handling and storage of classified material up to the SECRET level in accordance with the requirements of the Department of Defense (DD) Form 254 (Contract Security Classification Specification), attached under Section J in order to participate in this acquisition. All interested vendors shall submit Defense Counterintelligence and Security Agency (DCSA) documentation with Volume V that authorizes an active/valid Facility Clearance (FCL) of Top Secret with classified safeguarding of Secret. Providing complete packages/copies of all documentation is required. Incomplete packages, pending, or in-process documentation/clearances will NOT be accepted.

United Stated Special Operations Command (USSOCOM) will NOT provide any sponsorship for Security Clearances to enable access to the CLASSIFIED portions of this requirement. A prerequisite to this requirement is that all interested vendors that wish to propose for the Prime Contractor role shall already have DCSA approved CLASSIFIED Storage Capability and individual Security Clearances. ALL interested parties shall have this in place as of the posting date of the solicitation. Under no circumstance will interested Prime Contractor Offerors be able to utilize a potential Sub-Contractor's Classified Storage capability to circumvent this requirement. Upon request from an interested party and verification that all clearance and storage capability requirements have been satisfied, the Government will provide the classified attachment(s). USSOCOM will provide all CLASSIFIED documents to the approved physical ship-to address location of the interested vendor.

L.1.3 Notice Regarding Organizational Conflict of Interest (OCI) – Determination to Participate in this Acquisition

L.1.3.1 The acquisition of services under this solicitation may create actual or potential conflicts of interest for offerors and their prospective subcontractors. In assessing and addressing OCI, USSOCOM will follow the guidance in the Federal Acquisition Regulations (FAR) Subpart 9.5.

Offerors are responsible for ensuring that both they and their proposed subcontractors are not restricted from participating in this acquisition due to an OCI caused by any existing or in-process

USSOCOM contract. This includes all USSOCOM funded contracts or subcontracts, including those at the Headquarters and either the Theater Special Operations Commands (TSOCs) or the Geographic Combatant Commands (COCOMs).

L.1.3.2 USSOCOM prefers that offerors competing have no known OCIs. While mitigation plans will be considered, they create considerable work for the Agency and each offeror to ensure that OCIs are adequately mitigated at the time of contract and/or task order award. Consequently, industry is encouraged to avoid OCI issues to the maximum extent practicable prior to submitting proposals by prudent teaming.

L.1.3.3 Certain capability areas under this requirement present heightened concern to USSOCOM with respect to OCI. Contractors, in many instances, provide advisory and engineering support regarding the performance of existing USSOCOM programs and/or contracts. Any TCC tasks that create biased ground rules or impaired objectivity for an offeror or proposed subcontractor will make that prime offeror ineligible for award. In some instances, establishing an acceptable OCI mitigation plan for TCC will be challenging, if not impossible. Please note that a proposal of 100% subcontracting and firewalls WILL NOT be considered an acceptable OCI mitigation plan.

L.1.4 Proposal Format and Content.

L.1.4.1 Don’t submit elaborate brochures or documentation, binding, detailed artwork, or other embellishments.

L.1.4.2 Submit proposals in Microsoft (MS) Word or searchable PDF format (MS Office 2010 compatible). Submit price/cost spreadsheets in MS Excel (MS Office 2010 compatible). The proposal when printed must fit on 8.5 x 11 size paper, in 12 point, Times New Roman, single line spacing, with one inch margins. Tables, charts, graphs and figures shall be used when necessary to depict organizations, systems and layout, implementation schedules, plans, etc. These displays shall be uncomplicated, legible. Foldout pages may only be used for large tables, charts, graphs, diagrams, and schematics, and will be counted as 2 pages. Foldout pages shall not be used for pages of text. For tables, charts, graphs, and figures, the text shall be no smaller than Microsoft Word 9 point, Times New Roman. Each proposal volume shall be submitted as a separate file or files.

L.1.4.3 Titles and contents of the volumes shall be provided as defined in Table L.1. Pages exceeding the limits in Table L.1 will not be read or considered in the evaluation of the proposal.

The following are exempt from page limitations for the RFP: Cover sheets; Table of contents; List of Table and Drawings; Glossaries; Acronym List; Compliance Matrix; PPQ Tracking Records;

A significant inconsistency, if unexplained, may raise a question of the offeror’s understanding of the nature and scope of the work required and its ability to perform within the proposed price/cost constraints, which may cause the proposal to be rejected.

Note: It is expected that IDIQ level personnel would be an indirect cost, if this is inconsistent with the offeror’s accounting practices, offerors shall include as a direct cost and provide basis of estimate.

M.1.4 EVALUATION PROCEDURES FOR FACTORS. The Government’s evaluation team will evaluate the offeror’s proposal and apply a Combined Technical/Risk Rating for Factors 1 and 2 (See Table M.1 below for a description of the ratings). Proposal evaluation will focus on strengths, weaknesses, significant weaknesses, and deficiencies. Note that if an offeror’s proposal demonstrates a material failure to meet a Government requirement, it is a deficiency. Offerors that simply restate the Government’s requirement will be rated unacceptable.

Table M.1 Combined Technical/Risk Ratings Color Rating Description Blue Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Purple Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Reference Sections C and L.2. for detailed requirements. Evaluation of this factor will focus on the strengths, weaknesses, significant weaknesses, and deficiencies of the proposal. Evaluation of risk associated with the offeror’s proposal for this factor is inherent in the evaluation.
