About this file

This document is the Government's response to industry questions regarding a Performance Work Statement (PWS) for a federal contract opportunity. The key details are:

The PWS requires the contractor to provide one (1) qualified Subject Matter Expert (SME) to support the Navy Parachute Team's requirements. The government notes that this single SME requirement limits the offeror's ability to leverage a team of experts and provide backup contingencies. There are also contradictions between the single SME requirement and the PWS sections stating the contractor shall be responsible for their own management and free from government supervision. The government acknowledges there is no evident benefit to limiting the consulting services to a single SME, and indicates it may reconsider this requirement based on the industry feedback provided.

The related federal contract opportunity is a 5-year, single-award, Firm Fixed Price Indefinite Delivery Indefinite Quantity (IDIQ) contract for Subject Matter Expert advisory support services for the Navy Parachute Team. It will be a 100% Small Business Set-Aside acquisition under NAICS code 541990 with an estimated value of $19.5M. The full Request for Quote package will be available around May 13, 2024.

Government Response to Industry Questions

1. PWS 3.1:

The Contractor shall provide one (1) qualified SME necessary to meet NPT’s requirements as defined in this Performance Work Statement (PWS).

0. This requirement does not provide the Government the benefit of leveraging from the depth and breadth of a team of experts, that an offeror would want to assemble, in order to deliver the best possible service.

0. The single SME requirement limits the offeror’s ability to provide for backup contingencies in the event of attrition, illness, schedule conflicts etc. This is particularly important for a multi-year IDIQ engagement

0. Paragraph 3.1 contradicts 3.3, Particularly (2) “shall be responsible for their own management and administration of the work required and bear sole responsibility for complying with any and all technical, schedule, or financial requirements or constraints associated with performance of this contract…” And… (3) “shall be free from supervision or control by any Government employee with respect to the manner or method or performance of the services specified;”

0. There is no conceivable benefit to the Government, to have the consulting and advisory service limited to a single SME

In light of these concerns, will the contracting office reconsider this new, peculiar and overly restrictive requirement?
