(1) Whether the offeror, and/or any of its principals, has or has not, within the last five years, in connection with the award to or performance by the offeror of a Federal contract or grant, been the subject of a proceeding, at the Federal or State level that resulted in any of the following dispositions:

(2) If the offeror has been involved in the last five years in any of the occurrences listed in (c)(1) of this provision, whether the offeror has provided the requested information with regard to each occurrence.
(d) The offeror shall post the information in paragraphs (c)(1)(i) through (c)(1)(iv) of this provision in FAPIIS as required through maintaining an active registration in the System for Award Management database via https://www.acquisition.gov (see 52.204-7).
(End of provision)
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (APR 2014)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address. The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. An offeror within the United States may contact Dun and Bradstreet by calling 1-866-705-5711 or via the internet at http://fedgov.dnb.com/webform. The Technical Capability will be evaluated as PASS/FAIL. If the Technical Capability Factor fails, then the quote may not receive further consideration for evaluation or award. The Past Performance Factor is significantly more important than Price. Price will be evaluated, but not rated.
Factor 1 – Technical Capability
Basis of Evaluation: Technical Capability will be evaluated on a PASS/FAIL basis basedo n whether the Quoter meets Original Equipment Manufacturer (OEM) capability requirements to work on the required craft; and has a facility site within 30 miles of Government location at 2220 Schofield Road, Virginia Beach, VA as required to perform the required work items of the solicitation. Quotes which do not demonstrate the required certification and/or capability and facility location at the time of submission will NOT be evaluated further.
Factor 2 - Past Performance
Basis of Evaluation: Past performance will be evaluated based on relevancy and confidence. For the Past Performance factor, the ratings identified in Tables 1 and 2 below, entitled “Past Performance Relevancy Ratings Table” and “Past Performance Confidence Assessment Ratings Table”, will be used for the assignment of ratings for relevancy and past performance confidence assessment.
Past Performance will be assessed as follows:
The Government’s evaluation will focus only on work experience already performed. Work yet-to-be performed, and work prior to the last 3 years from the closing date of this solicitation, will not be considered. In addition, performance data will only be assessed for those references demonstrating at least 1 year of completed performance prior to the closing date of the solicitation.
Quoters are advised that in evaluating a Quoter’s past performance, the Government may, at its sole discretion, consider information from sources outside the submitted quote. These considered sources will be held to the same parameters of evaluation as the Quoter provided past performance information. For example, the Government may consider information based on its own experience with the Quoter and/or may contact the parties for whom the Quoter performed contracts and consider their response when evaluating the Quoter’s quote. The Government may review Contractor Performance Assessment Reporting System (CPARS) ratings on other relevant contracts and may also consider Past Performance Information Retrieval System (PPIRS) ratings, regulatory agency databases, past performance questionnaires, information submitted by each Quoter with its quote, and other existing past performance information contained in either local or other supervisor files, or from other Government sources or non-Government sources. General trends in a contractor’s performance will also be considered.
The assessment of the Quoter’s Past Performance is one of the factors used for evaluating the Quoter’s ability to successfully perform the requirements of this solicitation, as well as to determine the Quoter’s performance risk for the subject solicitation. Such consideration is separate and distinct from the Contracting Officer’s responsibility determination under FAR Part 9. The Government reserves the right to contact references provided by the Quote, and otherwise verify statements and representations made in the Quoter’s quote, but reserves the right not to contact all references. In the case of a Quoter without a record of relevant past performance or for whom information on past performance is not available, the Quoter may not be evaluated favorably or unfavorably on past performance.
The past performance evaluation may also consider the past performance of affiliated companies or operating divisions within the parent company or joint ventures of the parent company when it is reasonable to attribute the experience of these past efforts to the quoted effort and when the quote clearly demonstrates the resources (e.g. financial resources, overall oversight and management or other resources) of the parent or affiliated division will meaningfully affect performance of the instant acquisition. Consideration of past performance of teaming partners or subcontractors will only be given if the percentage of their performance is provided and permission for its use is contained in the quote. The past performance of teaming partners or subcontractors who are quoted to perform less than 20% of the work and are not quoted to perform critical aspects will not be evaluated.
Past Performance Relevancy Ratings – Regarding relevancy, each past performance reference under each quoter’s Past Performance submission will be evaluated to determine scope and magnitude relative to the requirement. The following definitions will apply to this evaluation:
Scope: Experience in the areas defined in the PWS.
Magnitude: The measure of the similarity of the dollar value of work actually performed under the quoter’s contract or contracts, during the relevant period established by the solicitation, to the dollar value of this requirement.
Quoters lacking relevant past performance history will not be evaluated favorably or unfavorably on past performance. However, the quote with no relevant past performance history, while not rated favorably or unfavorably for past performance, may not represent the most advantageous quote to the Government. In this instance, the quoter will receive a rating of “Not Relevant” in the past performance evaluation.
Past Performance Confidence Assessment Ratings – Past Performance Confidence Assessment Ratings – The overall assigned rating for Past Performance will be the Past Performance Confidence Assessment rating. The assignment of this rating will be based on the quality of the relevant past performance. The quality of performance under a past performance reference that has no relevance to the instant requirement will not be considered in the overall assessment of Past Performance Confidence.
In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available, the quoter may not be evaluated favorably or unfavorably on past performance rather the quoter will receive an “Unknown Confidence” rating.
In order to verify past performance information and determine the quality of the past performance submission, the Government may contact some or all of the references provided, as appropriate, and may collect information through questionnaires (i.e. the Past Performance Information Form), telephone interviews and existing data sources to include but not limited to the Past Performance Information Retrieval System (PPIRS). The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. This past performance information will be used for the evaluation of past performance.
This evaluation and rating are separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the quoter’s past performance will be used as a means of evaluating the relative capability of the quoter and other competitors to successfully meet the requirements of the RFQ. In determining the rating for the past performance evaluation factor, the Government will give greater consideration to the contracts which the Government considers are most relevant to the RFQ.
Factor 3 - Price Evaluation Methodology: All prices, including FAR 52.217-8, will be evaluated for reasonableness in accordance with FAR 52.217-5, Evaluation of Options, and FAR 13.106-3(a).
Although price is considered in a manner that makes it less important than the past performance factor, it has the potential to become more significant during the evaluation process. The degree of importance of the price will increase with the degree of equality of the quotes in relation to the other factor on which selection is to be based. The importance of price will also increase when a quote's price is so significantly high as to diminish the value to the Government that might be gained under the other aspects of the quote. If, at any stage of the evaluation, all quoters are determined to have submitted equal, or virtually equal, or generally equivalent, past performance quotes, price could become the factor in determining which quoter shall receive the award.
Rating Tables Factor 1 – Technical Capability The following ratings will be used in the evaluation of the Technical Capability Factor.
Rating
Description
Pass
Meets requirements. Quote demonstrates a fully qualified staff and a facility that is located within 30 miles of SBT-20 facility.
Fail
Does not meet requirements. Quote did not demonstrate a fully qualified staff and/or a facility that is located within 30 miles of SBT-20 facility.
Factor 2 – Past Performance
The following relevancy ratings will be used in the evaluation of the Past Performance factor.
Rating
Description
Relevant
Present/past performance effort involved similar scope and magnitude of effort this solicitation requires.
Somewhat Relevant
Present/past performance effort involved some of the scope and magnitude of effort this solicitation requires.
Not Relevant
Present/past performance effort involved little or none of the scope and magnitude of effort this solicitation requires.
The following Confidence Assessment ratings will be used in the evaulation of the Past Performance factor.
Rating
Description
Substantial Confidence
Based on the quoter’s recent/relevant performance record, the Government has a high expectation that the quoter will successfully perform the required effort.
Satisfactory Confidence
Based on the quoter’s recent/relevant performance record, the Government has a reasonable expectation that the quoter will successfully perform the required effort.
Limited Confidence
Based on the quoter’s recent/relevant performance record, the Government has a low expectation that the quoter will successfully perform the required effort.
No Confidence
Based on the quoter’s recent/relevant performance record, the Government has no expectation that the quoter will be able to successfully perform the required effort.
Unknown Confidence (Neutral)
No recent/relevant performance record is available or the quoter’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
SOURCE SELECTION DECISION
The Government intends to evaluate quotes and award a contract using the procedures of FAR 13.5, Test Program for Certain Commercial Items. The Government shall select the vendor whose quote represents the best value to the Government, considering technical capability, past performance, and price when compared to other quotations. The Government also reserves the right to not award a contract if a contract award is not in the best interest of the Government.
