COMBINED SYNOPSIS/SOLICITATION

H92240-20-Q-1007 is issued as a Request for Quotation (RFQ) for commercial items prepared in accordance with the information in FAR Subpart 12.6 for commercial items, using simplified acquisition procedures found at FAR Part 13, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

This is total small business set–aside under the category below:

The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-06 effective 05-06-2020.

QUOTES ARE DUE: 24 June 2020 at 9:00 a.m. Pacific Standard Time.

Quotes shall be valid for 60 days, and shall be provided in electronic format. The electronic quote submission shall fit on 8.5 x 11 size pages, in no less than 12 pt, single line spacing, with one inch margins, Times New Roman font.

No facsimile quotes will be accepted. All quotes must be clearly marked with the RFQ number and MUST be submitted via email to Kelly.mcneill@socom.mil. Contractors are responsible for verifying receipt of their quotes to this email address before the specified due date and time. Contractors are advised to plan ahead, ensuring enough time to account for any potential delays in email transmission. Email file size shall be limited to 10 MB. If documents exceed 10 MB, contractors shall submit documents via separate emails to ensure each email is no more than 10 MB. Submissions with .zip files are not acceptable and will not be delivered by the government email server. The government server does not generate rejection notices and it may not forward a file if quarantined by server. As such it is the vendor’s responsibility to ensure its quote is received.

Questions regarding this RFQ shall be directed to the Contracting Officer no later than 22 June 2020 at 12:00 P.M.

Quotes received without a completed copy of the provision at FAR 52.212-3 Alt. I or completed SAM representation may be considered non-compliant and become ineligible for award (NOTE: Offerors registered in SAM are still required to complete paragraph (b) of FAR 52.212-3 Alt. I and submit with quote). Vendors without DFARS representations and certifications in SAM must submit any applicable to this RFQ with their quote. Vendors must be registered in the System for Award Management (SAM) (www.sam.gov) to be eligible for award.

FAR PROVISIONS/CLAUSES BY FULL TEXT:

52.212-1 INSTRUCTIONS TO OFFERORS-COMMERCIAL ITEMS ADDENDUM

The following are additional instruction to offerors:

(m) Addenda: Submission Requirements:

Factor 1 – Technical. The offeror shall describe quoted items in sufficient detail to allow the Government to properly evaluate the items conformance to Attachment 1 Product Description.

Factor 2 – Price. The Quoter shall provide a firm fixed price, including delivery, for all items included within this solicitation. The Government may require additional “other than certified cost and pricing data” prior to award.

52.212-2 EVALUATION -- COMMERCIAL ITEMS (OCT 2014)

(a) Be advised that the Government is conducting this acquisition using simplified acquisition procedures in accordance with FAR Part 13. The Government will award a contract resulting from this solicitation to the responsible Quoter whose quote conforming to the solicitation is the Lowest Price Technically Acceptable

(LPTA).

All quotes received from eligible Quoters will be initially evaluated for completeness and conformance with the RFQ instructions. Incomplete and nonconforming quotes will not be further evaluated.

All complete and conforming quotes will be considered in terms of price, lowest to highest, and then the apparent lowest-priced Quoter will be evaluated for acceptability under the Factor 1 - Technical. If the lowest-price Quoter is determined technically unacceptable, the acceptability of the next lowest-price Quoter will be evaluated, continuing this process as necessary until the LPTA Quoter is identified.

The following factors shall be used to evaluate quotes:

Factor 1 – Technical Factor 2 – Price

A finding of Unacceptable in Factor 1 may result in the entire quote being determined unacceptable and, therefore, ineligible for award. The Government shall evaluate Technical Quotes using the following adjectival ratings:

Adjectival Rating Description Acceptable Quote meets the requirements of the solicitation.

Unacceptable Quote does not meet the requirements of the solicitation.

Factor 1 - Technical. The Government will evaluate information submitted by the Quoter for this factor and will make an acceptable or unacceptable rating. Acceptable is defined as the proposed items demonstrate conformance to Attachment 1 Product Description. Unacceptable is defined as the proposed items do not demonstrate conformance to Attachment 1 Product Description. The Government reserves the right (but is not required) to seek additional information from only the lowest price vendor(s) and make award considering the additional information.

Factor 2 – Price. All prices will be evaluated for price reasonableness IAW FAR 13.106-3. In case of any discrepancy between a unit price and an extended price, the unit price will be presumed to be correct and the Government reserves the right to adjust the offeror’s total evaluated price accordingly without seeking further clarification from the offeror.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1)in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

252.204-7000 DISCLOSURE OF INFORMATION (OCT 2016)

(a) The Contractor shall not release to anyone outside the Contractor's organization any unclassified information, regardless of medium (e.g., film, tape, document), pertaining to any part of this contract or any program related to this contract, unless--

(1) The Contracting Officer has given prior written approval;

(2) The information is otherwise in the public domain before the date of release; or

(3) The information results from or arises during the performance of a project that involves no covered defense information (as defined in the clause at DFARS 252.204-7012, Safeguarding Covered Defense Information and Cyber Incident Reporting) and has been scoped and negotiated by the contracting activity with the contractor and research performer and determined in writing by the contracting officer to be fundamental research (which by definition cannot involve any covered defense information), in accordance with National Security Decision Directive 189, National Policy on the Transfer of Scientific, Technical and Engineering Information, in effect on the date of contract award and the Under Secretary of Defense (Acquisition, Technology, and Logistics) memoranda on Fundamental Research, dated May 24, 2010, and on Contracted Fundamental Research, dated June 26, 2008 (available at DFARS PGI 204.4).

(b) Evaluation. The Government--

(1) Will evaluate offers in accordance with the policies and procedures of Part 225 of the Defense Federal Acquisition Regulation Supplement; and

(2) Will evaluate offers of qualifying country end products without regard to the restrictions of the Buy American statute or the Balance of Payments Program.
