QUESTION
RESPONSE
1
Will the construction manager for Phase 1 for the Consolidation of the Department of Homeland Security (DHS) at the St. Elizabeths Campus be excluded from consideration for the campus coordinator solicitation?
FAR Subpart 9.5 specifically addresses Organizational and Consultant Conflicts of Interest. This subpart prescribes responsibilities, general rules, and procedures for identifying, evaluating, and resolving organizational conflicts of interest. The scope for the Campus Coordinator will include the administration of global issues pertaining to all three (3) phases for the project. The global issues will be relative to the oversight and management of interdependent projects. At a minimum, it is expected that there will be three (3) Architects of Record (one for each phase); three (3) Construction Management Firms (one for each phase), and over one hundred Construction Contractors (large and small). Each Construction Management (CM) professional services contract is intended to perform design phase (excluding actual design), procurement phase, construction phase, reimbursable, supplemental, claims, testing, and miscellaneous services under each phase.
2
Will the campus coordinator for the Consolidation of the Department of Homeland Security (DHS) at the St. Elizabeths Campus be excluded from consideration for the Phase 2 and Phase 3 construction management solicitations?
3
SF 33 lists the proposal due date as July 1, 2010. The RFP on page 93 lists the due date as June 28, 2010. Which is correct?
Due date is July 1, will be updated.
4
Subsection L.8.2.3, Technical Proposal Contents, says that the technical proposal shall be no more than 75 pages, inclusive of the table of contents, charts, exhibits and any other materials. (1) Part One – Technical Proposal Requirements lists 8 pages of forms (for a joint venture, this would mean 16 pages of forms). (3) Part Three – Forms, requires SF 33 (plus any amendments), representations and certifications (16 pages) and GSA form 527 (24 pages for our joint venture. Thus approximately 50 of the 75 pages would be required forms. Is it GSA’s intent to limit Part Two to 75 pages or to move the form from the technical proposal to the price proposal?
75 pages are just for the Technical portion.
5
Subsection L.8.2.3, Technical Proposal Contents, and Subsection 8.2.4, Price Proposal Contents, both require SF 33 (plus amendments) and representations and certifications. Does GSA want to see both forms in both proposals?
No, just the Pricing.
6
FACTOR 2: Past Performance of Firm, page 97, references a Past Performance Questionnaire at attachment 11. The RFP currently has no attachments. Will GSA supply the Past Performance Questionnaire?
Contracting Officer will supply forms.
7
Can GSA align the key personnel titles on p. 41 with the titles used on the pricing sheets in Section B?
Yes
8
In Section H, p. 42, is the webmaster/IT specialist analogous to the IT Coordinator or the assistant IT coordinator on the pricing sheets?
Yes
9
FACTOR 3: Key Personnel, p. 90, “resumes for key personnel shall not exceed three typed pages.” Does this statement mean three pages total for five resume or three pages each for five resumes?
3 pages for each person.
10
Please define the difference between FACTOR 5: Small Disadvantaged Business Participation Plan, p. 100, with targets expressed as dollars and percentages of total contract value, and Price Proposal Tab 5, Subcontracting Plan?
See attached Sheet – SDB Participation Plan and SB Subcontracting Plan.
#10 Response to CC RFI Log #1: SDB Participation Plan and SB Subcontracting Plan Please define the difference between FACTOR 5: Small Disadvantaged Business Participation Plan, p. 100, with targets expressed as dollars and percentages of total contract value, and Price Proposal Tab 5, Subcontracting Plan?
FACTOR 5: Small Disadvantaged Business Participation Plan, (p. 100), is an evaluation factor for the participation of SDB concerns in performance of the contract.
The Small Disadvantaged Business Participation Plan addresses specifically SDBs which the US Small Business Administration defines as a small business concern that is at least 51 percent owned by one or more individuals who are both socially and economically disadvantaged. This can include a publicly owned business that has at least 51 percent of its stock unconditionally owned by one or more socially and economically disadvantaged individuals and whose management and daily business is controlled by one or more such individuals.
SBA further defines socially disadvantaged groups as those who have been, historically, subjected to "racial or ethnic prejudice or cultural bias" within the larger American culture. Identified groups include: African Americans, Asian Pacific Americans, Hispanic Americans, Native Americans and Subcontinent Asian Americans.
The Small Business Subcontracting Plan encompasses ALL small business concerns: small business (including ANCs and Indian tribes), veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business (including ANCs and Indian tribes) and women-owned small business concerns as subcontractors.
FAR 52.219-24Small Disadvantaged Business Participation Program—Targets (Oct 2000)
(a) This solicitation contains a source selection factor or subfactor related to the participation of small disadvantaged business (SDB) concerns in the contract. Credit under that evaluation factor or subfactor is not available to an SDB concern that qualifies for a price evaluation adjustment under the clause at FAR 52.219-23, Notice of Price Evaluation Adjustment for Small Disadvantaged Business Concerns, unless the SDB concern specifically waives the price evaluation adjustment.
(b) In order to receive credit under the source selection factor or subfactor, the offeror must provide, with its offer, targets, expressed as dollars and percentages of total contract value, for SDB participation in any of the North American Industry Classification System (NAICS) Industry Subsectors as determined by the Department of Commerce. The targets may provide for participation by a prime contractor, joint venture partner, teaming arrangement member, or subcontractor; however, the targets for subcontractors must be listed separately.
(End of provision)
FAR 52.219-25 Small Disadvantaged Business Participation Program—Disadvantaged Status and Reporting (Apr 2008)
(a) Disadvantaged status for joint venture partners, team members, and subcontractors. This clause addresses disadvantaged status for joint venture partners, teaming arrangement members, and subcontractors and is applicable if this contract contains small disadvantaged business (SDB) participation targets. The Contractor shall obtain representations of small disadvantaged status from joint venture partners, teaming arrangement members, and subcontractors through use of a provision substantially the same as paragraph (b)(1)(i) of the provision at FAR 52.219-22, Small Disadvantaged Business Status. The Contractor shall confirm that a joint venture partner, team member, or subcontractor representing itself as a small disadvantaged business concern is a small disadvantaged business concern certified by the Small Business Administration by using the Central Contractor Registration database or by contacting the SBA’s Office of Small Disadvantaged Business Certification and Eligibility.
(b) Reporting requirement. If this contract contains SDB participation targets, the Contractor shall report on the participation of SDB concerns at contract completion, or as otherwise pro-vided in this contract. Reporting may be on Optional Form 312, Small Disadvantaged Business Participation Report, in the Contractor’s own format providing the same information, or accomplished through using the Electronic Subcontracting Reporting System’s Small Disadvantaged Business Participation Report. This report is required for each contract containing SDB participation targets. If this contract contains an individual Small Business Subcontracting Plan, reports shall be submitted with the final Individual Subcontract Report at the completion of the contract.
