PROJECT: Construction and related services for Various Zones within the States of Arizona, California, Hawaii and Nevada

1. This Amendment is issued to incorporate revised Pages that were changed in Volumes I and II to make corrections and to incorporate response to Questions received. The changes on the affected Page are denoted in red text where the change occurred on the Page. Some of the changes include:

Volume I Revisions and Corrections--

a. Page VI - 14, Para. 6.(b)(3), FAR 52.219-14 Limitations on Subcontracting (Dec 1996); General Construction % is changed from 15 to 25% to match Para. 3.02, FAR 52.236-1 Performance of Work by the Contractor's percentage on Page VI - 20 as shown

In addition, the word "not" in the last sentence is capitalized and underlined for added emphasis. The first sentence of the paragraph after the line "NOTE: ALL PROPOSAL SHALL HAVE ORIGINAL SIGNATURES." is revised to change the number of the technical proposal submission from two (2) original copies to four (4) and the word "copies" is added as shown

g. Page VII -11, Para. 3.03(a) Content of Technical Proposal, the last sentence is revised to add reference to the "Offer Receipt Date" and to change the date denoted from "February 26, 2009" to "February 27, 2009" as shown

h. Page VII -11, Para. 3.03(a) Format of Technical Proposal is revised to denote "(b)" vice "(a)" as shown. In addition, the two paragraphs are revised to 1.) clarify the maximum number of pages if submitting a proposal for a single Tier or if submitting a proposal for both Tiers in the first paragraph, and 2.) add the word "technical" in the second paragraph's first and second line and "Table of Contents" and "Title Page" in the third line as shown.

i. Page VII -11 through Page VII - 12, Para. 3.04, PRICE PROPOSAL SUBMISSION REQUIREMENTS is new and is added to provide information instructions on the (a) Content of the Price Proposal, and (b) Format of the Price Proposal as shown

The revised pages as a result of this Amendment has been incorporated in the solicitation. Offerors are required to download the revised RFP in FedBizOps. Individual revised pages for Volumes I and Volume II will NOT be downloaded separately!

The following is Part I of the answers provided from questions received. The remaining questions will be responded to as Part II and issued under a separate amendment:

I. Regarding Forms and Exhibits:

Performance Evaluation Exhibit on page VII-29: Is the Offeror supposed to send this exhibit to the Owners' Representative shown on the Past Performance Questionnaire or is this a form used by the GSA Evaluation Team?

Answer: No. This form is to be used after award of the contract(s) and at the task order level

Are we required to submit our proof of Insurance certificate with our proposal, as per page VI-26 (7.03) and VII-28, Exhibit section?

Answer: No. This form is to be used only after award of the contract(s)

What is the Code & Facility Code, for block #14, on Form No. 1442 Do we enter this or does GSA?

Answer: Code = DUNS Number; Facility Code = Cage Code

Page VII-4, question No. 11, are we supposed to check award box, or notice to proceed or none at all?

Can you please advise if you will make the forms that require response available in a format in which our answers can be entered. The .pdf file is locked down and we were trying to enter the response electronically so it is neater and easier for you to read rather than handwritten. Thank you.

Can the government provide the experience work sheet in Word format (form VII-15) for the contractors use?

Answer: No

On Standard Form 1442 back, is there a clean copy? When we fill out the bid documents for the pricing do we use the SF 1442 and white out where it states “Lump sum offer on sample tier 1 and tier 2 projects”. Or do we use a different form?

Answer: Please see revised Page VII - 6, Amendment 01. Lump Sum price proposal shall be denoted on the revised Page VII - 8, as amended. Please refer to revised Paragraph 3, NOTE TO BIDDERS/OFFERORS

On the Past Performance and Experience information, can we fill out the forms on pages VII-15-17 or write the same information on a different sheet for at least 3 different projects? Will this information suffice for both the Past Performance and Experience evaluation factors?

Answer: Yes. Please refer to Paragraph 4.02, Reference Project Submissions Requirements to insure you submit the necessary information required

Under Technical Evaluation 4.02(1)it states "Past performance and Experience information should consist of the following, and can be submitted using the format at the end of this Section." Is the format the forms labeled

Once we have registered on ORCA, what response is needed in the “Statement of Offerors” on page VII-26?

For the Reference forms on Pages VII - 15 through VII - 17, whose name goes on the last line, Name of Project Manager, the Client/Agency Rep or the Offeror's?

II. Regarding Response Due Date for Proposals:

Original solicitation on Jan 6, 2009 shows response is due Feb. 13, 2009. Additional Instructions posted on fob.gov on Jan. 28, 2009 says the offer receipt date is Feb. 27, 2009. Please confirm if the new response date is Feb 27, 2009.

Answer: Response due date is February 27, 2009, however see IMPORTANT NOTE on last page of amendment regarding Offer Receipt Date extension to March 6, 2009.

Please confirm bid date. Specs and bid forms (vol I) show bid date of 3:00PM PST on Feb 27, 2009. Specs and bid forms (vol II) show bid date of 3:00PM PT on Feb 25, 2009. Or will the bid date be different due to additional information / amendments being provided.

SF1442 states the due date as 2/27/09 @ 3:00 pm. On page VII-11, the due date is 2/26/09. Which date is correct?

Is the Bid Date February 25th or 27th? Both dates are stated in Solicitation.

The other question is the response date of February 13, 2009---can you clarify what this date is for? Is this date the new cut-off date for additional questions?

Answer: This was the initial Offer Receipt Date when the synopsis for the requirement was posted in FedBizOps. This is NOT the new cut-off date for additional questions and there will NOT be another date to submit additional questions

I would like to confirm that the proposal submission has not changed from February 27, 2009.

Page VI-1 indicates an offer date of February 27, 2009 and page VII – 1 indicates a date of February 25, 2009: which date is correct?

Most of the solicitation states that the due date is Feb 27, 2009. However, pg VII-1 states Feb 25th 2009. I just wanted to be clear that it is Feb 27th, 2009.

Also need clarification on the bid date:

1) Solicitation showed Response Date is 2/13/09 but

2) Bid Forms showed Offer Receipt Date and Time for Volume I of II is 2/27/09 3Pm and for Volume II is 2/25/09 3pm.

When is the due date to turn in bid proposal?

Cover sheet of Volume II states Offer Receipt Date of February 25, 2009 vice February 27, 2009 in the rest of the RFP.

Page VI – 1, Offer Receipt Date and Time states the due date is February 27, 2009. Page VII – 1, Offer Receipt Date and Time states the due date is February 25, 2009. Which is correct?

There are multiple dates listed in the solication for the proposal submission deadline. I note 3 separate dates; Feb 25th, 26th and 27th. Please specify the correct due date for proposal submission.

There is a discrepancy on the actual due date for the proposal on this project. FBO.GOV has the response date as 02/13, the cover sheet on the solicitation has it listed as 02/25, and the SF1442 has it listed as 02/27. Which is the correct date?

III. Regarding Project Pricing:

Although my company is located in Zone #6, should I be using Zone #1 (Arizona), for implementing Davis-Bacon wages for the two sample projects?

Answer: Yes. The appropriate Davis-Bacon wage decision for Arizona is included with both Sample Projects

Please confirm that although the Tier 1 and 2 sample project location is noted as in Arizona that the intent is to price the work as if it were in our home zone. In our specific case, the work location is within the state of Hawaii vice figuring for travel/lodging/per diem costs to complete the work in Arizona.

Answer: Pricing of the sample projects must use the appropriate Davis-Bacon wage decision for Arizona that is included with both Sample Projects

Since we are bidding for the Hawaii zone, and the sample for the price proposal is in Arizona, are we supposed to bid on the work as if we are going to do it in Arizona?

Answer: Yes

For both sample projects, are we to use the attached Davis-Bacon wages for labor prices? Or are we to use the specific region’s (i.e. Hawaii) Davis-Bacon wages for estimating labor prices? Please advise. Thanks in advance.

Answer: Yes. Labor prices must use the appropriate Davis-Bacon wage decision for Arizona that is included with both Sample Projects

For both sample projects, the project location is in Tucson, AZ. If we are bidding in zones other than AZ, are we to assume that the project location is in the Zone we are submitting for. For example, if bidding only in the Hawaii zone, do we assume the same sample project scope/details located at local offices (Tier 1 – local Hawaii (Honolulu) Federal Courthouse, Clerk’s Office, Tier 2 – local Hawaii (Honolulu) Federal Courthouse)?

The sample projects are located in Arizona. Should we, as out-of-state contractors, include travel and per diem costs?

Will we receive an Amendment for us to provide Sample Line Item Prices, for given Descriptions of Work, for various Zones?

Answer: No. There is no Sample Line Item Prices for this requirement

Are we required to submit a construction schedule with each Sample Bid per page VII-7, section 2?

Answer: No

Per page VII-8, section 3, are we required to submit a Sample Bid for each zone we are proposing on?

Answer: No (see revised Page VII - 8, Section 3 incorporated in the RFP with this amendment)

Question: Should these proposals be prepared as if this project location was within Sierra Range Construction's project zone, or as a Zone 1 project preformed by a Zone 4 Contractor?

Answer: Zone 1. Pricing of the sample projects must use the appropriate Davis-Bacon wage decision for Arizona that is included with both Sample Projects

Am I to bid the project as if the Sample project were in my zone, or in AZ (not my zone)? An example as to where this would affect my price would be in shipping of panels to AZ versus shipping to CA. Am I to assume this is not a remote project?

Answer: Zone 1. Pricing of the sample projects must use the appropriate Davis-Bacon wage decision for Arizona that is included with both Sample Projects

To clarify, are we to "bid on the (2) sample projects? If so is this to be filed with the San Francisco office?

Answer: Only if submitting a proposal for both Tiers. Proposals shall be submitted to the address shown on revised Page VII - 8, Paragraph 5.(b) INSTRUCTIONS FOR SUBMITTING PROPOSALS

Can you clarify / expand the criteria for pricing of the sample projects as shown on page VII-8? Per page VII-7 Davis Bacon rates are to be used for each zone for consideration, so is a separate price package to be submitted for each zone?

Answer: Pricing of the sample projects must use the appropriate Davis-Bacon wage decision for Arizona that is included with both Sample Projects. Pages VII - 7 and 8 have been revised with this amendment to clarify the pricing of the sample project(s)

Thanks for returning my call. I just wanted clarify regarding the geographical areas. Does that mean for bidding purposes the work will need to be perform at the various states as well? Or where you currently reside? (Hawaii)

Answer: No. Pricing of the sample projects must use the appropriate Davis-Bacon wage decision for Arizona that is included with both Sample Projects

The pricing proposal instructions states the sample projects are to be provided in a lump sum price proposal. It then instructs to provide an itemized breakdown in sufficient detail to permit a complete analysis. Upon reading further it directs us to the SF1442 Bid/Offer sheet which states “LUMP SUM OFFER ON SAMPLE TIER 1 AND TIER 2 PROJECTS”. So what is required for the pricing proposal; page VII-8 which has the lump sum sample projects, an itemized detailed breakdown of the price, or both?

Answer: A completed revised Page VII - 8 for the Tier or Tiers that the proposal is for AND an itemized price breakdown in sufficient detail as outlined in revised Paragraph 2, BID/OFFER FOR SAMPLE TIER 1 AND TIER 2 PROJECT

Standard Form 1442, para. 17, does not provide clearly for the submittal of separate Tier 1 and Tier 2 lump sum prices. It appears to combine the prices into a lump sum offer. Can you clarify this situation?

Answer: Please see revised Page VII - 6, Amendment 01. Lump Sum price proposal shall be denoted on the revised Page VII - 8, as amended. Please refer to revised Paragraph 3, NOTE TO BIDDERS/OFFERORS

We are proposing on ZONE 1: STATE OF ARIZONA, Tier 1 and Tier 2. Are we to provide a price for the sample projects as if they are located in ZONE 1?

IV. Regarding Sample Project Specs:

Sample project Tier 2 for US Probation Office first and second floor painting and re-carpet of offices and corridors, will there be cad drawings provided?

On the sample projects for tiers 1 and 2, there were no attached plans or measurements of the scope of work. Would plans or additional information on these sample projects be supplied later?

Shall we assume that the projects are to be completed within normal working hours or shall we consider the 70-30 format in which 30% of the work will be done during off hours. The information mentioned would be needed to determine the proper price of the sample projects.

Our team just brought another question to my attention. This time it is regarding the sample project for Tier 2- (sample project # 2-0031) item item 1 enclosures A-D; items B-D are attached to the sample, however, item A (CAD Layout and details) is not attached. Was this an accidental ommision, or are we not reading the sample correctly?

I would like to confirm that these are just sample projects for our review only and not new documents that we should incorporate into our proposal package. There is some confusion on our team as to whether these sample documents do in fact change anything within the solicitation package, or that they have been posted to be viewed as samples.

Although square footage amount is provided in the specifications for the carpet, a drawing would facilitate a more accurate price proposal. (i.e. carpet seaming and layout drive the labor and waste factors) Will drawings or electronic files be provided and if so, will they be in the AutoCAD format?

Para 3.03 (a), Page VII-11, Content of Technical Proposal – Solicitation states that the technical proposal is limited to a maximum of 12 pages. The written summary must not exceed 9 pages and a min of three (3) reference projects are be submitted. Assuming we are to use the enclosed reference forms (ref 1-3, Page VII-15 thru 17, the Reference Projects will take 3 pages.

a) Is the written summary intended to be in narrative form for Factor I – Evidence of Local Office, Factor II – Past Performance, and Factor III – Experience?

Answer: It can be. The written summary should capture or be in addition to what needs to be provided for Factors 1, 2 and 3

b) Or is Factor II – Past Performance supposed to be addressed by providing performance evaluation questionnaires (using the form on Page VII-31 or similar) completed by an agency rep for the three (3) Reference Projects provided? If so, the questionnaires will take another 3 pages (assuming 3 reference projects) and therefore the Written Summary will be limited to 6 pages under the 12 page max. Is this the intent?

Answer: See response to question a) above. The form on Page VII - 31 is a postaward form and should NOT be used in the technical proposal

Should our proposals for Tier 1 and Tier 2 share the same envelopes and 12 page Technical Proposal or do you want separate proposals with separate Technical Proposals?

In the supplementary instructions page VII-11 section 3.03 (a) Content of Technical Proposal states that the technical proposal shall consist of a written summary that addresses the Offeror's past performance.

4.02 reference project submission requirements paragraph (c) on page VII-13 notes that the Government will check the references submitted.

4.02 reference project submission requirements paragraph (b) on page VII-12 notes that the Government will contact individuals and firms the Offeror has performed work to evaluate past performance and experience.

Page VII-13 Factor 2 -Past Performance states that the following items will be evaluated - 1) Quality of Work 2) Timeliness of Performance/Delivery 3) Cooperation and Business Relations 4) Customer Satisfaction/Overall Rating.

These questions support the idea that the past performance is not a part of the written summary but instead are items to be addressed by GSA through evaluations and customer / customer rep interviews for the reference projects and other sources.

Please confirm that the Offeror is not expected to address their own past performance but rather GSA will evaluate this through the reference projects and other sources including interviews with the customers / customer reps? If so, is the Offeror to provide copies of formal evaluations from the customer for the reference projects submitted?

Answer: GSA will evaluate this through the reference projects and other sources including interviews with the customers / customer reps. Therefore, Offeror is required only to submit three completed reference forms on Pages VII - 15 through

VII - 17

If evaluations are to be submitted for the reference projects, please confirm that the evaluations will not count against the 12 page maximum limit?

Answer: Submitted evaluation forms that address past performance that are in addition to reference forms on Pages VII

- 15 through VII - 17 will count towards the 12 page limitation in the Offeror's Technical Proposal

The same questions apply to Factor 3 - Experience as it relates to the Written Summary and the reference projects. In other words, is the Offeror expected to provide additional information outside of the reference projects for the Written Summary to address this factor?

If we are a JV and going after multiple zones, can we submit 3 performance questionnaires for each zone?

Answer: 3 performance questionnaires is required per Tier NOT per Zone

When we submit our proposal, what other information is necessary? Or where would I find a checklist of items needed to ensure my bid proposal meets the prerequisites?

Answer: Yes, 12 pages maximum for Tier 1 and 12 pages maximum for Tier 2

Can a contractor submit on both the Tier 1 and Tier 2 IDIQ Contracts? If so, should the Tier 1 and Tier 2 packages be submitted seperately?

Answer: Yes, if that is the Offeror's intent. Yes per instructions provided in the revised Volume II

The solicitation discusses submissions for Tier I and Tier II contracts – are separate submissions required for participation in each of the Tier levels?

Answer: Yes

The solicitation lists 8 Zones covered by Region 9 – are separate submissions required for each zone that we desire to compete in?

Answer: No

Volume II of II, Section 3.03 - Technical Proposal Submission Requirements, Paragraph (a) states "...A minimum of THREE reference projects shall be submitted, for Similar Work..." Section 4.02 - Reference Project Submission Requirements, Paragraph (a) states "Offerors should submit the following information on EACH contract performed within the past three years for Similar Work." Can you please clarify if you want us to submit every relevant project performed within the past three years or are we only required to provide a minimum of THREE project examples?

Answer: Three (3)

VI. Regarding Factor 1, Evidence of Local Office:

On page VII-13 of GS-09P-09-KSD-0031, 4.03 Evaluation Factors, Factor1 -evidence of local office "For the purpose of this solicitation, an office out of a private residence... is not considered to be a bona fide office." Is it possible to reconsider this part. I have been successfully ran & performed contracts like that of this solicitation is concerned with. I can re-assure you I am not a handyman pretending to be a contractor.

Answer: No

With regard to evidence of local office(s)--since the address will be cross checked against the address in the CCR database, how can I list any additional local offices in the CCR??-- I do not see any room to add additional offices.

Answer: One office can be listed on Block 14 of the Standard Form 1442 Back page and the remaining office listed in the Written Summary of the Technical Proposal

I hate to be a bother but can you tell me what would suffice as evidence of a local office or a bona fide place of business within a zone? Would a city business showing the office address be fine? Thanks again for your assistance.

Answer: A bona fide place of business is defined as a non-temporary office from which business is regularly conducted in the name of the Contractor. This location must be operational during regular business hours Monday through Friday.

Verification of bona fide place of business will be verified through Central Contractor Registration (CCR)

To clarify, in your evaluation of "evidence of local office", we would just provide you our office address that we operate out of in our proposal and the GSA will cross check to validate this.

Answer: Yes, through CCR and if it meets the definition and criteria of a bona fide place of business

For the various Zones - If we show ONE (as listed in CCR) office, does that mean we can only select one zone on the SF 1442?

Answer: If you are submitting a proposal in the Zone where your bona fide place of business (office) is located, then the answer is Yes. Multiple offices located in other Zones can be denoted in the written summary of the Technical Proposal if the intent is to submit a proposal for more than one Zone

Section 4.03 – Evaluation Factors / Factor 1 – Evidence of Local Office states, “the address provided will be cross checked against the CCR database.” In accessing the CCR website we discovered that the database does not offer the option to list location of other or “satellite” business offices. Please advise on how you wish to have this information documented or incorporated into the CCR database for verification cross check.

Answer: One office can be listed on Block 14 of the Standard Form 1442 Back page and the remaining office listed in the Written Summary of the Technical Proposal
