Questions
1. The Notice posted in FedBizOpps dated 5/27/10 states that the Past Performance Questionnaires should be submitted to the Government no later than 20 June 2010.
However, the RFP’s Section L.6.1 states that the Questionnaires should be submitted via a sealed/unopened envelope with our technical proposal (which is to be E-Mailed). With this earlier date of the Questionnaire submission to the Government, does this mean that the Offeror should have the references submit their completed questionnaires directly to the Government instead of first mailing them to the Offeror?
Answer: Past Performance Questionnaires are requested to be submitted by June 20, 2010 and not required by June 20, 2010. The due date for response to the Solicitation is June 27, 2010. The language referring to “sealed/unopened envelope” has been removed from the RFP.
2. There is also a conflict in the proposal due date stated in the RFP. The FedBizOpps announcement states a due date of 27 June 2010 at 11:59pm, but on page 50 of the RFP, the bottom of the page states a proposal due date of 25 June 2010. Which date is correct?
Answer: The due date is June 27, 2010. The bottom of page 50 of the RFP has been revised to “TBD”.
3. The SF 1449 is entirely blank and contains no information.
Answer: A Completed SF 1449 has been added.
4. The FedBizOps webpage indicates a proposal due date of June 27, 2010. The solicitation (page 50) indicates a proposal due date of June 25, 2010. Please clarify the correct date.
Answer: The due date is June 27, 2010. The bottom of page 50 of the RFP has been revised to “TBD”.
5. The Period of Performance specified in Section B.2.2 is 1 July through 31 May.
Please confirm that the month of June is intentionally omitted, or provide an updated Period of Performance.
Answer: Section B.2.2, the Period of Performance has been corrected to include the month of June.
6. The running header on the solicitation states “CECOM-GSA”, and Section C 5.0 refers to “the DFARS clauses included in the basic CECOM contract”. Please specify which CECOM contract is referenced, and it’s applicability to this solicitation.
Answer: The running header on the solicitation has been corrected to read CENCOM-GSA in lieu of CECOM-GSA. Section C, 5.0 has been revised as follows:
“The Governments rights in technical data and computer software is set out in the
DFARS clauses incorporated in this solicitation and may be modified by any special data or software rights clauses which appear in Section H”.
7. The solicitation makes reference to including the DFARS clauses related to Government rights in technical data and computer software that are included in the basic CECOM contract. Please advise which specific DFARS clauses are applicable.
Answer: The running header on the solicitation has been corrected to read CENCOM-GSA in lieu of CECOM-GSA. Section C, 5.0 has been revised as follows:
“The Governments rights in technical data and computer software is set out in the DFARS clauses incorporated in this solicitation and may be modified by any special data or software rights clauses which appear in Section H”.
8. Paragraph 1.7 of the Performance Work Statement (PWS) indicates that for self drive vehicles, the contractor personnel must obtain an international drivers license.
Paragraph 3.2 of the Support Plan for 24/7 USG Technical Security Team at PAF Base Shahbaz states that the PAF will allow US obtained driver’s licenses to suffice for driving permissions while personnel are on Shahbaz AB. Please confirm requirement.
Answer: International Driver’s licenses are required.
9. Solicitation refers to Government Furnished Equipment (GFE), materials, and facilities that will be provided for the execution of this contract. It appears that this GFE will be provided by the Government of Pakistan as Buyer Furnished Equipment (BFE). If a discrepancy arises on the management of this GFE/BFE between FAR clauses and Pakistan requirements, which will take precedence?
Answer: FAR Clauses
10. Clause 252.225-7040 Contractor Personnel Authorized to Accompany U.S. Armed Forces Deployed Outside the United States. Is the Shahbaz AB currently in a “Designated Operational Area”?
Answer: Pakistan is considered part of the CENTCOM Area of Responsibility.
11. The summary cost schedule shows the following: Management level employees, 10;
Force Protection Specialists, 10; Technical Specialists 15 for a total of 35. Will the Government allow for some variability in the number 35 to support a proposed concept of operations?
Answer: The identified number of 35 personnel were considered and estimate not to be exceeded. Pricing of your proposals should be based on this number. The attached power point slide will demonstrate the deployment stratification envisioned during the requirement development. Supplemental organizational proposals with less than 35 personnel will be reviewed.
12. Please provide advisement on any tax exemption that exists between the US and Pakistan that applies to the potential contract in Pakistan.
This information is essential to developing the cost volume for proposals.
Answer: There is a letter of Agreement (LOA) between the US and Pakistan. The following is an excerpt from the agreement:
D. Taxes, Duties, and Charges for Doing Business. USG and/or USG contractor contracts(s) implementing this LOA will include the clause entitled "Taxes Foreign Fixed-Price Contracts (June 2003)" set forth in Federal Acquisition Regulation Subsection 52.229-6; therefore, price and delivery estimates within this LOA anticipate the following:
1. Property, materiel, equipment, household furniture, appliances, and supplies imported into the country by USG and/or USG contractors exclusively for use in support of the USG and/or USG contractors and its personnel and consigned and marked as required or approved by the USG will be exempt from import and export duties, taxes, licenses, excises, imposts, and any other identifiable charges. The USG and/or USG contractor will maintain an inventory control and accounting system adequate to reflect the usage and disposition of all USG and/or contractor-owned property that has entered the country duty-free under this LOA.
2. The purchaser, its agencies, and political subdivisions will levy no taxes or fees (including taxes on individual or corporate income or property, customs and import duties, or other taxes on employee personal household goods, supplies and personal effects imported into the country for personal use) on the USG and/or USG contractor, its employees, or the dependents of such employees.
3. If any charges under D.1 or D.2 are imposed by the purchaser, costs thereby incurred by the USG and/or USG contractor will be reimbursed to the USG and/or USG contractor at cost, including applicable overhead and General and Administrative, but excluding profit, out of national funds to be provided by the purchaser under this LOA.
