Per the FAR, if a federal entity is not the direct purchaser of a product or service and contracts the purchasing to another entity, FAR 52.208-9, outlines that a contractor must use mandatory sources of supply or services currently provided on the mandatory procurement list.
I am writing to respectfully request, per CFR 51, FAR 8.7, FAR 52.208-
9, CFR 48, and JWOD Act 41 USC 48, you update your solicitation to insert this clause into your current listings to ensure that Contractors providing you information for the service will understand that the regulation supports usage of the procurement list products.
Furthermore, our mandatory AbilityOne products will meet your green cleaning initiatives. In fact we have worked closely with GSA and Key
Sustainable Product (KSP) initiate in which a number of mandatory
AbilityOne products were incorporated into.
I would also like to work with any future awardee to ensure compliance with federal purchasing guidelines with the AbilityOne program. National
Industries for the Blind (NIB) will allow Contractors to a federal agency who are not a authorized distributor/dealer or partner to buy for use on their service contract or on behalf of the government mandatory use
GSA has been working with AbilityOne
Commision closely to ensure the full strategy of BMO covers interests of AbilityOne and
NIB.
