SECTION B SUPPLIES OR SERVICES AND PRICES/COSTS
B.1 General
(a) The Construction Manager (CM) shall provide a variety of project management services including, but not limited to: preplanning, programming, design management, design review, procurement support, construction management, commissioning, and postconstruction support in cooperation with GSA (owner) personnel, building occupants (as GSA clients), architectengineers, and construction contractors. The CM does not perform design or actual construction work. All contracts for design and construction will be directly with GSA. The level of services required by the CM is dependent on GSA’s available resources. Services may be procured as “firm fixed price (FFP)” tasks or “time and materials (T&M)” tasks under the Orders issued via this Indefinite Delivery/Indefinite Quantity contract. A Task Order may contain both FFP tasks and T&M tasks. The price of these task orders shall include the cost for all management, supervision, labor, materials, supplies, and equipment (except as otherwise provided). Further, the CM shall plan, schedule, coordinate, and assure effective performance of all services described in the respective task order.
(b) The contract will be used to support projects, on an asneeded basis, within GSA’s Northeast and Caribbean Region (Region 2) which covers State of New York and New Jersey (Counties of Bergen, Essex, Union, Morris, Passaic, Hudson, Middlesex, and Monmouth), Puerto Rico and the Virgin Islands. GSA has a wide variety of design and construction projects within this Region involving both new construction and/or renovations of existing buildings. Some of the existing buildings are historic properties. The building types include federal office buildings, federal courthouses, border stations and other types of real property. Project sizes range from small remodeling or repair projects to multimillion dollar new buildings or major renovations of existing facilities.
(c) GSA intends to use the “Construction Management Standards of Practice” issued by the Construction Management Association of America (CMAA) in developing task order scopes of work. GSA also intends to use CMAA publications titled “Contract Administration Procedures”, “Time Management Procedures”, “Cost Management Procedures”, and “Quality Management Guidelines” that supplement the “Construction Management Standards of Practice” in developing the task order scopes of work. These CMAA documents establish industry standards of service to define the full range of construction management services without limiting the methods and procedures by which those services will be provided for a particular project or program. The documents are intended as a guide to the level of services a CM could provide. The individual task orders will specify the services to be provided. Not every task order will require every service listed in these CMAA documents. Conversely, some task orders may require unique CM services not listed in these documents.
(d) CM firms are encouraged to provide staff certified as construction managers by the Construction Manager Certification Institute sponsored by the CMAA.

B.2 Contract Type/Duration
(a) The contract will be an Indefinite Delivery Indefinite Quantity (IDIQ) contract against which task orders will be issued. The contract will consist of a base year, extending one full year (365 calendar days, 366 calendar days if a leap year occurs) from the date of contract award (As an example, if contract award occurred on January 1, 2015 to December 31, 2015), and four (4) additional one full year options, to be exercised at the discretion of the Contracting Officer, for a potential total contract duration of five (5) full years from the contract award date.
(b) Maximum Total Contract Amount
For each contract, the potential aggregate contract total over the term of the entire contract (base year and four potential option years), is $30,000,000.00.
(c) Guaranteed Minimum
The Government will order at least $2,500.00 in services during the base year of the contract. (Note: The guaranteed minimum order amount applies to the base year only.
Award of the additional option years is not guaranteed nor is there a guaranteed minimum order amount in any given option year that is exercised.). Failure to submit a proposal for any request for proposal issued during the base period in accordance with the terms and conditions of this contract will result in the contractor’s forfeiture of the guaranteed minimum amount.
B.3 Contract Task Orders
(a) All CM services will be procured through the issuance of contract task orders as requirements occur. Contract task orders will be issued using the GSA Form 300, titled “Order for Supplies and Services”.
A GSA Form 300A may be used for continuation sheets when necessary. Attachments forming part of each contract work order may also be used for lengthy statements of work, etc. All contract task orders will be priced with an appropriate dollar value and indicate a performance period for the required services. The task order performance period may extend beyond the expiration date of the current contract effective period (The end date for either the base year or exercised option years whichever is latest). Task orders, and associated modifications, must be signed by the Contracting Officer or a designated Contracting Officer’s Representative (COR) to be valid (Designated COR’s will be identified in writing at contract award). The GSA Form 300 will also be used to modify issued task orders when necessary.
(b) The hourly contract manhour rates shall be used for pricing the level of effort in each contract task order. Rates for disciplines not included in the initial contract must be priced

and incorporated by modification to the basic contract before being used in contract task orders unless adequate cost and pricing data is available to demonstrate the reasonableness of the rate/cost.
(c) Cost proposals for task orders shall typically be submitted within five (5) working days after receipt of the Government proposal request and scope of work unless a longer time is requested or granted due to the complexity of the request. Typically, the CM will be provided with a project specific statement of work with a proposal request as initiation of a task order. When authorized or requested by the Government, reimbursable incidental expenses required in connection with the work scope shall be included as part of the cost breakdown in the proposal. The price for each contract task order will be based on fixed hourly rates established in the contract for the effective period(s) when they will be performed, the negotiated level of effort for each required discipline, travel (if authorized), miscellaneous items, reproduction costs, deliverables, and all other terms agreed upon by the parties.
(d) In addition to costs and performance time, proposals submitted in response to specific task order scopes of work shall identify the proposed CM team/personnel that will be provided.
The proposed team/personnel shall be subject to Government acceptance and approval.
(See Section C and Clause H.6 for requirements regarding CM personnel staffing and assignments)
(e) When urgencies occur, the Contracting Officer may unilaterally issue contract task orders on a nottoexceed price basis and the CM is required to immediately proceed with performing all such work. Definitive pricing for such task orders shall be resolved as quickly as possible after the order is issued through negotiations between the parties.
(f) Work shall not commence in relation to a project specific task order until the task order has been signed by the Contracting Officer or their designated representative (COR). Issued task orders will serve as the notices to proceed with the corresponding work.
(g) Two Multiple Award IDIQ contracts will be awarded from this solicitation. One Multiple Award IDIQ contract shall be setaside for small businesses for projects at an estimated cost of construction of $10,000,000 or less. GSA reserves the right to compete CM services, for projects with an estimated cost of construction of $10,000,000 or less, under the unrestricted Multiple Award IDIQ if capacity or performance problems arise under the small business setaside Multiple Award IDIQ. A second Multiple Award IDIQ contract shall be awarded on an unrestricted basis to firms for projects with an estimated cost of construction of over $10,000,000. These firms will be required to respond to a Small Business Subcontracting Evaluation Factor, with preference given to firms who enter into Mentor Protege agreements (see https://www.sba.gov/contracting/governmentcontractingprograms/8abusinessdevelopm entprogram/mentorprotegeprogram ) with 8(a) companies. The Government shall award between three (3) and five (5) contracts under each Multiple Award IDIQ contract. If there are multiple awards, awardees will be given a fair opportunity to be considered for each task order over $2,500. Factors such as price, past performance on prior task orders under the contract (including quality of deliverables/services, timeliness, schedule analysis and control, business relations, commissioning, estimating, and cost control), and potential

Individual task orders may also contain incentive clauses providing for payment of additional fixed fees where predetermined performance measures are established.
B.4 Contract Executive
(a) The CM shall identify a Contract Executive who shall be responsible for the overall administration and coordination of the CM’s activities on the contract. The Contract Executive shall be the principal point of contact between the CM, and the Contracting Officer as well as the principal point of contact for task order proposal requests, contract correspondence, etc.
(b) The Contract Executive shall assume the general responsibility, on behalf of the CM, for assuring timely submission of proposals, availability of work teams, and the quality of the CM services provided.
(c) The Contract Executive shall assure that a written quarterly report is provided to the Contracting Officer beginning 3 months after contract award. The quarterly report shall summarize the contract status identifying both pending and issued task orders. The report shall also provide a summary indicating the value of the pending and issued task orders with respect to the established Maximum Order Limitation amount.
B.5 Travel
Travel will not be reimbursed except as provided in the following paragraphs:
(a) Projects requiring the services of the CM will be located with GSA’s Northeast and Caribbean Region. There will not be any reimbursement for travel to projects within a 50 mile radius of any local office areas of the CM within the Northeast and Caribbean Region.
(Note: Local offices are defined as established branch and/or home offices of the CM firm and specifically exclude temporary field offices established at project sites.)
(b) Any travel to be allowed must be authorized by the COR in advance. The allowable travel reimbursement per visit to sites in cities or locations outside of the CM’s local office areas shall be fixed based on allowable fares and per diem cost that shall not exceed the rates set forth in the Federal Travel Regulations in effect at the time the contract task order is negotiated. In addition, all travel by privately owned vehicle outside of the local office areas will be reimbursed based on Federal Travel Regulations mileage rates. Travel costs that cannot be established per Federal Travel Regulations shall be negotiated between the appropriate GSA representative and the CM and confirmed through contract modifications issued under the “Changes” clause.
(c) No travel reimbursement will be authorized unless the CM provides sufficient written evidence of costs incurred, including receipts, vouchers, or other information as may be required by the Government.
B.6 Payments

(a) Progress payments will be made on individual task orders as CM work proceeds upon submission of a signed invoice, on company letterhead, by the CM firm. The invoice must be signed by an appropriate representative of the CM firm and should also reflect the “ACT No.” assigned to the work order (in Block 4 of the GSA Form 300). Preinvoice payment meetings or discussions are encouraged to resolve any problems with the invoice and assure that payment is expedited once the invoice is received. Payment will normally be made within 30 calendar days from receipt of the invoice by the Government unless a different timeframe is specified in the task order. Upon contract award, the CM shall provide the information necessary to permit all payments to be made by Electronic Funds Transfers (EFT).
(b) Final payment for each contract task order will only be made when the services required in the order are completed and accepted by the Government. To receive final payment for each individual task order, the CM must include a completed GSA Form 1142, Release of Claims, with their final invoice. To be accepted, the GSA Form 1142 must be signed, witnessed, and affixed with either the firm’s Corporate Seal or the seal of a Notary Public.
B.7 Contract Hourly Rates
(a) The Government has specified certain Disciplines/Labor Categories required for contract performance. These are indicated in the Price Sheet for the base year and 4 option years at the end of Section B. The CM is to propose hourly rates for each discipline/labor category in the Price Sheet. The hourly rates for each discipline will be used for pricing task orders in each of the respective performance periods. Note that the GSA estimated manhours are solely for evaluation of the hourly rates contained in each offer and do not guarantee the actual work to be performed by each Discipline/Labor Category.
(b) The hourly rates proposed by the CM and accepted at contract award for each respective performance period, i.e., the base year or one of the four option years, are to be fixed for the duration of that period, including any short term extensions to the last option period not exceeding six (6) months. Hourly rates are not to exceed two decimal places.
(c) Requirements for disciplines/labor categories and/or travel to locations (outside a 50 mile radius of the CM’s local office areas) not listed in this contract, or for related special or unusual services, are classified as “miscellaneous” (See Clause B.8) services. Such services may be required by the government through contract modifications under the “Changes” clause.
(d) The contract cost principles and procedures in the Federal Acquisition B5 Regulation (FAR) at Part 31 apply to the development of the required hourly rates. The CM shall comply with these prerequisites in forming the required hourly rates for the indicated disciplines/labor categories in each time period and any pricing for additional services.
(e) In developing the required hourly rates and multiplier factors, the CM must include all allowable overhead costs to include home office support, anticipated companywide increases, fringe benefits, individual employee promotions, all direct labor costs, computer time, data entry, CADD usage, carrier/messenger services, local travel, supplies, equipment, communication services, and profit associated with this contract. increases will not be granted for any alleged omissions or miscalculations of contract pricing.
(f) The hourly rates listed by the CM and accepted at contract award will be the rates that will be used as the basis for pricing future task orders issued under this contract. The base year and each option period are to be separately priced based on the Price Sheet at the end of this section.
B.8 Miscellaneous Items
This term “Miscellaneous Items” refers to work or materials that may be required in support of the project services under task orders. Advance approval by GSA is required for these “Miscellaneous Items”. Such work, when required by the Government, will be handled as contract modifications under the "Changes" Clause.
B.9 Additional Instructions
(a) Offerors are cautioned that any offer may be rejected as nonresponsive if it is materially unbalanced as to prices for the base and/or the four optional contract periods. An offer is unbalanced when it is based on prices that are significantly understated for some work and prices that are significantly overstated for other work.
(b) Neither the CM nor its employees will be required to prepare, sign or seal any drawings or specifications as part of the contract scope of work.
(c) Offerors must propose prices for all disciplines/labor categories in order to be considered for award. Offerors may not use pricing alternatives, which differ from these instructions.
(d) The Contractor is required to provide its own computer equipment and software adequate to fully satisfy all operational requirements of this contract and task orders requiring field office operation requirements. This should be considered in developing the price proposal as no reimbursement is authorized for such items after award of the contract. This contract requires computerized capabilities of the Contractor.
NOTES:
● Basis used for hourly rates shall be 2016 per annum plus 8 holidays.
● Data development and preparation requirements will be priced using the following scheduled rates.
● If required, testimony participation will be priced using the following schedule to the extent practicable.
In order to be considered for award, please provide an hourly rate for all disciplines/labor categories in both the base and option periods.
The total evaluated price for each discipline/labor category in the following schedules is equal to the GSA estimated manhours multiplied by the cm’s proposed hourly rate.

The GSA estimated manhours are solely for evaluation of the cm offers and do not guarantee a specific level of effort to be purchased by the government nor that the corresponding labor category will be used.
The CM’s proposed hourly rates in the following schedules should reflect the home office firm fixed price rate. Offerors shall propose a discount factor for work to be performed onsite (field) and propose a discount factor for work to be performed on a time & materials basis.

SECTION C DESCRIPTION/SPECIFICATION/STATEMENT OF WORK
Scope of Work for Construction Management Services IDIQ
Services listed herein under this scope of work, may be procured either for federally owned or leased facilities in the geographic region covered by GSA Region 2 including: all of New York State, Northern New Jersey (Counties of Bergen, Essex, Union, Morris, Passaic, Hudson, Middlesex, and Monmouth), Puerto Rico and U.S. the Virgin Islands.
Services may be procured as “firm fixed price (FFP)” tasks or “time and materials (T&M)” tasks under the Orders issued via this Indefinite Delivery/Indefinite Quantity contract. A Task Order may contain both FFP tasks and T&M tasks. The work will be accomplished by either the CM’s home office staff or by staff at the project location. Furthermore, CM services may be required for an individual, standalone project or for a series of projects.
A) Project Preplanning: Programming Phase Services
Such services may include, in no particular order:
1) participate in initial planning including requirements development
2) prepare / review project management and communication plans
3) prepare / review feasibility studies
4) prepare / review site studies
5) prepare / review environmental and hazardous material studies
6) prepare / review site investigations and surveys (including archaeological, geotechnical, topographical, site utilities surveys)
7) prepare / review budget and cost estimates
8) preparation of preliminary schedules
9) cost modeling and analysis
10) cost control management
11) review / develop lease and supplementary lease agreement (SLA) requirements
12) review design intent and general arrangement drawings
13) assist with negotiations
14) assist in preparing solicitations
15) preparation of lifecycle cost analysis
16) assist in source selection activities
17) assist in site selection activities
18) perform market studies (material availability, contractor interest, etc.)
19) assist in requirements development, including consolidation of GSA and tenant agency requirements
20) assist GSA in developing quality assurance plans

6) perform quality assurance reviews
7) verify A/E maintenance of records in GSA’s ePM system
8) prepare cost estimates (including independent check estimates)
9) facilitate cost reconciliations between the CMa estimate and the A/E estimate
10) perform cost analysis including life cycle cost analysis
11) conduct / participate in Value Engineering workshops
12) analyze Value Engineering proposals
13) facilitate / participate in Value Engineering reviews
14) cost control / monitoring
15) prepare / review energy studies
16) prepare / review utility studies
17) facilitate design problem / conflict resolution
18) consolidate / track / backcheck design review comments
19) review / track design scope changes (including analysis of schedule and cost impact)
20) prepare / review / track schedules (including design and construction schedules)
21) conduct / participate in Time of Performance meetings to establish construction durations
22) facilitate / participate in all “Partnering” activities during design (workshops, meetings, etc.)
23) assist in ensuring tenant improvement and core shell requirements are clearly delineated, per the GSA PBS pricing guide, www.gsa.gov/pricingdeskguide
24) establish or monitor quality assurance and quality control activities and systems.
25) assist in requirements conformity tracking and verification (as a quality control measure).
26) verify historic preservation, environmental and sustainable requirements and review design for compliance, including tracking LEED performance

4) attending / participating in prebid conferences
5) preparing solicitation amendments
6) performing cost / bid / proposal analysis
7) conducting market research
D) Project Construction Phase Services
These services may include, in no particular order:
1) establishing temporary field offices
2) setting up job files, working folders, and record keeping systems [ePM
(electronic) and/or hard copy]
3) maintaining organized construction files
4) scheduling and conducting preconstruction meetings as well as preparing meeting minutes
5) scheduling, conducting, and documenting regular progress meetings with all interested parties to review project status, discuss problems, and resolve issues (prepare minutes, etc. for distribution)
6) handling / preparing project correspondence to respond to the parties involved with each project, confirm verbal discussions / directives, document actions taken and decisions made, etc
7) preparing and maintaining daily diaries for project activities noting events affecting construction progress (weather, manpower, site equipment, work performed, etc.)
8) managing the submittal review process including maintenance of submittal logs
9) verify contractor maintenance of records in GSA’s ePM system
10) review and monitor contractor’s quality assurance plan
11) reviewing all construction submittals for compliance with green purchasing requirements (e.g. product cut sheets, manufacturers’ data) as specified in the design, including checking for material characteristics, third party certifications, VOC levels, etc.
12) reviewing waste diversion submittals for accuracy with the requirements as specified in the design, including checking for Waste Hauler Receipts, monthly C&D Waste Management Reports, and Certification of Recycling/Reclamation.
13) performing inspections of construction as work proceeds, taking action to identify work that does not conform to the contract requirements, and notifying the contractors and the government when work requires correction

14) compiling through site inspections lists of defects and omissions related to the work performed and providing these lists to the contractor for correction
15) reviewing and monitoring of project schedules against construction progress with emphasis on milestone completion dates, phasing requirements, work flow, material deliveries, test dates, etc.
16) timely administration and management of construction contract change orders (drafting proposal requests, reviewing and preparing scopes of work, preparing cost estimates, preparing GSA Form 2437 (Findings of Fact), reviewing cost proposals, assisting GSA in preparing government negotiation positions, assisting and participating in negotiations, documenting negotiation discussions, preparing change order packages for GSA’s signature and processing)
17) leading problem resolution and handling of disagreements between parties (including development of the Government’s position)
18) maintaining marked up sets of project plans and specifications for future asbuilt drawings
19) reviewing construction contractor payment requests (including preparation of necessary forms for signature and payment processing by GSA)
20) monitoring project financial data and budgetary cost accounting (Maintain spreadsheets indicating project fund allowances, obligations, payments, balances, planned expenditures, etc.)
21) monitoring construction contractor compliance with established safety standards (note and report unsafe working conditions, failures to adhere to safety plan required by construction contract)
22) monitoring construction contractor’s compliance with contract labor standards (including performing site labor interviews, collecting, reviewing, and maintaining weekly payrolls for all project contractors and subcontractors, reporting potential wage violations to GSA personnel)
23) coordination of construction activities with Building Managers, occupying agency personnel, Operations and Maintenance contractor personnel and Custodial contractor personnel.
24) managing the design and construction clarification process and, when appropriate, reminding the A/E and other parties involved of the need for timely actions
25) participation in and/or facilitating “partnering” activities during construction (workshops, meetings, etc.)
26) preparing special reports and regular project status reports
27) providing for progress and/or final photographs of project work
28) performing site surveys using a registered surveyor (establish building lines, elevations, approaches, utility locations, etc.)
29) providing drafting services with CADD support (asbuilt drawings, survey layouts, utility plans)
30) providing assistance in obtaining permits
31) perform hazardous material assessments and monitoring of hazardous material abatement work
32) managing project closeout activities
33) providing cost estimating

34) observing activities and reviewing documentation leading to Leadership in Energy & Environmental Design (LEED) certification.
The Government reserves the right to procure construction and demolition waste audits of specific construction projects via this CM contract vehicle upon request. Pricing for this service shall not be included in the base CM IDIQ price, but rather shall be negotiated at time of Government's request.
E) Commissioning Services
These services shall include providing professional and technical expertise for startup, calibration, and/or certification of a facility or operating systems within a facility. The CM must be able to provide complete, comprehensive commissioning services from design through construction and postoccupancy.
Commissioning services may include, in no particular order:
1) startup planning
2) forecasting startup duration
3) estimating startup costs
4) determining startup objectives
5) organizing startup teams and team assignments
6) testing building system components
7) conducting performance tests
8) obtaining O&M material
9) conducting, scheduling and/or supervising O&M training
F) Testing Services
Provide access to the services of an independent testing agency / laboratory to perform project specific quality control testing and inspection services during any of the phases listed above or as an independent activity.
The services may include, but are not limited to, testing/inspection of soils, concrete, precast concrete, precast concrete connections, steel, steel decking, applied fireproofing, roofing, waterproofing, curtain walls/glazing, elevator installations, masonry, pipe metallurgy and wall thickness, asbestos containing material, lead base paint and hazardous materials.
G) Claims Services
Provide technical support (not legal assistance) in handling disputed matters once a contractor has made written demand for payment or other relief under the contract and submitted it to the Contracting Officer for decision in accordance with the Disputes Act of 1978. In relation to Claims Services, the CM will review disputes and claims from the construction contractor(s) and render all assistance that the Government may require, including, but not limited to, the following:

1) Furnishing reports with supporting information necessary to resolve disputes or defending against the claims
2) Preparation and assembly of appeal files
3) Participation in meetings or negotiations with claimants
4) Appearance in legal proceedings
5) Preparation of cost estimates for use in claims negotiations
6) Preparation of risk assessments/analyses relative to claim exposures
7) Preparation of findings of fact and any other documentation required by the
Government
H) Post Construction Services .
Post Construction services may include, in no particular order:
1) Performing Post Occupancy Evaluations (POE’s)
2) Assisting GSA in the formulation of lessons learned
3) Providing occupancy planning including development of move schedules, cost estimates, inventory lists, etc.
4) Providing move coordination and/or furniture coordination
5) Providing telecommunication and computer coordination
6) Providing security system installation coordination
7) Providing assistance in the evaluations of A/E and/or Contractor performance.
I) General Services:
During the life of the contract, the CM may be tasked to provide services not related to a specific project. These services may include, but are not limited to:
1) Providing special consultant or special inspection services, such as assessments of hazardous materials, an Industrial Hygienist to monitor removal of hazardous material, a historic preservation consultant to review historically significant matters in existing buildings, etc.
2) Performing special studies and/or updates to prior studies
3) Performing other specialized services such as updates to master or environmental plans, interior space planning, existing site surveys, site models, etc.
4) Providing move coordination of tenant relocation
5) Providing photographic records beyond the normal scope of presentation and inspection services required
6) Providing expertise as required in unusual situations from specialty disciplines, such as expert testimony for hearings, etc.
7) Providing certification services of trade societies, institutes, organizations, etc.
8) Providing scheduling and/or estimating services for other GSA functions
(leasing projects, etc.)
9) Providing expertise, not design, in areas such as sustainability, fire safety, physical security, geotechnical, seismic safety, historic preservation, moisture control, accessibility, building automation, materials evaluation, etc

10) Ensuring the technical soundness of government and/or contractor provided supplies and/or services/processes and decisions through the review, oversight and management of services, construction and/or lease projects, including assessment of contractor performance to ensure services provided meet contracts specifications as well as business and workplace needs
11) assisting with the administration of A/E design contract task orders (drafting A/E design proposal requests, assisting with the preparation of Independent Government Estimates (IGEs), assisting with the review of A/E cost proposals, assisting GSA in negotiations)
11) Administration of design build construction contract orders (drafting design build proposal requests, preparing cost estimates, reviewing cost proposals, assisting GSA in negotiations)
12) Provide support during the drafting of construction contractor performance evaluations
J) Electronic Project Management (ePM):
GSA requires the use of ePM throughout the project life cycle as a repository for timely and accurate project information, and to serve as a tool to manage and monitor progress and modifications. Use ePM to post all project information, including sensitive but unclassified (SBU) documents, and communications. Review and collaborate with the Project Delivery Team and GSA using, but not limited to, ePM system features and workflow processes.
