About this file

This document is a set of contract stipulations and operating plan guidelines for gravel pit operations in the Superior National Forest, dated March 2023. The materials cover detailed requirements for mineral material extraction, including operational constraints such as permitted mining methods, equipment usage, timber removal, topsoil management, and environmental protection measures. Key stipulations include using only front-end loaders for mining, maintaining a minimum 15-foot clearing around the working pit face, stripping and stockpiling topsoil, preventing erosion, and ensuring proper equipment marking and removal.

The document includes operating plan outlines for two specific sites - the Assinika Pit and Portage Brook Pit - which require comprehensive documentation on company details, pit location, operation type, equipment, environmental protection measures, and reclamation plans. Accompanying site maps show the current and proposed pit areas, with the Assinika Pit expanding from 3 to 9 acres and the Portage Brook Pit reducing from 8 to 4 acres. Special use permits are required for long-term storage of finished products, batch plants, and secondary processing facilities. The guidelines emphasize strict adherence to Forest Service regulations, environmental conservation, and safe operational practices.

GREENWOOD AREA ERFO REPAIRS

GRAVEL PIT STIPULATIONS, OPERATING PLAN OUTLINE, AND

PIT MAPS

Superior National Forest Minerals March 2023

Appendix B: Contract Stipulations

OPERATIONS

1. All permitted operations shall be conducted in accordance with any operating plan that has been attached to the permit and approved to the Forest.

2. All operations shall be conducted consistent with the pit management plan, if applicable.

3. A contract or permit limits the onsite processing of mineral materials to the first salable product. The first saleable product is unwashed crushable material, unless the highest and best use of the material is alternately defined in a pit management plan. Additional onsite processing may be authorized with an operating plan or special use permit.

4. All material must be paid for prior to removal unless installments are explicitly authorized.

5. Only front-end loaders can be used for the mining of material. Mining with an excavator is allowed only if approved by the pit management plan or the authorized officer.

6. At the conclusion of operations, vegetation and trees at the top of the deposit shall be cleared and grubbed to a minimum of 15 feet from the working pit face.

No undercutting shall be permitted during operations and no overhangs shall be left on the working pit face.

7. Topsoil shall be stripped a minimum of 15 feet beyond any working face and stockpiled in areas indicated on project map, or as otherwise approved or directed by the Authorized Officer. The operator shall take appropriate measures to prevent and protect soils from erosion. Additionally, measures shall be taken to prevent erosion of stockpiled topsoil such as use of native seed mix.

8. Standing timber shall not be ‘caved’ into the pit. Standing timber must be purchased, felled, and removed prior to mining operations.

9. Permittee will secure appropriate timber permits, if needed, before operations begin. Timber will not be removed beyond the perimeter specified by the authorized officer.

10. Slash, brush, and non-merchantable timber cleared from the pit area shall be stockpiled in locations designated or approved by the Authorized Officer.

11. No material from the pit area shall be dumped into standing timber.

12. No material shall be buried in the pit area unless approved by the Authorized

Officer.

13. Mining of materials outside the approved extraction or permit area, shall be considered trespass.

14. Any equipment left on-site for the duration of the permit or contract shall be properly marked (e.g., placard in a window, stenciled on the equipment, etc.) with the operator/owner’s name and contact information.

15. No equipment or materials will be stored at any mineral material site for longer than the duration of the permit. Long-term storage of mineral materials in not allowed unless authorized under a special use permit, operating plan, or by other exception.

Ownership of all stockpiled material must be clearly marked. Ownership of material stored beyond the time allowed by permit, contract, or other exception will revert to the Forest Service (36 CFR 228.43(d)).

16. During operations, trash shall be stored in suitable containers and removed from the contract area for disposal in accordance with State and other local laws.

17. Cultural surveys have been conducted in the project area, if, during the course of operations, any artifact, cultural feature, or other archeological items are discovered, the Forest Service shall be notified and operations shall be immediately ceased, so that the potential significance of the found material can be assessed and a possible mitigation plan prepared. No mining is to occur within 5 feet of the water table.

18. Clean all heavy equipment and other vehicles before transporting them onto National Forest System lands. Concentrate inspections and cleaning on the undercarriage, with special emphasis on inspecting and cleaning the axles, frame, cross-members, motor mounts, underneath steps, running boards, and front bumper/brush guard assemblies. Sweep the vehicle cabs and deposit refuse in waste receptacles. The permittee shall contact the Forest Service so we can verify that equipment has been cleaned prior to transport onto National Forest System lands.

19. If any listed species or key habitat feature (wolf or lynx den, nest etc.) is found in the project area, the permittee shall contact Forest Service immediately to determine the appropriate course of action.

20. The Authorized Officer shall be notified in advance of any deviation from an approved operating plan. Any changes shall be submitted as an amendment to the operating plan and must be approved--in writing--by the Authorized Officer before any operations re-commence. Amendments shall include the reason for the changes, detailed descriptions of the proposed changes, and any necessary maps or diagrams. All operations conducted in advance of approval of an original, revised, or amended operating plan, or which are not in accordance with an approved plan, constitute violations of the terms of the permit and are grounds for revocation of the permit and potentially deemed a trespass.

21. Where applicable, the operator shall provide copies of all permits obtained from State or Federal agencies pertaining to operations prior to implementation.

22. No permanent or temporary structures or facilities shall be built unless approved under an operating plan or contract.

SAFETY

23. All vehicles, heavy equipment, and chain saws shall have appropriate spark arresters and be equipped with or have fire extinguishers in close proximity.

24. All operations utilizing motorized equipment shall have an appropriate spill response plan and spill response kit. Measures shall be taken to avoid environmental contamination (e.g., dual containment for on-site fuel storage).

25. No explosives or firearms are allowed in the contract area unless approved by the Authorized Officer.

26. The Authorized Officer shall be given advanced notification of any activity that could involve hazards to public safety and suitable actions will be taken to protect the public.

REPORTING

27. All commercial contractors shall submit a production verification log (weight, truck count, or other authorized measurement) to the Forest Minerals Staff within 14 days of the permit expiration.
