JUSTIFICATION AND APPROVAL (J&A) FOR USE OTHER THAN FULL AND OPEN
COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) Norfolk
2 Description of the Action Being Approved: This is a sole source justification for work to be provided under Work Items (WIs): 0201, 0287, 0293, 0451, 0452, 0453, 0454, 0455, 0458, 0459, 0482, 0483, 0508, 0510 0546, 0557, 0562, 0569, 0574, 0581, 0592, and 0598 of the Statement of Work (SOW) for the Mid-Term Availability (MTA) of the USS GRASP (T-ARS 51) under request for proposals (RFP)
N32205-20-R-7008. This Justification is covering only the portion of the acquisition, which anOriginal
Equipment Manufacturer (OEM) Authorized Facility / Manufacturer / Representative is required and the approval level requirements will then only apply to that portion. The justification applies to sole source, limited source and brand names only as indicated. Where an OEM has qualified additional companies to service the OEM’s equipment, this justification will embrace those companies as well.
This justification does not preclude brand name or equivalent products where an OEM is not the sole source, but venders must proffer independent technical and engineering analysis sufficient to support assertion of equivalence, as MSC lacks the technical equipment and staff to perform suchanalysis.
3 Description of Supply Services: MSC Norfolk requires OEM authorized technical field representatives and OEM parts to accomplish requirements of WIs listed below. The estimated combined dollar value of the twenty (20) Work Items is that will be funded utilizing FY 21 Operation &
Maintenance funds.

4 Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304 (c)(2)
When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
5 Rationale Justifying Use of Cited Authority:
a. WI 0202, Reduction Gear, Clutch and Brake Inspection
This work requires a David Brown and Eaton Airflex authorized service representative to service the reduction gear, clutch and brakes of the main propulsion system. The reduction gear, clutch and brakes are critical equipment per SMS #10.6-002-01-ARS. Per COMSC INSTRUCTION
4490.1, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause failure of the main propulsion system and loss of propulsion power generating capability at sea, leading to increased risk to the ship and crew. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company.
Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
b. 0287, CSI_Automation & Propulsion Control Inspection
This work requires an authorized OEM technical representative to inspect, service, test, and repair the machinery control system automation and propulsion control systems. The propulsion control systems are critical equipment per Safety Management System (SMS) T-ARS Critical Equipment
List 10.6-002-01-ARS. Per COMSC INSTRUCTION 4490.1, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment classified as “critical.” Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. A loss of automation and propulsion control results in loss of propulsion control which when at sea affects crew and vessel safety. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the
OEM service and replacement parts.
c. WI 0293, CSI_Main Propulsion Diesel Engine – Minor Overhaul (10,000 Hours)
This work requires a Caterpillar authorized service representative to service the Ship Service Diesel
Engines. The diesel engines are critical equipment per SMS #10.6-002-01-ARS. Per COMSC
INSTRUCTION 4490.1, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as
“critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause failure of the Ships Service Diesel Engines and loss of propulsion power generating capability at sea, leading to increased risk to the ship and crew. OEM-authorized Representatives will only install genuine
OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. d. WI 0451, Annual Radar Service (1 YR)
This work requires a Furuno technician to service the ship's Furuno Marine Radars. The radars are critical equipment per SMS #10.6-002-01-ARS. Only qualified service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly installed or deficient parts could cause system failure and loss of navigation at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
e. WI 0452, CSI_Annual ECDIS Service
This work requires a Sperry technician to service the ship’s ECDIS Vision Master. The ECDIS is critical equipment per SMS #10.6-002-01-ARS. Per COMSC INSTRUCTION 4490.1, an OEM or
OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM-authorized serviceand parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure and loss of navigation at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within theauthorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. f. WI 0453, CSI_Annual GYRO System
This work requires the supply of a Sperry technician to service the ship’s main gyro compass, model MK27F. The gyro compasses are critical equipment per SMS #10.6-002-01-ARS. Only qualified service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure and loss of navigation at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company.

g. WI 0454, CSI_Annual VDR Recertification
This work requires a Manufacturer’s Authorized Technical Representative IAW ABS recognized external specialists to service the ship’s voyage data recording (VDR) equipment. The VDR equipment is critical equipment per SMS #10.6-002-01-ARS. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure and loss of communication at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. h. WI 0455, CSI_Annual Radio Communication Equipment Certification
This work requires a Manufacturer’s Authorized Technical Representative IAW ABS recognized external specialists to service the ship’s radio communication equipment. The radio equipment is critical equipment per SMS #10.6-002-01-ARS. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. i. WI 0458, CSI_Whip Antenna Maintenance (1 x 5 Years)
This work requires a Manufacturer’s Authorized Technical Representative to inspect and service the ship’s Whip Antennas. The Whip Antennas are critical equipment per SMS #10.6-002-01-ARS.
Only qualified service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure and loss of

j. WI 0459, CSI_Echo Sounder Service
This work requires a Manufacturer’s Authorized Technical Representative to inspect, service, test, and repair the ship’s ECHO Sounder systems, used for diver communication. Only qualified service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services.
Incorrectly, installed or deficient parts could cause system failure and loss of Communications at sea. Qualified Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company.

k. WI 0482, CSI_Windbird Calibration (Annual) and repair the ship’s Belfort Windbird system. Only qualified service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure and [loss of full navigation capabilities at sea]. Qualified

l. WI 0483, CSI_TVDTS System Servicing
This work requires a qualified electronics technician trained on the maintenance and overhaul of the ship’s TVDTS system. The TVDTS provides entertainment for the Crew onboard the vessel.

m. WI 0508, Bow Thruster Repair
The work item requires the supply of Brunvoll OEM parts and technical representatives for the servicing the USNS Grasp’s Model SPI-VP 500 Bow Thruster. The Bow Thruster is listed as critical equipment in SMS Form T-ARS Critical Equipment List 10.6-002-01-ARS. Per COMSC
INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment classified as “critical.” Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. The loss of Bow Thruster can cause loss in propulsion maneuverability and stop missions at sea. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required
n. WI 0546, CSI_Air Regulator Valve Refurbishment (1 x 30 Months) and repair the ship’s High Pressure Regulating Valve Manifolds. Only qualified service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure and loss of Communications at sea. Qualified

o. WI 557, CSI_Inspect, Test and Certify Deck Cranes (1 x 5 Years)
This work requires an OEM authorized service facility and technical representative to service the ship’s deck cranes. Only qualified service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure and loss of Communications at sea. Qualified Representatives will only install genuine

p. WI 0562, CSI_SCBA Annual Inspection
This work requires a recognized service facility and technical representative IAW ABS recognized external specialists to service the ship’s Self-Contained Breathing Apparatus (SCBA) equipment.
The SCBA equipment is critical equipment per SMS #10.6-002-01-ARS. Per COMSC
INSTRUCTION 4490.1, an ABS Recognized specialist is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause SCBA equipment failure and loss of firefighting capability at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
q. WI 0569, CSI_Fire and Smoke Detection and Alarm System (Annual)
This work requires an OEM authorized technical representative to service the ship’s Fixed and
Smoke Detection and Alarm System, which is critical equipment per SMS #10.6-002-01-ARS. Per
COMSC INSTRUCTION 4490.1, an ABS/Coast Guard recognized specialist is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”.

Door and Shutters. The Fire Doors and Shutters are a watertight boundary and are critical Mission
Equipment per SMS #10.6-002-01-ARS. Per COMSC INSTRUCTION 4490.1, an ABS/Coast
Guard recognized specialist is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause firefighting equipment failure and loss of firefighting capability at sea.

This work requires a Caterpillar authorized service representative to service the Ship Service Diesel
Engines. The Main Propulsion Diesel Engines are critical equipment per SMS #10.6-002-01-ARS.
Per COMSC INSTRUCTION 4490.1, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause failure of the Ships Service Diesel Engines and loss of electrical power generating capability at sea, leading to increased risk to the ship and crew. OEM-authorized Representatives will only install genuine
OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not

4. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The requirement has been synopsized at the Government Point of Entry (GPE), FedBizOps website, and the
Government intends to post a Request for Proposal (RFP) along with this justification at the GPE with the intent of awarding a firm-fixed price contract to the lowest price offeror. Any prospective contractor will be required to use the OEM or OEM Authorized vendor as a subcontractor to perform the work in the related WIs.
5. Determination of Fair and Reasonable Cost: The Contracting Officer will determine theanticipated cost to the Government of the supplies/services covered by this J&A willbe fair and reasonable.
6. Actions to Removed Barriers to Future Competition: For reasons set forth in Paragraph 5, MSC has no plans at this time to compete future contracts for the types of services covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible. If the prime contractor identifies an alternate source fully qualified by technical expertise, experience, and access to OEM parts and technical data, the prime contractor must submit its analysis and documentation supporting the alternate source to the Contracting Officer not later than N32205-20-
R-4100.
