About this file
This document is a Question and Answer Matrix for the North Warning System (NWS) Heavy Fixed Wing (HFW) Airlift Services recompete contract. The solicitation is a US Government contract anticipated to be issued via Full and Open Competition. The requirement involves airlift services with specific airworthiness and operational requirements, particularly for defense-related services involving aircraft operations in challenging environments.
Key details include a focus on aircraft certification, with the Performance Work Statement (PWS) specifying that contractor aircraft will be considered military aircraft and operate under a Temporary Authority to Operate (TAO) during DND/CAF-tasked operations. The current incumbent is Canadian Commercial Corporation. The contract requires aircraft capable of meeting payload and short-runway requirements, with flexibility around FAA certification standards (potentially allowing Part 91-operated aircraft). The Government seeks clarification on airworthiness standards and is open to various aircraft configurations that can meet operational requirements for North Warning System heavy fixed-wing airlift services.

Q# Document Pg # Paragraph Comment/Question Disposition
1 Sections L&M N/A N/A
Given the recompete nature of this requirement — and the fact that industry is already familiar with the mission and scope — we respectfully recommend considering opportunities to streamline or further clarify Section L to maintain traceability while preserving ease of interpretation for offerors.
It is not in the Government’s best interest to streamline sections L & M.
Therefore, to ensure that we receive proposals that appropriately meet the requirement, we need a more detailed L & M.
2 PWS Pgs 9-10 14 and subparagraphs
We would like to request clarification on the Air Operator Certificate requirement as it relates to the airworthiness and operational framework described in the Performance Work Statement (PWS).
Section 14 of the PWS clearly states that, while performing defence-related services for DND/CAF, contractor aircraft are considered military aircraft for the purposes of the Aeronautics Act and will operate under a Temporary Authority to Operate (TAO), which replaces the civil Certificate of Airworthiness and Air Operator Certificate during DND/CAF-tasked operations.
At the same time, Section 14.5 references holding an AOC issued under FAA Part 119, 121, 125, or 135 as one method by which DND/CAF may give credit during the TAO assessment.
Given that:
•The PWS places airworthiness and operational oversight with DND/CAF through the TAO, •The TAO explicitly replaces civil flight authority for the duration of defence-related services, and;
•Ex-military aircraft capable of meeting the payload and short-runway requirements cannot practically operate under FAA Part 121 or 125.
Can the Government confirm that FAA Part 91-operated aircraft are acceptable for this requirement, provided the contractor successfully obtains a DND/CAF Temporary Authority to Operate and meets all applicable airworthiness, safety, and operational requirements under the DND/CAF framework?
The references of FAA Part 119, 121, 125, or 135 are example certificates provided within the PWS. The Government cannot confirm and accept a specific FAA certificate; it is the offeror’s responsibility to hold valid certificate(s) that meets all applicable airworthiness, safety, and operational requirements to operate in Canada as determined by the NAV Canada.
3 Synopsis N/A N/A Will this be a US government or Canadian government contract? This will be a US Government Contract.
4 Synopsis N/A N/A Can GSA US Brokers bid this? The Government anticipates issuing the request for proposal via Full and Open Competition.
5 Synopsis N/A N/A Can a US 14 CFR Part 121 Air Carrier be a subcontractor? The Prime Contractor is responsible to ensure performance (including any subcontractors) meets all of the NWS Heavy Fixed Wing requirement.
6 Synopsis N/A N/A The incumbent is Canadian Commercial Corp, which does not appear to be an airline. Is it possible to know what airlines are flying this?
All information regarding the current NWS Heavy Fixed Wing requirement (contract FA489021C0011) can be found online (e.g. SAM.gov, Federal Procurement Data System, etc.).
