ADDENDUM TO 52.212-2 – EVALUATION –
COMMERCIAL PRODUCTS AND SERVICES (NOV 2021)
1.0 BASIS FOR AWARD
Award will be made to the responsible Offeror whose proposal has the best rated technical solution for the price that is complete, reasonable and balanced, with a realistic PECP.
The Government will determine best value using tradeoff procedures, in which Technical Capability is significantly more important than Cost/Price. In doing so, the Government will determine the most advantageous offer, thus accepting other than the lowest priced Offeror. This may result in an award to a higher technically rated, higher priced Offeror, where the decision is consistent with the evaluation factors, and the Contracting Officer reasonably determines that the technical approach of the higher priced Offeror outweighs the price difference.
The Government intends to award one Firm-Fixed Price Blanket Purchase Agreement to the responsible Offeror who can provide the best value to the Government considering price and non-price factors.
The Government will review all documents for compliance. When all requested documents are received and confirmed compliant, then the Offeror’s proposal package will be submitted for evaluation.
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
2.0 EVALUATION METHODOLOGY
2.1 Evaluation Factors
The following evaluation factors will be used to evaluate each proposal:
Volume I – Administrative Submission
Volume II – Factor I – Technical Capability:
• Subfactor I: Technical Approach
• Subfactor II: Staffing/Management Approach
Volume III – Factor II – Price
Technical proposals will be evaluated based on a streamlined methodology IAW FAR 16.5. The Offeror’s price proposal will be evaluated for completeness, fairness and reasonableness, and balance. PECP will be evaluated for realism. Only proposals determined to be complete, fair, reasonable, and balanced, with a realistic PECP will be eligible for award.
2.2 Evaluation Process
The first step of the evaluation process is the Government will review all proposals to ensure compliance and completeness. Proposals determined compliant and complete will be forwarded to the technical evaluation team and the price evaluation team.
The second step of the evaluation process is to evaluate the technical and price elements of the Offeror’s proposal. The Government will conduct an immediate comparison of offers received, IAW the evaluation factors as provided. Independent scoring will not be used.
The Government intends to evaluate proposals and award a contract without interchanges (see paragraph 2.2.1) with Offerors. Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a technical and price standpoint.
2.2.1 Interchanges
Interchanges are fluid interaction(s) between the Contracting Officer (CO) and the Offerors that may address any aspect of the proposal and may or may not be documented in real time. The Government intends to make award based on the initial proposal submissions without conducting interchanges.
Therefore, each offer should contain the Offeror’s best terms from a cost/price and technical standpoint.
However, the Government reserves the right to hold interchanges using Interchange Notices (INs) if, during the evaluation, it is determined to be in the best interest of the Government. Offeror responses to INs will be considered in making the order selection decision. Interchanges may be conducted with one, some or all Offerors as the Government is not required to conduct interchanges with any or all Offerors responding to this RFP.
Once the Government determines the Offeror that is best-suited to meet stated requirements, the Government reserves the right to communicate with only that Offeror to address any issues, if necessary, and finalize an order with that Offeror. If the parties cannot successfully resolve outstanding issues, as determined pertinent at the sole discretion of the Government, the Government may communicate with the next best-suited Offeror, based on the original analysis and address any necessary issues with that Offeror. If the government begins interchanges with the next best-suited Offeror, no further interchanges with the previous Offeror will be entertained until after order award. This process will continue until an agreement is successfully reached and an order is awarded.
2.2.2 Proposal Revision Opportunity Notices (PRON)
If required (based upon interchanges discussed above), the Offerors will provide proposal change pages along with its Interchange Notice responses for any aspect of the proposal that will be incorporated into the awarded contract. After interchanges are completed Offerors will not be given any further opportunity to submit proposal revisions. The Government reserves the right to request Proposal Revisions from all, some or none of the Offerors.

4.0 EVALUATION CRITERIA: VOLUME II – TECHNICAL APPROACH
The Government will evaluate both subfactors to determine an overall rating for Factor 1 Technical Approach. During the evaluation of each proposal, the Government will assign each subfactor a rating as shown below. Offerors must receive an acceptable rating on each element within the subfactors in order to be considered technically acceptable under those subfactors. A rating of unacceptable in one subfactor will constitute an overall rating of unacceptable for
Factor 1 Technical Approach.
The following ratings will be utilized:
TECHNICAL APPROACH RATINGS
Rating Description
Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths.
Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength.
Acceptable Proposal indicates an adequate approach and understanding of the requirements.
Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements.
Unacceptable Proposal does not meet requirements of the solicitation and, thus, contains one or more deficiencies and is unawardable.
Strength: An aspect of an offeror’s proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.
Weakness: A flaw in the proposal that increases the risk of unsuccessful contract performance.
Significant Weakness: A flaw that appreciably increases the risk of unsuccessful contract performance.
Deficiency: A material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
4.1 Subfactor 1: Technical Approach
The Government will evaluate the extent of which the Offeror’s proposal for their experience and expertise required to perform the entire range of tasks in the PWS. Offeror’s proposal will provide information pertaining to experience performing major/critical aspects is feasible, and meets or exceeds the requirements described in PWS.
This requirement is met when the Offeror’s proposal sufficiently demonstrates all of the following standards below:
A comprehensive, feasible, and efficient approach to meeting and accomplishing the objectives, conditions, and requirements of each task of the PWS:
a. Task 1 Introduction to PPBE Course.
b. Task 2 PPBE Executive Course.
c. Task 3 Program and Budget Review (PBR) Course.
d. Task 4 Testing.
e. Task 5 Make -Up and Ad Hoc Courses.
f. Task 6 Electronic Student handouts and Other Instructional Material.
g. Task 7 Program Management.
4.2 Subfactor 2: Staffing/Management Approach
Staffing Approach. The Government will evaluate the Offeror’s proposal for their capability to staff, recruit, retain, and replace personnel with the experience and expertise required to perform the entire range of tasks in the PWS. This requirement is met when the Offeror’s proposal sufficiently demonstrates all of the following standards below:
Acceptable degree of relevance, comprehensiveness, and effectiveness of the stated qualifications, experience, skills, and roles of personnel to meet the requirements and support the Offeror’s technical and management approaches.
Acceptable rationale for projected staffing and approach to how each task and subtask is staffed to include estimated hours and labor mix of the personnel, their expected work location, clearance level, and functional knowledge.
Acceptable methodology to hiring, retaining, and replacing appropriately qualified personnel throughout the life of the contract.
Management Approach The Government will evaluate the Offeror’s proposal for their capability of managing their personnel and subcontractors/teaming partners (if applicable), their approach to efficiently and proactively manage the PWS requirements, and how they will provide the Government visibility into the PWS tasks.
This requirement is met when the Offeror’s proposal sufficiently demonstrates all of the following standards below:
Acceptable relevancy and comprehensiveness of the Offeror’s proposed management approach including an assessment of the degree to which it reflects an effective, efficient, feasible, and practical level of understanding of the operating environment in accomplishing the tasks and deliverables of this TO from a management perspective with minimal risk.
Acceptable effectiveness, relevancy, and practicality of the Offeror’s methodology to ensure clear lines of authority and communication within the Offeror’s team and between the Offeror’s team and the Government, for timely problem identification, mitigation, and resolution.
5.0 EVALUATION CRITERIA: VOLUME IV – COST/PRICE
The Offeror’s price proposal will be evaluated for completeness, fairness and reasonableness, and balanced. PECP will be evaluated for realism. Only proposals determined to be complete, fair, reasonable, and balanced, with a realistic PECP will be eligible for award.
Total Evaluated Price (TEP): The proposals will be evaluated on the total evaluated price (TEP).
TEP will be calculated as follows: TEP = Base Period CLINS + Option Period 1 CLINS + Option Period 2 CLINS + Option Period 3 CLINS + Option Period 4 CLINS. The TEP consist of all CLINS, Optional CLINS and the NTE CLINs for the contract’s period of performance.
Submission of certified cost or pricing data is not required; however, if the cost information is needed by the Contracting Officer to determine a fair and reasonable price, the offeror shall submit the other than certified cost or pricing data as requested. Evaluation of the option period prices shall not obligate the Government to exercise such options.
Completeness: The proposal will be reviewed to determine the extent to which all the price elements have been addressed. The Offeror’s proposed price and other information will be evaluated to ensure continuity and traceability of prices to the technical volume and between the initial proposal and any revisions thereto. The review will determine the adequacy of the Offeror’s proposal in addressing and fulfilling the ITO requirements.
Reasonableness: For a price to be reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business. The Government will determine prices fair and reasonable through the use of one or more of the price analysis techniques at FAR 15.404-1(b)(2).
Balanced pricing: Offerors are cautioned against submitting an offer that contains unbalanced pricing.
Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one (1) or more contract line items is significantly over or understated. The Government will analyze proposals to determine whether they are unbalanced with respect to cost/price, variable quantity matrix factors, and separately priced line items. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
Realism: The Government will evaluate the Offeror’s PECP for realism by assessing the compatibility of proposed cost/price with proposal scope and effort. For the PECP to be realistic, it must reflect what it would cost the Offeror to perform the effort, if performed with reasonable economy and effectively in the relevant geographic area, based on recognized national and regional compensation surveys.
Evaluation of the PECP. The Government will evaluate the Offeror’s PECP for realism IAW FAR Provision 52.222-46 - Evaluation of Compensation for Professional Employees (Feb 1993). For the PECP to be realistic, the compensation plan(s) will be evaluated to determine if the compensation level proposed is unrealistically low IAW the scope and effort of the PWS. The analysis will be based on labor rates in the National Capital Region (U.S. Postal Codes 20762 / 20330). Failure to comply with the requirements in FAR Provision 52.222-46 may constitute sufficient cause to justify rejection of the proposal.
*Offerors are highly encouraged to provide index sources for justification of their proposed unburdened rates.
Option to Extend Services. Evaluation of FAR 52.217-8, Option to Extend Services. The RFP and subsequent award for this acquisition contains the clause at FAR 52.217-8, Option to Extend Services.
The option to extend the contract term will be evaluated as part of the initial evaluation, whereby any resultant exercise of this option is within scope of the pending contract. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed six (6) months. Offerors are required only to price the base and option CLINs. Offerors shall not submit a price for the potential six-month extension of services period.
The Government will evaluate the possible prices for FAR 52.217-8 through its evaluation of the base and option prices. If conditions warrant the exercise of this option, the price(s) for continued performance under this clause shall be at the same price(s) as awarded for the base period or the option period (whichever is being extended). As such, if the base and option prices are considered fair and reasonable then the cost of the possible extension of services under FAR 52.217-8 shall be considered fair and reasonable and in the best interest of the Government. Evaluation of options shall not obligate the Government to exercise the option(s).
52.217-8 shall be considered fair and reasonable and in the best interest of the Government. Evaluation of options shall not obligate the Government to exercise the option(s).
