Data Sharing Agreement Summary

This is a Data Sharing Agreement (MOU) between the Florida Fish and Wildlife Conservation Commission (FWC) and third-party service providers governing the disclosure and handling of FWC data. The agreement establishes terms and conditions for data access, use, and protection to ensure confidentiality, integrity, and availability of sensitive information. The scope of data sharing includes confidential information exempt from public disclosure under Florida Statutes Chapter 119, personal information as defined in section 501.171(1)(g), and data restricted from public disclosure based on federal or state laws related to privacy, security, business trade secrets, and public records exemptions. The agreement applies to all personnel assigned to perform services who have access to information processing facilities or possess system, database, developer, network, or administrative capabilities for moderate-impact or higher systems. All individuals requiring such access must undergo comprehensive background investigations prior to access and annual reviews thereafter, including federal criminal history checks for computer-related, identity-theft, financially-related, forgery, and sensitive records misuse offenses.

The agreement mandates stringent data security requirements aligned with the National Institute of Standards and Technology (NIST) Framework, NIST Special Publication 800-53 Revision 5, Florida Cybersecurity Standards (Chapter 60GG-2), and the FBI Criminal Justice Information Services (CJIS) Security Policy. Third parties must implement administrative, technical, and physical safeguards, encrypt all data-in-transit and data-at-rest using FIPS 140-2 or FIPS 140-3 standards, maintain least-privilege access controls, and apply timely security patches. Data at rest and in transit must remain within the continental United States unless approved by the FWC Chief Information Officer. The agreement explicitly prohibits third parties from using FWC data to train, fine-tune, or improve artificial intelligence, machine learning, large language models, or automated decision-making systems without prior written approval from the CIO. Breach notification must occur within two business days of determination, with detailed reporting required within ten calendar days. Cloud Service Providers must obtain annual SSAE 18 SOC 2 Type II audits at no cost to the agency. The FWC retains all ownership rights to data and reserves audit rights over third-party systems, applications, networks, facilities, and data centers.
