FACILITIES and insert the following wording:

“A successful Offeror must maintain sufficient facilities that will demonstrate that Offeror can adequately perform Contract as specified herein. WMATA may make site visits prior to contract award and during contract performance to examine the offeror’s facilities. This will include inspection of facilities, warehousing, communication with key personnel and verification that necessary equipment, supplies, etc. are readily available. Facilities(s) must demonstrate that Offeror has the capability to perform the work described in the Technical Specifications.”

8. DELETE the acronym ‘N/A’ from “CHAPTER II , Clause 2. OPTIONS- EVALUATION – N/A and insert the following words: “In awarding this Contract, the Contracting Officer shall evaluate offers for any option quantities or periods contained in a solicitation in accordance with PPM §§ 4-21 through 4-23.”

(a) When exercising an option, the Contracting Officer shall provide written notice to the Contract or within a reasonable amount of time before exercising the option.

Contracting Officer shall determine the effect of the adjustment on prices under the option before the option is exercised.

(c) In accordance with PPM § 4-23, the Contracting Officer may exercise options only after determining that—

(1) Funds are available;

(2) The requirement covered by the option fulfills an existing WMATA need ;

(3) The exercise of the option is the most advantageous method of fulfilling WMATA’s needs, when price and other factors are considered.

(4) Contractor is not listed in the System for Award Management’s Exclusions (See www.sam.gov).

(5) The Contractor’s past performance evaluations on other Contract actions have been considered; and

(2) An informal analysis of prices or an examination of the market indicates that th e option price is better than prices available in the market or that the option is the more advantageous offer.

http://www.sam.gov/

(3) The time between the award of the Contract containing the option and the exercise of the option is so short that it indicates the option price is the lowest price obtainable or the more advantageous offer. The Contracting

Officer shall take into consideration such factors as market stability and comparison of the time since award with the usual duration of Contracts for such supplies or serv ices.

(e) The determination of other factors under subparagraph (d):

(1) Should take into account WMATA’s need for continuity of operations and potential costs of disrupting operations; and

(3) In the case of a cost-type Contract, if—

(a) The option contains a fixed or maximum fee; or

(b) The fixed or maximum fee amount is determinable by applying a formula contained in this Contract;

(4) A specific price that is subject to an economic price adjustment provision; or

(5) A specific price that is subject to change as the result of changes to prevailing labor rates provided by the U.S.

Secretary of Labor.

(g) The Contract modification or other written document that notifies the Contractor of the exercise of the option shall cite this article as authority.”

14. ADD the following clause as RFP SOLICITATION INSTRUCTION 32. ‘CYBERSECURITY REQUIREMENTS’:

CYBERSECURITY REQUIREMENTS

“This Article defines cybersecurity requirements for all hardware, software, and firmware included as part of a defined end item

(hereinafter referred to as the “products” for purposes of this section) to be provided under this Contract, whether resident within a microprocessor-controlled system, provided as part of test or interface equipment, provided for the purpose of post-download data analysis and processing, or incorporated within training technology and manuals, and Bench Test Equipment (BTE) as defined in the Technical Specifications of each product. T hese requirements apply to all systems that include processors or other programmable components such as Programmable Logic Devices

(PLDs). All products for this Contract are subject to these same requirements, except as stated within the specifications.

Contractor is required to flow these requirements down to all subcontractors and require that the subcontractors flow these requirements down to all of their subcontractors and subsuppliers, regardless of their supply chain tier. Thus, where the word

“Contractor” is used, it includes all subcontractors and subsuppliers, in the full supply chain.

All hardware, software, and firmware included as part of the finished product(s) shall comply with cybersecurity practices cu rrent at the time of delivery and consistent with cybersecurity frameworks s uch as those defined by the International Standardization

Organization (ISO), the National Institute of Standards and Technology (NIST), International Information Systems Security

Certification (ISC2), or Information Technology Infrastructure Library (ITIL). At a minimum, these practices shall include:

1. Removal of all software components that are not required for the operation and/or maintenance of the product. If removal is n ot technically feasible, then the Contractor shall disable software not required fo r the operation and/or maintenance of the product.

Contractor shall provide a list of all disabled software to the Contracting Officer’s Technical Representative for continuous cybersecurity monitoring purposes. This removal shall not impede the primary fu nction of the product.

2. Provision of all required technical documentation, and specific detail of software/firmware that supports the product, includ ing scripts and/or macros, run time configuration files and interpreters, databases and tables, and all oth er included software

(identifying versions, revisions, and/or patch levels, as delivered). The listing shall include all communications ports and authorized services required for normal operation, emergency operation, or troubleshooting.

3. Removal of and/or disabling, through software, physical disconnection, or engineered barriers, all services and/or ports in the product not required for normal operation, emergency operations, or troubleshooting. They shall include communications/network ports and physical input/output ports (e.g., USB docking ports, CD/DVD drives, video ports, and serial ports).

4. Provision of all required technical documentation and specific detail of the product’s security features and security -focused instructions on product maintenance, support, and reconfiguration of default settings.

5. Documentation of options for defining access and security permissions, user accounts, and applications with associated roles.

Contractor shall provide all access configurations, including any access credentials (e.g., maintenance account or default system usernames and passwords) used, and out-of-band support interfaces (e.g., remote service connections, and automated software update/patching interfaces).

DELIVERABLES

These cybersecurity requirements add no new deliverables to this Contract. All required technical details specified above are to be included as additions to the Draft Manuals (CDRL 16-01) and Final Manual Delivery (CDRL 16-02). The Service Manual, as required in Section 16.1.5, shall include the following as a standalone topic: “Cybersecurity.” The information in the Cybersecurity chapter will include all details required to service the hardware, software and firmware components of the finished end item.

Contractor will ensure that all hardware, software and firmware is included in the Parts Catalog, required in Section 16.1.6, Manuals

(CDRL 16-01 and 16-02). All software or firmware shall be identified and cataloged within each individual system. An index shall be included listing the software or firmware, the original equipment manufacturers’ (OEMs’) addresses and phone numbers. The software or firmware shall be listed with a numbering system that will allow WMATA to identify and track version changes. The version number shall be used in place of an OEM part number.”

QUESTIONS FROM INTERESTED VENDORS AND WMATA RESPONSES

Q1. Would WMATA take delivery in 2020 of the machines?

Response 1: Please see the below delivery time frames as stated in the technical specifications for each piece of equ ipment.

E-Clip Installer – 270 Days after Notice to Proceed

Tie Plate Inserter - 270 Days after Notice to Proceed

Swing Loaders – 180 Days after the Notice to Proceed

Q2. Does WMATA have a crane to unload a 22,000 LB. machine, or would we be required to lease a crane to unload to meet the FOB Delivery requirement?

Response 2. The contractor is required to unload any equipment delivered.

Q3. Clearance drawings on 17.1.3 and 17.1.4 are not legible. Please provide more clear drawings so that nothing is lost in translation.

Response 3. Revised drawings have been attached to this amendment.

THE FOLLOWING QUESTIONS ARE PERTAINING TO THE 5 TON AND 10 TON SWING LOADERS :

Q4. 2.1.2 3) Asks that each unit be equipped with a rigid boom, extended boom, and stiff hook. Can you confirm that this is referring to the standard boom, the telescopic boom, and the tote hook options? We do not recognize these terms.

Please see attached images of these options to confirm.

Response 4. We confirm that “standard, telescopic and tote hook options” are the attachments we would like. Feel free to amend that section to this language.

Q5. 2.7.2 1) Asks for 4 sets of diagnostic equipment. Is this per unit or total for the entire order? So for three 5 ton units and three 10 ten units, does WMATA need 4 sets of diagnostic equipment or 24 sets?

Response 5. We are requesting 4 sets per technical specification. If the different diagnostic equipment is required for the 5 ton and the 10 ton, then we would like 4 for each des ign application.

Q6. 4.3. 1)a) Specifies that hi-rail mechanical locks are prohibited, but 4.3. 4) Requires hi-rail positive locks for on-rail and off-rail travel modes. Please elaborate on what WMATA deems an acceptable positive lock for hi-rail.

Response 6. Revise 4.3.1)a) last sentence to read “Mechanical locks are prohibited for the on -rail travel mode.” And, revise

4.3.4) to read “Hi-Rail shall have a positive lock for off-rail travel mode and for on-rail freewheel towing.”
