About this file
This is a pre-bid meeting Q&A document for the Fox Creek Stream and Floodplain Work Activity project (Contract ID: 5-23-011 - B50456) involving the Department of Natural Resources (DNR). The project encompasses earthwork and grading activities including berm construction, spillway work, site restoration, and temporary seeding at the Fox Creek site. Key deliverables include backfilling of gullies and breach areas, grading of berms and spillways with staked elevations subject to DNR approval, dewatering of the site (to occur in late January or February 2026), restoration of the north access road to original conditions, and removal or controlled burning of cleared vegetation. The Notice-to-Proceed is anticipated by the end of March 2026, with a contract end date of June 30, 2026. The contractor is responsible for all staking and site restoration activities, including repair of any rutting or damage incurred during construction.
The project is funded by grant funding with an expiration date of June 30, 2026, requiring all invoiceable work to be completed by that date. DNR is exploring alternative funding sources should work extend beyond the grant deadline due to circumstances beyond the contractor's control, though any work completed after June 30, 2026, will not be eligible for payment without a formal contract extension and alternate funding arrangement. DNR has waived standard IDOT seeding window requirements due to the June end date falling outside normal seeding periods, though seed must be applied as soon as possible upon grading completion. No official cost estimates have been provided by DNR to external sources, and the contractor is responsible for site stabilization and temporary seeding per IDOT specifications if demobilization becomes necessary due to prolonged delays.

Fox Creek SFWA Pre-Bid Meeting January 7, 2026 5-23-011 – B50456
Vendor Questions:
1. Please elaborate on project funding and contract end date constraints.
Answer: The grant funding for this project expires on June 30, 2026. DNR fully intends and expects the Contractor to make every possible effort to have this project completed by then. However in the event the work cannot be completed by June 30 due to factors outside of their control, DNR is looking into options for alternative funding and will advise the contractor as the end date approaches. The Contractor will invoice DNR for all work completed through 6/30/26. Any work completed after the end date will not be eligible for payment unless a contract extension and alternate funding source has been arranged. If a lengthy delay warranting demobilization or contract termination is anticipated, the contractor will be required to stabilize the site and apply temporary seeding per IDOT specifications. If work is able to be resumed after a lengthy delay, reasonable expenses for secondary mobilization and temp seeding will be considered for compensation.
2. When can we expect Notice-to-Proceed?
Answer: Assuming an awardable bid is received and timely completion of the items needed for contract execution by the low bidder, NTP should be issued by the end of March.
3. Is Temporary Seeding required? Project end date of June is outside the IDOT seeding window.
Answer: DNR will waive seeding window requirements due to contract end date being outside of normal seeding window. Contractor must apply seed as soon as possible upon grading completion.
4. What are earthwork/compaction specifications?
Answer: Refer to notes on plan Typical Section and Cross Section sheets. Backfilling of gullies and breach areas shall be done with the most cohesive soils available onsite, likely found in the lower portions of the overflow spillway and south access path excavations.
5. The insides of the berms are underwater currently?
Answer: Site Staff will open the water control gates and dewater the sites in late January or February
6. Will the Contractor be responsible for Staking?
Answer: Yes. Staked elevations for top of berms and spillways are to be reviewed and approved by DNR prior to initiating grading.
7. Should the north access road be graded & seeded post completion?
Answer: Contractor to restore to original conditions and repair any ruts or damages as necessary. Seeding is not required.
8. What is to be done with the cleared vegetation?
Answer: Hauled offsite or burned onsite in a manner approved by the Site Superintendent
9. Did DNR provide any of the project cost estimate numbers listed on 3rd party plan holder websites? One listed it at $1 million, another listed $100k.
Answer: No, DNR has not provided any cost estimates or ranges of any kind to outside sources for this project.
10. For the south berm, how critical is it to dig to the minimum inside toe elevation?
Additional excavation shown at the toe of slope is only to provide an optional borrow source for the berm regrading as needed. Excavations cannot go below that elevation.
