C.1 ATTACHMENT B STATEMENT OF WORK (SOW)

PAGE 13 OF 100 1305M220RNWWR0025

National Weather Service (NWS) – Central Region

Regional Facilities Roof Replacement Single Award IDIQ Contract

Base Statement of Work

1. BACKGROUND

The National Weather Service Central Region includes 32 Weather Forecast Offices (WFO) and support buildings throughout the 14-state Region. These WFO facilities were constructed between 1989 and 1995. The WFOs have three types of roofs; asphalt (78%), metal (19%), and membrane (3%). See table of locations under “Place of Performance.”

2. OBJECTIVES

2.1 Reduce NWS manpower requirements currently dedicated to multiple individual contracting actions for roofing projects.

2.2 Establish a team that can provide a consistent level of service and quality of workmanship throughout all facilities in the region.

2.3 Establish a contract with a contractor able to provide single point of accountability for completion of all roof replacement projects.

3. SCOPE

The contractor shall provide all materials, labor, equipment, and supervision to complete removal and replacement of the various types of roofs on WFOs located in the Central Region for the National Weather Service (NWS). This work shall be accomplished through a Single Award, Indefinite Delivery, and Indefinite Quantity (IDIQ) contract.

PAGE 14 OF 100 1305M220RNWWR0025

4. GENERAL CONTRACT REQUIREMENTS

4.1. DEFINITIONS

The terms listed below are defined as indicated wherever they may be used in the technical specifications.

4.1.1. "General Clauses", "General Conditions", or "General Provisions" shall be read as "Contract Clauses".

4.1.2. “Contracting Officer (CO)” is a person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings.

4.1.3. “Contracting Officer’s Representative (COR)” is a federal employee delegated limited authority by a CO to monitor and perform specific, enumerated contract management duties related to contract planning, contract administration, technical oversight, and closeout to ensure that the contractor’s performance meets the standards set forth in the contract.

4.1.4. “Meteorologist-In-Charge (MIC)” is the top position held at the WFO. They may serve as the Point of Contact (POC) at the WFO. The MIC has no contractual authority, however should be aware of construction schedules and mobilizations. The MIC may designate assistant MIC(s) to act on their behalf by naming such assistant(s) in writing and transmitting a copy of such designation to the CO through the

COR.

4.1.5. "Provide" shall be defined as "furnish, install, test and make ready for use".

4.1.6. “Days” shall be defined as calendar days, unless specifically stated otherwise.

4.1.7. “Task order” is an order issued for specific work to be performed in accordance with the terms of the contract, awarded after evaluation of a proposal. A task order includes the terms and conditions of the contract; site specific requirements and terms included in the request for proposal issued by the CO; and the Contractor’s proposal that is accepted by the CO.

4.1.8. “Key Personnel” are employees of the contractor who are considered essential to the work being performed under this contract. (Reference CAR Clause 1352.237.75). This employee(s) may represent the Contractor in performing site visits, preparing proposals, receiving task orders, and performing other administrative functions associated with performance under this contract and any resultant task orders.

4.1.9. “Request for Proposal (RFP) communicates the Government’s requirements to the prospective contractor for the purpose of soliciting a proposal. An RFP will include but is not limited to a description of the Government’s requirement or scope of work; schedule/delivery requirements; place of performance; statutory and regulatory requirements; and instructions for submitting a proposal.

4.2. PRECEDENCE

Where the specific work requirements in a task order differ from the requirements set forth in this statement of work, the requirements in the task order shall govern provided that the work to be performed is within the scope of this contract.

4.3. ORDERING PROCEDURES

Ordering procedures are provided in the Ordering clause under FAR 52.216-18. The CO will issue a request for proposal to the Contractor’s key personnel. A task order may or may not result from the Contractor’s response to an RFP.

4.4. INQUIRIES

Inquiries regarding individual task orders shall be directed to the person(s) identified in the RFP and subsequent task order as the POC.

4.5. WAGE RATES

PAGE 15 OF 100 1305M220RNWWR0025

Applicable Davis-Bacon or Service Contract Act Wage Rates will be provided with the RFP and incorporated into the individual task orders. (Reference FAR Part 22 – Application of Labor Laws to Acquisitions)

4.6. CONSTRUCTION SCHEDULING

4.6.1 TASK ORDER INSTRUCTIONS

The instructions for preparation and submittal of the contractor-prepared schedule will be included with individual task orders. Contractor shall verify schedule with CO and COR prior to the CO issuing Notice to Proceed (NTP). The contractor falls behind the approved schedule, the contractor shall take steps necessary to improve its progress, including those that may be required by the CO.

4.6.2. PERIODIC SCHEDULE UPDATES

Contractor shall submit monthly schedule updates to the CO, COR, and MIC. These submissions shall enable the CO and COR to assess Contractor's progress. If the Contractor fails or refuses to furnish the information and project schedule data, which in the judgment of the CO or COR is necessary for verifying the contractor's progress, the contractor shall be deemed not to have provided an estimate upon which progress payment may be made.

4.6.3. REQUEST FOR TIME EXTENSION

In order to request an extension to the delivery schedule on a task order, the contractor shall submit a written request for an extension to the CO, prior to the required delivery or completion date. The request, at a minimum shall explain the basis for the delay, provide a revised schedule for completion, and include a plan for mitigating any future delays in completing the task. Once the CO approves the request, the revised delivery schedule will be incorporated into the Task Order by issuance of a bilateral modification.

4.6.3.1 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER

Reference FAR clause 52.349-10 Default (Fixed Price Construction) that is incorporated into this contract. In accordance with paragraph (b) (1) of this clause, the Contractor has the right to proceed with the work and an order shall not be terminated in the event that the Contractors failure to prosecute the work or any separable part is the result of specified unforeseen causes including unusually severe weather.

The Contractor’s request for an extension due specifically to “unusually severe weather” shall be based on the following:

a) The weather experienced at the project site during the contractual period of performance as specified in the task order must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month based on historical weather data taken from NOAA records; and

b) The unusually severe weather must actually cause a delay to the completion of the project.

4.7 Hours of Operation, Holidays, and Closures

4.7.1. Hours of Operation

The Government’s hours of operation are typically from 8:00 AM to 5:00 PM Monday through Friday, except for legal holidays. Any deviations from this schedule shall be annotated in the specific Order. The contractor shall be required to complete all work during the specified hours of operation. If any unique circumstances arise in which there is a need to deviate from these hours, the contractor shall contact

PAGE 16 OF 100 1305M220RNWWR0025

the CO at least five (5) business days prior with the specific details regarding the need for a deviation. If the deviation is acceptable, the CO will notify the contractor.

4.7.1. Federal Holidays

Services under this contract are not required to be performed on Federal Holidays unless specified in the task order. Below is a list of Official Holidays. Additional days may be designated by federal law, executive order, or presidential proclamation.

New Year’s Day Martin Luther King, Jr.’s Birthday Washington’s Birthday Memorial Day Independence Day Labor Day Columbus Day Veterans Day Thanksgiving Day Christmas Day

The official website for specific dates of these holidays at: http://www.opm.gov/Operating_Status_Schedules/
