About this file
This document appears to be a solicitation specification or requirements document from the U.S. Department of Justice Federal Bureau of Prisons, Federal Correctional Institution in Texarkana, Texas, for food supply procurement. The document establishes mandatory compliance requirements for delivered food items, including adherence to all applicable Federal, State, and local regulations relating to preparation, packaging, labeling, storage, distribution, and sale of food supplies in the commercial marketplace.
The specifications require compliance with the Federal Food, Drug, and Cosmetic (FD&C) Act, Fair Packaging and Labeling Act, and associated regulations. When allergens are present, items must comply with FD&C Act allergen labeling requirements, with major allergens identified as wheat, fish, milk, soy, tree nuts, eggs, peanuts, shellfish, and sesame. The document emphasizes that failure to comply with National Menu Specifications will result in disqualification from award consideration, with no specification substitutions accepted. Foreign-produced items are acceptable unless specifications specifically require U.S. or Canadian origin. The Food Service Administrator (FSA) has discretion over which specification options are bid, institutions may bake items that are typically fried, and the Nutritional Food Service Administrator/Chief Dietitian makes final product compliance determinations.

The delivered item(s) must comply with all applicable Federal, State, and local mandatory requirements and regulations relating to the preparation, packaging, labeling, storage, distribution, and sale of the supplies in the commercial marketplace. Delivered item(s) must comply with all applicable provisions of the Federal Food, Drug, and Cosmetic (FD&C) Act, the Fair Packaging and Labeling Act, and regulations promulgated thereunder. When a known allergen is included in the item(s), the item(s) must comply with the allergen labeling requirements of the FD&C Act.
Major allergens identified in the FD&C Act include: wheat, fish, milk, soy, tree nuts, eggs, peanuts, shellfish, and sesame or those in effect on the date of the solicitation, contract, or purchase order.
Failure to comply with the National Menu Specifications will result in your quoted item not being considered for award. No specification substitutions will be accepted. If a specification does NOT state it must be a product of the United States or Canada, it is acceptable for it to be a "product of" a Foreign Country and distributed in the United States or Puerto Rico. When options are offered on the specifications, it is the FSA's determination as to what options are put out to bid. Not all options need be put out for bid. (i.e., cans and pouches). Items that are fried may be baked at the institution’s discretion. The NFSA/Chief Dietitian will make the final determination on product compliance.
