About this file

The file is a Federal Debarment Certification Form from the Department of Labor (DOL), requiring participants in federal assistance fund transactions to certify that they are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in federal transactions. The document outlines comprehensive instructions for completing the certification, emphasizing the importance of accurately representing the participant's status and providing immediate written notice if certification becomes erroneous. Participants must agree not to enter into lower tier covered transactions with debarred entities and include the certification clause in all solicitations without modification.

The certification form carries significant legal and procedural implications, with potential consequences including suspension and/or debarment if false or erroneous information is provided. The document stipulates that participants are not required to establish an extensive record-keeping system beyond what a prudent business person would normally maintain. The certification is a material representation of fact, and participants may rely on certifications from lower-tier participants unless they know the certification is erroneous. The form does not require participants to possess knowledge beyond what is typically known in ordinary business dealings, but mandates good faith reporting of their current federal transaction eligibility status.
