SECTION 1

DESCRIPTION OF SERVICES

1.1 SCOPE OF WORK

1.1.1 The 377th Air Base Wing is the host organization for Kirtland AFB. The Wing supports more than 123 tenant organizations and mission partners, including the Air Force Research Laboratory, Air Force Operational Test and Evaluation Center, 58th Special Operations Wing, Air Force Inspection Agency, Air Force Safety Center, the Department of Energy Albuquerque Office and Sandia National Laboratory.

1.1.2 In accordance with this Performance Work Statement (PWS), AFI 23-201, Fuels Management attachment 4 and, [endnoteRef:1]DoD 4140.25M, Chapter 2, Section D, DoD Management of Bulk Petroleum Products, Storage and Dist. Facilities, the contractor is required to perform and provide the following functions/personnel: Contract Manager, Fuels Bulk Storage, Fuels Laboratory, Fuels Requisitioning, Fuels Information Service Center, Fuels Product Distribution, Fuels Administration, Fuels Accounting and Administration, Compliance and Environmental, Resource Control Center, Checkpoint/Preventive Maintenance of Vehicles and Facilities, and Material Control. Workload Estimates are found in Appendix D. [1: ]

1.1.3 The Contractor Shall. “Shall” indicates a mandatory requirement; for all directive language in this PWS, it is implied that “the contractor shall” precedes the directive language.

1.1.4 GOVERNMENT OBSERVATIONS: The wing commander will be responsible for continuous observation of the contractor’s performance under the contract. The commander will exercise these responsibilities through the CORs, his wing staff and in connection with visits by USAF/MAJCOM Inspector General, USAF/MAJCOM and staff agencies, and other authorized government personnel who shall be permitted to observe contractor operations as necessary. All observations of incomplete or defective performance will be recorded and written notices issued by the CO who will require the contractor to reply, in writing, to the CO within 3 work days after receipt, giving reasons for the less than satisfactory condition, the corrective action, and procedure to prevent recurrence. The government reserves the right to review the contractors certification and recertification program at any time.

1.1.5 Applicable Regulations, Manuals, and Technical Orders. The Contractor shall follow publications and use forms to the extent (that is, a specific procedure in a paragraph, section, chapter or volume) specified in the Performance Work Statement, listed in Appendix C. All publications and forms listed shall be provided by the government at the start of the contract or be available on the Internet, http://www.e-publishing.af.mil/, and http://www.e-publishing.af.mil/otherpublishingsites.asp. It is the responsibility of the Contractor to establish follow-on distribution requirements with the Publications Distribution Office (PDO). Supplements or amendments to listed publications from any organizational level may be issued during the life of the contract.

1.1.5.1 Comply with and ensure that all mandatory publications listed in Appendix C are current and up-to-date.

1.1.5.2 Notify COR personnel when changes occur prior to implementing any such revision, supplement, or amendment that will result in an increase in contract price. Submit a price proposal to the Contracting Officer (CO) reflecting changes. Price proposal shall be submitted within 30 calendar days from the date the Contractor receives notice of the revision, supplement, or amendment giving rise to the increase in cost of performance. Unless the revisions are required to be implemented immediately based on the safety of personnel or property, the contractor will not perform in accordance with the revised publications until the CO has accepted the proposal and a modification has been issued. Failure of the Contractor to submit a price proposal within 30 calendar days from the date of receipt of any change shall entitle the government to performance in accordance with such change at no increase in contract price.

1.1.6 Contract Changes. Any matter concerning a change to the scope, prices, terms or conditions of this contract shall be referred to the Contracting Officer (CO).

1.2 CONTRACTOR PERSONNEL.

1.2.1. Appoint and provide a contract manager and alternate who shall be responsible for the performance of the work and must have completed the Air Force Petroleum Logistics Management Course (PLMC) prior to award. The contract manager and an appointed alternate(s) shall be designated in writing to the CO within 7 days after contract award. The contractor shall provide telephone numbers for 24 hour a day contact of the contract manager and alternate to the Contract Officer Representative (COR) within 5 calendar days of award.

1.2.1.1 The contract manager and/or alternate(s) shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract.

1.2.2 Contractor Employees. Do not employ persons for work on this contract if such employee has a history or is determined by the government to be a potential threat to the health, safety, security, and general well being or operational mission of the installation.

1.2.2.1 All contractor employees shall present a neat and well groomed appearance. Furnish an identifying badge, which shall include as a minimum: the person's name, the name of the contractor, and address of the work location the individual is assigned to on a daily basis. Each employee shall wear the badge on the outer clothing on the front of the body between the neck and waist so that the badge is clearly visible while on duty. Badges must be of a distinctive design so as not to be confused with United States Air Force (USAF)-controlled/restricted area badges. Contractor employees entering controlled areas are required to have in their possession a USAF issued-controlled/restricted area badge.

1.2.2.2 Do not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest, nor shall the contractor employ any person who is an employee of the Department of Defense, either military or civilian, unless such person seeks and receives approval in accordance with the Joint Ethics Regulation (JER), DoD 5500.7-R. The contractor shall not employ any person who is an employee of the Department of Defense if such employment would be contrary to the policies contained in AFI 64-106, Air Force Industrial Labor Relations Activities.

1.2.2.3 The contractor is cautioned that off duty active military personnel hired under this contract may be subject to Permanent Change of Station (PCS), change in duty hours, or deployment. Military Reservists and National Guard members may be subject to recall to active duty. The abrupt absence of these personnel could adversely affect the contractor’s ability to perform. Their absence at any time shall not constitute an excuse of nonperformance under this contract.

1.2.2.4 The contract manager, alternate(s), and all other contract employees must be able to read, write, speak, and understand English fluently.

1.2.2.5 Do not employ off-duty COR’s who perform surveillance of contract or subcontract operations. Do not allow foreign national employees access to the Kirtland network without Air Force approval in accordance with AFI-33-207, Computer security. Request for such approval shall be submitted to the CO.

1.2.2.6 Control of Contractor Employees. The selection, assignment, reassignment, transfer, supervision, management, and control of employees in performance of this work statement shall be the responsibility and prerogative of the contractor; however, the contractor shall comply with the requirements set forth in this PWS and in Kirtland AFB regulations in appendix C concerning conduct of employees as referenced herein.

1.2.2.7 All contractor employees shall be subject to toxicological testing at the expense of the contractor on a non-reimbursable basis. The contractor shall accomplish the specified testing using a certified or method approved by the Government medical substance abuse toxicological testing facility. Results of those tests will be provided to the CO and/or Functional Director (FD) if requested. Positive test for illegal substances will result in removal from the position and revocation of all Kirtland AFB access or entry based on their role as a contract employee.

1.2.2.8 Smoking Policy. Employees shall comply with the Air Force smoking policy as described in AFI 40-102, Tobacco Use in the Air Force, KAFBI 40-102, Tobacco Use on Kirtland Air Force Base.

1.2.2.9 Freedom of Information Act Program. Comply with the security requirements in DoD 5400.7-R, Freedom of Information Act Program (FOIA). All official government records affected by this contract are subject to the provisions of the Freedom of Information Act (FOIA), DLAE-P-4 (Privacy Act 5 USC 552a) Prohibition Against Entering Privacy Act Information in the Resource Control Center (RCC) Application. Any request received by the contractor for access and releases of information from these records to the public (including government and contractor employees acting as private citizens), whether oral or in writing, shall be immediately brought to the attention of the CO for forwarding to the Installation FOIA Manager to ensure proper processing and compliance with the Act.

1.3 GENERAL TRAINING.

1.3.1 Formal Training. Training and qualifications must meet Air Force Specialty Code (AFSC) 2FOX1 (fuels specialist) requirements. Formal training courses listed in Appendix E shall be provided at the Air Education and Training Command Technical Training Centers. Government training courses requested by the contractor, and the Government validates the need, will be scheduled. Government quarters, dining facilities, and transportation may be utilized when appropriate, as determined by the FD. The Government may allow use of Government Furnished Vehicle’s (GFV) to the contractor to facilitate training and recertification with FD and CO written approval. Travel to and from training location shall be in accordance with the Joint Travel Regulation (JTR). Only actual allowable costs as specified by JTR will be reimbursed IAW FAR 31.206-46, Travel Costs. No additional contractor costs will be included in reimbursement.

1.3.2 Informal Training. The following training will be provided by the host base and is mandatory for employees filling positions indicated. Requests to attend training courses shall be submitted to the COR no later than 60 days after employment start date unless mandatory completion dates dictate otherwise. 1.3.3 Government Training. The Government will provide technical training for new equipment requirements or technologies as determined by the FD and CO. Cost of training will be at government expense. The contractor shall submit request for such training through the FD to the CO.

1.3.4 Fuels Training. The contractor will provide contractor employees to perform laboratory and cryotainer functions. Employees must have successfully completed the formal Fuels Quality Control and Cryotainer Maintenance courses listed in Appendix E prior to the first day of the full performance period of this contract. A minimum of two fully trained contract employees must be capable of processing information using the Fuels Management Defense System (FMDS also known as “The Purple Hub”). These employees must have successfully completed Fuels Accounting and FMDS courses.

1.3.5 Additional Training.

1.3.5.1 Annually, bulk storage personnel shall attend emergency generator training to meet OSHA/Air Force standards and it shall be provided by the Government on an as needed basis. The training will be documented by the contractor as listed in Appendix C.

1.3.5.2 All contractor personnel required to operate vehicles on the flight line will successfully complete flight line Drivers Training and have in their possession a valid State Commercial Drivers License, current AF Form 483, (Certificate of Competency) prior to the end of the 30 day transition period and does not have color-vision impairment IAW AFI 48-123, Medical Examinations and Standards that would preclude driving on the flight line. The Contract Manager will verify that personnel have satisfactorily completed prescribed Special Experience Identifier (SEI) training requirements IAW AFI 23-201, attachment 7, listed in Appendix C less the SEI 28. Use of over the counter and/or prescription medication shall be strictly monitored and flight line driving shall not be allowed. Protection of government personnel and other resources is of the utmost importance.

1.3.5.3 Ensure CBT Information Protection Training is completed during the 30 day transition period and annually thereafter by all employees.

1.3.5.4 All personnel shall be trained in the use of fire extinguishers during the 30 day transition period and then annually thereafter. Training documentation shall be maintained by the contractor.

1.3.5.5 Facility Security (FS) person. Appoint a Facility Security (FS) person, the FS person shall assist the LRS Security Manager in providing contractor employees with training required by DoDR 5200.1, Industrial Security Program Regulation, Chapter 10, AFPD 31-4, Information Security, and AFI 31-401, Information Security Program Management. Provide initial and follow-on training to contractor personnel who work in Air Force controlled/restricted areas. Air Force controlled/restricted areas are explained in AFI 31-101 Installation Security Plan and KAFBI 31-101, The Air Force Installation Security Program.

1.3.5.6 Ensure that employees who are designated as the Chief of Records complete the Chief of Records ADLS course and re-accomplish the course annually, Chief of Record's will also attend the General Awareness Training (in-person, Base level training).

1.3.5.7 Ensure employees who are designated as the Records Custodian (RC) complete the RC ADLS and re-accomplish annually, RC's will also attend the General Awareness Training (in-person, Base level training).

1.3.5.8 Ensure that employees who are designated as the Functional Area Records Manager (FARM) complete the FARM ADLS course and re-accomplish annually. FARM's will also attend the General Awareness FARM Training (in-person Base level training). Provide one copy of the required training certificates to the COR and Base Records Manager (BRM) at the completion of the training.

1.4 MEETINGS

1.4.1 Meeting Support. The Contract Manager or Alternate is expected to attend the following meetings as requested. Meetings may be periodically held between top-level base personnel and contractor management to discuss contract status as required. Some of the meetings may include:

1.5 QUALITY CONTROL

1.5.1 Quality Control Plan. Establish and maintain a complete and effective Quality Control Plan (QCP) to assure the requirements of the contract is provided to meet the requirements of the contract. An updated copy must be provided to the CO and FD as changes occur. The QCP shall cover all PWS requirements and the services listed in the Services Summary (SS). It must specify the areas to be inspected on either a scheduled or unscheduled basis, and how often inspections shall be accomplished.

1.5.2 Internal Quality Control Evaluations/Quality Control Program. Establish a Quality Control program and appoint a Quality assurance evaluator (QAE) IAW AFI 20-112. The Quality assurance evaluator will perform Internal Evaluations, spot checks, re-checks and randomized spot checks as required IAW AFI 20-112. Provide the FD/COR a monthly schedule of spot checks, randomized spot checks, and six-month evaluations prior to inspection month. Fuel sampling requirements IAW T.O. 42B-1-1 and the re-checks schedule will be provided to the COR no later than the last work day of the previous month. The COR will make evaluations of the Contractor’s internal Quality Control Inspection evaluations, spot-checks and re-checks as listed in the Service Summary. Failure to submit the monthly schedule will result in an unacceptable evaluation. All inspection documentation shall be made available to the COR/LGRQ at the end of the month.

1.5.3 The government will evaluate the Contractor’s performance under this contract using the method of surveillance specified in the Quality Assurance Surveillance Plan (QASP). All shifts will be evaluated to periodically include weekends. When an observation indicates defective performance, the COR shall request the Contractor’s representative to initial the observation. For those tasks listed in the Service Summary, the quality assurance evaluators will follow the methods of surveillance specified in this contract, the QASP and AFI 63-103, Chapter 4 Acquisition of Services. COR personnel will record all surveillance observations. COR surveillance of tasks not listed in the SS or by methods other than those listed in the SS will occur during the performance period of this contract.

1.5.4 Performance Evaluation Meetings. The contract manager may be required to meet at least weekly with the FD and the CO during the first month of the contract. Meetings will be as often as necessary thereafter as determined by the CO. However, if the contractor requests, a meeting will be held whenever a Performance Assessment Report (PAR) is issued. The written minutes of all performance evaluation meetings shall be prepared by the government. Should the contractor non-concur with the minutes of the meeting, they must state any areas of non-concurrence in writing to the CO within fourteen (14) days of receipt of the signed minutes. The minutes will be included in the contract file.

1.5.5 Contracting Officer Representative (COR):

1.5.5.1 The COR(s) is/are a representative(s) of the CO but do not have the authority to make changes to the scope, price, or terms and conditions of the contract.

1.5.5.2 COR will complete an unsatisfactory report and inform the contract manager when any unsafe action is discovered or identified and will request corrective action. The following safety related items are considered extremely hazardous operations or events and any discrepancies/defects noted will result in an unacceptable PAR and will be ultimately reflected in the annual Contractor Performance Assessment Report Summary (CPARS) evaluation.

1.5.5.2.1 Improper grounding/bonding procedures during fuel/LOX operations to include aircraft and ground support equipment servicing, issue/support tank servicing, fuel rotations, fill stand and return to bulk operations, tank truck receipts, LOX issues, laboratory sampling and analysis. Note: When sampling equipment with an in-line sampler that is equipped with an internal bond wire, the equipment does not need to be grounded.

1.5.5.2.2 A lack of serviceable fire extinguishers in the vicinity of any refueling or LOX servicing operation.

1.5.5.2.3 Impeding an emergency evacuation route for personnel involved in fuels/LOX servicing.

1.5.5.2.4 Failure to follow the two man policy IAW AFOSH 91-38, Chapters 2, 3, and 5, AFI 23-201 Chapter 3, T.O. 00-25-172, Chapters 3-6, T.O. 37-1-1, Chapters 2, 6 and operators checklist.

1.5.5.2.5 Protective equipment not being utilized when required.

1.5.5.2.6 Insufficient available space in tanks to accommodate receipt operations.

1.5.5.2.7 Bottom loader & De-fuel test button not activated during aviation fuel fillstand/de-fuel operations.

1.5.5.2.8 Individual not on top of the refueling unit or ground products servicing unit during filling operation if high level shut off valve is inoperative.

1.5.5.2.9 During all fuel/LOX operations; failure to ensure all possible sources of ignition are at least 50’ from the perimeter of the fuels facility and the fuels servicing safety zone (FSSZ).

1.5.5.2.10 Failure to analyze fuel samples in the fuels laboratory under an operating exhaust hood.

1.5.5.2.11 Continuing Fuels operations if a leak occurs. A leak is defined as a spray, stream, or accumulation of fuel, jeopardizing system/personal safety.

1.5.5.2.12 Using improper spotter procedures when backing a refueling unit.

1.5.5.2.13 Storing fuel samples in the lab when the exhaust fan is inoperative and/or storing in excess of 10 gallons of fuel overnight in the fuels lab.

1.5.5.2.14 Failure to immediately terminate a fueling operation in the event a safety violation occurs.

1.5.5.2.15 Any reportable fuel spill that occurs as a result of system/unit operator negligence.

1.5.5.2.16 Failure to utilize vehicle chocks immediately after operator vacates cab/seat of refueling vehicles being used in fueling operations.

1.5.5.2.17 Failure to utilize mandatory checklists for any fuel movement operation.

1.5.5.2.18 Failure to perform a visual walk-around safety inspection prior to moving or operating any refueling vehicle.

1.5.5.2.19 Failure to hold the “Deadman Control or Lanyard” when pump is engaged and fuel is moving or circulating; to include lab personnel obtaining fuel samples or assisting other organizations obtaining fuel samples.

1.5.5.2.20 Failure to provide oversight of fueling operations to ensure no safety violations occur.

1.5.5.2.21 Sleeping during any fuels operation.

1.5.5.2.22 Failure to perform checkpoint inspection for all vehicles utilized.

1.5.5.2.23 Failure to perform Foreign Object Damage (FOD) checks.

1.5.5.2.24 Failure to follow checklists/safety procedures while performing any fuels/LOX/deicing duties.

1.5.5.2.25 Failure to comply with AFOSH 91-501, Chapter 9 (e.g., remove watches, rings, smoking materials, lighters or matches) before entering any fuels area.

1.5.5.2.26 Failure to ensure LOX carts are a minimum of 25’ from FSSZ.

1.5.5.2.27 Failure to set parking brake at all times when vehicle is parked. IAW AFJMAN 24-306, Chapter 8.

1.5.5.2.28 Failure when transiting any Entry Control Point (ECP) with mechanically operated gates, to ensure the gate is fully secured before leaving the area.

1.6 HOURS OF OPERATION.

1.6.1 Normal Hours. Perform work required under this contract as indicated below:

1.6.2 Ensure personnel are on duty to support mission requirements.

1.7 EMERGENCY/CONTINGENCY SITUATIONS. IAW DoDI 3020.37, Continuation of Essential DoD Contractor Services accidents, rescue operations, civil disturbances, natural disasters, and military peacetime and wartime operations may necessitate that the contractor provide increased support or “surge” support above the Firm Fixed Price (FFP) level, IAW 252.237-7023, Continuation of Essential Contractor Services.

1.7.1 Attend Contingency Operation meetings as requested by the FD.

1.7.2 Update and maintain the existing Strike Plan. The Strike Plan shall address how the contractor will provide required services in the case of a labor dispute. Submit the updated Strike Plan for acceptance no later than thirty (30) days following the contract award date. The CO will consider approving any changes to the plan within thirty (30) days of occurrence.

1.8 ENVIRONMENTAL REQUIREMENTS.

1.8.1 Environmental Laws and Regulations Compliance. Institute a strict compliance and environmental evaluation program and be knowledgeable of and comply with Executive Order 13423, applicable federal, state, local laws, permits, and DoD, AF, AFMC and KAFB regulations that are listed in an Appendix C. Comply with petroleum and hazardous substance pollution contingency plan and spill prevention, control and countermeasures plans and ensure all fuel personnel are trained in their responsibilities under these plans. Establish policies and procedures to protect the health and safety of personnel using, living, or working on properties under the jurisdiction of Kirtland AFB and minimize or eliminate risks of environmental pollution. Contractor operated facilities and operations are subject to environmental compliance inspections without notice. The contractor shall be liable for any failure to comply with the foregoing requirements and environmental damage and remediation resulting from such failure.

1.8.2 Environmental Compliance. Comply with 377 MSG/CEAN Hazardous Material Emergency Planning and Response Plan, environmental requirements listed in Appendix C, and incorporate the following procedures.

1.8.2.1 Appoint an Environmental Monitor to perform the duties outlined below as well as outlined in AFI 23-201, Paragraph 7.10.8, that is experienced working with environmental instructions and procedures. The Environmental Monitor shall be the focal point for all environmental issues and processes that deal with requirements of this PWS.

1.8.2.2 Responsible for providing a fully trained workforce. Provide environmental, health, and safety training to ensure employee compliance with Federal, State, and local laws, regulations and instructions.

1.8.2.3 Participate in AFI 90-803, Environmental, Safety, and Occupational Health Compliance Assessment and Management Program (ESOHCAMP).

1.8.2.4 Comply with Laws and Regulations. Comply with and be knowledgeable of all applicable Interstate, Federal, State, and local laws, regulations and requirements regarding environmental protection. In the event environmental laws/regulations change during the term of this contract, the contractor is required to comply as such laws come into effect.

1.8.2.5 Comply with all applicable Federal, State, and local laws and regulations covering environmental protection, pollution control and abatement listed in Appendix C. Environmental violations include, but are not limited to, violations of permit terms (e.g., reporting, records keeping, exceeding limitations on emissions or effluents, etc.), statuary or regulatory violations (e.g., failure to notify, consult, or obtain permits), releases (e.g., failing to report, etc,), and any other negligent intentional or criminal conduct giving rise to an environmental violation of applicable environmental laws and regulations, as defined above.

1.8.2.6 Be liable for and promptly pay any fines or penalties assessed against the Air Force, Department of Defense (DoD), or the United States for noncompliance resulting from environmental violations attributable to the contractor, contractor’s employees or agents, or subcontractors, in performing this contract. The government retains the right to initiate and complete all cleanup actions for which the contractor shall reimburse the government for all costs associated with cleanup.

1.8.2.7 Coordination of Environmental Issues. Contractor environmental Monitor or alternate shall coordinate all activities involving environmental issues with the 377 MSG/CEAN and notify the FD of said coordination. Notify the FD of any action or event, which results in or may result in adverse environmental effects or that has a potential for environmental concern.

1.8.2.8 Contractor Environmental Plan. Develop, manage and maintain a complete environmental plan to assure compliance with all environmental statutes and regulations. Submit the Environmental Plan to the CO for FD approval thirty (30) days prior to the start of the first operational performance period and as changes occur within five (5) days of change. The plan shall include, but not limited to the following:

1.8.2.8.1 Hazardous waste accumulation, transportation, storage and personnel training.

1.8.2.8.2 Satellite accumulation point management and training.

1.8.2.8.3 Small spill cleanup and training.

1.8.2.8.4 Self evaluation programs which ensures compliance with all federal, state, and local environmental rules and regulations.

1.8.2.8.5 Hazardous Material/Waste training program for personnel.

1.8.2.8.6 Hazard Communication Program and training.

1.8.2.9 Coordinate Environmental Issues. The contractor environmental monitor or alternate shall coordinate all activities involving environmental issues with the 377 MSG/ CEAN and notify the FD of said coordination. Notify the FD of any action which results in or may result in adverse environmental effects or that has potential for environmental concern.

1.8.2.10 Notification of Environmental Spills. Respond to hazardous material spills caused in performance of this contract. If the contractor spills or releases any hazardous material, the contractor or its agent shall immediately report the incident to 377 MSG/ CEAN. The contractor is responsible for reporting spill to the appropriate regulatory agencies IAW KAFBI 32-7001, Installation Hazardous Material Emergency Planning and Response Plan. The liability for the spill or release of hazardous material by the contractor shall rest solely with the contractor. Reimburse the government for cost of sampling and laboratory analytical services, cleanup, and recovery of the contractor-caused spills if additional clean up and recovery services are required by another source.

1.8.2.11 Hazardous Material Storage and Use. Follow manufacturer’s guidelines and professional recommendations for all hazardous materials in the control of humidity, temperature, cleanliness and materials handling.

1.8.2.12 Manage hazardous material management program as required for the performance of this PWS. Comply with all policies and procedures developed by the Hazardous Material Management Process Team (HMMPT) as detailed in KAFBI 32-7001, Hazardous Material Management Supplemental Instruction. The purchase of all hazardous materials will be reported to and approved by the HMMPT.

1.8.2.13 Establish policies and procedures to protect public health and safety by minimizing or eliminating the risk of environmental pollution.

1.8.2.14 Contractor Cleanup. Keep all work areas and storage areas free from waste materials, excess hazardous materials and rubbish.

1.8.2.15 Hazardous Waste Collection. Ensure proper collection and turn-in of contractor generated hazardous, non-hazardous, toxic, special or radiological wastes and materials. Turn-in procedures shall be IAW all current Federal, State, and local environmental rules and regulations. All hazardous waste is manifested under the KAFB EPA Hazardous Waste Identification Number IAW KAFBI 32-7001.

1.8.2.16 Obtain approval from 377 MSG/CEAN for all additional on-installation hazardous waste accumulation and satellite accumulation points/sites (IAP) listed in Appendix F.

1.8.2.17 All contractor generated hazardous waste transported off installation shall be manifested to an EPA permitted treatment, storage or disposal facility IAW 40 CFR Parts 260-272 and 20.4, New Mexico Application Committee (NMAC). Coordinate hazardous waste turn-in and disposal requests through the FD and the 377 MSG/CEANC, IAW AFI 32-7002, Environmental Information Management Systems, KAFBI 32-7002, Solid Waste Management, and AFI 32-7042, Solid and Hazardous Waste Compliance.

All routinely generated waste will be disposed of at the government’s expense.

1.8.2.18 Solid Waste Management. Comply with the solid waste regulations in 20.9 NMAC, AFI 32-7042. Participate in the installation recycling program and use pollution prevention and source reduction.

1.8.2.19 Storm Water Management. Ensure management, operation, and maintenance of storm water discharge under contractor control is done in compliance with all current Federal, State, and local environmental rules and regulations as listed in Appendix C. Comply with Energy Independence and Security Act (EISA) Section 438 (42 USC 17094) requirements and IAW AFPAM 32-7043, Hazardous Waste Compliance, Implement best management practices contained in the Multi-Sector General Storm Water Permit and Plan, the Municipal Separate Storm Sewer System Permit and Plan, and the Construction General Storm Water Permit.

1.8.2.20 Affirmative Procurement. Comply with Executive Order 12873 Federal Acquisition, Recycling and Waste Prevention.

1.8.2.21 Environmental Management Systems. Participate in the Installation Environmental Management System, as required by Executive Order 13423 Strengthening Federal Environmental, Energy and Transportation Management.

1.8.2.22 Contact 377 MSG/CEANC, Environmental Branch Office and request guidance on all large-scale remedial industrial waste pumping, industrial waste tank and pump station cleaning, hazardous material recovery and disposal, and industrial waste transportation and disposal.

1.8.3 Material Safety Data Sheets (MSDS). Provide MSDS to 377 MSG/CEANC for each hazardous material to be used during the performance of the contract. Information regarding any additional hazardous materials identified after the start of performance shall be submitted with corresponding MSDS to 377 MSG/CEANC for approval prior to bringing the hazardous materials on the base. Maintain a MSDS catalog in each applicable fuels work centers. In addition to required labeling, a number or identification label shall be securely affixed to each hazardous material for cross-reference to the corresponding MSDS on file in the inventory catalogue maintained in the work center.

1.8.3.1 Submit an Air Force Form 3952, Chemical Hazardous Material Request Authorization for each hazardous material that they are using during the performance of the contract to:

1.8.3.2 Provide a list to 377 MSG/CEANC showing known quantities of each hazardous material brought on the base indicating how much was used, and how much was not used. The hazardous material list will be provided within 30 days of award of contract and quarterly thereafter.

1.8.3.3 The contractor shall not store hazardous materials on Kirtland AFB without prior approval by the 377 MSG/CEANC. All hazardous materials approved for storage shall be stored in accordance with all applicable, federal, state, local and Air Force laws, regulations, instructions, policies, guidance and directives listed in Appendix C.

1.8.4 Ethanol (E85) Additives. Contract Manager ensures fuel deliveries of mogas contain an ethanol additive into each mogas receipt during the month of October to insure 2.7% oxygen by weight minimum analysis is obtainable on 1 November each year through the last day of February, IAW 2006 HB 282, New Mexico (NM) Standard and AFI 32-7044 listed in Appendix C.

1.9 DISASTER PREPAREDNESS, EXERCISES, AND OTHER REAL WORLD CONTINGENCIES

1.9.1 Emergency situations (e.g., accident and rescue operations, civil disturbances, natural disasters, and military peacetime and wartime contingency Operations and exercises) may require that the contractor provide increased or reduced support.

1.9.1.1 If the emergency requires additional effort resulting in an increased workload it shall be subject to a negotiated equitable adjustment.

1.9.2 Upon notification by the CO, provide services to support contingencies up to and including war that would generate surge requirements. The CO will advise the contractor of the required level of effort verbally and follow up with a written change to the contract. Payments for these services will be negotiated.

1.9.3 Review, provide input, and support all Base Plans or OPLANs as needed to provide adequate POL servicing support. After contractor review is complete the OPLAN shall be routed through the COR for approval prior to the end of the 30 day transition period.

1.10 CONTRACTOR CONTINGENCY PLAN

1.10.1 Establish and maintain a complete Contingency Plan that will ensure “continuation of services” during periods of crisis, such as a national wartime mobilization. The Plan shall be provided to the CO within 30 days after contract award. Revisions to the Plan shall be submitted to the CO within 30 days after the revision is deemed necessary.

1.11 CONSERVATION OF UTILITIES. Instruct employees in utilities conservation practices. Responsible for operating under conditions that prevent the waste of utilities which shall include the following:

1.11.1 Lights shall be used only in areas where and when work is actually being performed.

1.11.2 Mechanical equipment controls for heating, ventilation, and air conditioning systems shall not be adjusted.

1.11.3 Government telephone services are provided for the transmission of government information only. Telephone communications are subject to security monitoring at all times per DoD Directive 4640.6, Communication Security Monitoring and Recording.

1.11.4 Access to government Local Area Network (LAN), e-mail, internet and government networks and servers shall be limited to official use only. All network connections can and will be monitored IAW AFI 33-219, Web Management and Internet Use.

1.12 HOUSEKEEPING.

1.12.1 Good housekeeping practices shall be maintained in all contractor work areas. Duty locations will be neat and orderly with no excessive paperwork or other clutter visible. Suitable containers shall be located throughout the work area for easy disposal of waste.

1.12.2 All floors and work sites shall be kept clean and free of hazardous and slippery materials. All spills shall be cleaned up immediately. Use only noncombustible absorbents to dry up spills of flammable materials.

1.12.3 Custodial services will be provided in accordance with the current base custodial contract.

1.13 FIRE PROTECTION. Fire protection shall be IAW AFOSH Standard 91-100 and the following requirements:

1.13.1 Follow all local fire regulations and standards listed in Appendix C to ensure that damage does not occur to government property or personnel.

1.13.2 Government furnished portable fire extinguishers shall be maintained in a fully charged and operable condition and kept in their designated locations. When fire extinguishers are removed for maintenance or testing, a fully charged and operable unit shall be provided.

1.13.3 All personnel shall be familiar with the placement and operation of fire extinguishing equipment, location of fire alarm stations, how to report a fire to the Fire Department and building evacuation plans.

1.14 VEHICLE OPERATOR LICENSING.

1.14.1 Vehicle fueling operators shall possess a valid State Hazardous Material CDL Class B with hazmat endorsement driver’s license and a government vehicle operator’s license to operate a Government vehicle. All vehicle operator’s shall be trained and certified as operators for each type of vehicle they operate and complete applicable traffic safety training courses, specified in AFI 91-207, The USAF Traffic Safety Program prior to operating on the flight line. Vehicle operator training is the responsibility of the contractor. Training will be documented by the contractor and will be subject to review by the CO or FD at anytime. 1.14.2 All vehicles listed as GFV in Appendix K shall be inspected and maintained in good operating condition and appearance. Daily, weekly, and monthly inspections will be documented on an AF Form 1807 with a complete list of discrepancies and conditions. Signatures indicate the inspection has been completed.

1.14.3 Contractor personnel shall comply with all directives pertaining to operation of privately-owned vehicles on Kirtland Air Force Base per AFI 31-204, Air Force Motor Vehicle Traffic Supervision, Vehicles Registration Official (VRO) Handbook, Vehicle Registration Program, Kirtland AFB, 14 July 2000, and applicable MAJCOM/Local supplement listed in appendix C.

1.14.4 All personnel who operate GFVs or are authorized Private Owned Vehicles (POVs) on the flight line shall be properly licensed, certified, and authorized IAW AFI 13-213, Airfield Management, AFI 24-301, Vehicle Operations, and other applicable directives and MAJCOM/Local supplement listed in Appendix C.

1.14.5 Assume responsibilities as the Vehicle Unit Flight line Driving Program Manager for contractor personnel. Comply with AFI 24-301, AFI 31-204, and AFMAN 24-306, Manual for Wheeled Vehicle Driver, AFOSHTD 91-100, Aircraft Flight line Ground Operations and Activities, AFI 13-213, Airfield Management, and MAJCOM/Local supplement.

1.15 SECURITY

1.15.1 Visitor Group Security Agreement (VGSA). The contractor shall:

1.15.1.1 Enter into a long-term visitor group security agreement. This agreement shall outline how the contractor integrates security requirements for contract operations with the Air Force to ensure effective and economical operation on the installation. The Air Force will provide the following security support:

a. Storage containers for classified information/material, use of base destruction facilities, classified reproduction facilities, use of base classified mail services, security badge, base visitor control, investigation of security incidents, base traffic regulations, use of security forms and conducting inspections required by DoD 5220.22-R, Industrial Security Regulation, Air Force Policy Directive 31-6, Industrial Security, and Air Force Instruction 31-601, Industrial Security Program Management.

b. Security support requiring joint Air Force and contractor coordination includes packaging classified information, mailing and receiving classified materials, implementing emergency procedures for protection of classified information, security checks and internal security controls for protection of classified material.

1.15.2 Clearance Requirements. All contractor personnel will possess or obtain an appropriate facility security clearance level of SECRET or higher as established in the applicable DD Form 254, DoD Contract Security Classification Specification. If the contractor does not possess a facility clearance, the Government will request one.

1.15.3 The government will assume the costs and conduct security investigations for the initial security clearances. Submit security clearance requests to the COR within 15 days after contract award. Due to extensive cost involved with security investigations, requests for contractor security clearances shall be kept to an absolute minimum. Comply with the DoD 5200.2-R, Personnel Security Program, and AFI 33-119, Air Force Messaging. Notify 377 ABW/IPD prior to performance of the contract. The notification shall include:

a. Name, address, and telephone number of company representatives.

b. The contract number and contracting agency.

c. The highest level of classified information which contractor employees require access to.

d. The location(s) of contract performance and future performance, if known.

e. The date contract performance begins.

f. Any change to information previously provided under this paragraph.

1.15.4 Entry to Restricted Areas. When the contractor employees require entry to restricted areas, the contractor will request access and then the Air Force shall submit National Agency Check and Inquiries (NACI) for contractor employees. Contractor personnel shall successfully complete a NACI investigation to obtain entry to a restricted area. Comply with DoD 5200.2-R and AFI 31-501, Personnel Security Program Management, requirements.

1.15.5 Pass and Identification Items. Ensure the following pass and identification items are obtained for employees and vehicles:

a. DoD Common Access Card

b. AF Form 1199, USAF Restricted Area Badge.

c. AF Form 75, Visitor/Vehicle Pass (AFI 31-204) prior to obtaining CAC and Defense Biometric Identification System (DBIDS) provided by 377 SFS Pass & ID.

1.15.6 Retrieving Identification Media. Retrieve all identification media from employees who depart for any reason before the contract expires; terminated for cause, retirement etc.

1.15.7 Listing of Employees. Maintain a current listing of employees. The list shall include employee’s printed name, signature and level of security clearance. The list shall be validated and signed by the contractor and provided to the CO and FD within 30 days of contract award. Updated listings shall be provided when an employee’s status or information changes or when requested by a COR.

1.15.8 Additional Security Requirements. In accordance with DoDR 5200.1 and AFI 31-401, comply with AFI 33-207, Computer Security Assistance Program; AFI 33-203, US Air Force Emission Security (EMSEC) Program; AFI 33-204, Information Assurance Awareness Program; AFSSI 9100, Communication Security (COMSEC), Command, Control, Communications and Computer Awareness Program (ETAP),AFI 33-201 V2, Communication Security (COMSEC), and AFI 10-1101, Operations Security (OPSEC) Instructions.

1.15.9 Reporting Requirements. Report to the 377 LRS, Security Manager any information or circumstances which they are aware of that may pose a threat to the security of DoD personnel, contractor personnel, resources, and classified or unclassified defense information which may be classified as counterintelligence incidents, IAW AFI 71-101, V4, Counterintelligence.

1.15.10 Physical Security. Safeguard all government property and provide adequate resource protection for fuel servicing equipment and facilities to prevent contamination, pilferage, sabotage, and accidental damage, including controlled forms provided for contractor use. At the close of each work period all government equipment and facilities shall be secured.

1.15.11 Internal Operating Instructions (OI). Develop, NLT 30 days after the start of the first performance period date an OI IAW AFI 23-201, Chap 1.17, Fuels Management. The OI shall be written in accordance with AFI 33-360, Publications and Forms Management. Provide OI’s to the COR for coordination through the FD.

1.15.12 Controlled/Restricted Areas. Comply with local base procedures IAW AFI 23-201, Chap 4.1, and KAFBI 31-101 Air Force Installation Security Program, for entry into Government controlled/restricted areas.

1.15.13 Requirements for Network Account.

A. Requires a NAC investigation at a minimum B. Complete a DD Form 2875, System Authorization Access Request C. Complete an AF 4394 Air Force User Agreement Statement D. Complete Information Protection/Assurance Training E. Complete User Software Training F. Complete User Computer Security Training

1.16 KEY/COMBINATION CONTROL.

1.16.1 Key Control. Establish and implement methods to ensure accountability for all keys/key cards issued to the contractor by the Government are not lost or misplaced and are not used by unauthorized persons. Keys issued by the Government to the contractor shall not be duplicated.
