space, phone support, and LAN access during the transition period IAW PWS Para 1.21.10. (para 1.21.10 has been incorporated in to the PWS)

RFPSchedule B, Item 0001 and Addendum to FAR 52..212-4, Item 14.0 Transition/Phase-InSchedule B states the Transition/Phase-In is 1 Sep 12 through 30 Sep 12. However, Addendum FAR to 52.212-4, Item 14.0 states the Transition/Phase-In starts 31 Aug 12. Please clarify.RFP Attachment, addendum to FAR 52.212-4, item 14.0 Transition/Phase-In date is revised. The transition date is 1 Sep 12-30 Sep 12.
RFPAddendum to FAR 52.212-2, Para 4, NMGRTThe para states the current percentage of tax applicable to the acquisition. Does the successful offeror have the opportunity to recover these expenses as part of requests for equitable adjustment at the exercise of each option of the contract?IAW FAR Part 52.229-4 (g)- Federal, State, and Local Taxes (State and Local Adjustments)- states that "The Contractor shall promptly notify the Contracting Officer of all matters relating to Federal, State, and local taxes and duties that reasonably may be expected to result in either an increase or decrease in the contract price and shall take appropriate action as the Contracting Officer directs. The contract price shall be equitably adjusted to cover the costs of action taken by the Contractor at the direction of the Contracting Officer, including any interest, penalty, and reasonable attorneys’ fees". (within 30 days IAW FAR Part 52.222-43 (f))
RFPDLA Energy has posted a sources sought notice under SP0600-12-R-0533 solicitation number, for the operation of the Bulk Storage Operations function at Kirtland AFB, and three other bases. We understand that contract will start in late 2013, and will have an effect on the Kirtland contract currently being solicited - FA9401-12-R-0011. Since we will be bidding these services in our FFP pricing - should we address this change in our proposals?No, propose IAW the instructions provided in the RFP. Do not anticipate changes.
RFPRFP Closing Date?Refer to FBO, solicitation FA9401-12-R-0011, Fuels RFP attachment, page 1, block 8.
RFPThe FBO.com presolicitation synopsis page indicated NTE amounts for the cost reimbursable CLIN. Will the government be incorporating these figures into the final solicitation via amendment?No. The government will use NTE amounts for cost-reimbursable CLINs at the time of the award as it states in the solicitation.
PWS1.1.2Please identify which waivers to the organizational structure outlines in AFI 23-201, Chapter 7 are currently approved for the contract organization. Also, please outline what functions will not be considered for waiver to the referenced organization.Currently, there are no approved waivers. Appendix C outlines Publications and Forms which are not considered waiverable.
PWS1.1.2If the proposal is priced in expectation of waivers being granted, will a pricing adjustment be allowed in the case of waivers being denied?Price adjustments will be

made if a waiver to the PWS is approved.

PWS1.2.2.7The para states random testing is requied after initial hires are completed for the contract. What is the percentage of employees to be tested under the random testing provision?Drug testing will be done IAW PWS Para 1.2.2.7 (revised). All contract employees shall be subject to substance abuse toxicological testing at the contractor's expense.
PWS1.4.1The para states that End of Fiscal Year Support is to be provided, as required, in September. Are services beyond normal duty hours for fuels management, as outlined in PWS para 1.6, cosidered as reimbursable overtime?No. Fiscal year end close out will be accomplished within the normal duty hours.
PWS1.8.2.17The para states that generated hazardous waste will be disposed of in accordance with Federal and States status. Are the costs of this disposal the responsibility of the government?Hazardous waste disposal will be at the cost of the government (IAW 1.8.2.17 revised), unless contractor is found negligent in their duties that initiated the hazardous waste (IAW 1.8.2.10)

PWS 1.18.6 The para identifies AFI 10-404 tenant support requirements. Please provide a listing of the current host tenant support agreements and effective dates of the agreements in place. There are no host tenant support agreement. If one is initiated, then price of additional workload will be negotiated with contractor.

PWS2.4.4The para outlines the issue window for LOX products. Are LOX issues beyond the normal window considered as an over and above?No. Paragraph 2.4.4 identifies the normal, routine service times for LOX, but does stipulate that emergency situations can occur at any time.
PWS2.6.1The para states that the FISC will be supervised and manned 24/7. Is the government stating that there is a requirement for a dedicated supervisory person in the FISC for the 24/7 period?Supervisory responsibilities are to be determined by the contractor.
PWS2.8.1The para states that the contractor must submit an overtime request to the FD and CO for approval prior to work being performed. Do we need to provide an overtime rate for each proposed position with our proposal? If so, will an additional CLIN be established to reflect the overtime rates?Overtime rate is not needed at the time of the evaluation of the proposals. Overtime CLINs are 0006, 1004, 2004, 3004, and 4004 as it states in the RFP.
PWS3.3Will the government provide non-expendables for the Fuels labrotary?Yes. See appendice I.
PWS3.8.1Based on Section 3.8.1 in the PWS the contractor is responsible for the maintenance cost and replacement responsibility for GFE w/o reimbursement from the government. Will you provide a list of what equipment this is referring to. Our assumption is that the contractor will not be responsible for the R11’s or the L1 Storage tanks.Para 3.8.1 has been amended. Contractor will not be responsible for maintenance or replacement of Vehicles, Buildings, or Bulk Storage Facilities unless they are damaged by contractor negligence.
