Questions and Answers

1. Is the Contractor responsible if the retention pond overflows?

The Government will maintain the water level of the retention pond. Since this is a BPA, the technical POC for the Government will call the Contractor out when water needs to be removed from the retention pond. Once the call is made it is the responsibility of the

Contractor to begin the removal process within 48 hours of the call.

2. Is there any specific way that the sample collection needs to be made?

The sample collection shall be done in a method that is in accordance with industry standards and compliant with the requirements of the Contractors chosen analysis lab.

3. How will the Contractors chosen treatment and disposal facility be analyzed by the technical team for compliance?

The technical team will check to make sure the facility is in compliance. The facility shall be in compliance with local, state, and federal EPA requirements and not involved in any public nuisance activities. This includes any open or recent Notice of Violations (NOVs), findings or other regulatory actions.

4. What is the Government looking for in terms of an analysis report?

The report should be similar to attachment 6 of the solicitation titled Pond Water

Analytical Report. See subfactor 2 in the evaluation factors listed in attachment 2 of the solicitation.

5. The payment method of the BPA language paragraph 10 titled Method of Payment (b) titled

Government Purchase Card calls for the contractor to accept GPA payments up to $250,000 from a warranted Contacting Officer. Is the Government planning on using a warranted Contracting

Officer’s government purchase card up to $250,000?

The Government has no plans of using a warranted Contracting Officer’s government purchase card. This element of the BPA language paragraph 10 titled Method of

Payment (b) titled Government Purchase Card will be removed from the final award of the BPA. Any call over $25,000 will be facilitated through a call order and paid through the WAWF system.
