Continuation of block 14. DESCRIPTION OF AMENDMENT/MODIFICATION

The Purpose of this Amendment to solicitation- FA8576-23-R-0003 is to update this soliciation after receiving and evaluating a proposal and recommendations from the contractor. Another adequate proposal is required to be submitted by the date below. This soliciation is to accomplish the following:

A) Extend the Request for Proposal deadline to 17 May 2024 at 3:30pm

B) Update the basic year and ordering period dates to reflect updated planned award schedule

C) Remove the following CLINs since the cost elements of this contract are being removed:

0009- Engineering Services 0010- Travel 1009- Engineering Services 1010- Travel

D) Renumber the following CLINs since the CLINs above were removed:

CLIN 0011 is now CLIN 0009 CLIN 1011 is now CLIN 1009

E) Remove clauses that pertained to cost

F) Replace Attachment 1 - Performance Work Statement, dated 14 August 2024 with an updated version titled: Attachment 1 - Performance Work Statement, dated 30 April 2024.

G) Update CLIN 0011 and 1011 to remove reference to data reports that are no longer required by the PWS.

H) Replace Attachment 2- CDRLs from the original RFP with the updated CDRLs.

Except as provided by this solicitation amendment, all terms and conditions of this solicitation remain unchanged and in full force and effect.

This copy of this amendment to soliciation FA8576-23-R-0003 contains all updated information from previous amendments and clauses/provisions for the RFP.

PART I - THE SCHEDULE

SECTION B

SUPPLIES OR SERVICES AND PRICES/COSTS

B.1 GENERAL: This Request for Proposal (RFP) is issued with the intent to establish a contract to support the Defense Advanced GPS Receiver (DAGR) System. The Contractor (independently and not as an agent of the Government) shall furnish all necessary personnel, labor, supplies, materials and travel (except as otherwise authorized by the Contracting Officer) as required to perform the requirements described herein, and as required under each line item. Performance shall be in accordance with all provisions and specifications as stipulated herein.

B.2 CONTRACT TYPE: This is a Requirements type contract as defined in FAR 16.5. The quantities identifed in the Schedule represent the Government's Best Estimated Quantities (BEQs) and do not represent a minimum or maximum quantity. Failure of the Government to order the BEQ quantity will not entitle the contractor to an equitable adjustment under the contract. This contract utilizes Firm Fixed Price (FFP) type Contract Line Item (CLINs). Each CLIN indicates the type used for each particular requirement.

B.3 ORDERING PERIOD: In accordance with the clause in Section I of this contract, FAR 52.216-18, Ordering, orders may be issued hereunder for a period of two (2) years from the effective date of the contract against the contract line item numbers (CLINs) included in the schedule. Orders issued hereunder shall utilize the CLIN representing the period in effect at the time of order award for purposes of pricing. The contract periods associated with each CLIN series are defined as follows:

Basic year: 0001-0009 – 31 July 2024 - 30 July 2025 Order Period I: 1001-1009 – 31 July 2025 - 30 July 2026

B.4 AUTHORITY TO ISSUE ORDERS: Only the AFLCMC/WNK Contracting Office may issue orders for this contract.

B.5 PLACE OF PERFORMANCE: Performance of orders issued hereunder shall be in accordance with individual orders.

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern.

The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

(a) Invoice payments—

(5) Computing penalty amount. The Government will compute the interest penalty in accordance with the Office of Management and Budget prompt payment regulations at 5 CFR part 1315.

(i) For the sole purpose of computing an interest penalty that might be due the Contractor, Government acceptance is deemed to occur constructively on the **** day (unless otherwise specified in this contract) after the Contractor delivers the supplies or performs the services in accordance with the terms and conditions of the contract, unless there is a disagreement over quantity, quality, or Contractor compliance with a contract provision. If actual acceptance occurs within the constructive acceptance period, the Government will base the determination of an interest penalty on the actual date of acceptance. The constructive acceptance requirement does not, however, compel Government officials to accept supplies or services, perform contract administration functions, or make payment prior to fulfilling their responsibilities.

(a) Definitions. As used in this clause—

(1) “Contract financing payment” and “invoice payment” have the meanings given in section 32.001 of the Federal Acquisition Regulation.

(2) “Electronic form” means any automated system that transmits information electronically from the initiating system to all affected systems. Facsimile, e-mail, and scanned documents are not acceptable electronic forms for submission of payment requests. However, scanned documents are acceptable when they are part of a submission of a payment request made using Wide Area WorkFlow (WAWF) or another electronic form authorized by the Contracting Officer.

(3) “Payment request” means any request for contract financing payment or invoice payment submitted by the Contractor under this contract.

(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests and receiving reports using WAWF, in one of the following electronic formats that WAWF accepts: Electronic Data Interchange, Secure File Transfer Protocol, or World Wide Web input. Information regarding WAWF is available on the Internet at https://wawf.eb.mil/ .

(c) The Contractor may submit a payment request and receiving report using other than WAWF only when—

(1) The Contracting Officer authorizes use of another electronic form. With such an authorization, the Contractor and the Contracting Officer shall agree to a plan, which shall include a timeline, specifying when the Contractor will transfer to WAWF;

(2) DoD is unable to receive a payment request or provide acceptance in electronic form;

(3) The Contracting Officer administering the contract for payment has determined, in writing, that electronic submission would be unduly burdensome to the Contractor. In such cases, the Contractor shall include a copy of the Contracting Officer’s determination with each request for payment; or

(4) DoD makes a payment for commercial transportation services provided under a Government rate tender or a contract for transportation services using a DoD-approved electronic third party payment system or other exempted vendor payment/invoicing system (e.g., PowerTrack, Transportation Financial Management System, and Cargo and Billing System).

(d) The Contractor shall submit any non-electronic payment requests using the method or methods specified in Section G of the contract.

(e) In addition to the requirements of this clause, the Contractor shall meet the requirements of the appropriate payment clauses in this contract when submitting payment requests.
