In the event of overlapping deliveries due to exercise of option, the Contractor shall not be required to deliver more than ___ EA NSN:1730-01-560-2167BA, Part#: PT90-F-509 in any 30 day period.

ADDRESS / INSTRUCTIONS.
(The above Clause/Provision has been modified.)
INSURANCE POLICY
The government has determined that a break in the supply of this item (that is, failure to deliver due to timeliness and/or conformance) would jeopardize support to operational units’ mission capability.
Additionally, the item is of such complexity and/or so critical that first article testing measures are required for all unproven sources to ensure that the unproven source is capable of producing a conforming part.
Therefore, the government reserves the right to award the Mission Essential Quantity (MEQ) and, if necessary, the remainder of the requirement to a proven source. Therefore, two contract line items are provided to correspond with each of the two alternatives.
Alternative I (Awarding the Entire Basic Quantity)
Under Alternative I, Proposals “A” and Proposals “B” are evaluated together in accordance with clause M-900 of this solicitation to determine best value to the Government.
Proposal A (First Article Required) (Unproven source) First Article Quantity 1 each Production Quantity 10 each
Proposal B (First Article Not Required) (Proven/Qualified source) Production Quantity 11 each
If a Proposal “B” is successful, award is made to that qualified source. If a Proposal “A” is the successful offeror, then all proposals will be evaluated under Alternative II. The Government now anticipates awarding two contracts. One contract will be awarded to the successful unqualified source and one contract will be awarded to the successful qualified source.
Alternative II (Insurance Policy Award)
Activation of the Insurance Policy. The government shall first determine the apparent successful offeror for the complete quantity under Alternative I. If offers are received from both proven and unproven sources and it is determined that an unproven source is the successful offeror (and is also responsive and responsible), then the prices under Alternative II shall be evaluated. Once a decision has been made to progress to Alternative II, offers under Alternative I shall no longer be considered. Again, the insurance policy is activated only when an unproven source is the successful offeror under Alternative I. If an unproven source is the successful low offeror under Alternative I, evaluation now occurs under Alternative II, with the intention of awarding two contracts, one with First Article(s) and a production option to the unproven source, and one with a mission essential (MEQ) quantity and a production option to a proven source.
Under Alternative II, all Proposal Cs are evaluated against Proposal Cs (unqualified sources) to find the successful first article contractor, and all Proposal Ds are evaluated against Proposal Ds (proven/qualified sources) to find the successful qualified source.
Proposal C (First Article Required) (Unproven source) First Article Quantity 1 each Production Quantity 2 each (to be exercised if the First Article is successfully produced) *Production Option Quantity 8 each (see note below)
Proposal D (First Article Not Required) (Proven/Qualified source) MEQ Quantity 8 each *Production Option Quantity 3 each (see note below)
*Production Option Quantities are only awarded to satisfy the entire requirement under the following conditions:
Proposal C: in the event a fair and reasonable price can not be negotiated with the proven source for the MEQ quantity OR Proposal D: in the event the unproven source is unable to submit a conforming First Article on schedule.
Scenario (1): Unproven source delivers an approved first article If the unproven source delivers an approved first article, then manufacture of production units by the “newly approved” source is authorized to begin. The Production Option CLIN may be exercised for the MEQ quantity (8) in the event a fair and reasonable price cannot be negotiated with the proven source.
Scenario (2): Unproven source fails to deliver an acceptable first article If the unproven source fails to deliver an approved first article, then production line items will be terminated for convenience of the Government. Then, the proven/qualified source Production Option CLINs will be exercised for the remainder of non-MEQ production quantity (3 each). **The unproven source will have to fail in the effort to produce the First Article BEFORE the production option for the proven source can be exercised.
>>NOTE to Unproven Sources: Complete both Alternative I, Proposal A and Alternative II, Proposal C.
>>NOTE to Proven/Qualified Sources: Complete both Alternative I, Proposal B and Alternative II, Proposal D.
Offeror Note: For First Article Wavier Information see “First Article Applicability and/or Conditions for Wavier” Section L-409.
>> All offerors shall propose on the outyear option.

FIRST ARTICLE TEST, CERTIFICATION AND DISPOSITION REQUIREMENTS
(FEB 1998)
(IAW FAR 9.308-2)
Test criteria are as follows:
Lot/Item Government Test/Inspection Requirements
Lot/Item Contractor Test/Inspection Requirements 0001AA (See Below)
First Article Test:
Contractor portion of First Article (FA) testing consists of performance of Acceptance Test Procedure (ATP) and all pre-ATP testing/inspection IAW the item Technical Data Package (TDP), plus documentation of conformance to same incl. dimensions, materials & processes. Final FA acceptance shall not be granted until the FA passes final Government First Article inspection and/or functional testing after delivery.

2) Failure to pass the Acceptance Test Procedure (ATP) (DWG 2230) and/or any/all pre-ATP tests contained/referenced in the TDP, shall be grounds for failure of FA Testing.
3) No waiver will be granted of Form/Fit/Function testing except to those manufacturers having previously produced the PT90-F-509 or -511 Engine Trailer and having previously passed form/fit/ function testing. NOTE: At delivery, all items are subject to a receiving inspection IAW the relevant portion of the item Technical Order (T.O.) in accordance with USAF standard practice.

(2) Delivery: 100 days after A001 approval (est. NLT 334 DAC)
(3) Approval: See CDRL
5) Items failing to pass FAT testing will be returned to/retained by the contractor pending disposition by the contractor.
NOTE: Any subsequent retest involving dimensional re-inspection, load tests as contained in the ATP or Form-Fit-Function Tests may entail testing at either the Contractor facility or at a Government facility (as appropriate), involving more thorough verification of compliance with all requirements, dependent upon the degree and nature of the judged non-compliance noted in the initial FAT attempt. Any such re-testing could be subject to contract negotiation IAW the requirements of the FAR’s and other public law as applicable.
6) The First Article test at the contractor facility will be witnessed by the Government Program Engineer, Program Manager, Contract Officer, QAR, and Boeing technical rep or combination thereof (some may waive attendance). At minimum, the QAR will witness the contractor test. Government and Boeing technical reps will witness Government/Boeing testing at Government facility.
7) Government inspection and/functional test will be conducted after First Article delivery (in accordance with the contract). The weapon system prime contractor may assist in conducting the inspection and/functional test.
