About this file
This is a Questions and Answers document for an overhead door installation contract. The requirement specifies installation of a bronze-colored overhead door with 24-26 gauge steel construction that must be insulated to match existing doors on the base. The door operates on 3-phase voltage (specifications to be verified from the equipment plate), does not require a high-cycle spring, and installation must occur during working hours of 7:30 AM to 3:30 PM. Burn permits must be issued on the day of work but can remain valid through job completion.
Contractors must comply with FAR Clause 52.219-14 (Limitations on Subcontracting) applicable to this Total Small Business Set-Aside contract. For supply, prime contractors must identify a U.S. small business manufacturer for the doors and verify size status in SAM.gov, or confirm an SBA waiver exists. For service, the prime contractor must perform at least 50 percent of the cost of contract performance for personnel. Installers require standard safety training and appropriate fire extinguishers for welding; no additional site-specific training is mandated. Contractors may submit alternative specifications only if they conflict with company requirements, with reasoning provided at quote submission.

9. FAR Clause 52.219-14, Limitations on Subcontracting (Oct 2022) (15 U.S.C. 657s). Could you please confirm how this clause applies to this requirement? Specifically, as a prime contractor under a Total Small Business Set-Aside, we would like to understand whether subcontracting to a similarly situated entity is permitted. If so, would the work performed by the similarly situated entity count toward our required performance percentage, or is there a minimum percentage of work that the prime contractor must perform directly to ensure compliance with this clause? If a small business acting as the prime contractor intends to hire another similarly sized entity (also a small business) to provide door installation services, and the prime contractor does not have direct contact with the manufacturer of the doors, how would FAR 52.219-33, the Nonmanufacturer Rule, apply in this situation?
If a clause may not apply to your company or needs to be removed please send in what clause and reasoning for it when you submit your quote.
10. what steps should the prime contractor take to ensure compliance with this clause when subcontracting the installation services and supplying the doors?
Supply: 1. Identify a U.S. small business manufacturer for the doors. 2. Verify their size status in SAM.gov. 3. Alternatively, confirm an SBA waiver exists for this product type.
Service: Ensure your firm performs at least 50% of the cost of contract performance incurred for personnel.
