About this file

This document is the SECTION M PROVISIONS for a federal contract opportunity. It outlines the evaluation basis and award criteria for a 5-year IDIQ contract to provide F-16 Circuit Card Assemblies to support USAF and FMS orders.

The contract will be awarded on a price-only basis, with the lowest priced, responsible offeror who meets the solicitation requirements receiving the award. Past performance will not be evaluated. Proposed prices must be fair and reasonable, and pricing must be balanced across line items. The government intends to award without discussions, but reserves the right to conduct clarifications. The solicitation has an anticipated award date within 30 days after the May 30, 2024 closing date. Post-award notices will be provided to the successful offeror and unsuccessful offerors, including the contract price and reason(s) for non-selection.

SECTION M PROVISIONS

EVALUATION BASIS FOR CONTRACT AWARD

**SOURCE SELECTION PROCEDURES WAIVED**

EVALUATION - PRICE ONLY

1. Introduction. All offers shall be considered. Award shall be made on All or None basis. Offerors shall submit the proposal IAW with provision 52.215-1, Instructions to Offerors – Competitive Acquisition and ALT II for deliveries.

Offerors are required to be the actual qualified manufacturer and a responsible DoD contractor. The offeror shall meet all of the requirements in the solicitation and resulting contract to include all of the required delivery times or propose competitive delivery times with justification (see 52.215-1 ALT II). The proposal will be evaluated to determine if it meets the Government’s requirement. If an offeror fails to meet the solicitation requirements nor provided reasonable justification for new proposed delivery times, the Government has the right to reject the offer and the offeror will be ineligible to receive the award. The contract is scheduled for award within 30 days after the solicitation closed.

2. Evaluation – Price Only. a. This acquisition shall use price as the only evaluation factor. The Procurement Contracting Officer (PCO) has waived evaluating past performance and source selection procedures due to the fact that there is not enough competition to warrant source selection and therefore would not be beneficial in selecting the best value for the Government. Instead, the lowest priced offer who is in compliance to the solicitation and has been determined a responsible DoD contractor per FAR Subpart 9.1 shall receive the award.

b. Total Evaluated Price (TEP). The PCO shall calculate the TEP that represents the IDIQ maximum value as follows, below is an example:

YEAR 1: First Article (FA) 1EA X Unit Price $7 = $7 YEAR 1: FA Test Plan & Procedures 1EA X Unit Price $4 = $4 *YEAR 1: Optional Contingency CLIN for Provisioning Prototype(s) for FA Subparts Total Unit Price(s) $5 = $5 YEAR 1: BEQ 7EA X Unit Price $5 = $35 YEAR 2: BEQ 8EA X Unit Price $6 = $48 YEAR 3: BEQ 8EA X Unit Price $7 = $56 YEAR 4: BEQ 8EA X Unit Price $8 = $64 YEAR 5: BEQ 8EA X Unit Price $9 = $72 $291 Max IDIQ Ceiling Value

c. Price Reasonableness. Normally, price reasonableness is determined by receiving adequate price competition.

However, if only one offer is received, the offer shall provide necessary supporting evidence at the PCO’s request to demonstrate their proposed price is fair and reasonable IAW provision 252.215-7008, Only One Offeror, in order to receive the award.

d. Price Must Be Balanced. “The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items” that it poses an unacceptable risk IAW 52.215-1(f)(8).

3. Award Without Discussions. The Government intends to award a single 5-year IDIQ without discussions;

however, the Government reserves the right to conduct discussions if deemed in the Government’s best interest.

Clarifications are limited exchanges between the agency and offerors that may occur when contract award without discussions is contemplated; an agency may, but is not required to, engage in clarifications that give offerors an opportunity to clarify certain aspects of proposals or to resolve minor or clerical errors IAW FAR 15.306(a). The agency has broad discretion to decide whether to engage in clarifications with an offeror. Clarifications cannot be used to cure deficiencies or omissions in a proposal or otherwise revise a proposal.

4. Post-Award Notices.

a. Successful Offeror. IAW 15.504, Award to successful offeror, “The contracting officer shall award a contract to the successful offeror by furnishing the executed contract or other notice of the award to that offeror.” (a) If the award document includes information that is different than the latest signed proposal, as amended by the offeror’s written correspondence, both the offeror and the contracting officer shall sign the contract award.

b. Unsuccessful Offeror. IAW FAR 15.503(b)(1) “Within 3 days after the date of contract award, the contracting officer shall provide written notification to each offeror whose proposal”…”was not selected for award ( 10 U.S.C.2305(b)(5) and 41 U.S.C.3704)”.
