PERFORMANCE-BASED WORK STATEMENT (PWS)

FOR

HAZARDOUS MATERIALS MANAGEMENT SYSTEM (HMMS) PROGRAM MANAGEMENT OFFICE (PMO) SUPPORT 22 May 2008

1.0 DESCRIPTION OF SERVICES

The Hazardous Materials Management System Program Management Office, OO-ALC/ITMS, has the overall responsibility for the management of the HMMS Program for all of the DoD and other Federal Government “using” facilities. This includes but is not limited to: contract management; technical, functional, operational and training support; business analysis and process improvement; planning and coordinating application and technical upgrades; planning and coordinating implementation for new using facilities; planning and coordinating HMMS community meeting and Conferences; planning and coordinating for system demonstrations for potential “using” facilities.

The objective of this SOW is to provide non-personal functional services to assist the HMMS PMO to successfully maintain and improve the HMMS. The contractor shall provide continuous assistance and support to the HMMS PMO to enhance the functional capabilities of HMMS and support related operations, training, implementation and programmatic activities for the PMO and all installed and to-be installed HMMS locations.

1.1 Basic Services - Program Management Support. (FFP - Full-time)

1.1.1 The Contractor shall assist the PMO to enhance the functional capabilities of HMMS.

1.1.1.1 The Contractor shall be thoroughly familiar with the mission and capabilities of the HMMS environment and skilled in conveying that information.

1.1.1.2 The Contractor shall serve as a member of the HMMS Program Management Team.

1.1.1.2 The Contractor shall participate in HMMS system reviews.

1.1.1.3 The Contractor shall advise management and technical personnel on required changes in process and methodology for the program to remain compliant with current regulatory requirements.

1.1.1.4 The Contractor shall assist the PMO with requirements identification and management.

1.1.1.5 The Contractor shall support the HMMS PMO with requirements identification, development, and testing oversight to ensure integration of new features, functions, and technologies into current business processes.

1.1.1.6 The Contractor shall participate in functional reviews of product enhancements and feature clarifications for correctness and adherence to the design concept and user standards.

1.1.1.7 The Contractor shall participate with the HMMS Program Manager to ensure problem resolution and user satisfaction.

1.1.1.8 The Contractor shall participate in special teams or committees as designated by the PMO.

1.1.1.9 The Contractor shall assist the PMO with the creation, review, and coordination of required programmatic documentation such as: HMMS Program Charters, plans, briefings, and business plans.

1.1.2 The Contractor shall assist the PMO by providing Project Management Services as required

1.1.2.1 The Contractor shall create and execute a plan for the successful accomplishment of the assigned project(s).

1.1.2.2 The Contractor shall create and track the project schedule.

1.1.2.3 The Contractor shall participate in all required functional training and functional on-site support for the all phases of the project.

1.1.2.3 The Contractor shall participate with other key participants in the project such as the support contractor, the Service/Agency/site and the supporting personnel, trainers, functional specialist, technical specialist, etc.

1.1.2.4 The Contractor shall participate in, create agendas, and produce minutes for all meetings required to accomplish the project, including teleconferences and face-to-face meetings.

1.1.3 The Contractor shall assist the PMO as needed, in planning, coordinating, overseeing, documenting and reporting on site surveys for current, planned or potential HMMS using sites. The site survey team, consisting of technical and functional specialists, primary support contractor representatives and PMO representatives shall evaluate the sites’ functional business practices, existing technical equipment and communications capabilities, workload, the functional, logistics, engineering requirements for implementation, training requirements, required implementation support and out-year requirements necessary for a successful implementations.

1.1.3.1 The Contractor shall create and participate in the site survey as directed by the PMO.

1.1.3.2 The Contractor shall provide input to the PMO to identify the optimal composition of the site survey team needed to meet the requirements of the particular site survey.

1.1.3.3 The Contractor shall provide input on the site survey schedule with the site, the survey team members and the PMO. This shall include any required/desired briefings, what persons, facilities and/or areas of the site shall be surveyed.

1.1.3.4 The Contractor shall provide or participate in any pre-requisite material, briefings, checklists or other information required for the survey.

1.1.3.5 The Contractor shall participate with the site survey team for any associated briefings for the site personnel.

1.1.3.6 The Contractor shall prepare a site survey report to include, the agenda, methods, and findings from the site survey team.

1.1.4 The Contractor shall assist the PMO in overseeing, monitoring, evaluating and improving HMMS operations, system upgrades, and new site implementations.

1.1.4.1 The Contractor shall examine current technical and functional business practices, and ensure, as applicable, the customer(s) are provided with the best system(s) to meet their objectives and goals for the Hazardous Material Management Program

1.1.4.2 The Contractor shall assist the PMO, the sites and the primary support contractor methods, mechanisms and materials for identifying, reporting and resolving data or system weaknesses

1.1.4.3 The Contractor shall, as directed by the PMO, participate in corrective actions and user training.

1.1.4.4 The Contractor shall participate, as directed by the PMO, in any required implementation support as new modules are brought online and maintenance fixes to existing software are implemented, integrated, or interfaced into the HMMS Program environment.

1.1.4.5 The Contractor shall provide assistance to the HMMS user community, such as, but not limited to, coordinating with the sites and the PMO for Site Progress Validations and Problem Resolution. As new modules are released, the Contractor shall assist the Customer with implementation for deployment of the system and interface updates.

1.1.4.6 The Contractor shall provide input for technical and functional implementation, training, and progress assessments for the implementation of new HMMS using sites.

1.1.5 The Contractor shall assist the PMO in communicating information about the HMMS program to current and potential HMMS users, to the various military Services, other Federal Government agencies and in planning, coordinating and executing meetings and conferences held for the HMMS User community.

1.1.5.1 The Contractor shall participate in the annual HMMS Site POC Conference. This conference provides the users with a platform for expressing their views and opinions about the direction of the program, and specific solutions to ever-changing compliance requirements.

1.1.5.2 The Contractor shall assist the PMO with the planning, coordination and execution of the annual HMMS Users’ Conference.

1.1.5.3 The Contractor shall assist the PMO in planning, coordinating, and briefing development for presentations and demonstrations of HMMS to potential HMMS using facilities in the DoD and other government agencies, for HQ’s and Agency decision makers and at HMMS related User and trade conferences.

1.1.5.4 The Contractor shall create newsletters for distribution to the HMMS Using community.

1.1.5.5 The Contractor shall assist the PMO in developing responses to program inquiries, misinformation, and problems resulting from misperception and miscommunication by outside sources or agencies.

1.1.6 TRAVEL REQUIREMENTS. This task requires travel to various DoD and/or commercial installations both in the CONUS and OCONUS. Contractor travel shall be with prior approval of the PMO, shall be in accordance with the Joint Travel Regulations and is subject to the not-to-exceed funding limit for this task.

1.2 Basic Services - Functional Support (Training, Implementation, Testing, Site Survey participation, Demonstrations) (T&M - As Required)

1.2.1 The Contractor shall assist the PMO enhance the functional capabilities of HMMS.

1.2.1.1 The Contractor shall be thoroughly familiar with the mission and capabilities of the HMMS environment and skilled in conveying that information.

1.2.1.2 The Contractor shall participate in HMMS system reviews.

1.2.1.3 The Contractor shall participate in HMMS functional testing.

1.2.1.4 The Contractor shall advise management and technical personnel on required changes in process and methodology for the program to remain compliant with current regulatory requirements.

1.2.2 The Contractor shall assist the PMO in providing operational support to the HMMS Users by providing functional expertise to assist in identifying and correcting operational problems at the HMMS using facilities.

1.2.2.1 The Contractor shall be knowledgeable in the HAZMAT/HAZWASTE process business rules supported by the HMMS, and be able to analyze the existing HMMS user environment.

1.2.3 The Contractor shall provide HAZMAT functional training.

1.2.3.1 The Contractor shall assist the PMO, or those designated by the PMO, in the development of appropriate training syllabuses.

1.2.3.2 The Contractor shall provide input into the required training facilities, aids and equipment.

1.2.4 The Contractor shall assist the PMO in the implementation of HMMS at existing (version upgrades) and new HMMS using facilities.

1.2.4.1 The Contractor shall participate in on-site and telephonic site surveys.

1.2.4.2 The Contractor shall assist new and existing HMMS using facilities with business practice implementation or modifications.

1.2.4.3 The Contractor shall assist the HMMS using facilities with data conversion.

1.2.4.4 The Contractor shall assist the PMO with the briefings, presentations and demonstrations of HMMS to potential DoD and other government agencies and at HMMS related User and trade conferences.

1.2.3 TRAVEL REQUIREMENTS. This task requires travel to various DoD and/or commercial installations both in the CONUS and OCONUS. 3.0 GOVERNMENT FURNISHED PROPERTY AND SERVICES

3.1 The government shall provide the contractor personnel with use of workspace, furniture, telephones, and computer equipment and access with the OO-ALC. If the specific task order requires the contractor to gain access to either the Hill AFB local area network (LAN) or the use of the internet from Hill AFB, or Hill AFB email service, the OO-ALC point of contact, designated by the QAP, shall forward the contractor’s request to the 75ABW/CS/BCC for a computer account. The sole authority to provide or deny the contractor privileges to Hill AFB computer services lies with the 75ABW/CS/BCC. All documentation provided as part of this contract shall remain government property and shall be returned to the government at the end of each task order period of performance. The QAP shall periodically inspect and inventory government property in relation to this PWS, and provide the information and results to the contracting officer.

3.2 Facilities. The Government shall furnish and/or make available facilities described below. The identification of any hazardous conditions does not warrant or guarantee that no other possible hazards exist, or that the workaround procedures currently employed shall be adequate to meet the responsibilities of the Contractor. Compliance with applicable laws and regulations for the protection of employees is exclusively the obligation of the Contractor, and the government shall assume no liability or responsibility for the Contractor's compliance or noncompliance with such requirements. The Contractor shall return the facilities to the government in the same condition as received, fair wear and tear and approved modifications excepted. These facilities shall be used in the performance of this contract only.

3.2.1 Office Space. The availability of space at Hill AFB could change at any time in the future and the contractor shall be prepared to provide office space. The contractor may request additional office space if needed, however, the Air Force may not be able to support any additional requests and as such, the contractor must be prepared to provide office space for support staff if required. If available, the government shall provide approximately one hundred-five (105) square feet of suitable working space and appropriate office furniture for each contractor personnel. Location is presently in Building 1211.

3.2.2 Office Equipment. The Air Force shall make available to the contractor all necessary Air Force Hardware and Software for execution of this contract. GFE CPUs and monitors shall be provided to each contractor who is assigned to Hill AFB as required. Individual equipment custodians track computer equipment. A list of specific serial numbers assigned to contractor personnel shall be provided as required. Government Furnished Property shall be managed in accordance with the provisions of FAR 45.5.

3.3 Property. Not later than 5 days prior to start of the first operational performance period, the Contractor and a Government Property Administrator Representative (GPAR) shall conduct a joint inventory of all government furnished property. The Contractor shall receipt for all property provided by the government. The Contractor and a Government Property Administrator Representative (GPAR) shall jointly determine the working order and condition of all property. Items of property not in working order shall be returned to the government for disposition. If the Contractor does not participate in the inventory, the Contractor must accept as accurate the listing and stated condition of property provided by the government.

3.3.1 Obtaining Additional or Replacement of Government Furnished Property (GFP). The government shall replace, at its discretion, the GFP. However, the government is required to replace such property only when due to fair wear and tear, and it is no longer usable for its intended purpose. The Contractor shall submit requests through the Government Technical Representative (GTR) and Contracting Officer (CO) for approval and any appropriate contract modification. Upon approval, the Contractor shall obtain the Government Furnished Property (GFP) item and transfer to the contract as GFP.

3.3.2 Property Accountability. Within 10 days of completion of the contract, a joint inventory of property shall be conducted by the Contractor and a Government Property Administrator Representative (GPAR). The Contractor shall be liable for loss or damage to Government Furnished Property beyond fair wear and tear. Compensation to the Government shall be effected either by withholding amounts owed to the Contractor or by direct payment by the Contractor; the method to be determined by the Contracting Officer (CO). All property in need of repairs/maintenance shall be repaired/maintained by the Contractor within 30 days of discovery, but before the joint inventory is made. All repairs/maintenance not performed by the Contractor shall be done at the government's option and at the Contractor's expense. In the case of damaged property, the amount of compensation due the government by the Contractor shall be the actual cost of repair, provided such amount does not exceed the economical repair value (75 percent of the costs to replace such item). In the case of items damaged beyond economical repair or items lost, the amount of the Contractor's liability shall be the depreciated replacement value of the item to be determined by the Contract Officer (CO).

3.3.3 Disposition of Property. When Government Furnished Property is determined to be beyond economical repair it shall be reported to the Government Property Administrator Representative (GPAR) for disposition. Upon completion of the contract, all remaining Government Furnished Property shall be reported to the Government Property Administrator Representative (GPAR) in accordance with FAR 45.6.

4.0 GENERAL INFORMATION

4.1 SECURITY REQUIREMENTS. The security manager of the using activity shall complete a "Request for Identification Credential (AFMC Form 496)" for each employee of the contractor requiring access to Hill AFB. The requests shall be submitted to Pass and Registration (South or West Gate Visitors Center). The contract administrator shall complete an “Unescorted Entry Authorization Certificate” (AF Form 2586) for each employee requiring entry into controlled areas. The request shall be submitted to Pass and Registration (Gates Visitor Center).

4.2 Quality Control.

4.2.1 Quality Control Program. In compliance with the clause entitled “Inspection of Services”, 52.246-4, the contractor shall establish a complete Quality Control Program to ensure the requirements of this contract are provided as specified. The contracting officer shall notify the contractor of acceptance or required modifications to the plan before the contract start date. The contractor shall make appropriate modifications (at no additional costs to the government) and obtain acceptance of the plan (as needed) by the contracting officer before the start of the first operational performance period.

4.2.2 The government shall periodically evaluate the contractor’s performance by appointing a representative(s) to monitor performance to ensure services are received. The government representative shall evaluate the contractor’s performance through intermittent on-site inspections of the contractor's quality control program and receipt of complaints from base personnel. The government may inspect each task as completed or increase the number of quality control inspections if deemed appropriate because of repeated failures discovered during quality control inspections or because of repeated customer complaints. Likewise, the government may decrease the number of quality control inspections if merited by performance. The government shall also investigate complaints received from various customers located on the installation. The contractor shall be responsible for initially validating customer complaints. However, the government representative shall make final determination of the validity of customer complaint(s) in cases of disagreement with customer(s).

4.2.2 Quality Assurance Personnel (QAP).

4.2.2.1 The QAP/s is a representative/s is the authorized government representative(s) who shall perform assessments of the contractor’s performance. Subsequent to contract award, the identity of the QAP/s, with a brief resume of their duties and authority shall be promptly furnished to the successful bidder/offeror.

4.2.2.2 The QAP/s or alternate/s shall inform the contract manager in person when discrepancies occur and shall request corrective action. The QAP/s or alternate/s shall make a notation of the discrepancy on their tally/surveillance checklist with the date and time the discrepancy was noted and shall require the contract manager (or authorized representative) to initial the entry on the tally checklist. The contractor is required to provide weekly and monthly activity updates to the QAP. Results from the weekly/monthly status reports shall be used to determine acceptability of performance as measured in the Service Summary (Para 2 of PWS).

4.2.2.3 Any matter concerning a change to the scope, prices, terms or conditions of this contract shall be referred to the Contracting Officer and not to the QAP/s.

4.2.2.4 The services to be performed by the contractor during the period of this contract are at all times and places subject to review by the Contracting Officer or authorized representative/s.

4.3 Physical Security. The contractor shall be responsible for safeguarding all government property provided for contractor use. At the close of each work period, government property and materials shall be secured.

4.4 Key Control. Issuance of key cards to the contractor by the government is not required under this task. The Contractor shall perform work at the contractor’s business location.

4.5 Hours of Operation.

4.5.1 The contractor shall perform the services required under this contract during normal business hours, or after hours as may be necessary, in order to provide maximum availability of contractor’s support services to the HMMS PMO.

4.5.2 The contractor is not required to provide service on the following recognized holidays: New Year’s Day, Martin Luther King Day, Presidents’ Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas Day. If the holiday falls on Saturday, it is observed on Friday. If the holiday falls on a Sunday, it is observed on Monday. If the holiday falls on their Friday off, it is observed on Thursday.

4.5.3 Emergency Services. On occasion, services may be required to support an activation or exercise of contingency plans outside the normal duty hours described above. The contractor’s responsibilities for emergency support are described in Section One.

4.6 Conservation of Utilities. The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions which prevent the waste of utilities which include the following:

4.6.1 Lights shall be used only in areas where and when work is actually being performed.

4.6.2 Mechanical equipment controls for heating, ventilation, and air conditioning systems shall not be adjusted by contractor or by contractor employees unless authorized.

4.6.3 Water faucets or valves shall be turned off after the required use has been accomplished.

4.6.4 Government telephones shall be used only for official government business.

4.7 Records. The contractor shall be responsible for creating, maintaining, and disposing of only those government required records that are specifically cited in this PWS or required by the provisions of a mandatory directive listed in Appendix E, Applicable Publications and Forms. If requested by the Government, the contractor shall provide the original record or a reproducible copy of any such record within five working days of receipt of the request.

4.8 Environmental Controls. The contractor shall be knowledgeable of and comply with all applicable Interstate, Federal, State, and Local laws, regulations, and requirements regarding environmental protection. In the event environmental laws/regulations change during the term of this contract, the contractor is required to comply as such laws come into effect. If there is an increase or decrease in cost as a result of the change, the contractor shall inform the Contracting Officer pursuant to notice requirements and negotiate a modification to the contract.

4.8.1 Notification of Environmental Spills. If the contractor spills or releases any substance contained in 40 CFR 302 into the environment, the contractor or its agent shall immediately report the incident to Hill AFB Fire Dept at 777-1911. The liability for the spill or release of such substances rests solely with the contractor and its agent.

4.8.2 Material Storage and Use. The contractor shall follow manufacturer’s guidelines and professional recommendations for control of humidity, temperature, cleanliness, and materials handling. This includes hazardous materials.

4.9 Government Observations. Government personnel, other than contracting officers (COs) and quality assurance personnel (QAPs), may from time to time, with CO coordination, observe contractor operations. However, these personnel may not interfere with contractor performance or make any changes to the contract.

4.10 Safety Requirements. In performing work under this contract, the contractor shall:

4.10.1 Conform to the safety requirements contained in the contract for all activities related to the accomplishment of the work.

4.10.2 Take such additional immediate precautions as the contracting officer may reasonably require for safety and mishap prevention purposes.

4.10.3. Develop and provide at the start of the orientation period or the start of the first operational performance period (if there is no orientation period) a safety plan for the protection of government facilities and property and to provide a safe work environment for contractor personnel.

4.10.4. Provide protection to government property to prevent damage during the period of time the property is under the control or in possession of the contractor.

4.10.5. Include a clause in all subcontracts to require subcontractors to comply with the safety provisions of this contract as applicable.

4.10.6. Record and report promptly (within one hour) to the contracting officer or designated government representative (GR), all available facts relating to each instance of damage to government property or injury to either contractor or government personnel.

4.10.7. In the event of an accident/mishap, take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, and preserve evidence until released by the accident/mishap investigative authority through the contracting officer.

4.10.8. If the government elects to conduct an investigation of the accident/mishap, the contractor shall cooperate fully and assist government personnel in the conduct of investigation until the investigation is completed.

4.10.9. Include a clause in each applicable subcontract requiring the subcontractor's cooperation and assistance in accident reporting and investigation.

4.11 Training. Contractor personnel shall complete all required Information Assurance and organizational training provided by the government (i.e. Safety, Security, Privacy, etc.).

4.12 Special Qualifications. There are no special qualifications are deemed necessary.

4.13 Partnering Agreement. The contracting officer may require a partnering agreement between the government and the contractor to ensure joint cooperation and a sound partnership of all parties involved in the execution of this contract. Partnering is the creation of a government-contractor relationship that promotes achievement of mutually beneficial goals. It involves an agreement in principle to share the risks involved in completing the project and to establish and promote a nurturing partnership environment. Representatives from each organization are encouraged to participate in developing the partnering agreement. Suggested representation is the civil engineer manager, the government inspector, the government contract administrator, the contractor’s manager and the contractor’s quality control person. All costs for the partnership agreement should be shared equally between the government and contractor. This group is responsible for developing a formal partnering agreement that should be signed by all parties involved. The agreement should contain as a minimum: specific goals to be reached and a list of objectives to reach the goals, a set of metrics to evaluate the objectives, a frequency for meetings to review the metrics, and a statement of cooperation to execute the terms of the agreement.

4.14 Continuation of Essential DOD Contractor Services During Crisis IAW DoDI 3020.37. IAW AFI 63-124, paragraph 2.7.1, and DODI 3020.37 this requirement is not considered mission essential.
4.15 Phase-Out.

4.15.1 If there is a change in contractor or if the operation reverts to in-house, the incumbent contractor shall provide familiarization for at least 30 days, to the government or the follow-on contractor, whichever the case may be.

4.15.2 The government reserves the right to conduct site visits in all contractor operated facilities in conjunction with the solicitation of offers for the follow-on contract. In the event the follow-on contract is awarded to other than the incumbent, the incumbent contractor shall cooperate to the extent required to permit an orderly change over to the successful contractor. With regard to the successor contractor’s access to incumbent employees, a recruitment notice may be placed in each facility.

4.16 Publications.

4.16.1 Compliance with all publications, regulations and operating instructions provided by the Government is required when:

4.16.2 They pertain to the procedures for materials expediting herein and where the contractor is authorized by the statement of work to accomplish the work specified in the publication, regulation or operating instructions.

4.16.3 The publications prescribe USAF policies, use of materials, procedures and processes applicable to the work requirements.

4.16.4 The contractor is required to acquire and work on the latest version of the publication.
