52.212‐1 ‐‐ Instructions to Offerors – Instructions to Offerors ‐‐ Commercial
52.212‐2 ‐‐ Evaluation Commercial items, Evaluation ‐‐ Commercial Items
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforms to the solicitation. The following two factors shall be used to evaluate offers:
Technical Capability – the Government will evaluate the Contractor’s response to the following‐‐
ITEM SPECIFIC REQUIREMENT
A Contractor must provide proof of five years or more experience in the operation and repair of the Coolant Recycling Equipment listed as GFE or equivalent.
B Contractor must provide proof of five years or more experience in the servicing of the equipment listed out in the Equipment List or equivalent.
Your response to this portion shall be no longer than 10 pages. This is a pass‐or‐fail factor.
Price – the Government will award this requirement to a technically‐capable offeror based on the lowest total evaluated price of all CLINs (Basic and all four Option years; to include the 6‐month option IAW FAR Clause 52.217‐8)
Each Offeror shall provide a firm fixed price for the Coolant & Recycling Service CLINs. The Coolant & Recycling Service CLINs are as follows ‐‐
Basic Year 0001 (CMXG), 0004 (PMXG) Option Year I 1001 (CMXG), 1004 (PMXG) Option Year II 2001 (CMXG), 2004 (PMXG) Option Year III 3001 (CMXG), 3004 (PMXG) Option Year IV 4001 (CMXG), 4004 (PMXG)
For the Over & Above (O&A) CLINs, each offeror will provided a labor rate, which will then be multiplied by the estimated hours for each CLIN to come up with a total evaluation price for that CLIN. The O&A CLINs are as follows ‐‐
Basic Year 0002 (CMXG), 0005 (PMXG) Option Year I 1002 (CMXG), 1005 (PMXG) Option Year II 2002 (CMXG), 2005 (PMXG) Option Year III 3002 (CMXG), 3005 (PMXG) Option Year IV 4002 (CMXG), 4005 (PMXG) The estimated hours are listed below and in each O&A CLIN description; they are included for evaluation purposes only. NOTE:
the actual award amounts for the O&A CLINs may differ from the total evaluation prices used during the evaluation. Estimated remedial maintenance hours per year by organization are as follows:
CMXG ‐‐ 300 hrs PMXG ‐‐ 450 hrs
Contractors are not required to provide pricing for the Contractor‐Acquired Property (CAP) CLINs, which are 0003, 0006, 1003, 1006, 2003, 2006, 3003, 3006, 4003, and 4006).
The Coolant & Recycling Service CLIN prices will be added to the O&A CLIN evaluation prices for Basic Year and all Options to determine the offeror’s total evaluated price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) Evaluation Methodology. The Government will evaluate the three lowest‐priced offers for technical capability. Then, price will be evaluated for the technically‐capable offers and they will be listed from lowest to highest price based on the total evaluated price.
If one of the three lowest‐priced offers’ technical capability is determined to be unacceptable, it will be rejected, and the next lowest‐priced offer will be selected for evaluation.
Award will be made to the offer with the lowest total evaluated price that met the acceptability standards for technical capability.
NOTE: the total evaluated price will differ from the actual award amount as the O&A and CAP CLINs will be awarded with a fixed amount of money on them. These amounts will be based on past usage history of these CLIN types for this service.
(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212‐3 ‐‐ Offeror Representations and Certifications ‐‐ Commercial Items.
The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at http://www.sam.gov/portal (Only complete and return if there are changes to current SAM Registration. If 52.212‐3 is not returned the contractor is affirming that the current SAM registration is current, accurate, and complete). If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.
