SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

EVALUATION FACTORS FOR AWARD

M-1 BASIS FOR CONTRACT AWARD:

1. This is a competitive best value source selection in which the Government intends to award a contract resulting from this solicitation to the responsible, technically acceptable offeror with the lowest evaluated price whose proposal meets all solicitation requirements. FAR 15.101-2(b) states tradeoffs will not be made and no additional credit will be given for exceeding acceptability. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, and representations and certifications, in addition to those identified as evaluation factors or subfactors. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:

2. The following factors will be evaluated:

Factor 1: Price

Factor 2: Technical

A. Initially the government will review all proposals to determine if each timely received proposal meets the requirements of the RFP, drawings, specifications, and government standards and regulations pertaining to the specifications. Failure to meet the requirements of this solicitation may, at the Government’s sole discretion, result in the proposal being determined unacceptable, being ineligible for award and eliminated at this point from the competition and further consideration.

B. Price Factor: Next, the government will rank all proposals that have adhered to the solicitation requirements by price (from lowest to highest total evaluated price), including any option prices if applicable. For proposal evaluation purposes, the contract line item number (CLIN) will be evaluated as follows:

CLIN 0001 = Total Evaluated Price (TEP)

The government intends to award based on the total of CLIN 0001. The lowest total of CLIN 0001 shall constitute the lowest price offer.

Multiple contracts will not be awarded as a result of this solicitation.

C. Technical Factor: Next, starting with the lowest priced TEP offeror the Government will evaluate technical proposals for technical acceptability on an Acceptable/Unacceptable basis. ALL Technical Subfactors must be rated “Acceptable” to be considered technically acceptable. To be eligible for award, an offeror must have an

“Acceptable” rating in every non-priced subfactor either on the basis of the initial proposal, or as a result of discussions, if conducted.

The Technical Subfactors will be assigned a rating of Acceptable/Unacceptable as defined in accordance with DoD

Source Selection Guide Procedures, Table C-1, listed below:

Technical Acceptable/Unacceptable Ratings

Rating Description

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

Technical proposals will be evaluated based on the following two subfactors:

i. Subfactor 1: Experience - To be rated “Acceptable” the offeror must provide sufficient information on Attachment

07 to substantiate the offeror’s demonstrated previous experience as follows:

The prime offeror must submit information for a single project (e.g. single task order, single purchase order, single contract, etc.) performed or managed by the prime offeror as either a prime contractor or subcontractor clearly demonstrating to meet ALL of the following criteria:

a. Project shall be ongoing or completed within the past five (5) years from the issuance date of the solicitation

b. Project contract value of $1,000,000.00 or more

c. Project was construction at existing site or facility (NOT completely new construction)

d. Project includes ALL of the incidental construction work: Electrical work, excavation/earthwork, concrete work, landscaping and/or revegetation, utility work.

Experience for a project performed by a proposed subcontractor that the offeror may use for performance of the solicited requirement will NOT be considered, and will be rated “Unacceptable.”

AND

In order for the Government to assign a rating, the project information must be verified with the provided point of contact by the evaluation team, via phone or email. At a minimum, the Government will use the offeror's provided point of contact, phone or email to verify the project was performed by the named contractor and to verify that the minimum experience requirements stipulated above (a-c) were included in the project in order to determine if the experience requirements have been met. If the point of contact cannot be reached through reasonable attempt, a rating of Unacceptable will be assigned. In making a determination, the Government reserves the right to use both the information provided in the offeror’s proposal and information obtained from other sources available to the Government, to include, but not limited to, the Past Performance Information

Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; the Defense Contract Management

Agency; and interviews with Program Managers, Contracting Officers, and Fee Determining Officials.

ii. Subfactor 2: Conveyance Contractor License - The government requires the offeror to provide a licensed

Conveyance Contractor in the State of Colorado. To be rated “Acceptable” the offeror must provide a copy of its or a proposed subcontractor’s current, valid Conveyance Contractor License issued by the State of Colorado, Colorado Department of Labor and Employment Division of Oil & Public Safety. The license must be an active license and have been acquired prior to the closing date of this solicitation in order to be rated “Acceptable.”

The Government will verify the license is current, valid and issued by the State of Colorado, Colorado

Department of Labor and Employment Division of Oil & Public Safety.

3. Upon evaluation, if the lowest priced TEP evaluated proposal is rated “Acceptable” for all Technical Subfactors, the offer is considered technically acceptable and represents the best value for the Government, and the evaluation process stops at this point. Award will be made to that offeror without further consideration of any other offers. If the lowest priced TEP evaluated proposal is not rated “Acceptable” for all Technical Subfactors, the next lowest priced offeror will be evaluated and the process will continue (in order by price) until an offeror is rated “Acceptable” for all Technical Subfactors or until all offerors are evaluated. If all offerors are evaluated and none are rated "Acceptable", the Government reserves the right to enter discussions or cancel the solicitation at that point.

4. Offerors are cautioned to submit sufficient information and in the format specified in Section L. Offerors may be asked to clarify certain aspects of their proposal.

5. The government intends to award a contract without discussions with respective offerors. The government, however, reserves the right to conduct discussions if deemed in its best interest. Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for proposal revision. The government reserves the right to award one or no contract at all, depending on the quality of proposals submitted. Failure to propose for any item in the

Schedule B may, at the Government’s sole discretion, cause the offeror’s proposal to be rejected as unacceptable.
