1. TEMPORARY PROTECTION_______________________ ________________________

A. The Contractor shall protect all workmen, civilian and military personnel and the general public from injury. The Contractor shall coordinate and schedule all work with the Contracting Officer.

B. The Contractor shall conduct all work so as to cause the least interference possible with the normal activities of the operations of the airfield and surrounding areas.

2. SECURITY_________________________________________________________________

A. All project work and conduct of construction activity must comply with all Base security regulations and policies.

B. Identification Badges are required for projects on Westover ARB property and are to be obtained by completing an SF Form 1 Application for all Contractor's employees including subcontractor personnel working on the project. Badges shall be worn at all times while on Base and shall be visible at all times.

C. The Contractor shall be responsible for the return of all Identification Badges to the Contracting Officer after completion of the project. Final payment will not be made until all badges are returned.

D. The Contractor shall enter the project site only at a location approved by the Contracting Officer. Restrict all activities and movement of workers, supplies, and equipment to the designated project area and haul routes.

E. The Contractor shall not allow cameras on the project site nor photographs to be taken without written permission of the Contracting Officer.

F. Controlled Area of the Base When performing work in the controlled area Contractor personnel will be required to receive a briefing on operating a motor vehicle on the airport. At the conclusion of this training, they will be issued a pass which may allow them to drive to and from the construction site unescorted. Violations of the driving procedures can result in suspension of driving privileges or even removal from the project based on the severity of the infraction. Contractor personnel will also be required to sign in at Base Operations, Bldg. 1610 each morning before proceeding to the job site. They shall report back to Base Operations at the end of each day to sign out.

Work being performed in the controlled area is adjacent to the flight line, the work site can be periodically considered as a very high noise area. Workers shall be equipped with necessary personal protective equipment.

3. UNDERGROUND UTILITIES, UTILITY INTERRUPTIONS AND SHUTDOWNS___

Interruptions shall be defined as any Contractor operation that interferes with access through, or use of facilities or areas including utilities, Energy Monitoring and Control Systems (EMCS), parking lots, generators, roads, or airfields.

Request for an interruption shall be submitted to Chicopee Electric in writing at least fifteen (15) days in advance of the date desired and includes at least one alternate date. Include the following information: Location(s) of interruption(s), hours and dates of interruption(s), which services are affected and which facilities are affected. Contractor is cautioned that outages may not be granted on the date(s) requested. Contractor shall notify the Contracting Officer at least seven

(7) days in advance of any cancellation of any scheduled interruption. Services shall not be interrupted until receipt of approval of proposed hours and dates are received from the Contracting Officer.

4. QUALITY ASSURANCE_____________________________________________________

A. All items of work not addressed in these General Conditions shall be completed in strict accordance with the manufacturers’ specifications.

B. The quality assurance procedures of this section are a minimum. Provide additional quality control as required by the Contracting Officer. Any additional quality control, which may be required, shall not constitute a change in the contract.

C. The government is not obligated to inspect the Contractor’s work, or to protect the Contractor from the consequences of his work. Government inspection is a general examination of the Contractor’s conduct and workmanship and is solely for the purpose of the government.

Government inspectors do not have the authority to accept work, nor is government inspection to be construed as conclusive.

D. Government agents including inspectors, engineers and quality assurance evaluators are not authorized to change the contract without the written approval of the Contracting Officer; this lack of authority extends to all situations in which the action of these agents could be construed as constituting a change.

E. The quality of workmanship is subject to audit by government or government-designated inspectors at any time during the contract. The Contractor shall cooperate fully and provide all information necessary for this audit.

F. The Contractor shall institute immediate action to correct all variances from the contract or General Conditions and employ all procedures necessary to ensure future work shall conform to the requirements of the contract.

G. The Contractor shall submit all requests for changes in writing to the Contracting Officer. Do not proceed with changes without possession of written authorization of the Contracting Officer.

5. CONCEALED WORK_______________________________________________________

The Contracting Officer must approve all items of work including those which are to be concealed. The Contractor shall notify the Contracting Officer of his intention to conceal work 24 hours in advance of concealment.

6. SUBMITALS, DOCUMENTS AND CONSTRUCTION SCHEDULE

A. Approval must be obtained from the Contracting Officer for the material and equipment proposed to be incorporated into the work. Submittals shall be made no later than 30 working days after receipt of the Notice to Proceed or as specified by the Contracting Officer. The Contractor is to complete Air Force Form 3000, provided by the Contracting Officer, and submit four copies of the required materials for review. The Contracting Officer will return the submittals approved or disapproved within 10 working days after receipt, by AF Form 3000. If submittals cannot be made within 30 days after Notice to Proceed or as specified by the Contracting Officer, the Contracting Officer shall be advised of the difficulty and the Contractor shall request an extension of time for this task. Approval of submittals does not relieve the Contractor from performance in strict accordance with the contract or Statement of Work, nor does such approval constitute “acceptance” under other conditions of this contract.

B. Any and all “or equal” items or materials proposed by the Contractor to be used in the project shall be submitted for approval.

C. Submit catalog cuts and/or other manufacturer’s data on all materials proposed to be incorporated into the work for approval and purposes:

1) Electrical devices.

2) All generators shall have a 5 year extended warranty.

3) Automatic Transfer Switch.

4) The contractor must supply the government with a statement of conformity from the

Administrator of the USEPA pursuant to 40 CFR 89.105 stating that the engine conforms to the USEPA emission limitations in force at the time of installation.

5) Mechanical devices, including but not limited to louvers, ductwork, actuators and dampers and fans.

6) Double Wall Secondary Containment Sub-base Fuel Tank.

Tanks must be suitable for NFPA rated Class II diesel fuel with a flash point of < 125 F.

D. Construction Schedule.

The Contractor shall perform the work in accordance with the schedule shown below. Following completion of each submittal, the Government will perform a review of the submittal(s). The Contractor shall allow a minimum of ten (10) calendar days for Government reviews. Review conferences may be held as required after completion of this review. The Contractor will be required to attend these Conferences unless otherwise notified by the Contracting Officer. The technical comments from a review shall be incorporated into the submittal before the start of the next contract effort. The Government shall establish the time and place of these conferences.

All work shall be carefully scheduled to prevent any excessive shutdown time of utilities or services. The Contractor shall make written request to the Contracting Officer for approval of all work requiring shutdown 72 hours prior to commencement of such work.

Installation Schedule. The contractor shall provide a detailed installation schedule. The installation schedule estimate shall show all work tasks, including but not limited to, demolition dates, material and equipment delivery time frames, and expected completion date. Generator installation and removal requires proper coordination per AFI 1062 section 8.2 and 8.3.

E. Documents

1. The schedules shall be submitted electronically in PDF format every 2 weeks. The electronic version may be transmitted via e-mail or CD-ROM, however email is preferred. The schedules shall be transmitted to the Contractor Officer Project Manager and Installation Point of Contact. The schedule shall clearly identify the critical path, and the Contractor shall regularly advise the Contracting Officer of events that could impact critical path.

2. Provide CADD construction drawings using the latest version of Auto CADD on CD-

ROM with index prepare and stamped by a Professional Engineer.

Provide As-Built drawings stamped by a Professional Engineer.

The contractor must supply the government with a statement of conformity from the

Administrator of the USEPA pursuant to 40 CFR 89.105 stating that the engine conforms to the USEPA emission limitations in force at the time of installation.

3. As-Built Drawings. The Contractor shall provide to the Contracting Officer, upon completion of the project, a complete set of project documents consisting drawings.

Submit drawings pertaining to the engine generator set and auxiliary equipment, including but not limited to the following:

a. Detailed elementary, schematic wiring of control panel, engine generator and generator circuit breaker.

b. Floor plan arrangement of exhaust, air intake, fuel oil cooler, and jacket coolant water system including arrangement of piping and pipe sizes.

c. Particulars on concealed products which will not be easily identified after construction completion.

d. Changes made by modifications to the Contract.

7. SUPERINTENDENCE BY THE CONTRACTOR________________________________

A. At all times during the performance of the contract and until the work is completed and accepted, the Contractor shall directly superintend the work or assign a competent Superintendent who is satisfactory to the Contracting Officer and has the authority to act for the Contractor.

B. The Superintendent is to oversee and coordinate all project related work being performed.

The Superintendent shall be able to read, write, speak and understand the English language.

C. Failure to comply with this requirement may be deemed as cause for a non-compensatory stoppage and suspension of work until the deficiency is remedied.

8. NOTIFICATION PRIOR TO CONSTRUCTION OR DEMOLITION_______________

A. In accordance with the requirements of the Massachusetts Department of Environmental Protection (MADEP), the Contractor shall prepare and submit form BWP AQ 06, Notification Prior to Construction or Demolition, to the Department on behalf of the government. The Contractor is also responsible for the remittance of the $85.00 notification fee. Complete information is available from the Department or on the DEP Web site at mass.gov/dep.

9. STORAGE AND HANDLING_________________________________________________

All new materials shall be transported, stored and handled according to the manufacturers’ written recommendations or as otherwise directed by the Contracting Officer.

The Contractor shall be responsible for the storage and safekeeping of all material to be incorporated into the work. The Contractor shall be responsible for all aspects of safety and security within the storage area.

The project is located with an existing flight zone. Contractor will not be allowed to store equipment or materials within the flight zone throughout the duration of the project. All material and equipment shall be removed to a location outside of the flight zone at the end of each work day.

Upon the Contractor’s request, the Contracting Officer will consider another or supplemental area for the Contractor’s use and storage of equipment, trailers, and materials; however, this will be solely at the discretion of the garrison and may not be approved. This area may not be in close proximity of the construction site but will be within the installation boundaries.

Fencing of materials or equipment will be required at storage locations; plastic strip inserts, colored green, must be used on the fence to screen the storage compound from the installation;

fence posts must be embedded into grade as recommended by the manufacturer. The Contractor shall be responsible for cleanliness and orderliness of the area used and shall restore the area to its original condition upon completion of the project.

The Government will not provide utilities to the storage area.

Provide adequate storage facilitates for protection of materials and equipment. Materials and equipment shall be stored so as to ensure preservation of their quality of fitness for Work.

Perishable items and items adversely affected by weather, rain, wind, dust, heat, or cold shall be Store within temporary waterproof sheds or mobile facilities with raised floors, and heated if necessary. Other materials and equipment shall be stored on wooden platforms and not on the ground. All storage facility locations shall be approved by the COR prior to bringing on site.

Storage facilities shall be clean, in good condition, undamaged and free of rust or surface deterioration. Rental trailers shall be of a neutral color. Unsightly material storage or office trailers will not be permitted.

The Contractor shall be responsible to maintain the condition of storage facilities, as defined above, and the entire construction site in a neat, orderly, professional and uncluttered manner.

Storage area(s) will be designated in the project’s vicinity as mutually agreed with the Contracting Officer and Facility Manager. At the end of each work day, the Contractor shall remove all materials and equipment form the work site and store all materials and equipment within the assigned storage area(s).

10. DAMAGED PROPERTY____________________________________________________

Work shall proceed in a manner which will minimize disturbance or risk of damage to surrounding structures, interior finishes, room furnishings, personal belongings, equipment or base infrastructure. The Contractor shall repair such items damaged by the Contractor in the course of carrying out the work at no additional cost to the government. All repairs shall match adjacent similar existing items in all aspects. All replacements will be in kind.

11. CLEANING UP____________________________________________________________

The Contractor shall at all times, keep the premises free from accumulation of waste materials or rubbish caused by work under this contract. All parts and equipment removed for replacement become the property of the Contractor and shall be removed from the premises. At the end of each work day and upon the completion of all work, the Contractor shall leave interior and exterior property in the condition in which it was found at the beginning of work.

The Contractor is responsible for removal and proper disposal of all Generators, construction material waste and any items not being reused including but not limited to muffler exhaust manifold, transfer switches, wiring, and conduits.

12. SAFETY PRECAUTIONS___________________________________________________

The Contractor shall take all necessary precautions in observing safety regulations in accordance with all Federal OSHA regulations, and shall assume the responsibility to guard against causing of fires and/or explosions and to protect government property. The Contractor shall perform the work in a manner consistent with security and with fire safety regulations especially with regard to exits and exit way access. Temporary closures shall not compromise security or fire safety.

The Contractor shall conduct all work so as to cause the least interference possible with the normal activities of the operations of the airfield and surrounding areas.

13. ENVIRONMENTAL PROTECTION__________________________________________

There is no known or anticipated asbestos, lead nor any type of regulated hazardous material involved with the work of this project. However, in order to provide for control of all environmental pollution arising from construction activities, the Contractor and his subcontractors, in the performance of this contract, shall comply with all applicable federal state and local laws and regulations concerning environmental protection pollution control and abatement.

AIR EMISSIONS

All generators procured/purchased for Westover must also be equipped with a non-turn-back hour counter (a.k.a non-resettable hour meter) as stipulated in both State and Federal regulations.

STATE REGULATIONS

Westover’s emergency engines are subject to 310 CMR 7.26 (42), in which the requirements for Stack Height and Emission Dispersion, Certification through Mass DEP’s Environmental Results Program, and Emission Limitation are sub-organized by the output capacity (i.e. greater than or equal to 37 kW, greater than or equal to 50 kW, etc.).

No contractor shall cause, suffer, allow, or permit the installation and subsequent operation of an engine unless said contractor has certified compliance with the requirements of Mass DEP’s 310 CMR 7.26(42) in its entirety in accordance with the provisions of 310 CMR 70.00:

Environmental Results Program Certification. Certification (refers to EPA Certificate of Conformity) shall include a statement from the supplier that the installed engine is capable of complying with the emission limitations for the first three years of operation. A one-time certification shall be made to Mass DEP (via the Mass DEP ERP Form) within 60 days of commencement of operation; annual certification is not required. The contractor must also supply to the government all information required to complete the installation certification required at 310 CMR 7.26 (42).

Westover emergency or standby engines used as mechanical power sources for water pumping activities such as, but not limited to, firefighting, flood control, waste water flow, are subject 310 CMR 7.26(42) in its entirety.

FEDERAL REGULATIONS: 40 CFR Part 60 Subpart IIII Compression Ignition engines must comply with NSPS at 40 CFR Part 60 Subpart IIII which includes requirements for certification, installing, configuring. (Spark Ignition engines comply with 40 CFR Part 60 Subpart JJJJ.) The contractor must supply the government with “EPA- Certified” documentation that the engine conforms to USEPA emission limitations. If applicable, contractor is responsible for performance testing as specified in 40 CFR Part 60 Subpart IIII; requirements for performance testing are based on engine displacement measurement typically expressed in liters per cylinder. If engine is equipped with a diesel particulate filter, the filter must be installed with a backpressure monitor that notifies the owner/operator when the high backpressure limit of the engines is approaching.

FEDERAL REGULATIONS: 40 CFR Part 63, Subpart ZZZZ - National Emissions Standards for Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines As applicable, Contractor must comply with 40 CFR Part 63.

14. HAZARDOUS MATERIAL REPORTING_____________________________________

A. The Contractor shall maintain hazardous material inventories and material safety data sheets (MSDS) for all hazardous materials (as defined in CFR 1910.120, 40 CFR’s 355, 370, & 372) to be stored and used on this installation. Hazardous materials must be inventoried when received and at project completion. The amounts used shall be maintained for the project duration, and for the calendar year (ending 31 December).

B. Hazardous Materials Inventories, Material Safety Data Sheets and material quantities used shall be submitted to the Contracting Officer for approval utilizing 439 AW Form 20, CONTRACTOR INFORMATION SHEET, at the end of this Section.

C. In the event of a spill, Contractor shall immediately notify the Base Fire Department at extension 911 as well as the Contracting Officer. The Contractor shall be solely responsible for the expense of any cleanup of such spill, and the cleanup shall be in accordance with the applicable provisions of 40 CFR Part 761.

D. Westover will properly prepare the proper paperwork for DRMO process including tagging on all existing generators.

1) Contractor is responsible for drain, purge all fluids and transfer fuel to the newly fuel tanks.

2) Westover will inspect making sure proper tagging draining and purging are being accomplished, before being deliver to the storage point at Westover Base Supply.

All fuel and storage tank removals will be performed in accordance with NFPA 30, 527CMR 1.00, and 310 CMR 30 (when applicable). All items to be disposed of shall be done so in a legal manner according to all applicable Federal, State and Local laws and regulations.

15. HAUL ROUTES___________________________________________________________

The established haul access routes shall be the only routes used by the Contractor. The Contractor shall ensure that all vehicle operators associated with the project, or those of suppliers, are properly instructed before entering the Base.

Deliver equipment: Deliver equipment on pallets or blocking wrapped in heavy-duty plastic, sealed to protect parts and assemblies from moisture and dirt. Plug piping conduit, exhaust and air intake openings. Protect and prepare batteries for shipment as recommended by the battery manufacturer. Store auxiliary equipment at the site in covered enclosures, protected from atmospheric moisture, dirt and ground water.

16. TEMPORARY STAGING AND CONSTRUCTION AIDS________________________

The Contractor shall provide, erect, maintain, and remove all necessary construction aids that are required for the performance of the work.

17. PERFORMANCE

The performance period for this statement of work is 180 calendar. The Contractor shall begin work as described in the scope of work within 10 days of notice to proceed (NTP). All meetings and progress reports are due in a timely fashion and will begin no later than 30 days after receipt of NTP. No construction work shall begin prior to government approval of plans and specifications.

Progress Review Meetings: The Contractor shall hold progress review meetings and shall coordinate these meetings with the Base POC. These meetings will be a review of work performed, issues, schedules, milestones, and current status. The schedule of the progress review meeting may be modified by the Base POC with notification to the Contractor. These meetings will continue until the project is closed out.

Schedules: The Contractor shall adhere to all meeting and reporting schedules and acknowledges the authority of the Base POC to reschedule any and all meetings and reports.

18. CONSTRUCTION/DEMOLITION WASTE MANAGEMENT PLAN AND

REPORTING

A. Prior to the start of the work, the Contractor shall prepare and submit for approval the Construction Waste Management Plan utilizing the form provided at the end of this section.

The Contractor perform a site survey to confirm information pertaining to the project.

B. The Contractor shall record, document and report the total amount of construction/demolition debris and other solid waste that is generated and disposed of under this contract. The Contractor shall also record the total amount of debris and waste that has been diverted through sale, reuse, or recycling and the quantity of waste disposed by landfill or incineration. The waste shall be recorded by weight, but volume in cubic yards will also be acceptable.

C. Contractor will salvage and reuse the construction/demolition debris to the greatest extent possible. Waste materials that cannot be salvaged and/or reused and have value as being recyclable, shall be recycled. Only materials unable to be economically salvaged or recycled shall be transported to a landfill or incinerator. Revenues or other savings obtained for recycling or returns shall accrue to the Contractor, except revenues generated from Base recycling activities.

D. The records shall be made available to the Contracting Officer during construction and shall be submitted to the Contracting Officer prior to project closeout utilizing the Waste Management Summary Form also attached at the end of this section.

Meetings, Conferences, Site Visits:

Post Award Meeting/Teleconference, Progress Meetings & Design Integration Meetings: After the issuance of a task order, the Contractor shall attend meetings at project site, Westover Air Reserve Base Chicopee, Massachusetts 01022. The purpose of these meetings includes, but is not limited to contract discussions, progress reviews, project scoping, planning, design reviews, project status, and the general exchange of information concerning current and future activities. All meetings shall be held at Westover Air Reserve Base Chicopee, Massachusetts 01022. The Contractor shall coordinate each meeting with all individuals listed in section this section Contractor shall schedule review meetings within 30 days of receipt of government comments. The Contractor shall record and provide copies of all meeting minutes not later than 5 business days after the meeting. Minutes shall be sent by email to each individual identified in this section below.

Plan/Review, Site, Visit/kickoff: The Contractor shall coordinate the site visit to be held at Westover Air Reserve Base Chicopee Massachusetts 01022 with all parties identified in this section below within 10 business days from award date. All Government comments will be reviewed and design changes discussed and approved. Construction will begin after acceptance and approval of final design.

Meeting Minutes: The Contractor shall prepare and publish all meeting minutes following CO/CE approval, track all action items assigned, and shall document all items discussed at a meeting as well as a meeting’s attendees.

TRAVEL

Travel Requirements: Site assessment/research, project discussion meetings and presentations will be held at Westover Air Reserve Base Chicopee, Massachusetts 01022.

CONTRACT ADMINISTRATION

Amendments: Not withstanding any of the provisions of this contract, the CO will be the only individual authorized to in any way amend or modify the terms of this task order.

20 WARRANTY

The Contractor shall complete all inspection and commissioning requirements prior to final inspection. The warranty shall be issued in accordance with FAR 52.246.21. Extended warranties offered by the Contractor and its Subcontractors or suppliers may be accepted at the Government’s discretion.
