4.0 VOLUME II - EVALUATION FACTOR I: TECHNICAL

The Government will evaluate all technical subfactors to determine an overall rating for Factor I Technical. During the evaluation of each quote, the Government will assign each subfactor a rating as shown below. Offerors must receive an acceptable rating on each element within the subfactors in order to be considered technically acceptable under those subfactors. A rating of unacceptable in one subfactor will constitute an overall rating of unacceptable for Factor I Technical.

The following ratings will be utilized:

- The Offeror's quote clearly meets the requirements of the solicitation; it indicated an adequate approach and understanding of the requirements. Acceptable

- The quote does not clearly meet the minimum requirements of the solicitation; has not demonstrated an adequate approach and understanding of the Unacceptable requirements.

4.1 Subfactor 1: Maintenance Control Program (MCP), incl. organizational structure The Government will evaluate the Offeror's quote for their capability to successfully manage operational tests, maintain, repair, and inspect the Barrier, Tire Killer, Bollard, and Gate Systems in the Kaiserslautern Military Community (KMC) and outlying areas, in a manner that will ensure continuous and safe operation. This evaluation will include the Offerors approach to manage personnel and subcontractors (if applicable) in order to efficiently and proactively manage the contract and perform the requirements stated in the Performance Work Statement (PWS).

This requirement is met when the Offeror's quote sufficiently demonstrates all of the following standards below:

4.1.1 Acceptable methodology to test, maintain, repair, and inspectBarrier, Tire Killer, Bollard, and Gate Systems and ensure continuous and safe operation of these systems.

4.1.2 Acceptable relevancy and comprehensiveness of the Offeror's proposed management approach including an assessment of the degree to which it reflects an effective, efficient, feasible, and practical level of understanding of the operating environment in accomplishing the tasks and deliverables of this PWS from a management perspective with minimal risk.

4.2 Subfactor 2: Heintzmann Industries training Certificate

4.2.1 Acceptable certificates of competency (Trained to work on Heintzmann Industries Systems).

5.0 EVALUATION CRITERIA: FACTOR III PRICE The Offeror's price quote will be evaluated for completeness, fairness and reasonableness, and balance. Only quotes determined to be complete, fair, reasonable and balanced will be eligible for award.

Award will be made on an "ALL-OR-NONE" basis. Failure to include a unit price and extended amount for each CLIN within the CLIN Schedule/Bid Schedule of the solicitation, except for the Over and Above CLIN (X005), may exclude the offeror from further consideration for award.

Total Evaluated Price (TEP): The quotes will be evaluated on the total evaluated price (TEP).

TEP will be calculated as follows: TEP = Base Period CLINs + Option Period CLINs (includes evaluation of FAR 52.217-8, Option to Extend Services IAW para. 7.0). The TEP consists of all CLINs and Optional CLINs for the purchase order period of performance, including the Government-established NTE amounts for CLIN X005.

The Government has established a Not-to-Exceed (NTE) amount of EURO 5,000.00 for the Over and Above CLIN(s) for the Base and Option Periods. While this fixed amount is included in the TEP for evaluation purposes, specific repairs or services under these CLINs will be quoted by the Contractor, negotiated, and modified onto the contract post-award only as needs are identified.

6.1 COMPLETENESS

The quote will be reviewed to determine the extent to which all the price elements have been addressed. The Offeror's proposed price and other information will be evaluated to ensure continuity and coherence between the initial quote and any revisions thereto. The review will determine the adequacy of the Offeror's quote in addressing and fulfilling the RFQ requirements.

6.2 FAIR & REASONABLENESS

For a price to be reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business. The Government will determine prices fair and reasonable through the use of one or more of the price analysis techniques at Revolutionary FAR Overhaul (RFO) 12.204 (a) and RFO 15.404-1(b)(2).

Submission of (other than) certified cost or pricing data is not required; however, if the cost information is needed by the Contracting Officer to determine a fair and reasonable price, the offeror shall submit the other than certified cost or pricing data as requested. Evaluation of the option period prices shall not obligate the Government to exercise such options.

6.3 BALANCED PRICING

Offerors are cautioned against submitting an offer that contains unbalanced pricing. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one (1) or more contract line items or base/option years is significantly over or understated. The Government may also consider an offer unbalanced if there is a significant difference between ordering periods or the proposed prices from year to year are above what would be considered a reasonable adjustment for escalation.

The Government will analyze quotes to determine whether they are unbalanced with respect to price and separately priced line items. A quote may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
